PIPEDA is Canada’s federal private-sector privacy law. It governs how covered organizations handle personal information in commercial activities and how federally regulated businesses handle employee information. Its ten fair information principles set expectations for responsible collection, use, disclosure, retention, and protection. Provincial privacy laws can apply instead to some in-province activities, but PIPEDA still matters for federal businesses and cross-border data flows.
What PIPEDA means
PIPEDA is the Personal Information Protection and Electronic Documents Act. The federal statute governs covered organizations’ collection, use, and disclosure of personal information in commercial activities. It also covers employee and job-applicant information handled in connection with operating a federal work, undertaking, or business. The Act’s consolidated text was current to September 21, 2026, and last amended March 4, 2025: Personal Information Protection and Electronic Documents Act.
“Federal private-sector privacy law” is a useful shorthand, not a claim that PIPEDA governs all information held in Canada. Federal government institutions are generally governed by the Privacy Act, while provincial and territorial public bodies have their own rules.

Does PIPEDA apply to a business?
It depends on the organization, the activity, and how information moves. The Office of the Privacy Commissioner of Canada (OPC) identifies banks, airlines, telecommunications companies, and interprovincial transportation businesses as examples of federally regulated organizations. PIPEDA applies to personal information they handle in connection with operating the federal business, including employee information. See the OPC’s PIPEDA overview.

For other organizations, the key question is whether the information is handled in a commercial activity covered by the Act or by a substantially similar provincial law. A charity or not-for-profit is not automatically covered simply because it operates; the nature of the activity and other facts matter.
Information and activities generally outside PIPEDA
- Information used solely for personal purposes.
- Information used solely for journalistic, artistic, or literary purposes.
- Business contact information, but only when used solely to communicate with someone about their employment, business, or profession.
- Information handled by federal government institutions generally governed by the federal Privacy Act, and by provincial or territorial governments and their agents under public-sector rules.
What counts as personal information?
PIPEDA defines personal information as information about an identifiable individual. It can include a person’s name, age, identification numbers, income, ethnic origin, blood type, opinions, evaluations, employee file, credit or medical records, and a consumer’s intentions. The definition is not limited to highly sensitive details or electronic records; context can make information identifying even when it does not name someone directly.
What are PIPEDA’s 10 fair information principles?
Schedule 1 of the Act sets out ten principles. The OPC’s principles page, modified May 29, 2025, provides an overview: PIPEDA fair information principles.

- Accountability: An organization is responsible for personal information under its control and designates someone to oversee compliance.
- Identifying purposes: It identifies why it is collecting information before or at the time of collection.
- Consent: It obtains a person’s knowledge and consent, except where the law provides otherwise.
- Limiting collection: It collects only information needed for identified purposes.
- Limiting use, disclosure, and retention: It uses and discloses information for those purposes, subject to legal exceptions, and keeps it only as long as needed.
- Accuracy: It keeps information sufficiently accurate, complete, and current for its intended use.
- Safeguards: It protects information in proportion to its sensitivity.
- Openness: It makes its privacy policies and practices understandable and accessible.
- Individual access: It gives people access to their personal information and a way to request corrections, subject to legal limits.
- Challenging compliance: It provides a process for people to raise concerns about the organization’s handling of information.
These principles apply across the information lifecycle. Consent is not an absolute requirement in every situation: the Act contains exceptions, and valid consent depends on what a person would reasonably understand about the nature, purpose, and consequences of the handling. A privacy notice by itself does not establish compliance. The Act also requires that any collection, use, or disclosure be for purposes a reasonable person would consider appropriate in the circumstances.
How PIPEDA overlaps with provincial privacy laws
Alberta, British Columbia, and Quebec have general private-sector privacy laws that have been deemed substantially similar to PIPEDA. For many activities occurring within one of those provinces, the provincial law generally applies instead of PIPEDA, subject to the law’s scope and the organization’s circumstances. The OPC’s overview of provincial privacy laws explains the exemptions.
PIPEDA continues to apply to federally regulated businesses and to relevant personal information moving across provincial or national borders in commercial activities, including where an organization is based in Alberta, British Columbia, or Quebec. Provincial health information statutes deemed substantially similar also cover personal health information in Ontario, New Brunswick, Nova Scotia, and Newfoundland and Labrador.

To work out which rules may apply, assess the activity rather than labeling an entire organization under one statute:

When must a PIPEDA breach be reported?
A breach of security safeguards includes loss of, unauthorized access to, or unauthorized disclosure of personal information resulting from a safeguards breach or a failure to establish safeguards. An organization must report a breach to the Privacy Commissioner of Canada and notify affected individuals when it is reasonable in the circumstances to believe the breach creates a real risk of significant harm. Both steps are due as soon as feasible after the organization determines that the breach occurred. The Act’s breach provisions are in section 10.1 of PIPEDA.

Significant harm can include bodily harm, humiliation, reputational or relationship damage, lost employment or business opportunities, financial loss, identity theft, negative credit effects, or property damage or loss. The organization assesses the risk by considering factors such as the sensitivity of the information and the probability it will be misused.
What a report and notice must include
The Breach of Security Safeguards Regulations, current to September 21, 2026, prescribe the contents of reports to the Commissioner and notifications to affected people. Reports include known circumstances and cause, timing, information involved, the number of affected people, mitigation and notification steps, and a contact person. Individual notices describe the circumstances and timing, the information involved, mitigation measures, steps the person can take to reduce harm, and a contact route. Direct notice is the norm; indirect notice is permitted in specified circumstances, including when contact details are unavailable, direct notice could cause further harm, or it would cause undue hardship.
Organizations must keep a record of every breach for 24 months after determining that it occurred. That retention period is set by the regulations; it is not the threshold for deciding whether a breach must be reported.

How complaints and enforcement work
An individual may complain to the Privacy Commissioner of Canada. The Commissioner can investigate and issue a report containing findings and recommendations. After receiving the report or a notice that the complaint was discontinued, the complainant may apply to the Federal Court for a hearing within the statutory timeframe. The Court may order an organization to correct its practices, publish a notice of corrective action, or pay damages, including for humiliation.
The Commissioner may also conduct an audit where statutory grounds exist and may enter into a compliance agreement. These are distinct routes: the Commissioner investigates and makes recommendations, while court remedies are for the Federal Court to order. The OPC’s PIPEDA overview describes the Commissioner’s role.
Practical next steps for organizations
- Map the organization’s activities and information flows, including employee information, commercial operations, and transfers between provinces or countries.
- Identify the applicable federal, provincial private-sector, or provincial health privacy rules for each activity.
- Document purposes, limit collection and retention, and make consent and privacy practices understandable.
- Use safeguards proportionate to information sensitivity and maintain a process for access requests and privacy concerns.
- Establish a breach-response process that assesses significant-harm risk, supports timely reporting and notice when required, and preserves breach records.
Organizations with uncertain jurisdiction or complex data flows should consult qualified Canadian privacy counsel or the relevant privacy regulator. This article is general legal information, not a determination of the law governing a particular set of facts.
