Privacy by design means building protections for people into a product’s architecture, defaults, and operations from the start—not relying on a privacy policy or adding safeguards only after a problem. For developers, that means deciding what data an app needs, who can access it, how long it stays, and how people can understand and control its use.
GDPR Article 25 establishes data protection by design and by default requirements for processing within its scope. The NIST Privacy Framework, by contrast, is a voluntary tool for managing privacy risk. The ten principles below are a practical developer checklist synthesized from official guidance and foundational privacy-by-design principles; they are not an official regulator-published list of ten.
What does privacy by design mean for developers, and what should I build into my app from the start?
Privacy by design and data protection by design are closely related ideas: consider privacy impacts as you make product and engineering decisions, then build suitable safeguards into the system and its operation. The European Commission says organizations should implement technical and organizational measures at the earliest stages of processing design. The Commission’s explanation of how personal data should be handled gives examples such as collecting only necessary data, keeping it for the shortest possible time, and limiting access on a need-to-know basis.
That makes privacy a design and lifecycle concern, not just a matter of securing a database or writing a notice. A person can be affected by how a product uses data even when no attacker or security incident is involved. Security is essential, but it does not address every privacy risk.

Privacy by design and the two frameworks developers should distinguish

The EDPB’s Guidelines 4/2019 page explains the Article 25 guidance. NIST’s Privacy Framework page describes its voluntary framework. Neither reference turns the checklist below into a universal, prescriptive implementation recipe: appropriate measures depend on context and risk.
10 practical privacy-by-design principles for developers

Anticipate privacy risks
During discovery and design, map how product operations use data and ask what consequences people could experience. Consider intended processing as well as failures, and revisit assumptions when features, data flows, or context change. NIST frames privacy in terms of risks people may experience from system, product, or service operations—not only cybersecurity incidents.

Make privacy the default
Start with the least data exposure and processing consistent with the intended function. For example, a social profile should not be visible to an indefinite audience by default. The European Commission describes limiting profile accessibility from the start as an example of data protection by default.

Build privacy requirements in early
Include privacy requirements in architecture, design reviews, and development work rather than treating them as a release-stage check. The Commission’s guidance calls for safeguards at the earliest stages of processing design.

Minimize collection and processing
Request and process only the personal data needed for the defined purpose. Avoid collecting optional fields merely because they might prove useful later; extra data creates obligations to protect, govern, and eventually delete it.

Tie every data use to a clear purpose
Record why each category of personal data is needed, and assess proposed later uses against that purpose. This is a practical way to operationalize necessity-by-purpose guidance, not a complete statement of every legal basis an organization may need under applicable law.

Set a retention limit
Define when data will be deleted or anonymized and implement that rule in storage policies and scheduled jobs. The Commission identifies keeping data for the shortest possible time as a default-protection example.

Restrict access
Use need-to-know access, role-based permissions, and appropriate separation between users and internal services. Review service accounts and operational access as well as the permissions exposed in the user interface.

Protect data throughout its life cycle
Select technical and organizational protections that suit the system and threat model. The Commission names encryption and pseudonymization as design examples: encryption encodes information so only authorized parties can read it, while pseudonymization replaces identifying material with artificial identifiers. Neither control alone establishes compliance or removes every privacy risk.

Make practices visible and usable
Explain relevant processing in language people can understand, and provide workable controls for them. Design and defaults should support respect for individuals’ rights; a notice that users cannot understand or a control they cannot practically use falls short of that goal.

Review and improve continuously
Reassess privacy assumptions and safeguards during operation and after material changes to features, data, or context. The EDPB describes data protection by design and default as a continuous process requiring regular checks.

- Purpose: Why is the data needed, and which feature uses it?
- Access: Which people, services, and roles may use it, and under what conditions?
- Retention: When should it be deleted or anonymized, and what system enforces that rule?
- Explanation and control: What does the person need to know, and what choices or rights must the product support?
- Review owner: Who checks that the purpose, access, retention, and safeguards remain appropriate?
Then ask not only “What if this data is exposed?” but also “How could someone be affected if the system behaves exactly as designed?” That second question catches privacy harms that incident-response planning alone may miss.
Examples of privacy by design in an app
- A private profile by default: Make a new profile accessible only to an appropriate audience unless the person chooses otherwise. The Commission gives limiting profile accessibility as an example of a default safeguard.
- Short retention: Set a defined deletion or anonymization period for data no longer needed for its purpose, and ensure the storage and job logic actually enforce it.
- Limited internal access: Restrict personal data to a small, need-to-know group instead of granting broad access for convenience.
- Pseudonymization: Replace direct identifiers with artificial identifiers where that is suitable for the use and system. The Commission lists this as an example measure.
- Encryption: Encode messages or stored information so only authorized parties can read them, choosing implementation details for the system and threat model.
These are design measures, not guarantees. Their suitability depends on how the product processes data and the risks involved.
How privacy differs from security
Security controls help prevent unauthorized access, alteration, loss, or disclosure. Privacy risk is broader: it also includes consequences of legitimate processing, such as collecting more than a feature needs, exposing information to an unnecessarily broad audience, or retaining it without a continuing purpose. NIST says cybersecurity risk management contributes to privacy risk management, while also noting that privacy risks can arise in ways unrelated to cybersecurity incidents. NIST’s framework overview provides that broader risk-management context.
