There is no universal winner. Commercial AI is generally the quickest, lowest-operations path for low-risk, standardized services. Open-source or open-weight AI is better when a city needs data sovereignty, offline operation, deep customization, or independence from a supplier and can fund engineering and lifecycle operations. Most cities should plan a governed hybrid portfolio rather than force every service onto one model or vendor.

Why this decision matters now

Artificial intelligence has moved from experimental projects into routine government work, but public-sector governance and procurement capacity have not kept pace. The OECD’s Digital Government Outlook 2026 reports that AI is used in at least one government area in 35 of 36 OECD countries, or 97%. Yet only 21 of those 36 countries, 58%, provide central support for procuring AI goods and services.

Oversight is uneven as well. Fourteen of 36 OECD countries, 39%, require pre-deployment risk assessments. Eleven, 31%, conduct post-deployment audits, and only six, 17%, maintain an open algorithm register. Just 10 countries, 28%, report any financial or non-financial impact measurement for government AI use cases. Those figures do not show that AI is inherently unsafe; they show why a city needs a decision and governance method before selecting a model.

The choice affects more than model quality. It determines where resident data is processed, who can change the system, how quickly a service can be launched, what happens when an incident occurs, and whether the city can leave the arrangement without losing its records or workflow.

What “commercial” and “open” mean in practice

Commercial AI

Commercial AI usually means a hosted application programming interface, a managed cloud model, or a software platform sold under a contract. The supplier operates the model-serving layer and commonly handles GPU capacity, scaling, patching, uptime engineering, and some monitoring. A city sends prompts, documents, or structured data to the service under agreed terms and receives generated text, classifications, summaries, or other outputs.

This arrangement is not automatically a black box or automatically unsafe. A contract can impose restrictions on training use, retention, location, subcontracting, audit access, incident notification, and deletion. Those controls must be negotiated and verified rather than assumed from a product label.

Open-source and open-weight AI

“Open” covers several different arrangements. An open-source model may publish code and license it for modification; an open-weight model may publish the trained parameters while keeping some training data or development components closed. A city can run either category itself, through a cloud account or on premises, if the license and technical requirements permit it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Self-hosting gives the city or its integrator responsibility for hardware or cloud capacity, model serving, dependency updates, vulnerability response, evaluation, logging, abuse controls, backups, monitoring, and staff continuity. Open availability does not guarantee transparent training data, safe behavior, support, or zero cost. The license, weights, dependencies, and maintenance obligations must be checked for each candidate.

Commercial and open deployment compared

Decision axis Commercial AI Open-source or open-weight deployment
Time to pilot Usually faster because the supplier provides hosted infrastructure and model operations. Usually slower while the city or integrator selects hardware, installs serving software, and establishes evaluation and monitoring.
Infrastructure burden Lower internal burden for GPUs, scaling, patching, and availability engineering. Higher internal or integrator burden for capacity planning, serving, patching, backups, and observability.
Data sovereignty Depends on contract, processing locations, subcontractors, retention settings, and the supplier’s technical controls. Can keep processing in a city-controlled cloud or facility, subject to the deployment environment and its operators.
Customization Configuration, retrieval, fine-tuning, and workflow options depend on the supplier’s product and terms. More control over model, prompts, retrieval, fine-tuning, guardrails, and surrounding software.
Vendor dependence Higher risk if APIs, data formats, model behavior, or pricing are difficult to replace. Potentially lower dependence on one supplier, but the city may become dependent on an integrator, hardware stack, or scarce specialists.
Security updates The supplier generally maintains the hosted service; the contract should define notice, evidence, and incident duties. The city or integrator must track vulnerabilities and apply model, operating-system, library, and serving updates.
Performance on local needs Large managed models may perform well on general tasks, but local languages, names, forms, and policy terminology require testing. Allows targeted adaptation and local retrieval, but quality depends on the selected model, data, tuning, and evaluation capability.
Portability Export rights and usable formats must be written into the contract; an API alone may not make migration easy. Weights and software may be portable under the license, although hardware, integrations, and operational know-how still have to move.
Reliability Can offer mature availability engineering and service-level commitments; outages and model changes remain supplier risks. Can support always-on or disconnected operation, but the city must engineer redundancy, capacity, and recovery.
Municipal skills required Product integration, data governance, security review, testing, and contract oversight remain necessary. All of those skills plus model serving, infrastructure, release management, evaluation, and incident response.
Cost pattern Often lower initial investment and usage-based or subscription spending; long-term costs depend on volume and contract terms. Higher initial investment is common, with ongoing infrastructure, staffing, energy, support, and upgrade costs.

No cell in this table establishes a universal price or accuracy advantage. The OECD evidence does not identify a break-even threshold at which one approach always becomes cheaper. A city must calculate its own total cost and test its own languages, service data, and resident needs.

When commercial AI is the better starting point

Low-risk, standardized services

A hosted model is a sensible first option for work such as drafting internal summaries, classifying routine requests, searching a published knowledge base, or helping staff find information when an error does not directly determine a resident’s eligibility, legal status, benefits, safety, or enforcement outcome. These tasks can be bounded with approved content, confidence thresholds, and human review.

Time-sensitive pilots

Commercial services can shorten the path from an approved experiment to a working pilot because the city does not first need to purchase or configure GPU capacity and a full model-operations stack. This is valuable when a department has a narrow service problem, limited engineering capacity, and a defined evaluation window.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Limited internal operations capacity

The U.S. Government Accountability Office has reported that agencies often acquire AI as a service rather than as a product and have difficulty accessing technical experts and understanding AI-related costs. A managed service can reduce the number of specialized roles required to begin, although it does not eliminate the need for procurement, privacy, security, accessibility, testing, and contract-management expertise.

Conditions that must be negotiated

“Hosted” should never be treated as a complete privacy or procurement decision. The solicitation and contract should specify:

  • Whether prompts, uploaded files, outputs, logs, or telemetry may be used to train or improve a supplier’s models.
  • Retention periods, deletion methods, backup deletion, and the city’s ability to verify deletion.
  • Processing and storage locations, including the jurisdictions in which subcontractors may operate.
  • Named subprocessors and advance notice of changes to them.
  • Security controls, vulnerability handling, breach notification deadlines, and cooperation with investigations.
  • Audit rights, relevant assurance reports, testing access, and evidence of compliance.
  • Service levels, support response, maintenance windows, rate limits, and continuity arrangements.
  • Notice before a material model, safety-filter, embedding, or API behavior change.
  • Export formats for prompts, source documents, feedback, configurations, audit logs, and generated records.
  • Accessibility requirements for the interface and generated content, plus a human escalation path.
  • Termination assistance, transition support, data return, deletion certification, and a usable replacement plan.

OECD guidance places safeguards across the full lifecycle, from pre-market screening through contract management. A contract that covers only uptime and price leaves the city exposed to the most consequential changes.

When open or self-hosted AI is worth the investment

Sensitive or restricted resident data

Self-hosting can keep prompts, documents, and outputs inside a city-controlled cloud or facility. That can simplify sovereignty requirements and reduce exposure to external processing, but it does not make the environment secure by itself. Identity management, encryption, segmentation, privileged-access controls, logging, backups, and incident response still have to be designed and operated.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Offline and critical-infrastructure operation

An open deployment can continue operating when an external connection is unavailable or when policy prohibits sending data outside a protected network. This is relevant to emergency, field, transportation, utility, or other always-on workloads. The city must provide local capacity, spare capacity, tested recovery procedures, and a safe degraded mode for periods when the model or hardware is unavailable.

Deep local customization

Open weights and surrounding software can permit adaptation to local languages, spelling, place names, forms, ordinances, and service taxonomies that a general hosted model may not handle reliably. Customization can mean retrieval from authoritative city documents rather than changing model weights; in other cases it may involve tuning. Each approach needs representative testing and a rollback path.

Long-term independence

Open deployment can reduce dependence on a single model supplier and give the city more control over upgrade timing, interfaces, and cost drivers. That advantage is real only if the city preserves the skills, documentation, source code, model artifacts, and operational procedures needed to maintain the system. A city that cannot staff those functions may simply replace vendor lock-in with integrator lock-in.

The obligations that move in-house

  • Provisioning and capacity planning for processors, storage, networking, and failover.
  • Secure model-serving software, operating-system and library patching, and dependency inventories.
  • License review for model weights, code, datasets, and redistribution or commercial-use restrictions.
  • Evaluation for accuracy, harmful outputs, bias, privacy leakage, accessibility, and local-language performance.
  • Abuse prevention, authentication, rate limiting, content controls, and separation of administrative duties.
  • Centralized logs, monitoring, alerting, backup, disaster recovery, and evidence retention.
  • Release management for new model versions, prompts, retrieval indexes, filters, and integrations.
  • Continuity plans for staff turnover, contractors, hardware failure, and unsupported dependencies.

The OECD notes that pre-trained open-source models can reduce costs, support self-hosting in cloud or on premises, and improve control over data and long-term costs. It also cautions that self-hosting may require a higher initial investment than license or volume pricing. Both statements can be true for the same city at different stages of a program.

Choose by use case and risk tier, not by ideology

A city should make a separate decision for each service. “AI for the city” is not one workload: a public website assistant, a call-center summarizer, a permit-review aid, a benefits screener, and a traffic-control component have different consequences and controls.

Tier 1: assistive, low-impact work

Examples include drafting, translation suggestions, internal search, meeting summarization, and classification that a trained employee checks before action. Commercial AI often fits when data can be minimized or de-identified and the city has strong contract controls. Open deployment may still be justified for sensitive documents, high volume, or a requirement to run inside a protected network.

Tier 2: resident-facing information

A chatbot that explains published services can use either approach, but it should retrieve from approved sources, show when information was last updated, identify itself as automated, and provide an accessible human route. The city should test languages, disability access, ambiguous questions, escalation behavior, and hallucinated instructions before launch.

Tier 3: high-impact recommendations

Systems that influence benefits, housing, immigration, employment, education, licensing, inspections, policing, fines, health, or other material opportunities require heightened scrutiny. A model should not silently make the final decision. The city needs documented human authority, reasons that can be explained, an appeal process, records of the inputs and outputs used, and independent review appropriate to the service.

Tier 4: safety-critical or operational control

Where an error could threaten physical safety, essential infrastructure, or emergency response, reliability, deterministic fallbacks, offline capability, cybersecurity, and tested recovery matter more than conversational fluency. The model should be constrained to a clearly defined role, with manual override and a non-AI operating mode.

A governance gate before production

OECD describes strong governance as the cornerstone of successful AI adoption in government. Apply one gate to commercial and open systems so a cheaper or more controllable deployment cannot bypass scrutiny.

  1. Define the service and affected residents. State the user problem, the decision or assistance the model provides, the people who may be excluded, and the accountable department.
  2. List prohibited and high-impact uses. Decide whether the system may recommend, rank, deny, enforce, or trigger an action. Prohibit uses that the city cannot explain, review, or lawfully operate.
  3. Classify the data. Identify personal, confidential, legally protected, operational, and public information. Minimize inputs and specify retention, deletion, access, and location requirements.
  4. Assess privacy and security. Threat-model prompt injection, data exfiltration, insecure integrations, account compromise, model theft, supply-chain vulnerabilities, and misuse by authorized users.
  5. Test representative performance. Use real service scenarios and the languages, names, dialects, documents, and accessibility needs encountered locally. Measure errors by group and task, not only an overall average.
  6. Document human review and appeal. Name the person or team with authority to override an output, define when review is mandatory, and provide residents a usable correction or appeal route.
  7. Publish an understandable notice. Explain that AI is used, its purpose, the data involved, limitations, human contact, and how to challenge an error.
  8. Monitor after launch. Track incidents, complaints, accuracy, drift, latency, availability, accessibility failures, security events, and changes in the underlying model or knowledge base.
  9. Schedule independent review. Set a date for audit or reassessment before launch and after material changes. Keep records sufficient to reconstruct important outputs.

How to calculate total cost of ownership

Price per request is only one line in a municipal AI budget. Compare both options over the period in which the service is expected to operate, using the same workload and service-level assumptions.

Cost category Commercial questions Open/self-hosted questions
Initial implementation Integration, configuration, identity, testing, migration, and training fees. Architecture, hardware or cloud setup, serving stack, integration, testing, and staff training.
Recurring operation Subscription, token or request charges, storage, support tiers, and minimum commitments. Compute, storage, networking, energy, support contracts, licenses, and on-call coverage.
People Procurement, privacy, security, accessibility, evaluation, and supplier-management time. All commercial roles plus model operations, infrastructure, release engineering, and vulnerability response.
Change and growth Price changes, rate limits, model upgrades, new features, and export or migration work. Hardware refresh, capacity expansion, model upgrades, re-tuning, and dependency replacement.
Failure and exit Outage workarounds, incident response, data recovery, termination assistance, and replacement integration. Recovery capacity, spare components, staff continuity, unsupported software, and migration to another model.

Include the cost of delayed delivery and failed pilots, but do not assign a made-up monetary value to quality or sovereignty. Use a pilot to measure the city’s actual request volume, review time, error rate, latency, support load, and infrastructure utilization, then update the forecast.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Quality, language, accessibility, and reliability checks

Local language and task performance

A model that is impressive in a general benchmark may misunderstand local place names, minority languages, legal terms, abbreviations, or the structure of a city form. Build a test set from approved, representative cases. Compare not only answer correctness but also refusal behavior, citation or source grounding, consistency, and the severity of an error.

Accessibility

Accessibility includes the resident interface, authentication flow, response format, reading level, language support, keyboard and screen-reader behavior, and the ability to reach a person without using the AI. Generated content should be checked for inaccessible formatting, unexplained jargon, and instructions that conflict with the city’s accessible alternatives.

Reliability and continuity

Ask what happens during a supplier outage, a local network failure, a model update, a corrupted retrieval index, or a sudden demand spike. Commercial services need tested fallback channels and clear status communication. Self-hosted systems need redundant capacity, patch windows, backup restoration tests, and a manual process when the model is offline.

Build or buy a city chatbot: a practical sequence

  1. Start with the service outcome. Specify which questions the assistant may answer and which must be transferred to staff. Do not begin with a model brand or a generic “ask anything” interface.
  2. Assemble authoritative content. Identify the ordinances, service pages, forms, contact details, and operating hours that are allowed sources. Assign owners and review dates to each source.
  3. Set the risk boundary. Keep eligibility decisions, enforcement, emergency instructions, and other high-impact actions outside autonomous generation unless a separate approval process permits them.
  4. Run a controlled evaluation. Test normal, ambiguous, adversarial, multilingual, accessibility, and out-of-scope questions. Have subject-matter staff score answers and record harmful failure modes.
  5. Choose the deployment route. Select commercial hosting when speed and managed operations outweigh sovereignty concerns; select self-hosting when data, offline, customization, or independence requirements justify the operating burden.
  6. Design escalation and records. Give residents a human contact, preserve the information needed to investigate a complaint, and avoid retaining unnecessary personal conversations.
  7. Pilot with a limited audience. Use a defined time period, narrow content scope, incident owner, rollback switch, and success measures agreed before launch.
  8. Review evidence before expansion. Expand only if accuracy, accessibility, privacy, security, response time, support load, and resident outcomes meet the service’s thresholds.

Why a hybrid portfolio is often the practical answer

Different workloads have different constraints. A city might use a managed service for an internal drafting assistant, a self-hosted model for confidential case documents, and a conventional rules-based workflow for a benefits decision. The point of a hybrid strategy is not to use two technologies everywhere; it is to assign each workload to the architecture that fits its risk and operating reality.

Hybrid programs need common controls. Use one inventory of AI systems, one risk taxonomy, shared evaluation and accessibility requirements, consistent incident reporting, standard logging fields, and a portfolio-level register of owners, data categories, model versions, suppliers, and exit plans. Otherwise, a city can create a patchwork in which every department interprets privacy, testing, and human review differently.

Common failure modes and fixes

Choosing on headline accuracy

Failure: selecting the model with the strongest general benchmark or most fluent demonstration.

Fix: test the exact local languages, documents, workflows, and error consequences with representative cases and subject-matter reviewers.

Assuming open means free and transparent

Failure: budgeting only for a model download while ignoring hardware, people, patching, monitoring, licenses, and support.

Fix: inspect the license and dependencies and include the complete operating lifecycle in the total-cost calculation.

Assuming a contract solves governance

Failure: buying a hosted API with a privacy clause but no deletion verification, model-change notice, export format, audit right, or termination support.

Fix: make data rights, technical controls, service levels, change management, and exit assistance measurable contract obligations.

Launching without a human route

Failure: directing residents to a chatbot that cannot explain an answer, correct an error, or transfer a case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: publish a staffed escalation path, define mandatory review points, and give residents a way to challenge material outcomes.

Ignoring drift and updates

Failure: treating approval as permanent even though a supplier changes a model or a city changes its policies and source documents.

Fix: monitor performance and content freshness, require change notification where possible, and re-test after material updates.

Measuring activity instead of impact

Failure: reporting the number of conversations or generated documents as proof of success.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: measure service outcomes such as resolution time, accuracy, accessibility, staff workload, complaints, appeals, and equity impacts. OECD reports that only 10 of 36 OECD countries, 28%, measure any financial or non-financial impact of government AI use cases, so impact measurement is an area where cities can distinguish a mature program.

A decision rule for city leaders

  • Choose commercial first for low-risk, standardized, time-sensitive services when internal AI operations capacity is limited and a contract can meet data, audit, accessibility, portability, and human-oversight requirements.
  • Choose open or self-hosted for sensitive resident data, offline or critical-infrastructure operation, strong sovereignty requirements, deep local customization, or unacceptable vendor dependence—only when the city can fund and staff secure operations.
  • Choose hybrid when workloads differ, and apply one governance, evaluation, procurement, monitoring, and exit framework across the portfolio.

Practical verdict

Commercial AI is usually the better way to learn quickly and deliver bounded, low-risk assistance without building a model-operations organization. Open or self-hosted AI is the stronger fit when control over data, connectivity, customization, or long-term independence is worth the engineering and lifecycle burden. The safest and most economical answer for a city is determined service by service: classify the risk, test performance on local needs, price the complete lifecycle, contract for control and exit, and keep accountable people in charge of consequential decisions.
