PERM and Form I-140 are not interchangeable filings. In the usual employer-sponsored case that requires labor certification, the employer first asks the U.S. Department of Labor (DOL) to certify a permanent job opportunity through ETA-9089. After DOL certification, the employer files Form I-140, Immigrant Petition for Alien Worker, with U.S. Citizenship and Immigration Services (USCIS), submitting the certified labor certification when the category requires it.

PERM is the labor-market and worker-protection stage. The I-140 is the immigration-petition stage. They involve different agencies, different decisions and different deadlines, so approval of one does not mean the other has been approved.

PERM and I-140 at a glance

The easiest way to keep the stages straight is to compare what each agency is being asked to decide.

Question PERM labor certification Form I-140 petition
Agency U.S. Department of Labor (DOL), through the Office of Foreign Labor Certification (OFLC) U.S. Citizenship and Immigration Services (USCIS)
Main document Form ETA-9089, Application for Permanent Employment Certification Form I-140, Immigrant Petition for Alien Worker
Decision sought Certification that the permanent opportunity meets DOL’s labor-market and worker-protection test Adjudication of the employer’s immigrant petition, with the certified ETA-9089 attached when labor certification is required
Usual order Filed and decided first in a PERM-based case Filed after certification in a PERM-based case
Key time limit A certified labor certification is valid for 180 days for submission to USCIS Must be filed with the valid certification when the category requires PERM
Priority-date effect DOL’s receipt date for ETA-9089 is used as the priority date in labor-certification cases Does not turn every I-140 into a PERM case; some immigrant categories do not require labor certification

DOL’s overview describes the labor-certification purpose and the relationship between the two filings at its Permanent Labor Certification page.

What PERM labor certification does

PERM is the employer’s request to DOL to certify a permanent job opportunity. The agency’s certification is a labor-market finding, not an immigrant petition and not a visa grant. DOL describes the test as determining that there are not sufficient able, willing, qualified and available U.S. workers for the opportunity, and that employing the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.

The labor-market question

The central question is whether the employer has tested the relevant U.S. labor market in the manner required for that occupation and route. Recruitment requirements vary with the occupation and the applicable PERM route; the employer must follow the requirements that apply to its particular filing rather than treating every job as identical.

The worker-protection question

PERM also protects the position held by U.S. workers. DOL’s certification language addresses whether the permanent employment of the foreign worker would adversely affect wages and working conditions for workers in the United States who are similarly employed. This is why PERM is more than a form collecting information about the foreign employee: it is an agency review of the job opportunity and its effect on the labor market.

What document is filed

The application is Form ETA-9089. In a certified case, DOL issues an electronic certified form and a final determination document. The DOL foreign-labor-certification forms page explains that USCIS accepts the signed version issued electronically by OFLC upon certification for the relevant I-140 filing. An unsigned copy, an older draft or a different version should not be assumed to be acceptable.

What PERM does not do

  • It does not itself file an immigrant petition with USCIS.
  • It does not replace Form I-140.
  • It does not by itself produce a visa, an adjustment-of-status approval or admission to the United States.
  • It does not guarantee the outcome of a later USCIS decision.

DOL’s official certification language is precise: “there are not sufficient workers who are able, willing, and qualified, and who will be available at the time of application for a visa and admission into the United States and place needed to fill the job opportunities for which certification is sought, and the permanent employment of the foreign worker will not adversely affect the wages and working conditions of workers in the United States similarly employed.” The statement describes DOL’s certification finding; it is not a general guarantee about an individual’s immigration outcome. The wording appears on the ETA-9089 Final Determination.

What Form I-140 does

Form I-140 is a separate petition filed with USCIS by the employer in the usual employer-sponsored process. It asks USCIS to adjudicate the employer’s immigrant petition for an alien worker. When the immigrant category requires a labor certification, the employer submits the DOL-certified ETA-9089 in support of that petition.

The petition question

USCIS is not being asked to repeat DOL’s labor-market certification. The agencies make different decisions: DOL decides whether the permanent opportunity satisfies the labor-certification test, while USCIS decides the I-140 petition under its own authority. A DOL certification therefore does not equal I-140 approval, and an I-140 filing is not evidence that DOL has certified a job unless the required certification is actually included.

Why the distinction matters

People often call the entire employment-based process “the I-140” or “PERM,” but those shortcuts can hide a missing step. If a category requires PERM, filing the petition before the employer has a valid certification creates a sequencing problem. Conversely, obtaining PERM certification does not complete the employer’s immigration filing; the certified form still has to reach USCIS with the I-140 within its validity period.

Categories that do not use PERM

Not every I-140 category requires a DOL labor certification. In those categories, there is no PERM certification to attach and the ordinary PERM-first sequence does not apply. The DOL priority-date description is specifically for labor-certification filings, so it should not be generalized to every I-140 petition.

How the two stages fit together

For a case that does require PERM, the process has a defined handoff from DOL to USCIS.

  1. Employer identifies a permanent opportunity and the applicable PERM route. The employer determines that the position is a permanent job opportunity and follows the recruitment and filing requirements that apply to the occupation and route.
  2. Employer files ETA-9089 with DOL. The filing date is recorded by DOL. For labor-certification cases, DOL says USCIS and the Department of State use the date DOL receives this application as the priority date.
  3. DOL reviews the labor-certification application. DOL may issue a certification or handle the case through an audit-review track. The decision concerns the labor-market and worker-protection findings, not the later USCIS petition.
  4. DOL issues the certified form and final determination. The employer should retain the electronically issued, signed certified ETA-9089 and the final determination showing the certification and its validity period.
  5. Employer files Form I-140 with USCIS. The employer submits the certified ETA-9089 when the immigrant category requires labor certification. The filing must occur while the certification remains valid.
  6. USCIS makes a separate petition decision. USCIS adjudicates the I-140; that decision is separate from DOL’s certification decision.

This order is the ordinary PERM-based sequence described by DOL’s permanent labor-certification guidance. A case in an immigrant category that does not require labor certification follows a different path.

The 180-day validity window

DOL says a certified labor certification is valid for 180 days. It expires if the employer does not submit it to USCIS with the I-140 within that period. The 180 days is therefore a filing deadline for the handoff from DOL to USCIS, not an estimate of how long USCIS will take to decide the petition.

What to track after certification

  • The date the certification was issued or otherwise identified on the final determination.
  • The expiration date stated in the certification documents.
  • Whether the signed electronic ETA-9089 issued by OFLC is the version being prepared for the I-140.
  • The date USCIS receives the I-140 package, not merely the date the employer begins assembling it.

The final determination document identifies the certification and its validity period. Keep the certification and the final determination together so the filing team can verify that the document submitted to USCIS is the certified, signed version. If the 180-day period is about to expire, obtain case-specific advice rather than assuming that an extension, a draft copy or a late submission will preserve the certification.

Priority dates: what PERM contributes

For a labor-certification case, DOL says the date it receives the ETA-9089 application is used by USCIS and the Department of State as the priority date. That date is tied to the labor-certification filing, not to the later date on which the employer files the I-140.

Why the wording is narrow

The rule should be stated carefully. It applies to the labor-certification filing described by DOL. It does not mean that every I-140 has a PERM filing date or that every employment-based immigrant category requires ETA-9089. A category that does not require labor certification will have its own priority-date rules and no PERM receipt date to carry forward.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What to preserve in the file

Keep evidence of the date DOL received the ETA-9089 and the certified form that resulted from that filing. Those records connect the certification to the priority date used for the labor-certification case. Do not substitute the I-140 mailing date for the DOL receipt date when documenting the PERM-based priority date.

Current PERM processing snapshot

Processing information changes, and an average is not a promise for an individual employer. As of October 5, 2026, DOL’s OFLC Processing Times dashboard listed December 2025 priority dates in both the analyst-review and audit-review queues.

The dashboard is useful for understanding the age of cases being handled, but it cannot forecast a particular filing’s determination date. Common mistakes and how to avoid them

Calling PERM the petition

PERM is the DOL certification stage. The I-140 is the USCIS petition. Use the names of both forms and agencies in internal checklists, emails and case notes so a completed recruitment step is not mistaken for a filed immigrant petition.

Filing the I-140 before certification in a PERM-required case

The ordinary sequence is certification first, then the I-140 with the certified ETA-9089. Starting the USCIS filing before DOL has certified the job does not convert an uncertified application into the required supporting document.

Missing the 180-day deadline

A certification that is not submitted to USCIS with the I-140 within 180 days expires under DOL’s guidance. Build a date-control system as soon as certification arrives, with a responsible person checking the final determination and the USCIS delivery plan.

Using the wrong ETA-9089 copy

DOL’s forms guidance points to the signed electronic version issued by OFLC upon certification. Do not rely on an unsigned draft, an old saved copy or a form that does not match the final determination.

Assuming the DOL priority date applies to every I-140

The DOL receipt-date rule is for labor-certification cases. If the immigrant category does not require PERM, there is no ETA-9089 filing date to use under that rule.

Treating an average as a deadline

The 336-day figure is a dated average for analyst-review determinations, not a service guarantee. Queue dates and averages can change, and DOL says individual cases may take more or less time.

A document-and-date checklist for a PERM-based case

Use this checklist to separate the DOL work from the USCIS handoff:

  • Before filing: Confirm that the immigrant category actually requires labor certification and identify the permanent job opportunity and applicable recruitment route.
  • At ETA-9089 filing: Record the date DOL receives the application; this is the date used as the priority date for the labor-certification case.
  • During DOL review: Track whether the case is in analyst review or audit review, without treating a dashboard queue date as a prediction for the individual case.
  • At certification: Save the signed electronic ETA-9089 issued by OFLC and the final determination document.
  • Within 180 days: Confirm the certification’s expiration date and arrange for USCIS to receive the I-140 package with the certified form before that date.
  • At I-140 filing: Identify USCIS as the receiving agency and verify that the certified ETA-9089, rather than an unsigned or older copy, is included when required.
  • After filing: Keep DOL and USCIS receipts and decisions in separate sections of the case file so the two agency actions are not conflated.

Because the correct route depends on the job, employer and immigrant category, an employment-based immigration attorney can help assess individual facts. The checklist is a process-control aid, not a substitute for case-specific legal advice.

Why the distinction is useful to employees and employers

For employers

The employer is responsible for moving a certified labor opportunity into the USCIS petition stage on time. Separating the DOL and USCIS milestones makes it easier to assign responsibility: one team may monitor recruitment and ETA-9089 status, while another prepares the I-140 package and controls the 180-day expiration date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For sponsored workers

Knowing which stage a case has reached prevents misleading status descriptions. “PERM filed” means DOL has received an ETA-9089 application; it does not mean DOL has certified it. “PERM certified” means the labor-certification decision has been issued; it does not mean USCIS has approved an I-140. “I-140 filed” means the USCIS petition has been submitted, while “I-140 approved” is a separate USCIS outcome.

For anyone tracking a priority date

Keep the DOL receipt date and the certified ETA-9089 together. That date is the relevant priority-date input for the labor-certification case, while the later I-140 filing date documents a different milestone.

Bottom line

PERM asks DOL to certify that a permanent job opportunity passes the required labor-market and worker-protection test. Form I-140 asks USCIS to adjudicate the employer’s immigrant petition. In a PERM-required case, certification comes first, the certified ETA-9089 must be submitted with the I-140 within 180 days, and DOL’s ETA-9089 receipt date supplies the priority date for that labor-certification case. Treating the two filings as separate agency decisions is the key to tracking the case accurately.
