Real-estate listing photos must show a truthful picture of the property. The fact that an editor used Photoshop, Lightroom, or an AI tool does not by itself decide whether an image is acceptable. The important questions are what the edit changes, which state law applies, which multiple-listing service (MLS) receives the image, and how the image is published.
For REALTORS®, Article 12 of the 2026 NAR Code of Ethics requires honest communications and a true picture in advertising. State statutes can impose additional disclosure duties. An MLS can impose still more restrictive submission or labeling rules. California illustrates the difference: its law, effective January 1, 2026, requires disclosure and access to the original image for covered digitally altered images, while ordinary corrections that do not change the representation of the property are excluded.
The three rule layers you must check
Real-estate photo compliance is not governed by one nationwide editing standard. Treat these as separate layers rather than interchangeable rules.
| Layer | Who makes the rule | What it controls | What to verify |
|---|---|---|---|
| Professional ethics | NAR and its REALTOR® members | Truthful communications and a true picture in advertising, marketing, Internet images, and other representations | Whether the responsible licensee is meeting Article 12 and its Standards of Practice |
| State law | The state legislature and regulator | Definitions of covered alterations, disclosure language, links to originals, and advertising responsibilities | The law and current regulator guidance for the property’s state |
| MLS rules | The MLS serving the listing | What may be added, removed, or changed in listing images and how altered images must be submitted or labeled | The current rulebook and image FAQ for that MLS |
A photographer or editor can identify a risk, but the broker or salesperson responsible for the advertising remains accountable for accuracy. A local MLS may reject an image even when a state disclosure would make the image lawful to publish elsewhere.

What NAR’s Article 12 requires
Article 12 of the 2026 Code of Ethics says: “REALTORS® shall be honest and truthful in their real estate communications and shall present a true picture in their advertising, marketing, and other representations.” Standard of Practice 12-10 expressly includes Internet images and prohibits misleading consumers, including through misleading images. Read the full wording in the NAR Code of Ethics and Standards of Practice.
This is an ethical obligation for REALTORS®, not a complete national checklist of permitted sliders or software features. It does not mean every adjustment requires a disclosure everywhere, nor does it create a universal permission to alter a room after adding a disclaimer. The effect on the viewer and the rules governing the listing determine the result.
How to tell an ordinary correction from a material alteration
Use an effect-based test: does the finished image still represent the real property as it exists, or does it show a different feature, condition, view, or surrounding element? Software use alone is not the test.
| Edit or technique | Likely treatment under California’s statute | Practical compliance question |
|---|---|---|
| Exposure or dynamic-range adjustment | Excluded when it does not change the representation of the property | Did the adjustment merely reveal detail that was already present, or did it hide damage, add a feature, or make a condition appear different? |
| White-balance or color correction | Excluded when it does not change the representation | Are colors being made neutral and accurate, or is paint, flooring, landscaping, or another material being made to look like a different color? |
| Sharpening, cropping, straightening, or angle correction | Listed among common adjustments that are excluded when they do not change the representation | Does the crop remove context that a buyer needs, or does geometry correction make the room materially larger or differently shaped? |
| Lens-distortion correction | Not named separately in the statute; it must be assessed as an “other common adjustment” and by its effect | If the correction only restores straight lines, it may be ordinary. If it changes apparent dimensions, ceiling height, boundaries, or the relationship of features, obtain MLS and legal guidance. |
| Removing a stain, crack, utility pole, neighboring structure, or other visible element | A covered change because it removes or changes a property feature or visible surroundings | Do not treat the edit as a routine cleanup simply because it is easy to perform. |
| Adding virtual furniture, appliances, fixtures, landscaping, a view, or a different finish | A covered change because it adds or changes represented elements | Determine whether the image must be disclosed, labeled, excluded by the MLS, or replaced with an original image. |
The California rule’s ordinary-adjustment exception applies only when the adjustment does not change the representation of the real property. A slider that begins as exposure correction can cross the line if it conceals a defect or changes what a buyer would reasonably believe is there.

California’s digitally altered image law
California Business and Professions Code § 10140.8 took effect January 1, 2026. The California Real Estate Law defines a digitally altered image as one created by, or at the direction of, a real-estate broker or salesperson—or someone acting on their behalf—using photo-editing software or artificial intelligence to add, remove, or change elements.
Changes expressly within the definition
The statute names fixtures, furniture, appliances, flooring, walls, paint color, hardscape, landscape, façades, and floor plans. It also covers elements outside or visible from the property, such as streetlights, utility poles, views through windows, and neighboring properties. The list is important because an edit can be covered even when the changed object is not inside the room being photographed.
Changes excluded when representation stays the same
Lighting, sharpening, white balance, color correction, angle, straightening, cropping, exposure, and other common adjustments are excluded when they do not change the representation of the real property. The statute therefore does not make every Lightroom adjustment a disclosure event. The factual result shown to the consumer is what matters.

Required disclosure and original-image access
When a covered digitally altered image appears in an advertisement or other promotional material for the sale of real property, the broker, salesperson, or person acting on their behalf must provide two things:

- A reasonably conspicuous statement on or adjacent to the image disclosing that the image has been altered.
- A publicly accessible link, URL, or QR code that includes and clearly identifies the original, unaltered image.
If the material is on a website controlled by the broker, salesperson, or representative, the original must be included in the posting or supplied through the permitted link method. A disclosure that is difficult to notice, or a link that does not clearly identify the unaltered image, does not follow the process described in the statute.
California regulator guidance
The California Department of Real Estate’s Winter 2026 bulletin reiterates that advertising must be truthful and that using AI does not remove a licensee’s duty to review content for compliance. Read the bulletin at DRE’s Winter 2026 Real Estate Bulletin. This California law is not a nationwide rule; another state may have different definitions, disclosures, or no equivalent statute.
How an MLS can be stricter than a disclosure law
California’s law describes when disclosure is required, but an MLS can separately prohibit or limit the image. The California Regional MLS (CRMLS) digitally altered image guidance and FAQs restrict adding or modifying real-property elements and certain outside or visible elements in listing images. CRMLS describes an exception for improvements that will match the altered image by closing as part of the listed price, and it explains its own submission process in connection with California AB 723.
CRMLS guidance applies to its subscribers. It does not establish the rules for an MLS in Ohio, Texas, New York, or any other market. Before uploading an edited image, read the current MLS rule text and FAQ for the listing. Check whether the MLS requires an original image, a particular label, a separate image slot, or removal of the edited version; do not infer those procedures from CRMLS.

A defensible workflow for agents, sellers, and photographers
1. Identify the governing location and publication
Record the property’s state, county or market, MLS, and every place the image will appear. A photograph used only in a private staging proposal may be treated differently from one placed in an MLS, brokerage website, portal, social post, flyer, or paid advertisement. The responsible licensee should make the final call.
2. Preserve an unaltered original
Keep the camera original and an unaltered export before retouching. Use clear filenames and retain the version that corresponds to each edited image. California’s disclosure process requires access to the original for covered images, and maintaining it also lets an MLS or consumer compare what changed.
3. Classify each proposed change by effect
- Appearance correction: exposure, white balance, sharpening, cropping, straightening, or similar work that leaves the represented property unchanged.
- Feature change: adding, removing, repainting, replacing, concealing, or reshaping a property element or visible surrounding.
- Uncertain geometry or context: lens correction, perspective manipulation, sky or view replacement, object removal near a boundary, or an edit that could alter perceived size or condition.
For uncertain work, pause and ask the listing broker and the MLS before publication. Do not rely on the editor’s personal interpretation as a substitute for the governing rule.
4. Check the MLS before exporting a final set
Search the MLS’s current image rules for “digitally altered,” “virtual staging,” “photo manipulation,” “watermark,” and “disclosure.” Confirm whether the MLS permits the edit at all, whether the image must be labeled, and whether an original must accompany it. Save the relevant rule or support response with the listing file.

5. Add California disclosures when the statute applies
For a covered California image, place a reasonably conspicuous alteration statement on or adjacent to the image and provide a public URL, link, or QR code that clearly identifies the original. On a controlled website, verify that the original is included in the posting or reachable through the statutory link method. Test the link in a logged-out browser before publishing.
6. Review the complete advertising set
Review the final crop, caption, floor-plan label, and surrounding copy together. A technically accurate image can still mislead if its caption claims a feature that the photo does not show, or if a disclosure is separated from the image. Correct or remove any version that could give a buyer a false impression.
What to do about common edits questioned by photographers
Exposure and white balance
These are expressly listed among California’s common adjustments, but only when they do not change the property’s representation. Brightening a dark interior to show existing detail is different from brightening a damaged wall until the damage disappears. Neutralizing a color cast is different from turning beige cabinets white. Document the before-and-after when the distinction could be disputed.

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteLens-distortion and perspective correction
The California statute does not name lens-distortion correction specifically. A modest correction that restores straight lines without changing the room’s apparent dimensions may fit the “other common adjustments” exclusion. Aggressive correction can make a narrow room look wider, move a wall, alter a window’s apparent size, or change the relationship between a building and its surroundings. Because that effect can change the representation, submit the proposed image to the responsible broker and MLS for a rule-based decision.
Virtual staging and object removal
Adding furniture, deleting furniture, replacing appliances, changing finishes, removing poles, or substituting a view changes what the viewer sees. In California, those are the kinds of additions, removals, or changes covered by § 10140.8. Disclosure does not automatically make an image acceptable under an MLS; the MLS may restrict the edit or require a particular submission process.
Handling a listing outside California
Do not transplant California’s January 1, 2026 disclosure procedure to another state without checking local authority. The nationwide starting point for REALTORS® remains truthful representation under Article 12, while state advertising law and the local MLS supply the operational details.
For example, a discussion asking about photographers near MLSNOW in Northeast Ohio is anecdotal, not an MLS rule or legal opinion. The conversation can be found at this Real Estate Photography discussion, but an agent should obtain the current MLSNOW rules directly and confirm any Ohio advertising requirements before using an altered image.
Quick Recap
Common failure modes and fixes
- “It is only AI, so it is exempt.” AI is specifically included in California’s definition when it adds, removes, or changes elements. Classify the result, not the software.
- “A disclosure makes every edit legal.” State disclosure and MLS permission are separate questions. Follow both.
- “The editor approved it.” The responsible licensee still has to review the advertising for accuracy; California DRE guidance says AI does not transfer that responsibility.
- “The original is somewhere in our archive.” For a covered California image, the required public link, URL, or QR code must clearly identify and provide the unaltered image. An internal archive is not the same thing.
- “The same rule worked on another listing.” Rules vary by state and MLS and can change. Recheck the governing rule for every market and publication.
Final pre-publication checklist
- Have you identified the property’s state, MLS, and all publication channels?
- Does every edit leave the represented property unchanged, or does it add, remove, conceal, or change a feature or visible surrounding?
- For an uncertain lens, perspective, view, or object edit, have you obtained a decision from the responsible broker and MLS?
- Have you retained the unaltered original?
- If California law covers the image, is the alteration statement reasonably conspicuous and adjacent to the image?
- Does the California link, URL, or QR code publicly provide and clearly identify the original image?
- Does the MLS permit the image and prescribe any separate label, slot, or submission sequence?
- Has the responsible licensee reviewed the complete advertising set for a truthful picture?
