PS5 Digital Games: What Your Purchase Actually Gives You

Buying a digital PS5 game gives you a license to use it, not ownership of the underlying software. Sony’s terms generally describe that license as personal and non-transferable, subject to applicable local law. You can have a game in your PlayStation library without having the right to sell or transfer it like a physical copy.

What “owning” a digital PS5 game means

There are two different ideas behind the word “own.” You may have paid for a game and see it in the library associated with your PlayStation account. That does not necessarily mean you own the game’s software or intellectual property, or that you can transfer the license to someone else.

Sony Interactive Entertainment’s U.S. PlayStation Terms of Service make this distinction explicit: using words such as “own,” “purchase” or “buy” in connection with content does not mean that ownership of the software or its intellectual property has transferred to the user. Sony’s March 2026 PlayStation Terms of Service describe a Store purchase as a personal license for private, non-commercial use and state that the customer does not own the product.

These are Sony’s contractual terms, not a ruling about what a court would decide in every case. The legal effect can depend on the buyer’s country, applicable law, the relevant terms version and the details of the transaction.

Can you transfer or resell a digital PS5 game?

Under the terms reviewed, generally not as though it were a physical game copy. Sony’s terms describe the digital license as non-transferable and restrict selling or transferring PSN content. Sony’s March 2026 terms include an exception where applicable local law requires otherwise; the U.S. terms also qualify their restrictions with exceptions stated in the agreement or allowed by law.

That means a digital purchase should not be treated as a transferable asset just because it appears in your library. Whether a particular local law changes the result is a jurisdiction-specific question; the terms alone do not settle it for every buyer.

What could happen if you lose access to your account?

Sony’s terms warn that closing or deleting the account used to acquire content may mean losing access to that content. This describes a possible consequence, not a guarantee that every game will automatically disappear in every account-closure situation.

There can also be a separate account dependency for some third-party games. Sony’s European terms warn that closing or unlinking a required third-party account may affect access to a game published by that third party. The purchasing PlayStation account and any required publisher account are distinct, so check the game’s account requirements before unlinking or closing either one.

Can Sony suspend access to purchased games?

Sony’s U.S. terms say that a breach of the agreement may lead to suspension and loss of, or restricted access to, associated content. The terms condition use on compliance with applicable requirements. This is a contractual risk Sony describes; it does not establish that a particular account will be suspended or that a specific game will be removed.

Can you get a refund after downloading?

Refund and cancellation rights depend on the buyer’s jurisdiction and the transaction. Sony’s European terms give the European Economic Area as an example: a buyer may have 14 days to cancel a digital-content purchase, but consenting to immediate delivery can limit that right, and starting a download generally prevents cancellation merely because the buyer changed their mind. Rights relating to faulty content and other applicable legal protections may still matter.

The EEA example is not a worldwide refund rule. Check the policy and consumer law that apply to the country and account region used for the purchase, particularly before starting a download.

How is a digital purchase different from a boxed game?

The distinction matters, but it does not prove that every physical-disc buyer has identical rights or that every disc works without account, system or publisher requirements. Those questions depend on the relevant product terms and local law.

Which terms apply to your account?

Start with the country or region associated with your PlayStation account and the terms that apply there. Sony’s PS5 system agreement directs users in the Americas to its Software Product License Agreement. It directs users in Europe, the Middle East, Africa, Australia, Oceania, India, Russia and Ukraine to its Software Usage Terms. Both routes characterize software as licensed rather than sold, but the U.S. agreement’s detailed clauses should not be treated as the contract governing every region.

For a specific purchase, consider the terms shown for that account and transaction, as well as the law where you live. Sony can revise its terms, so the applicable version may depend on when and where the purchase was made.
