Registration and mutation are different records. A registration record shows that a sale deed, gift deed, partition deed or another instrument was presented and registered through the registration system. A mutation entry updates the revenue or land record after a reported change, usually so the administration can identify the person responsible for land revenue and related records. Mutation does not, by itself, create or extinguish ownership title, and registration should not be treated as a universal guarantee that the transferor had good title. To assess a property, compare the registered instrument, the revenue entry, parcel identifiers and the prior chain of title under the law of the state where the land is located.

The short answer: registry and mutation answer different questions

A property registry answers an administrative question: Was a particular instrument presented and registered under the applicable registration process? The registration office preserves the instrument and related particulars so the transaction can be found and relied on as evidence.

A mutation record answers a revenue-record question: Whose name or interest is currently reflected for this parcel in the relevant land or revenue record? It is commonly updated after a sale, inheritance, partition, gift, court order or other reported change. The entry helps the revenue administration maintain its records and collect land revenue; it is not a substitute for the deed or for adjudication of title.

The distinction matters because a registered deed can exist while mutation is pending, rejected or recorded under an incorrect name. Conversely, a revenue entry can show a person’s name even when the underlying title is disputed or the supporting instrument is defective. The safest approach is to treat the records as complementary evidence and then examine the underlying documents and chain of title.

What a property registration record is

Its purpose

Under the Department of Land Resources’ description, the Registration Act, 1908 is procedural legislation providing for registration of certain documents. Registration creates an official record that an instrument was presented, accepted and registered through the prescribed process. State registration departments also describe registration as serving the preservation of evidence, publicity of documents, assurance of title and fraud prevention.

Those functions make registration important, but they do not turn the registration office into a court deciding every ownership dispute. The office generally records the instrument and checks compliance with the registration procedure. The legal effect of the deed depends on the instrument’s terms, the parties’ authority, the property description and the applicable law.

What it can evidence

  • The existence of a particular registered instrument, such as a sale deed, gift deed, release deed, partition deed, lease or mortgage, depending on local law.
  • The names of the persons shown as parties, the execution and registration dates, consideration or other stated terms, and the identifying details captured in the instrument.
  • The parcel description supplied in the deed, including survey number, plot number, village or locality, area, boundaries and any stated undivided share.
  • The registration office, document number, book or volume reference and other indexing details that allow an official copy to be obtained.

What it cannot establish by itself

  • That the transferor unquestionably owned the property or had authority to transfer the entire interest described.
  • That no heir, co-owner, tenant, mortgagee, government authority or other claimant has a competing right.
  • That the parcel description is free from an area error, overlapping survey number, boundary mistake or identity mismatch.
  • That all later events affecting the property have been recorded, or that a court has upheld the transaction.

A registered document is therefore strong evidence that the instrument went through registration, but it is not a universal certificate of good title. The West Bengal registration department’s explanation of registration’s functions should be read as a description of the system’s purpose, not as a promise that every registered transfer is immune from challenge.

What a mutation or revenue record is

Its purpose

Mutation is the process of entering a reported change in the relevant land or revenue record. The record may be called a jamabandi, holding record, record of rights, khata, khatian or another state-specific name. The terminology, authority, forms and procedure vary because land and revenue administration is largely handled under state law.

Mutation commonly follows a registered transfer, but it may also follow inheritance, a family partition, a gift, a court order, acquisition or another event recognized by the local rules. The authority updates the name or interest shown against the parcel so that revenue demands and related administration are directed to the recorded person.

What it can evidence

  • The name, share or interest currently reflected in the relevant revenue record for the parcel.
  • The fact that the authority processed a mutation application or entered a change, together with an order number, date or supporting document where the local record includes those fields.
  • The parcel identifiers and area used by the revenue system at the time of the entry.
  • In some proceedings, a revenue entry may be evidence favouring the recorded person. Its evidentiary weight depends on the particular state, issue and legal proceeding.

What it cannot establish by itself

The Supreme Court material reviewed, including a judgment dated 7 November 2025, states the legal proposition that a jamabandi or holding entry does not necessarily confer title. In practical terms, mutation does not itself create ownership, transfer ownership, validate a defective deed or extinguish another person’s title. It is primarily fiscal and administrative.

An entry can remain in a deceased owner’s name, be made from an unregistered family arrangement, reflect only one co-owner, or contain a clerical error. A person named in the revenue record may still need to prove the underlying succession, transfer or partition. Conversely, a rightful owner may have a valid deed while mutation is delayed or incorrectly recorded.

Registry versus mutation: comparison

Comparison point Registration record Mutation or revenue record
Primary purpose Record an instrument presented for registration and preserve its particulars. Update the land or revenue record after a reported change for administration and revenue collection.
Typical authority The state registration department and the specified sub-registrar or registration office. The local revenue, land-record or municipal authority designated by state and local rules.
What it shows Parties, instrument type, dates, document reference and the property description written in the instrument. The person or interest reflected against a parcel, with local order and parcel details where available.
Does it prove title alone? No. It proves registration of the instrument, not necessarily that the transferor had good title or that no competing claim exists. No. Mutation does not by itself create or extinguish title; its evidentiary value varies with the issue and jurisdiction.
Document to inspect The complete registered deed or other source instrument, not only an index or abstract. The mutation order, revenue extract and the document on which the entry was based.
Key cross-check Survey or plot number, village, area, boundaries, parties, shares and registration date. The same parcel identifiers, recorded name or share, order date and supporting instrument.
Local variation Office names, search methods, fees and document categories vary by state. Record names, responsible offices, notice requirements, objections, deadlines and portals vary by state and locality.

How to check registry and mutation records

Use the following sequence for the state or territory in which the property is situated. A national-looking website or a familiar record name is not enough; confirm that the source is the authority responsible for the specific parcel.

  1. Identify the jurisdiction and local terminology. Note the state or union territory, district, sub-district, village or municipal ward. Ask which office maintains the registered instrument and which office maintains the land or revenue record. Determine whether the local record is called a jamabandi, khata, khatian, holding, record of rights or something else.
  2. Obtain an official copy of the registered instrument. Request the complete deed or other source document from the registration office or its authorized service. An index entry may omit recitals, schedules, co-owner shares, restrictions and the exact boundary description. Record the document number, book or volume reference, registration date and the office that accepted it.
  3. Obtain the current revenue extract and mutation order. Get the latest available extract for the parcel and, where the system provides one, the order or proceeding that changed the entry. Save the date of issue and the authority’s seal, digital signature or verification details. A display-only search result is less useful than an authenticated copy.
  4. Match the parcel identity. Compare survey number, subdivision, plot or parcel number, village, locality, area and boundaries. Check whether a resurvey or consolidation changed the number. A matching owner’s name is not sufficient if the land identity differs.
  5. Match the parties, shares and dates. Compare the transferor and transferee names, spelling variants, aliases, undivided shares, execution date, registration date and mutation date. Check whether the deed transfers the whole parcel or only a fractional interest. Do not silently treat a spouse, heir or co-owner as the sole owner.
  6. Read the chain of title. Start with the current deed and trace earlier deeds, partitions, releases, inheritance documents, grants or acquisition records that explain how the transferor obtained the interest. Note gaps in ownership, missing links, inconsistent areas and documents signed by someone whose authority is unclear.
  7. Search for relevant competing records. Depending on local availability, check encumbrance or mortgage records, court orders, acquisition notifications, restrictions, leases, tax or land-revenue arrears and pending objections. The availability and legal effect of each search differ by jurisdiction, so treat a clear search as evidence of what that database contains, not as a guarantee that no claim exists anywhere.
  8. Resolve discrepancies before relying on the property. If the deed, mutation entry and parcel identifiers do not align, stop treating the records as interchangeable. Ask the revenue authority about correction or objection procedures and obtain advice from a qualified local property lawyer or title-search professional when the issue concerns succession, boundaries, co-ownership, fraud or a break in the chain.

Fields to compare in a practical cross-check

Field Questions to ask Warning signs
Parcel number Is the survey, plot, subdivision or holding number identical in both records? Old and new numbers are mixed without a resurvey or conversion document.
Location Do village, locality, ward, district and sub-district match? Names look similar but identify different villages or administrative units.
Area Does the stated area match after accounting for units and undivided shares? The deed transfers one area while the revenue record shows another with no explanation.
Boundaries Do north, south, east and west boundaries describe the same parcel? Boundaries identify neighbours or roads that cannot coexist with the recorded location.
Parties and shares Are all transferors, heirs and co-owners accounted for? One co-owner is shown as transferring the whole property, or an heir is missing.
Dates and references Can the mutation order be linked to the registered deed, succession document or court order? The revenue entry predates the claimed transfer or cites an unrelated document.
Restrictions and claims Are mortgages, leases, acquisition notices, objections or court orders disclosed? A clean revenue extract is treated as proof that no encumbrance or dispute exists.

What to do when the records conflict

The deed is registered but mutation is still pending

This can be an administrative delay rather than proof that the deed is invalid. Keep the registered deed, submission receipt and any notice from the revenue authority. Check whether the local rules require a separate application, a notice to interested parties, payment of a fee or a copy of the deed. Do not assume that pending mutation changes the title question; it means the revenue record has not yet been updated.

Mutation names a person who is not the deed holder

Check whether the entry is based on inheritance, an earlier transfer, a court order or a clerical mistake. Obtain the order and supporting document instead of relying on the name displayed in a search result. If the entry affects a purchase, mortgage or possession dispute, have the competing instruments reviewed under local law.

The parcel number or area differs

First determine whether a government resurvey, subdivision, consolidation or change of measurement explains the difference. Look for an official correlation statement or map. If no lawful conversion explains it, treat the property identity as unresolved; a matching name cannot cure a mismatch in land.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

An heir, co-owner or boundary claimant objects

Mutation proceedings may record or notify an objection, but the revenue authority may not have jurisdiction to finally decide title. Collect succession documents, prior deeds, maps and court orders. A local property lawyer can identify whether the issue requires a civil declaration, partition, injunction, boundary survey or another remedy.

A registered instrument appears fraudulent or unauthorized

Registration alone does not validate a forged signature, impersonation or transfer by a person lacking authority. Preserve certified copies, identity and power-of-attorney records, payment evidence and correspondence. Seek urgent local legal advice because limitation periods, cancellation procedures and interim remedies are jurisdiction-specific.

Why state and local variation matters

Registration is a concurrent subject in India, while land and revenue administration, including mutation, is substantially implemented through state laws and local offices. The same event may therefore use different forms, record names, notice periods, fees, appeal routes and online services in different states. Some systems provide downloadable extracts; others require an application at a revenue office or service centre.

Do not infer a universal legal effect from a term used in one state. “Jamabandi” and “holding” are examples of terminology used in particular revenue-record contexts, not names that apply to every Indian property. Confirm which authority maintains the record for the exact parcel and whether an online copy is legally authenticated.

Documents to assemble before a purchase or title review

  • The complete current registered deed and certified copies of relevant earlier deeds.
  • Mutation orders, revenue extracts and any correction, objection or appeal orders.
  • Survey, subdivision, cadastral or resurvey maps and official parcel-number correlations.
  • Succession, probate, heirship, partition, release, gift or settlement documents where family ownership is involved.
  • Encumbrance, mortgage, lease, acquisition, restriction and court-order searches available in the local system.
  • Identity and authority documents for attorneys, guardians, companies, trusts or representatives who signed.
  • Receipts showing registration, mutation, tax or land-revenue payments; these support the administrative history but are not substitutes for title documents.

Common mistakes that create false confidence

  • Assuming that the person named in mutation is automatically the owner.
  • Assuming that a registered deed guarantees the seller’s title or rules out every competing claim.
  • Checking only an online index instead of reading the deed schedule, recitals and annexed map.
  • Ignoring fractional shares, inherited interests or the rights of co-owners.
  • Accepting a changed survey number or area without an official resurvey or conversion record.
  • Treating a tax receipt or revenue payment as proof of ownership.
  • Using a record from the wrong village, ward, district or similarly named locality.
  • Assuming that an unchallenged entry has the same evidentiary weight in every state or court.

When professional review is justified

Routine cross-checking may be enough when the deed, revenue entry, parcel identifiers, shares and chain of title all align and no adverse record appears. Professional review is prudent when there is a missing link, inheritance issue, unregistered family arrangement, boundary conflict, mortgage, acquisition notice, power-of-attorney transfer, company or trust ownership, suspected fraud, pending litigation or a disagreement between records.

Choose a practitioner familiar with the property’s state and local record system. Ask for a written description of the documents examined, the assumptions made, unresolved gaps and the difference between an opinion on documentary title and a guarantee of possession or litigation outcome.

A reliable standard for reading the records

Use registration to establish what instrument was officially recorded. Use mutation to see how the revenue administration currently reflects the reported change. Use the deed, prior instruments, parcel evidence and applicable law to evaluate the underlying title. Consistency across all records increases confidence and exposes errors early, but consistency alone does not replace examination of competing rights or a competent legal decision.

The Supreme Court’s 7 November 2025 discussion reinforces the central point: a revenue entry such as a jamabandi or holding entry does not necessarily confer title. The practical consequence is straightforward—never buy, mortgage, divide or litigate property on the strength of mutation or registration in isolation.
