Do not authorize a ransom payment or hire a negotiator until you know what the transaction can—and cannot—achieve. Payment does not guarantee a working decryptor, restored systems, deletion of stolen data, or an end to the incident. It also does not replace containment, forensic investigation, eradication, rebuilding, legal review, or reporting.
Use your incident-response plan first. Bring in technical responders, leadership, counsel, your insurer and relevant government contacts, then compare clean-backup recovery, rebuild and negotiated options against the same operational, legal and human consequences. The questions below are a decision framework, not a promise that negotiation will succeed.
Start with the incident-response plan, not the ransom note
An active ransomware event is a coordinated crisis. The joint CISA/FBI/NSA/MS-ISAC #StopRansomware Guide (September 2023) tells organizations to follow their approved response plan, coordinate internal and external stakeholders, preserve incident information and consider requesting assistance. A ransom demand should be treated as evidence and an input to that process, not as an instruction to bypass it.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteStabilize and preserve evidence
- Use your established containment procedures to isolate affected hosts and accounts without destroying volatile evidence or cutting off systems needed for safe operations.
- Record the ransom note, wallet addresses, chat handles, timestamps, file extensions, sample encrypted files and every communication. Preserve originals and hashes where your responders support that process.
- Ask responders to determine the initial access path, persistence, lateral movement, privileged-account exposure and whether data was copied before encryption.
- Do not let a negotiator delete logs, wipe systems or contact the actor outside the agreed chain of custody.
Put decision owners in writing
Name the executive decision-maker, technical lead, legal lead, communications lead and insurer contact. Define who can authorize an offer, sign a transaction, notify customers or regulators, and stop negotiations. A negotiator may advise or conduct communications; the organization retains responsibility for the decision.

Report and request help promptly
U.S. federal guidance urges reporting whether or not the victim pays. Consider the local FBI field office, the FBI Internet Crime Complaint Center (IC3) and CISA. CISA describes voluntary federal asset-response support that can include technical assistance, remediation advice and coordination. The Play ransomware advisory, updated June 4, 2025, repeats the prompt-reporting recommendation. Outside the United States, use your national cyber-incident authority and law-enforcement channels; U.S. reporting routes are not universal.
Questions to answer before authorizing any payment
1. What is actually affected?
Ask for an asset-and-data map that distinguishes encrypted, merely inaccessible, destroyed and still-operational systems. Identify critical business services, safety systems, backups, identity infrastructure, cloud tenants, third-party connections and manual workarounds. Require confidence levels and the evidence supporting each conclusion.
2. What can be recovered without paying?
Have responders test whether clean, offline or immutable backups exist, whether restoration credentials are intact, and whether rebuilds can be completed safely. Ask how long each path takes, what data would be missing, and whether restored systems could be reinfected from an undiscovered foothold. Recovery feasibility is incident-specific; do not accept a generic percentage or unsupported promise.

Ransomware groups commonly threaten publication as well as encryption. Ask whether outbound traffic, archive creation, cloud-access logs, endpoint telemetry or the actor’s samples support an exfiltration claim. If theft is plausible, have counsel assess privacy, contractual, employment, sector and notification duties in every affected jurisdiction. The federal guidance identifies the response and reporting need but does not decide every jurisdiction’s disclosure law.

4. What would payment buy, and what would remain uncertain?
Require a written statement of assumptions: the exact systems covered, the proposed decryptor or key, support promised by the actor, timing, testing method and any claimed deletion of stolen data. Treat every assurance as unverified until your technical team tests it. The authoring organizations of the joint guide state: “The authoring organizations do not recommend paying ransom. Paying ransom will not ensure your data is decrypted, that your systems or data will no longer be compromised, or that your data will not be leaked.”
5. Have law enforcement, counsel and the insurer been engaged?
Ask whether the relevant FBI/CISA contact has been made and whether sharing the wallet, alias, indicators and communications could help identify the actor or protect other victims. Involve counsel before making statements that could affect privilege, litigation, notification or sanctions analysis. Notify the insurer under the policy’s incident and consent provisions; coverage, panel requirements and reimbursement are determined by the actual contract, not by general guidance.
6. Has sanctions and transaction risk been assessed?
U.S. sanctions can prohibit transactions involving designated or blocked persons and entities. Treasury’s November 8, 2021 ransomware advisory encourages reporting incidents and payments with a potential sanctions nexus. Ask qualified sanctions counsel or compliance specialists to screen current lists, the actor, wallet, intermediaries and payment route. A negotiator’s statement that a transaction is “safe” is not a legal determination, and lists and advisories can change.
7. What is the harm of each option?
Document effects on patients, customers, employees, public services, safety and contractual commitments. Include the cost of downtime, overtime, emergency services, notification, credit monitoring, rebuilding and long-term monitoring—not just the ransom demand. Record who measured each estimate and what assumptions could change it.

Compare recovery and negotiation paths on the same criteria
These options can be combined, but none removes the need to eradicate the attacker and rebuild trust in compromised systems.
| Path | Questions to test | Main uncertainties |
|---|---|---|
| Clean-backup restoration and rebuild | Are backups isolated, complete and malware-free? Can identity, applications and hardware be rebuilt in a controlled sequence? | Missing data, restoration time, hidden persistence and backup compromise. |
| Incident-response-led recovery | Can responders identify and close the entry path, reset credentials, hunt for persistence and validate each restored service? | Scope may expand; specialist availability and duration vary. |
| Negotiated payment | Would a tested decryptor materially change the service-recovery timeline or data outcome after legal approval? | Decryptor failure, incomplete keys, continued access, data disclosure and sanctions exposure. |
| Hybrid approach | Can restoration and rebuilding proceed while a controlled communication channel gathers intelligence without delaying containment? | Divided attention, inconsistent messages and accidental evidence loss. |
Compare every path by (1) time and probability of restoring critical operations, (2) completeness and integrity of recoverable data, (3) persistence, exfiltration and reinfection risk, (4) legal, sanctions, privacy and regulatory exposure, (5) cost and policy conditions, and (6) effects on affected people. The FBI, CISA and Australia’s ACSC state in their Play advisory that they do not encourage paying because payment does not guarantee file recovery.
What to ask before hiring a ransomware negotiator
These are due-diligence questions derived from official coordination guidance, not an official certification checklist. The sources reviewed do not identify a universal regulator-approved negotiator credential or endorse a particular commercial firm.
Role and decision boundaries
- Will you provide communications only, threat-actor analysis, incident-response coordination, payment logistics, or a defined combination?
- Who performs each task, who is available around the clock, and who owns the final decision?
- How will you avoid interfering with forensic collection, privilege, law-enforcement contact or insurer requirements?
Comparable experience
- Which ransomware families, sectors and incident sizes have you handled?
- What can you substantiate without revealing another client’s confidential information?
- Can you provide references or an anonymized case description that explains the outcome and limitations, not just the ransom reduction?
Scope, deliverables and fees
- What written deliverables will we receive: situation reports, options analysis, communication logs, sanctions-screening records, payment instructions and a post-incident file?
- What are the response hours, escalation path, stopping conditions and handoff to recovery teams?
- Are fees fixed, hourly, contingent on the amount negotiated or contingent on a ransom being paid? List expenses and currency-conversion charges.
- Disclose conflicts, including relationships with insurers, payment providers, threat-intelligence sources or other parties in the incident.
Data handling and confidentiality
- What credentials, logs, personal data or ransom communications do you need?
- Can access be least-privilege, time-limited and controlled through your counsel or a secure workspace?
- Where are records stored, who can access them, how are they encrypted, and when are copies deleted or returned?
- Will negotiation records and artifacts be preserved for forensic, legal, insurance and reporting purposes?
Coordination and compliance
- How will you coordinate with internal responders, outside counsel, the insurer, law enforcement, CISA or another government response team?
- Who performs sanctions screening, what qualifications support that work, and will your written analysis be reviewed by the organization’s own counsel?
- How will you document wallet screening, counterparties, payment approvals and the chain of custody?
Failure and recovery planning
- What happens if the actor stops responding, raises the demand, sends a defective decryptor or leaks data despite payment?
- How quickly can you switch to restoration, rebuild and notification work?
- Will you help test a decryptor on isolated copies, validate recovered data and remove persistence, or does another team own those tasks?
Insurance, governance and cost control
Insurance may cover some negotiation or incident-response costs, but only the policy, endorsements, exclusions, panel rules, retentions and consent requirements answer that question. Before signing an engagement, ask the insurer in writing whether the proposed firm is approved, whether counsel must direct the work, what documentation is required and whether a payment would affect coverage. Do not assume reimbursement because another organization received it.

Use a decision log with dates, evidence, alternatives considered, approvals, legal advice and communications. Separate the ransom amount from negotiator fees, forensic work, restoration, business interruption, notification, public-relations support, regulatory response and long-term monitoring. A low demand can still produce a high total cost if systems require rebuilding.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. If the organization pays, refuses or pauses
If payment is authorized
Obtain documented legal, sanctions, insurer and executive approvals. Use a controlled wallet and transaction process, preserve every instruction and test any decryptor in an isolated environment before connecting restored systems. Continue threat hunting, credential resets, patching, segmentation and rebuild validation. Payment is not the end of response.
If payment is refused
Prioritize clean recovery, rebuild sequencing, evidence preservation, notification analysis and communications with affected people. Maintain the reporting channel and reassess the decision if new forensic facts change the operational or legal picture; a refusal is not a substitute for active recovery.
If negotiations pause or fail
Do not let a silent actor halt containment or restoration. Preserve the transcript, wallet information and timing, then execute the fallback plan. If stolen data appears online, preserve the location and evidence, involve counsel and law enforcement, and follow applicable notification and takedown processes.

What the 2025 Play ransomware advisory adds
The joint FBI/CISA/ASD advisory updated June 4, 2025, reported that approximately 900 entities had allegedly been affected by Play ransomware as of May 2025. That figure describes an allegation in the advisory, not an industry-wide success or payment rate. The same advisory says: “FBI, CISA, and ASD’s ACSC do not encourage paying a ransom as payment does not guarantee victim files will be recovered.” No reliable universal negotiation-success, payment or recovery percentage is established here, so reject claims that cite one without a publisher, date, population and method.
Questions for organizations outside the United States
The operational disciplines—containment, evidence preservation, recovery testing, stakeholder coordination and careful authorization—apply broadly. Legal conclusions do not. Replace FBI, IC3, CISA, U.S. sanctions and U.S.-specific notification assumptions with your national cyber authority, local law enforcement, privacy regulator, sector regulator, insurer and qualified counsel. If systems, employees or customers span countries, assess each jurisdiction rather than selecting the most permissive rule.
Warning signs of an unsafe engagement
- A promise of guaranteed decryption, guaranteed deletion or a guaranteed deadline.
- Pressure to bypass counsel, the insurer, leadership, responders or law enforcement.
- Requests for unrestricted administrator credentials, unexplained personal data or payment to an undisclosed wallet.
- No written scope, fee schedule, conflict disclosure, retention policy or failure plan.
- Claims of government approval or a universal credential that cannot be independently substantiated.
- Advice to stop backups, stop reporting or abandon recovery work while negotiations continue.
The practical decision rule is straightforward: authorize only after the organization understands its recovery alternatives, legal and sanctions exposure, stakeholder obligations, evidence quality and fallback plan. A negotiator can support communications and analysis, but cannot make payment safe, make recovery certain or remove the organization’s responsibility for the incident.
