Prediction markets and event contracts are related but not interchangeable. A prediction market is the venue or marketplace where trading occurs. An event contract is the contingent-payoff derivative traded in that venue. The contract may pay a fixed amount if a defined event occurs, or settle at another amount under its written rules. In the United States, the legal classification can be a futures contract or a swap depending on the structure, so the label alone does not determine which rules apply.

The short answer: venue versus instrument

Think of the distinction the same way you would distinguish a stock exchange from a stock. The exchange is the marketplace; the stock is the instrument being bought and sold. In the same way, a prediction market is a trading venue, while an event contract is the event-linked product listed there.

The Commodity Futures Trading Commission (CFTC) uses this venue-specific meaning in its March 16, 2026 advance notice of proposed rulemaking (ANPRM): a “prediction market” is a CFTC-registered designated contract market (DCM) or swap execution facility (SEF) that offers event contracts. The CFTC also says “event contract” is not a defined term in the Commodity Exchange Act or CFTC regulations. It uses the phrase descriptively for derivative contracts, typically with binary payoffs, whose value depends on an underlying occurrence or event.

That distinction matters because the same headline question—such as whether a candidate wins, inflation exceeds a threshold, or a storm reaches a location—does not by itself tell you what legal instrument you are trading, which regulator has authority, or how settlement will be decided.

What an event contract actually represents

A contingent payoff

An event contract sets out a condition and a financial consequence. A binary contract might pay a stated amount if the specified event occurs and nothing if it does not. Other contracts can use different payoff schedules, thresholds, or settlement values. The binding terms, not the short title shown in an app, define the obligation.

For example, a contract could refer to whether a published economic figure reaches a specified level by a stated date. The contract must identify the exact data release, threshold, time zone, source, revision policy, and payment formula. Two products that use nearly identical plain-language headlines can therefore have different triggers and different outcomes.

Futures, swaps and other classifications

The CFTC’s 2026 notice explains that an event contract may fit the statutory definition of a swap. An event contract can also be listed as a futures contract; futures are excluded from the statutory definition of swap. The event-based payoff describes what the contract is about, while its legal category depends on its structure and applicable law.

Some event-linked instruments can instead fall under Securities and Exchange Commission (SEC) jurisdiction, including security-based swaps. You cannot determine the regulator solely from words such as “prediction,” “event,” or “yes/no.” The venue’s registration, the contract documentation and the underlying reference all matter.

How prediction-market trading works

Prices are market-implied probabilities, not guarantees

In a common binary design, a contract’s quoted price reflects what traders collectively believe about the chance of the event. A contract quoted at 42 cents may be interpreted as a market-implied probability of roughly 42 percent when the payoff is one dollar, subject to fees, liquidity, spread and the contract’s exact payout rules.

That number is an observation about current trading, not a regulator-certified probability or a promise that the event has a 42 percent chance of occurring. It can be wrong, move rapidly as information changes, or reflect a thin market with few participants. A bid and an ask can differ substantially, so the price at which you can buy may not be the price at which you can immediately sell.

Entering and exiting before settlement

CFTC consumer material says customers may trade in and out before settlement at the current market price. You are not necessarily required to hold a position until the event is resolved. Your actual exit value depends on available bids, the spread, market depth, fees and any trading halt or limit in the rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A favorable headline outcome does not guarantee a profit if you paid too much, paid substantial fees, or cannot find a counterparty at a workable price. Conversely, a position can be closed before the event when the market price has moved in your favor, even though the final result is still unknown.

Settlement follows the written rule

Settlement provisions identify the trigger, evidence source, decision process and payout. They can specify an official government release, a named sporting result, a weather observation, a court or election determination, or another defined source. They may also explain what happens if data are revised, an event is postponed, an authority changes its methodology, or the source becomes unavailable.

Read the settlement section before trading. A contract’s everyday description is not a substitute for its operative definition. Pay particular attention to the cutoff time, time zone, qualifying threshold, tie or “no result” treatment, and who has authority to make the final determination.

Side-by-side comparison

Question Prediction market Event contract
What is it? A marketplace or trading venue where event-linked products are listed. A derivative whose payoff depends on a specified occurrence, outcome or measurement.
Primary function Matches orders, publishes prices and applies venue rules. Defines the economic exposure, trigger, payout and settlement method.
Typical price signal Displays bids, asks, last trades and available liquidity for listed contracts. Its quoted price can represent traders’ market-implied view of the event, especially in a binary design.
What determines payment? The venue enforces the contract and settlement process. The written contract terms determine whether, when and how much is paid.
Legal identity May be a CFTC-registered DCM or SEF under the CFTC’s usage in its 2026 notice. May qualify as a swap, a futures contract or another regulated instrument depending on structure; some event-linked products may involve SEC jurisdiction.
Main risks Liquidity, execution, fees, outages, rule changes and venue or intermediary risk. Loss of stake, ambiguous or unexpected trigger interpretation, data-source problems and market-price volatility.
What you should verify Registration, rulebook, customer protections, fees, access restrictions and dispute process. Trigger wording, source of evidence, cutoff time, payout, revision policy and settlement authority.

Why the distinction matters to a trader

The venue does not guarantee a particular contract

A registered venue has obligations, but registration does not make every listed contract risk-free or every interpretation obvious. CFTC materials describe registered exchanges as responsible for their trading rules and for monitoring anomalies and abuses, subject to agency oversight and enforcement. Futures commission merchants and other intermediaries have additional obligations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Those safeguards do not remove the possibility of losing money, a disputed settlement, a failed strategy, a technical interruption or insufficient liquidity. Venue-level protections and contract-level risks are separate questions.

Different contracts can have different exposure

Two products on the same market may reference different dates, data releases or definitions. One may settle on an initial figure while another uses a revised figure. One may pay for an “at least” threshold while another requires a value “above” it. Small wording differences can change the probability and the payout materially.

Jurisdiction affects availability and rights

Customer access can depend on where you live, the operator’s registration, the intermediary used, identity checks, product restrictions and current law. The CFTC asserts exclusive jurisdiction over certain commodity derivatives traded on registered markets, while state authorities and private parties have challenged how some contracts should be treated.

There is no single statement that all platforms are lawful nationwide or that every event product is regulated identically. The current legal position can differ by operator, contract, state and litigation status. Treat any broad marketing claim about nationwide legality as incomplete until you check the specific product and your jurisdiction.

Current U.S. regulatory picture

The March 2026 CFTC notice is a proposal for comment

On March 16, 2026, the CFTC published an ANPRM seeking information about event contracts and prediction markets. It discusses registration, contract-listing requirements, manipulation concerns and the Commission’s authority to prohibit particular event contracts that it determines are contrary to the public interest.

An ANPRM is not a final rule. It does not settle every contract category, resolve all jurisdictional disputes or create a universal approval for products already offered. Any explanation of the current framework should identify the notice as a proposal seeking information rather than binding final rulemaking.

Contract-specific guidance can be narrow

The CFTC staff index lists a September 22, 2026 advisory concerning “mention markets,” including contracts based on whether a person says specified words, appears at an event or interacts with another person. The index says staff described limited circumstances for listing such contracts and emphasized complete, contract-specific analysis and manipulation concerns.

Policy statements are not empirical findings

On February 17, 2026, CFTC Chairman Michael S. Selig said: “Event contracts allow businesses and individuals to hedge event-driven risks, enable investors to manage portfolio exposure, and provide the public with information about the outcome of future events.” This is the Chairman’s stated policy view. It should not be presented as proof that every market provides accurate forecasts, effective hedges or useful information in all conditions.

How large has the market become?

CFTC figures show a sharp increase in the number of listed or certified event contracts, but those measures do not equal trading volume, revenue or active users.

Period Figure What it measures
2006–2020 Approximately five event contracts per year on average Average number listed by designated contract markets, according to the CFTC in 2026.
2021 131 event contracts Contracts listed by designated contract markets.
2025 Approximately 1,600 event contracts Contracts certified for listing; not a count of active contracts, trading volume or traders.

The 2025 certifications covered financial indexes, economic indicators, weather, political and international events, science, culture, current events and sports. A certification indicates that a contract was approved for listing under the applicable process; it does not show how actively it traded or whether it attracted meaningful liquidity.

How to evaluate a contract before trading

  1. Identify the legal operator and venue. Find the registered entity, the type of registration claimed and the intermediary handling your account. Confirm the information through current official records rather than relying on an app label.
  2. Open the full rulebook or contract specification. Locate the document that controls settlement, not just the marketing headline. Record the contract symbol, edition or version and effective date.
  3. Rewrite the trigger in plain language. State exactly what must happen, by when, where and according to which source. Note whether the condition is “at least,” “more than,” “before,” “during” or another precise test.
  4. Check the evidence source. Determine which agency, data provider, official, referee or other authority supplies the decisive result. Look for revision, cancellation, postponement and unavailable-data provisions.
  5. Calculate the complete economics. Include entry price, exit price, spread, commissions, clearing or platform fees, maximum loss, maximum payout and any position limits. A one-dollar payout is not a one-dollar profit if you paid 70 cents plus fees.
  6. Inspect liquidity. Compare the bid and ask, displayed depth and recent trading activity. A quoted price may be difficult to obtain for a meaningful size, and an exit can be worse than the last traded price.
  7. Read the dispute and adjustment process. Find out who makes the initial settlement decision, how an objection is filed, the deadline, and whether the venue can correct an error or adjust a contract after an extraordinary event.
  8. Check customer and geographic restrictions. Confirm age, identity, location, account, funding and withdrawal requirements. Rules can change with new guidance or litigation.
  9. Separate information from investment advice. A market-implied probability is one signal among many. It is not a guarantee, suitability determination or individualized recommendation.

Common misunderstandings and how to avoid them

“A 60-cent contract guarantees a 60 percent chance”

No. The price can be read as an implied probability only under the contract’s payoff assumptions, and it is affected by fees, spreads, risk preferences, order imbalance and liquidity. It remains a forecast generated by trading, not a certified probability.

“Registration means there is no risk”

No. Oversight can impose rules and monitoring, but it cannot prevent every loss, manipulation attempt, technical failure, disputed interpretation or illiquid market.

“All event contracts are swaps”

No. The CFTC explains that some may meet the statutory swap definition, while others can be futures. Security-based swaps and other event-linked instruments can raise SEC questions. Classification requires analysis of the actual structure.

“More listings mean more trading”

No. The CFTC’s 2025 figure counts contracts certified for listing. It does not report volume, open interest, revenue or user numbers for those contracts.

When the products can be useful

Hedging an event-linked business exposure

A business whose costs or revenue depend on a measurable event may consider a contract as one component of a risk-management program. The hedge only works if the contract’s trigger, timing, notional amount and settlement source match the exposure closely enough. Basis risk remains when the market’s event is an imperfect proxy.

Managing portfolio exposure

An investor may use an event-linked position to offset a specific scenario affecting a broader portfolio. The relationship must be analyzed quantitatively: a contract’s fixed payout and binary trigger may not track the size, timing or probability distribution of the portfolio loss.

Seeking information from prices

Market prices can aggregate participants’ views and update as information arrives. Thin participation, strategic trading, stale orders and manipulation concerns can reduce that informational value. Treat the quote as one data point, not an objective measurement of truth.

A practical decision framework

If your main question is… Look first at… Why
“Where is this traded?” Venue registration, rulebook and intermediary The market is the infrastructure and rule set.
“What am I buying?” Contract specification and legal classification The event label does not identify the instrument.
“What does the price mean?” Payoff, bid-ask spread, fees and liquidity Price-implied probability is conditional and may be expensive to trade.
“How will I get paid?” Trigger, evidence source, cutoff and settlement authority Written terms control the result.
“Can I trade it?” Residence, account eligibility and current law Access and legal treatment are jurisdiction- and product-specific.
“Can I rely on the quote?” Volume, depth, participant quality and market integrity controls Listings and prices do not prove accuracy or liquidity.

What to remember

A prediction market is the venue; an event contract is the event-linked derivative traded there. The contract’s structure determines whether it may be treated as a swap, futures contract or another instrument, and some products can implicate SEC jurisdiction. Prices can express a market-implied probability, but they are not guaranteed forecasts. The settlement clause—not the headline—determines the trigger, evidence and payout. Finally, registration and oversight provide a framework for trading but do not eliminate financial, liquidity, settlement or jurisdictional risk.
