Official notices do not confirm a broad suspension of the PERM programme for Indian IT majors. The U.S. Department of Labor (DOL) announced a 180-day suspension of processing PERM applications filed by or for Cloudera; separately, a September 2026 White House proclamation restricted entry for certain H-1B workers. The distinction matters: neither notice establishes a multi-company PERM suspension or a measured talent-retention impact across Indian IT firms.
What does a PERM suspension mean?
PERM is the Department of Labor’s employer-filed permanent labor certification process. In most cases, it comes before the employer submits an immigrant petition to the Department of Homeland Security. Employers must complete required recruitment steps, which vary by occupation category and applicable rules. The certification concerns a particular sponsoring employer and job opportunity; it is not the H-1B temporary-worker visa. See DOL’s PERM program guidance.
A suspension of processing means the agency is not processing the applications covered by the notice during the specified period. The scope depends on the notice: it does not, by itself, establish that unrelated employers or cases are affected.

The Cloudera-specific PERM action
On May 12, 2026, DOL said it had suspended processing for 180 days of all PERM applications filed by or on behalf of Cloudera. DOL said the action followed evidence obtained by the Department of Justice alleging that the company engineered a non-functional recruitment process. That is the agency’s stated enforcement rationale and an allegation concerning Cloudera—not a finding about other employers. The announcement quotes Acting Labor Secretary Keith Sonderling: “Today’s action reflects this Administration’s commitment to holding bad actors accountable when they attempt to circumvent those protections.” Read DOL’s announcement.

A separate H-1B entry restriction
A September 18, 2026 White House proclamation extended restrictions on entry for certain H-1B specialty-occupation workers for an additional 12 months. It took effect September 21, 2026, and is set to expire 12 months later, on September 21, 2027, absent extension and subject to its terms and exceptions. The Federal Register published the proclamation on September 23, 2026. It addresses entry to the United States under specified conditions; it is not a broad PERM processing suspension. Read the White House proclamation and Federal Register text.
The White House says the $100,000 payment condition had been met for more than 700 petitions since the 2025 proclamation took effect. That figure is the administration’s reported count. The proclamation also states: “The restrictions enacted by the 2025 Proclamation have proven to be highly effective but the underlying conditions necessitating the restrictions persist.” Both statements concern the administration’s H-1B entry policy, not PERM processing.
Separate enforcement activity is not a blanket suspension
On July 8, 2026, DOL’s Office of Inspector General announced an investigation and intensified enforcement efforts concerning fraud and human trafficking in H-1B and PERM systems. An investigation announcement is not a finding against every employer and does not itself announce a general suspension. Read the OIG announcement.

Does this affect my green card?
The Cloudera notice covers PERM applications filed by or for that employer. It does not establish that a worker at another company is affected. If your employer or case is covered, the consequences depend on your stage in the process and the exact scope of the notice. PERM is employer- and job-specific, so a company-level action may create uncertainty for workers relying on that employer’s sponsorship, but the available notices do not determine the status of every individual case.
DOL’s processing-time page, updated October 5, 2026, showed analyst-review and audit-review cases at a December 2025 priority date. It also reported an August 2026 average of 336 calendar days for analyst-review determinations. These are system-wide processing indicators, not an estimate for a particular case and not evidence of a general suspension. Check DOL’s current PERM processing times.
Can I change employers?
Do not assume a PERM certification or pending application transfers to a new employer: the process is tied to its sponsoring employer and specific job opportunity. A change in employer can affect an employment-based immigration case differently depending on its stage and circumstances. The notices discussed here do not resolve an individual worker’s options. Check the current official guidance and consult a qualified immigration attorney about your own documents and timeline.

Does an approved I-140 protect my priority date?
The Cloudera notice does not explain how it applies to a worker with an approved I-140, and it would be unsafe to infer the effect from the company-level announcement alone. The answer depends on the notice, the case record, and current immigration rules. Workers in that position should have counsel review the specific filing and approval history rather than treating the PERM suspension announcement as a complete answer.
Is this the same as the H-1B restriction?
No. PERM is a labor-certification step in many employer-sponsored permanent-residence cases; the September 2026 proclamation concerns entry for certain H-1B specialty-occupation workers under stated conditions and exceptions. One action concerns PERM application processing for Cloudera, while the other concerns H-1B entry. The proclamation does not announce a general PERM suspension.

Employer-sponsored green-card uncertainty can be a retention concern when workers depend on a particular employer’s filing, because PERM is tied to that sponsor and job. But the official notices cited here do not establish a broad suspension for Indian IT companies, quantify affected employees across those firms, or show a resulting attrition rate. Treat claims that the wider industry has been affected as unconfirmed unless supported by specific agency notices.
The evidence to date supports a narrower conclusion: DOL took a Cloudera-specific action, while the White House issued a separate H-1B entry restriction. Neither is proof that Indian IT firms generally have lost access to PERM sponsorship or that workers have already left as a result.
