Patrick Witt has left his White House digital-assets post as the Senate remains unable to advance the CLARITY Act, the administration’s central crypto market-structure bill. The personnel change removes a senior legislative negotiator just as policy work is shifting toward action by the Securities and Exchange Commission and Commodity Futures Trading Commission.
What changed at the White House
The Block reported on Oct. 14, 2026, that a White House official said Witt’s temporary Department of Defense detail had expired. Witt served as executive director of the President’s Council of Advisors for Digital Assets and led administration efforts to move the CLARITY Act through Congress. The White House did not identify a replacement.
Witt is the third senior crypto policy leader to leave the White House in 2026. David Sacks departed in March after completing his 130-day special-government-employee period, and deputy director Harry Jung left in July. The departures leave the administration to pursue its digital-asset agenda with a changed senior team while the bill remains unresolved.
The White House said, “The White House appreciates his time and service to the Trump Administration, and wish him the best of luck in the future endeavors.”

Why the CLARITY Act stalled in the Senate
The Associated Press reported that the Senate voted 49-50 on a motion to advance the bill in September. Because the vote concerned proceeding to the legislation rather than final passage, it blocked the next step but did not permanently repeal or formally kill the bill. Any revival would require another agreement on the unresolved provisions and a new procedural vote.
Republicans said the measure would establish market guardrails, consumer protections and legal certainty for crypto businesses. Democrats demanded stronger safeguards against the president and his family profiting from digital assets while he is in office. How Trump’s crypto holdings intensified the ethics fight
The president’s financial interests became a central obstacle rather than a peripheral amendment. The Associated Press reported that Trump’s annual disclosure listed more than $500 million from sales of crypto products associated with World Liberty Financial and more than $1.4 billion from crypto businesses overall in the prior year.

Democrats argued that legislation governing the industry should not leave a sitting president and his family able to benefit from the market they are helping regulate. Their demands include stronger limits on issuing or sponsoring digital assets and a clear divestment or blind-trust requirement. Republicans maintained that Congress should still provide a broad framework for the market, even while the ethics provisions remain contested.

That conflict links the bill’s technical questions to a personal-interest dispute. Stablecoin economics, agency jurisdiction and state enforcement might be negotiable in isolation; rules affecting presidential holdings are harder to separate from the administration’s own conduct.
Did the Senate vote end the bill?
No. The 49-50 result stopped advancement in September, but it was not a final vote on the bill’s entire text. The legislation could return if negotiators resolve the ethics, stablecoin and enforcement provisions and if Senate leaders determine that another procedural attempt has enough support.

Witt warned after the defeat, “The full cost of today’s result may not be known for years to come, but this much is clear: It increases the risk that the standards that global financial markets adhere to in the future will be those of Brussels or Beijing, rather than Washington and New York.”

He had also cautioned before the vote that “A failed motion-to-proceed vote doesn’t give anyone anything they want.” That describes the immediate result: Democrats did not obtain the protections they sought, and Republicans did not obtain a statutory market framework.

What happens next
Agency rulemaking becomes the near-term path
CoinDesk reported on Sept. 22 that Witt and Treasury assistant secretary Luke Pettit saw little immediate reason to expect a quick lame-duck revival. Both pointed to work by the SEC and CFTC under their existing authority. Pettit said, “I don’t think it’s dead, but I do think that there is a sense that the focus is shifted to the administration.”
Existing authority allows the agencies to issue rules, interpret current statutes and pursue enforcement within their jurisdictions. That work can begin without a new market-structure law, but officials acknowledged that legislation would provide a stronger and more durable legal foundation. Agency action therefore may clarify parts of the market while leaving Congress’s unresolved jurisdictional and ethics choices in place.
The November 2026 midterms could reset negotiations
CoinDesk reported that the November midterm results may change the congressional calculus. A different Senate balance, new committee leadership or altered bargaining leverage could determine whether the bill returns during a lame-duck session or waits for a later Congress.

Semafor reported on Sept. 10 that Witt described the administration’s fallback as an “impressive rulemaking agenda” if legislation failed. He also warned that another legislative opportunity could take years. That would leave firms and consumers operating under a patchwork of agency rules, existing securities and commodities laws, and state-level enforcement while the major policy questions remain unsettled.
What Witt’s departure means for crypto policy
Witt’s exit does not by itself determine the CLARITY Act’s fate. It does, however, remove the administration official most closely associated with the bill’s congressional strategy at a moment when the Senate has rejected moving forward. The administration can continue regulatory work through the SEC, CFTC and Treasury, while any statutory solution depends on resolving conflicts over presidential ethics, stablecoin rewards, enforcement powers and the role of state attorneys general.
