Professional liability and general liability protect against different allegations. Professional liability—often called errors and omissions (E&O)—is designed for claims that a designer’s covered professional service contained an error, omission, negligent act, or failure to meet the required standard and caused loss. General liability (GL) is generally for third-party bodily injury, property damage, and, depending on the policy, personal or advertising injury arising from business premises or operations.

A design firm can need both. A client’s claim that incorrect specifications caused expensive rework is a professional-liability question; a visitor who falls in your office or property damaged during a site visit is generally a GL question. The policy wording, facts, jurisdiction, and contract—not the label alone—determine coverage. The guidance below is US-oriented and is not a coverage determination for any particular claim.

The difference at a glance

Comparison Professional liability (E&O) General liability (GL)
Typical allegation A covered mistake, omission, negligence, or failure in professional services causes a client or other party financial loss. Third-party bodily injury or property damage connected with business premises or operations; some policies also cover personal or advertising injury.
Designer example A client alleges that incorrect specifications, calculations, advice, or design coordination caused project rework or financial loss. A visitor slips in the studio, or a designer accidentally damages a client’s property during a site visit.
Main coverage question Did the allegation arise from a service within the policy’s professional-services definition, and were the claim and report made under the policy’s timing rules? Did bodily injury or property damage arise from covered premises or operations, and does an exclusion apply?
Contract review Check the professional-services definition, limits, exclusions, retroactive date, reporting conditions, and any extended-reporting provision. Check required limits, premises-and-operations scope, additional-insured wording, and the certificate or other proof the client requests.
Important limitation It is not automatically an accident policy for every event at a project. It should not be assumed to cover professional errors or pure economic loss when there is no covered bodily injury or property damage.

These are category descriptions, not promises that every policy will respond. Definitions and exclusions can move a claim from one category to another or remove it altogether.

What professional liability covers for a designer

Professional liability follows the alleged professional service. A claimant does not have to use the words “malpractice” or “E&O.” The practical question is whether the complaint says that your design judgment, advice, specifications, coordination, or another listed service was deficient and that the deficiency caused a covered loss.

Common allegations

  • An error in drawings, specifications, schedules, calculations, or other deliverables.
  • An omission, such as failing to identify a requirement that the agreed service required you to address.
  • Negligent professional advice or coordination that leads to rework, delay costs, or another claimed financial loss.
  • A failure to meet the professional standard or the scope promised in the engagement.

Coverage depends on the policy’s definition of professional services, the actual work you performed, the alleged cause of loss, exclusions, limits, and claim-reporting conditions. A policy written for one design discipline may not automatically include a new service, construction activity, project-management role, or consulting work added later.

What the policy is not

Professional liability is not a blanket warranty that a project will be profitable or defect-free. It does not automatically pay to redo every unsatisfactory deliverable, and it does not replace a contract’s allocation of responsibility. A dispute may involve a fee disagreement, a business decision, or a performance promise outside the covered professional service. The insurer will apply the policy wording to the allegations and facts.

What general liability covers for a designer

GL generally follows the firm’s premises and operations. Its central risks are accidental third-party bodily injury and property damage connected with running the business. Some GL forms also address personal or advertising injury, but the exact insuring agreement and exclusions control.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Typical studio and office incidents

  • A client or delivery person trips in the office and alleges bodily injury.
  • An employee or contractor causes accidental damage to a client’s furniture, equipment, or finishes while visiting the client’s premises.
  • Business operations create accidental physical damage to another party’s property.

GL is generally not designed to pay a client’s purely financial loss from an allegedly incorrect design. If a client claims that a specification caused costly rework but nobody was injured and no covered property damage occurred, the central question is normally professional liability, subject to the policy terms.

Why the activity and alleged cause matter

The fact that an incident happened “on a project” does not decide which policy applies. The alleged cause matters more than the project label.

Design error causing rework

A client says your specifications or professional judgment required demolition and replacement. That allegation is commonly associated with professional liability because it challenges the professional service and seeks financial recovery. Whether the claim is covered still depends on the services definition, exclusions, timing, and other terms.

Injury at the office

A visitor falls on your premises and alleges bodily injury. That is the kind of premises exposure generally associated with GL. The fact that the visitor came to discuss a design contract does not turn an ordinary accident into an E&O claim.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A site visit with two possible causes

Site visits can involve both professional and operational conduct. If a claimant says your professional observation or design judgment missed a condition, the allegation may raise professional-liability issues. If someone is injured because equipment or materials were left in a walkway, the allegation may instead concern operational negligence and GL. “Site visit” by itself is not a coverage classification.

Why many design firms carry both

Professional work and ordinary business operations create separate exposures. E&O addresses the risk that a client says the service itself was wrong; GL addresses accidental injury or property damage arising while the firm operates. Neither policy name should be treated as a substitute for the other.

Joseph Jones, Travelers’ director of risk management for professional liability, states: “Traditional business insurance does not cover the risk design professionals have when providing professional services.” That is an insurer representative’s explanation of the distinction, not an independent legal conclusion about any particular policy. The practical lesson is to examine the actual professional-services coverage rather than assume a conventional business policy includes it.

How contracts change the insurance question

A client agreement can require specific insurance even when a state does not mandate a particular policy. Design-firm contracts may specify policy types, per-claim and aggregate limits, additional-insured status, notice obligations, insurer ratings, or certificates and other proof of insurance. The requirement may also apply to subconsultants.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Read the insurance clause before buying

  1. Copy the exact insurance language from every active client agreement, proposal, master service agreement, and public- or private-project form.
  2. Highlight each requested coverage type, limit, deductible condition, additional-insured requirement, waiver, notice provision, and evidence-of-insurance requirement.
  3. Note whether the clause describes professional services, commercial general liability, automobile, workers’ compensation, cyber, or another coverage separately. Do not infer that one line satisfies another.

Match the clause to the policy documents

Compare the contract with the declarations, endorsements, exclusions, and definitions—not only the certificate. A certificate summarizes insurance and does not rewrite the policy. Confirm that your named services, territory, limits, and dates match the work and the contract. If an additional-insured endorsement is requested, verify that the endorsement actually exists and applies to the required operations; a certificate alone is not the endorsement.

Resolve conflicts before signing

If the contract asks for wording your policy does not provide, ask the broker or insurer whether an endorsement is available and what it changes. Obtain qualified legal or insurance advice when the clause is ambiguous, unusually broad, or inconsistent with your scope. Do not promise a client coverage based on an unconfirmed assumption.

Policy terms designers should compare

1. The covered professional services

List what the firm actually does: the design disciplines, advice, specifications, coordination, inspection or observation, technology work, and any other service sold to clients. Compare that list with the policy definition. Tell the insurer about new services before accepting work; a policy built around one service may not respond to another.

2. Claims-made timing

Many professional-liability policies use claims-made structures. In that arrangement, the timing of the claim and the report matters, not just the date the design work occurred. The Hartford describes claims-made and occurrence structures, retroactive dates, and extended reporting periods as policy-dependent features. Check:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The retroactive date, which can limit coverage for work performed before that date.
  • The deadline and method for reporting a claim or circumstance.
  • Whether an extended-reporting period is available when the policy ends, and what it covers.
  • How a change of insurer or cancellation could affect earlier work and known circumstances.

Follow the notice wording exactly. A late report or a circumstance known before the policy period can create a coverage dispute even when the design work itself was performed years earlier.

3. Limits and deductibles

Review each-claim and aggregate limits, deductibles or self-insured amounts, and whether defense or other claim expenses affect the available limit under the form. Compare the requested limit with the contract, the size and number of projects, and the firm’s ability to absorb a loss. No single limit is right for every designer.

4. Exclusions and special exposures

Travelers’ risk-selection guidance identifies several areas for a design firm to examine. Ask how the policy treats:

When one incident can raise both policy questions

Some allegations contain separate acts or damages. For example, a designer may be accused of making a professional error and of damaging physical property while trying to correct it. The professional allegation and the physical-damage allegation may be analyzed under different insuring agreements, subject to exclusions and anti-concurrent-causation wording. Notify the appropriate insurer rather than deciding for yourself that only one policy matters.

Give the carrier the contract, complaint or demand, project timeline, drawings or specifications at issue, and a factual description of what happened. Avoid admitting liability or promising payment before receiving advice. The insurer’s claims team will determine how the allegations map to the policy.

A practical decision framework

If the allegation says… Start by examining… Why
“Your design, specifications, advice, or coordination caused our financial loss.” Professional-services definition, exclusions, claims-made date, retroactive date, and reporting requirements. The alleged cause is professional judgment or deliverable quality.
“Someone was injured at your office or because of your operations.” GL premises-and-operations coverage, bodily-injury exclusions, limits, and notice rules. The allegation centers on third-party bodily injury.
“You damaged our physical property during your work or visit.” GL property-damage coverage and exclusions; also review whether a professional act is alleged. Physical damage is an operational exposure, but the facts may include a professional component.
“You failed to meet a contractual promise unrelated to professional judgment.” Contract wording, professional-services definition, and contractual-liability exclusions. A contract dispute is not automatically a covered professional error.
“A subcontractor’s work caused the loss.” Professional-services scope, subconsultant provisions, indemnity language, and any separate GL exposure. Responsibility and coverage can depend on how the subcontractor relationship is written.

This framework helps identify the first policy to review; it is not a coverage decision.

Limits: what the published guidance does—and does not—say

The ACEC Business Insurance Trust guide dated 2021 described $1 million per claim as a typical minimum requested of small design firms in that guide’s context. That dated observation is not a current universal recommendation, legal requirement, or market-wide statistic. A client contract, project size, jurisdiction, lender, or public-agency rule may require a different amount.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no robust, directly attributable statistic establishing a general professional-liability-versus-GL ratio for designers. The NAIC small-business material repeats an NFIB survey figure about the cost and availability of liability insurance being a major concern for small-business owners, but the page does not state the survey year and the figure is not specific to designers or this comparison. It should not be used as a dated designer-market statistic.

Step-by-step insurance review for a design firm

  1. Inventory the work. Write down every service sold, including occasional advice, coordination, site observation, technology work, and services performed by employees or subcontractors.
  2. Separate allegations by cause. Mark which exposures involve professional judgment or deliverables, and which involve premises, operations, bodily injury, or physical property damage.
  3. Collect contract requirements. Extract coverage types, limits, additional-insured wording, notice provisions, evidence requirements, and any geographic or project-specific conditions.
  4. Compare the policy form. Read declarations, definitions, insuring agreements, exclusions, endorsements, and conditions. Confirm that the named entity and all relevant operations are insured.
  5. Check timing. For claims-made coverage, record the retroactive date, reporting deadline, and available extended-reporting terms. Keep a renewal calendar so a demand or circumstance is not reported late.
  6. Ask about changing exposures. Before accepting work in a new location or adding technology, data handling, intellectual property-sensitive work, or a subconsultant arrangement, ask whether an endorsement or different policy is needed.
  7. Document the answer. Keep the broker’s or insurer’s written explanation with the contract and policy. A verbal assumption is difficult to prove when a claim arrives.

Common mistakes and how to avoid them

Assuming GL covers design mistakes

GL is generally built around bodily injury and property damage, not a client’s pure economic loss from an alleged professional error. Obtain and maintain professional liability when your work creates that exposure.

Assuming E&O covers every accident

An E&O policy is not automatically a premises-and-operations policy. Maintain GL for office visitors and accidental property damage unless your insurance adviser confirms another arrangement.

Buying by policy name alone

Two policies with the same title can define professional services, territories, exclusions, reporting, and technology risks differently. Compare the form and endorsements.

Ignoring a contract until after a claim

A client’s required limit or additional-insured wording may be impossible to add retroactively. Review the clause before signing and ask for written confirmation of any required endorsement.

Letting a claims-made policy lapse without advice

Cancellation, a new insurer, or a changed retroactive date can affect earlier work. Ask about continuity and an extended-reporting period before a policy ends.

Reporting only the lawsuit

Claims-made conditions may require reporting a demand or a circumstance that could reasonably become a claim. Follow the policy’s notice language and contact the carrier promptly when an issue arises.

Questions to take to your broker or insurer

  • Is every service in my current scope included in the professional-services definition?
  • Does the policy cover work performed by employees, independent contractors, and named subconsultants?
  • What is the retroactive date, and what happens if I change insurers?
  • What deadline and method apply to reporting a claim or circumstance?
  • Is an extended-reporting period available, and what events trigger it?
  • How are technology, client data, intellectual property, and work in other locations treated?
  • Does the GL policy cover the premises and operations my contracts describe?
  • Can the requested additional-insured wording be endorsed, and what evidence will the client receive?
  • Do deductibles, defense expenses, or other claim costs reduce the stated limit under this form?

Bottom line for designers

Use the alleged cause as your starting point: professional judgment and deliverables point you toward professional liability; accidental bodily injury or property damage arising from premises or operations points you toward GL. Because a single project can involve both kinds of activity, many design firms need both coverages. Confirm the actual service definition, exclusions, limits, claims-made timing, contract wording, and endorsements with a licensed insurance professional familiar with your discipline and jurisdiction.
