Short answer: buying a physical game normally gives you ownership of a particular disc or cartridge that you can resell under the U.S. first-sale rule. Buying a digital game usually gives your account a licence to access software under platform and publisher terms, not a transferable copy. Neither format guarantees permanent play: discs and cartridges can require patches, downloads, proprietary hardware or servers, while digital libraries can be lost through account problems, delisting, authentication changes or obsolete devices.
What you actually acquire with each format
Physical copies: ownership of the medium, not the game’s intellectual property
A physical purchase transfers possession of a particular lawfully made copy. In the United States, 17 U.S.C. §109(a) states that “the owner of a particular copy or phonorecord lawfully made under this title … is entitled, without the authority of the copyright owner, to sell or otherwise dispose of the possession of that copy or phonorecord.” This is commonly called the first-sale rule. It supports selling, giving away or lending that disc or cartridge; it does not transfer the publisher’s copyright, trademarks, source code or other intellectual-property rights.
The legal result is narrower than the phrase “I own the game” suggests. You own the object and the rights that attach to that copy. The publisher still controls reproduction, adaptation, public performance and distribution of new copies. Regional rules differ outside the United States, and a physical copy may be unusable without software updates, a platform account, downloadable content, an activation check or an operating server.

A digital game is generally delivered as digital content under a platform or publisher agreement. The European Union publication Do consumers still own what they buy? treats standalone digital games as digital content and examines whether buyers receive ownership-like rights to use, enjoy, rent, resell or modify them. The Australian Competition and Consumer Commission likewise reports that digital games are often supplied under restrictive licensing agreements rather than as physical goods.

Your account may show a “buy” button and a permanent-looking library entry, but the contract controls what that transaction means. Transfer, resale and continued access can be limited by the service terms and by regional consumer law. A practical reason resale is difficult is that a platform must stop the original account holder from continuing to use a licence after it is transferred; account-bound entitlements do not behave like a separable disc.
California’s disclosure rule
California’s 2024 digital-goods disclosure law, described in the ACCC report, requires a warning when a digital good marketed as a purchase is actually a revocable licence, unless the seller provides a non-revocable way for the consumer to retain it. The warning clarifies the transaction but does not turn a licence into a transferable physical copy, and it applies to the law’s covered sales rather than automatically changing every digital purchase worldwide.
Resale, lending and household sharing
| Question | Physical disc or cartridge | Digital licence |
|---|---|---|
| Can you sell the particular copy? | Generally yes in the United States under 17 U.S.C. §109(a), subject to regional law and ordinary ownership disputes. | Usually not as a separate object; transfer is controlled by the platform or publisher agreement and applicable law. |
| Can you lend it? | You can hand over the medium, but the borrower still needs compatible hardware and any required account, download or server. | Only through features the service expressly provides, such as household sharing; credentials must not be shared in violation of the terms. |
| What is transferred? | Possession of that lawful copy, not copyright, trademarks or source code. | A contractual entitlement associated with an account, not copyright or a transferable copy of the work. |
| What can stop use after transfer? | Missing patches, activation, DLC, damaged media, incompatible hardware or closed servers. | Account closure, revoked entitlement, service shutdown, DRM changes, delisting or loss of the account. |
For a physical sale, describe the exact edition, region, platform and included inserts. A cartridge that contains only a launcher, or a disc that requires a large first-day download, is not equivalent to a self-contained release. For a digital account, never assume that selling the account is permitted: account transfers can violate terms, expose personal data and leave the buyer unable to recover access.

Why “physical” does not always mean offline or permanent
Common dependencies in a boxed release
- Mandatory patches: the launch build may contain serious defects or lack content needed to finish the game.
- Download codes and DLC: an included code can expire, be redeemed once or be tied to a regional store.
- Activation and account checks: the first run may require an online token even when the disc remains in the drive.
- Server features: multiplayer, matchmaking, leaderboards, cloud saves and sometimes the entire campaign can depend on a publisher server.
- Proprietary hardware: a cartridge, disc format, motion accessory or storage device may not work on later consoles.
Before buying a physical edition for long-term use, check whether the base campaign starts with the console disconnected, whether the disc contains the executable or only an installer, whether updates are optional, and whether the seller identifies a region. A used copy can be legally resold while still being practically incomplete.
Why digital access can disappear
Account and entitlement failures
A digital library depends on the account that received the licence. Phishing, credential theft, a mistaken enforcement action, an inaccessible recovery email or a payment dispute can block the library even when the original purchase receipt exists. Use a unique password, multifactor authentication, current recovery details and saved receipts. Do not store recovery codes only inside the same account you are trying to recover.
Delisting, DRM and server shutdowns
A storefront can stop selling a title while existing customers retain a download; it can also alter authentication or stop redownloading. A publisher can retire servers required for launch, periodic checks, multiplayer or cloud saves. The outcome depends on the title’s implementation and the platform’s policy, so “it is in my library” is not proof of perpetual play.

The Consumer Financial Protection Bureau reported nearly $57 billion in U.S. gaming spending in 2023 and documented hacking attempts, account theft, lost access to gaming assets and collection of behavioral and financial data in gaming marketplaces. The figure is the CFPB’s reported market spending, not a guarantee that every purchase remains available, but it shows why account security and data practices matter alongside price.

A downloaded installer may depend on a discontinued operating system, graphics API, processor instruction or console generation. A platform can remove an old client, change file paths or require a newer security certificate. Keeping a copy of an installer is useful only if you also retain a compatible environment and any required licence or authentication service.
Preservation: what must survive for a game to remain playable
Preservation is more than keeping a disc or a download. The National Film and Sound Archive’s international survey identifies copyright restrictions, DRM, storage costs, obsolete hardware and software, obsolete carriers, and fragile links between physical and digital components. Its release quotes the threat directly: “Challenges to long-term collection and preservation of video games included hardware and software obsolescence, including the complexities of retrieving software from obsolete carriers, the fragility of interlinked digital and physical objects and the significant loss of heritage that has already occurred.”

The same release reports that a 2023 Video Game History Foundation study found 87% of games released in the United States were critically endangered. “Critically endangered” describes preservation risk, not a prediction that 87% of games will stop working tomorrow. It reflects how difficult it is to obtain, run and legally preserve older titles.
The preservation set for a physical game
- The original disc or cartridge, kept in a cool, dry, stable environment away from sunlight and magnetic or abrasive hazards.
- Compatible original hardware, controllers, memory devices and any unusual peripherals.
- Manuals, maps, packaging, serial information and regional release details that explain setup and dependencies.
- Downloaded patches or install data where the platform permits lawful retention, along with notes identifying the version and date.
- Evidence of whether the game requires an account, activation, a network service or a particular console firmware.
The preservation set for a digital game
- The purchase receipt, account identifier and platform terms in effect when the transaction was made.
- Permitted installers, patches, configuration files and save backups stored on more than one reliable medium.
- A record of the operating system, drivers, hardware and peripherals known to run the title.
- Documentation of launch requirements, DRM behavior, online features and any offline mode.
- A plan for migration when storage media, operating systems or account-recovery methods approach obsolescence.
Backups do not automatically defeat DRM or create a legal right to redistribute a game. They preserve your own data only to the extent allowed by the licence, copyright law and platform rules.
What preservation law permits—and what it does not
The U.S. 2024 circumvention rule creates limited exemptions for eligible libraries, archives and museums. They may circumvent access controls for preservation or local play when authentication servers have ceased operating or when a complete game is no longer reasonably available, subject to location, noncommercial and other conditions in the rule. These exemptions are institutional permissions, not a general consumer right to bypass DRM on a personal copy.

The Library of Congress Recommended Formats Statement says its preferences are designed to maximize survival and continued accessibility. It also says files should contain no DRM or encryption that controls access to, or prevents use of, the digital work. That is a preservation recommendation for custodians and format selection, not a promise that a commercial game will be supplied without access controls.

| Decision axis | Physical strengths | Digital strengths | Main qualification |
|---|---|---|---|
| Transferability | A particular lawful copy can generally be sold or given away in the United States. | Instant account access; no object to ship. | Digital transfer and resale are usually restricted by contract. |
| Offline play | May run from the medium without a store, download or account. | Can be available offline after installation if the platform supports an offline mode. | Either format may require patches, activation or servers. |
| Continuity after delisting | The medium may retain a playable base build. | Redownload and licence recognition depend on the service. | Neither format defeats server shutdowns or incompatible hardware. |
| Completeness | Packaging and manuals can remain with the copy. | Patches and updates can be delivered immediately. | DLC, updates and peripherals may be essential and separate. |
| Durability | Collectible and inspectable; vulnerable to physical damage and carrier aging. | No disc wear; duplicable backups may be possible within the rules. | Storage failure, DRM and platform obsolescence affect both. |
| Convenience | Can be lent or switched by changing the disc or cartridge. | Immediate delivery, search, portability and accessibility settings. | Convenience is tied to account, hardware and network availability. |
| Preservation rights | First-sale ownership helps possession but does not authorize copying protected software. | Institutional exemptions may apply in narrow circumstances. | Rights vary by jurisdiction and exemption conditions. |
How to choose before you buy
Choose physical when these outcomes matter most
- You expect to resell, lend, collect or give the particular copy away.
- You want the best chance of starting a base build without a storefront.
- The edition contains substantial playable content on the disc or cartridge.
- You are prepared to store the medium and maintain compatible hardware.
Choose digital when these outcomes matter most
- You need immediate delivery, fast device switching or a library without physical storage.
- Accessibility features, text scaling, remapping, language options or interface settings are important and easier to maintain digitally.
- You accept account dependence and have verified an offline mode or download policy.
- You value legitimate sales and portability more than resale or collecting.
Run this edition-specific check
- Identify the exact platform, region, edition and publisher account involved.
- Read the store or box requirements for mandatory downloads, activation, DLC, subscriptions and online services.
- Search the platform’s current support information for offline play, redownloads and account recovery.
- For a used physical copy, inspect the disc or cartridge, confirm that one-time codes are not required, and ask whether the title is server-dependent.
- For a digital purchase, save the receipt, enable multifactor authentication and record the account’s recovery options.
- Decide what you will do if the title is delisted: retain the medium, keep an authorized installer, or accept that access depends on the service.
Storage and account practices that reduce risk
Physical media checklist
- Store discs vertically in protective cases and cartridges in clean, anti-static containers.
- Avoid heat, humidity, direct sunlight, liquid cleaners and labels that can unbalance a disc.
- Keep manuals, codes and regional information with the item; do not assume an included code can be redeemed indefinitely.
- Test the copy periodically on the intended hardware rather than waiting until the console or drive is failing.
Digital library checklist
- Use a unique password and multifactor authentication on the platform and associated email.
- Keep recovery codes in an offline, secure location and update recovery contact details.
- Retain receipts and note the account region, platform and edition.
- Install updates while they remain available, maintain more than one backup of personal saves and configuration files, and document the operating environment.
- Do not share credentials or attempt account sales unless the service expressly allows it.
Common misconceptions and the precise correction
“A disc means I own the whole game.”
You own that physical copy. The playable experience may still be split among the disc, patches, DLC, account services and servers.
“Digital purchases are rentals.”
They are generally licences, but the exact duration, revocation rights and remedies come from the agreement and applicable consumer law. Some services provide continuing redownloads; others reserve broader suspension or termination powers.
The Tool Desk

It supports disposing of the particular lawful copy, not making an additional copy. Copyright and anti-circumvention rules remain relevant.
“If a game is preserved by a museum, I can download that preserved copy.”
The 2024 U.S. exemptions are limited to eligible institutions and specified conditions. They do not create a blanket public distribution right.
A practical long-term ownership plan
- Buy deliberately: choose the format based on resale, offline use, convenience and the title’s actual dependencies, not the packaging alone.
- Document the release: record platform, region, edition, version, included codes and online requirements.
- Secure access: protect the account, email and recovery methods before the library becomes valuable.
- Preserve what you lawfully can: retain the medium or authorized installers, patches, saves, manuals and compatible equipment.
- Recheck dependencies: test offline startup, redownloads and hardware compatibility while the service is still operating.
- Plan for failure: know whether your fallback is the unpatched physical build, a supported offline mode, an institutional preservation collection or acceptance that the title cannot be restored legally.
The most defensible way to think about ownership is therefore specific: you own a physical copy when you lawfully own that disc or cartridge; you usually hold a contractual digital entitlement when you buy from a storefront. Playability over decades depends on much more than that legal distinction—media condition, patches, hardware, accounts, DRM, servers and preservation rights all have to line up.
