Abdulrahman Alfozan, a 35-year-old Saudi national who worked as an OpenAI engineer, was arrested on October 9, 2026, after prosecutors alleged that he concealed an encrypted recording device in toilet paper inside an executive conference room. The federal charge concerns using or attempting to use a device to intercept oral communications. The public record describes allegations in a criminal complaint, not a conviction.

What happened

The U.S. Department of Justice says OpenAI determined that a recorder had been installed in an executive conference room in its San Francisco office on or about September 28, 2026. Investigators allege that the device was wrapped in toilet paper and plugged into a USB port on the back of a television. Its contents were encrypted.

OpenAI personnel discovered the device on September 30. The room was used for meetings involving confidential technical, commercial and strategic information, according to the DOJ. The department said those discussions could include proprietary research, product plans, business-development opportunities, nonpublic technical progress, strategic decisions, government engagements and commercial relationships.

Timeline of the case

Date What authorities and reports say
September 28, 2026 OpenAI determined the recorder was installed on or about this date, according to the Northern District of California.
September 30, 2026 OpenAI personnel found the concealed device in the San Francisco executive conference room.
October 9, 2026 The DOJ announced the arrest and charge of Abdulrahman Alfozan, 35.
October 13, 2026 Alfozan made his initial appearance in federal court, according to the DOJ. The Associated Press reported that he was due back in court on October 19.

Who was arrested?

The defendant is Abdulrahman Alfozan, a Saudi national and OpenAI employee who was identified in the DOJ announcement as an engineer. The department charged him with using or endeavoring to use a device to intercept oral communications. That charge addresses the alleged use or attempted use of the equipment; it does not by itself establish that anyone successfully accessed, copied or disclosed confidential information.

How prosecutors say the device was linked to Alfozan

The complaint, as described by the Associated Press, alleges that security-camera footage showed Alfozan near the executive conference room on nearly a dozen occasions even though he was not authorized to access it. After OpenAI installed an additional camera, footage allegedly showed him checking behind the television.

Investigators also found a second similar recorder in an unattended bag that contained Alfozan’s wallet and identification, according to the AP’s account of the complaint. These access patterns, the surveillance footage and the second device are presented by prosecutors as evidence connecting him to the placement. They remain allegations that must be tested in court.

What device was found?

The DOJ releases describe the item generically as an encrypted recording device. The San Francisco Standard, citing court documents, identified it as a Seeed XIAO ESP32-S3 Sense development board with a detachable camera sensor, digital microphone and microSD storage.

That identification describes the board’s reported hardware capabilities; it does not establish what it recorded, whether recording was successful, or whether anyone retrieved usable files. The complaint says the contents were encrypted.

Why the conference room mattered

Prosecutors say the room was regularly used for meetings where highly sensitive company information was discussed. The categories listed by the DOJ include proprietary research, product and technical plans, business-development opportunities, strategic decisions, government engagements and commercial relationships.

FBI Director Kash Patel framed the allegation this way: “According to the complaint unsealed today, Abdulrahman Alfozan allegedly concealed a covert recording device inside his employer’s executive conference room to secretly capture sensitive communications about the company’s super intelligence technology.” The quotation reflects the government’s description of the complaint, not a judicial finding.

What the charge means

The announced federal count alleges that Alfozan used or endeavored to use a device to intercept oral communications. “Endeavoring” covers an alleged attempt, so prosecutors do not need the public announcement to establish that confidential conversations were successfully captured in order to pursue the charge. The eventual case will turn on the evidence, the applicable statute and court proceedings.

What is established and what is not

The public materials establish that the DOJ announced an arrest and charge, that a recorder was found in the conference room, and that the complaint attributes surveillance, access and a second device to Alfozan. They do not establish guilt.

  • No conviction had been reported in the materials available for this article.
  • The public record does not establish that the recorder successfully captured intelligible conversations.
  • It does not establish that trade secrets or other sensitive information were obtained, disclosed or transmitted.
  • It does not establish that a foreign government directed or sponsored the alleged conduct.

Those distinctions are important because an arrest is the beginning of a criminal case, not proof that every allegation is true.

Why the allegations matter to technology companies

The alleged method combines physical access, a small off-the-shelf development board and a room where sensitive discussions occurred. For companies handling valuable research or commercial plans, the episode illustrates why insider-risk programs cannot rely only on network security. Controls may also need to address who can enter executive rooms, whether unused television USB ports are accessible, how cameras cover sensitive spaces, and how unattended bags or personal devices are handled.

Those are general security lessons, not findings that OpenAI’s controls failed in any particular way. In this case, prosecutors point to camera footage, access authorization and the alleged second recorder as the physical evidence supporting their theory.

What happens next

Alfozan made his initial appearance on October 13, 2026, and the AP reported a further court date of October 19. The proceedings will determine whether the charge advances and how the allegations are resolved. Until a verdict or other final disposition, descriptions of the installation, intended recording and any connection to stolen information should be treated as allegations from the complaint.
