Short answer: A traditional PAC is a federal campaign committee that can contribute directly to candidates and parties within statutory limits. A Super PAC can raise unlimited money from permitted sources, but it may spend only independently of candidate campaigns and cannot make direct, in-kind, or coordinated contributions to federal candidates or committees. A 501(c)(4) is an IRS tax-exempt social-welfare organization, not a campaign-committee category; it may lobby as a primary activity and conduct some campaign activity only while social-welfare work remains primary.
The labels come from different legal systems
“PAC” and “Super PAC” describe categories under Federal Election Commission (FEC) campaign-finance law. “501(c)(4)” describes an organization’s federal tax status under the Internal Revenue Code and IRS exemption rules. A 501(c)(4) does not become a PAC simply because it discusses public policy, and a PAC does not receive 501(c)(4) tax status merely because it advocates for a cause.
The distinction matters because each regime answers different questions. FEC rules govern who may raise or spend money in federal elections, how committees register, contribution limits, prohibited sources, disclaimers and periodic reports. IRS rules determine whether an organization qualifies for social-welfare exemption and whether political campaign intervention has become too substantial. State and local election laws can add separate registration, contribution, disclaimer and disclosure requirements.

What is a traditional PAC?
A traditional PAC is a political committee organized under FEC rules to raise and spend money in elections. Its defining feature is that it may make contributions directly to federal candidates and party committees, subject to statutory limits, source restrictions and reporting requirements. It can also make independent expenditures, but direct candidate support is the feature that most clearly separates it from a Super PAC.

Fundraising limits and prohibited sources
Individual contributions to a traditional PAC are limited by federal law. Corporate and labor-organization treasury money is generally prohibited for ordinary PAC contributions, although separate political-action funds may be established under the applicable rules. The committee must screen contributions, maintain records and report receipts and disbursements to the FEC.
How a traditional PAC can spend
- Direct contributions: Give money to a candidate or party committee within the applicable limit.
- In-kind support: Provide goods or services to a campaign when the transaction is treated as a contribution and complies with the limit and reporting rules.
- Independent expenditures: Pay for communications or other activity that expressly advocates election or defeat without coordinating with the campaign.
A PAC that wants to help a candidate by paying the candidate’s vendor, producing a coordinated advertisement or transferring campaign resources must treat the activity under the contribution and coordination rules rather than assuming it is independent.
What is a Super PAC?
A Super PAC is an independent-expenditure-only political committee. The FEC describes these committees as able to solicit and accept unlimited contributions from individuals, corporations, labor organizations and other political committees. That unlimited fundraising authority is paired with a strict spending condition: the money must be used independently of federal candidates and committees.

What “independent” means
Independence is more than putting a disclaimer on an advertisement. A Super PAC cannot make a direct contribution, an in-kind contribution or a coordinated contribution to a federal candidate or committee. Coordination can arise through communications, material involvement by campaign personnel, use of nonpublic strategic information or other conduct identified in FEC rules. A payment can therefore be treated as coordinated even when the check is written by the Super PAC rather than the campaign.
Unlimited does not mean unrestricted
Super PACs may accept unlimited amounts from permitted domestic sources, but they still must reject prohibited sources. Foreign nationals and federal contractors are prohibited sources for federal political contributions. The committee must also keep the independence boundary intact when hiring consultants, sharing vendors, communicating with campaigns or using campaign-created material.

Registration threshold and timing
For federal purposes, contributions or expenditures exceeding $1,000 in a calendar year trigger Super PAC political-committee registration. The FEC’s 2026 guidance says registration is due within 10 days after the threshold is crossed. The committee then files the required statements and periodic reports, including receipts and disbursements.
What is a 501(c)(4)?
A 501(c)(4) is an IRS-recognized social-welfare organization. Its central purpose must be social welfare, civic improvement or a related exempt activity. It may lobby extensively, and the IRS states that lobbying may be its primary activity without jeopardizing exemption. Political campaign intervention is different: the IRS says promotion of social welfare does not include direct or indirect participation or intervention in a political campaign for or against a candidate, so campaign intervention cannot become the organization’s primary activity.

Issue advocacy and lobbying
A 501(c)(4) can educate the public, advocate for legislation, organize members and communicate with lawmakers. Lobbying can be the organization’s main activity. Communications that discuss issues, voting records or public policy must still be evaluated under the applicable tax and election rules, particularly when they identify candidates near an election and contain election-related advocacy.
Political campaign activity
Some campaign activity can occur without automatically destroying 501(c)(4) status, but the organization must keep social-welfare work primary. The IRS evaluates the organization’s activities under the tax rules; FEC rules may also apply when spending qualifies as a federal independent expenditure or when the organization otherwise meets political-committee tests. Tax status does not shield an organization from election-law reporting or disclaimer requirements.
Tax treatment of donations
Contributions to civic leagues and other 501(c)(4) organizations generally are not deductible as charitable contributions for federal income-tax purposes. A donor should not treat a payment as a deductible charitable gift simply because the recipient has an IRS exemption letter. The organization should provide its own tax disclosures and donors should obtain professional advice for unusual transactions.

Can a 501(c)(4) donate to a Super PAC?
Generally, a 501(c)(4) can make a contribution to a Super PAC from funds it may lawfully use, but the payment is a political expenditure that must be evaluated under both regimes. The Super PAC must report the receipt under FEC rules and verify that the source is not prohibited. The 501(c)(4) must ensure that campaign intervention does not become its primary activity and must account for the expenditure in its IRS records and any required disclosures.

A 501(c)(4) may have a separate affiliated PAC, but each entity needs clear accounting, governance and compliance procedures. Shared staff, vendors or messaging can create coordination or private-benefit concerns if the arrangement is not structured and documented carefully.
Can a Super PAC give money directly to a candidate?
No. A Super PAC cannot make direct, in-kind or coordinated contributions to a federal candidate or federal committee. It can spend unlimited amounts on independent communications supporting or opposing a candidate, provided the spending is genuinely independent. A traditional PAC, by contrast, can contribute directly within the applicable statutory limit.
Do Super PACs have to disclose donors?
Super PACs file FEC reports that identify receipts and disbursements under federal reporting rules. In practical terms, donor information is generally reported, although the timing and presentation depend on the filing and the transaction. A donor’s money can also pass through an organization, creating additional questions about source reporting and applicable disclosure rules. Review the committee’s FEC filings and the relevant state law rather than assuming that every political payment appears in the same way or on the same schedule.
501(c)(4) disclosure is different. IRS tax filings, state charity or corporate filings and FEC reports may each reveal different information. Whether a 501(c)(4)’s donors are disclosed can depend on the organization’s filings, the type of expenditure and the governing federal or state law. “501(c)(4)” is not a guarantee of donor anonymity.

How the entities differ on coordination
| Situation | Traditional PAC | Super PAC | 501(c)(4) |
|---|---|---|---|
| Direct check to a federal candidate | Permitted within contribution limits | Prohibited | Must be analyzed under tax and election rules; the organization is not automatically a PAC |
| Independent advertisement | Permitted if reported and not coordinated | Core permitted activity | May be permitted, but campaign activity cannot be primary for the organization |
| Campaign supplies or services | Can be an in-kind contribution subject to limits | Cannot provide them in a coordinated transaction | Must be analyzed for political-activity, private-benefit and election-law consequences |
| Use of campaign strategy or nonpublic data | Can create a contribution or coordination issue | Threatens independent status | Can create both tax and election-law risk |
Federal, state and local jurisdiction
FEC rules apply to federal PACs and Super PACs. A state or local committee may face a different regulator, different contribution limits, different registration deadlines and different disclaimer language. Some states regulate 501(c)(4) political spending more aggressively than federal law, while municipal rules can add another layer for local races.
Before raising or spending money, identify the election, jurisdiction, recipient and communication type. A committee that is compliant for a federal Senate race may still need a separate state registration for a gubernatorial race. The organization’s IRS status does not determine whether it must register with an election authority.

Use a traditional PAC when direct candidate support is essential
A traditional PAC fits an organization that wants to contribute directly to candidates or party committees, accepts the applicable fundraising limits and can manage source screening and regular FEC reporting.
Use a Super PAC when unlimited independent spending is the goal
A Super PAC is designed for large-scale independent expenditures. It is appropriate only when the organization can maintain operational separation from campaigns and accept donor disclosure and FEC reporting obligations.
Use a 501(c)(4) when ongoing civic work and lobbying are central
A 501(c)(4) is designed for social-welfare and civic advocacy, including substantial lobbying. It may engage in some campaign activity, but an organization whose main purpose is electing or defeating candidates risks losing the fit between its activities and its tax status.

Compliance checklist before accepting or spending money
- Define the activity: Classify it as lobbying, issue advocacy, a direct contribution, an independent expenditure or another activity before money moves.
- Identify the regulator: Determine whether FEC, IRS, state or local rules apply, and assume more than one regime may govern the same transaction.
- Check the source: Screen for prohibited foreign-national and federal-contractor money in federal political activity, and apply any additional state restrictions.
- Test coordination: Review contacts, personnel, vendors, data and materials for campaign involvement or use of nonpublic information.
- Track thresholds and deadlines: For a federal Super PAC, monitor the $1,000 calendar-year threshold and file within 10 days after crossing it.
- Separate accounts and records: Keep political receipts, expenditures, lobbying costs and social-welfare activities identifiable in the accounting system.
- Prepare disclosures: Use the required FEC reports, disclaimers, IRS filings and state reports for the specific activity and jurisdiction.
- Document governance: Record approvals, purpose, source checks and independence controls so the organization can explain why the transaction was lawful.
Common mistakes and how to correct them
Calling every advocacy group a PAC
Advocacy, lobbying and voter education do not automatically create a PAC. Correct the label by identifying the organization’s legal status, activities and election-law thresholds.
Assuming a Super PAC can coordinate because it cannot donate
The prohibition covers coordinated and in-kind contributions as well as direct checks. Establish written firewall and vendor procedures before producing election communications.
Treating a 501(c)(4) as a tax-deductible charity
Most contributions to a 501(c)(4) are not deductible as charitable contributions. Give donors accurate receipts and tax information.
Assuming IRS exemption answers FEC questions
IRS recognition does not decide whether an organization is a federal political committee or must report an independent expenditure. Run both analyses.
Using federal rules for a state election
Check the state or local authority for separate registration, contribution, disclaimer and disclosure requirements before spending.
