Open models are usually easier to audit, but they are not automatically more trustworthy. When a release includes weights, architecture, code, documentation, evaluation results, and enough information to reproduce tests, an independent auditor can inspect substantially more than an API user can. A closed model can still be the better choice for a particular deployment if its provider supplies strong evidence, monitoring, security controls, incident reporting, and a credible route for accountability.
The practical answer is therefore two-part: openness improves inspectability; trust depends on the quality of evidence and controls around the entire system. The Organisation for Economic Co-operation and Development (OECD) describes AI openness as a spectrum, not a binary label, while the National Institute of Standards and Technology (NIST) treats trustworthiness as a combination of reliability, safety, security, accountability, transparency, explainability, privacy, and fairness.
What “open” and “closed” mean for an AI model
In software, “open source” usually refers to code released under a license that permits inspection, modification, and redistribution. AI systems do not fit that definition neatly because a model is only one part of a larger stack. The trained weights, architecture, training code, data, post-training process, evaluation suite, serving infrastructure, safety filters, and operating policies may all have different access terms.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteThe OECD’s 2025 AI openness: A primer for policymakers therefore presents openness as a spectrum. A hosted model that accepts prompts through an API is near the closed end. A downloadable model with published weights offers more access, but may still hide the training data, data-cleaning process, source code, evaluation harness, or deployment controls. A genuinely open release provides several of those components under usable licenses and documents how they fit together.

| Release pattern | What an auditor can normally access | What may remain hidden |
|---|---|---|
| Hosted black box | Prompt-and-response behavior, published documentation, and any tests the provider chooses to expose | Weights, activations, gradients, training data, internal safety layers, infrastructure logs, and often detailed version history |
| Weights available | Weights can be downloaded and run; researchers can probe behavior, inspect some architecture details, and perform local tests | Training data and provenance, original training code, post-training decisions, hidden filters, telemetry, and provider-side changes |
| Partly open system | Several of the weights, code, cards, evaluations, or deployment components | Any component not released or not documented well enough to reproduce results |
| Broadly open release | Weights, architecture, relevant code, documentation, evaluation methods, version identifiers, and sometimes data or data summaries | Information excluded for privacy, security, contractual, or legal reasons; operational behavior can still change after release |
“Open source” is therefore not a guarantee that every part of an AI system is inspectable. Ask exactly which artifacts are available, under what license, for which version, and whether an independent party can run them without the provider’s infrastructure.
Auditability and trustworthiness are different questions
Auditability asks how deeply an independent reviewer can examine a system and test claims about it. Trustworthiness asks whether the system is reliable, safe, secure, accountable, transparent, interpretable, privacy-preserving, and fair in the intended use. NIST’s AI Risk Management Framework 1.0 (2023) lists those characteristics explicitly. NIST also defines transparency as the extent to which information about an AI system and its outputs is available to people interacting with it, while warning that transparency alone does not make a system accurate, private, secure, or fair.
An open model can be highly inspectable yet poorly documented, vulnerable to misuse, trained on unclear data, or abandoned by its maintainers. A closed model can be difficult to inspect internally yet backed by disciplined evaluations, access controls, incident response, and version governance. The right comparison is not “open equals safe” versus “closed equals unsafe”; it is the strength of the evidence available for the risks in your deployment.

Black-box access
With black-box access, an auditor submits prompts or other inputs and observes outputs, latency, errors, refusals, and rate limits. This supports behavioral testing: factuality checks, bias probes, jailbreak attempts, robustness tests, and measurement of task performance. Repeated tests can reveal regressions between versions if the evaluator can identify and pin each version.

Black-box testing cannot directly reveal why a failure occurred. An auditor cannot inspect a hidden representation, determine whether a safeguard is a model behavior or an external filter, verify that the tested endpoint uses the documented model, or examine training examples that may have introduced a capability or bias. A provider can improve the visible behavior on a test set without addressing an internal failure mode.
White-box access
White-box access exposes internal artifacts such as weights, activations, gradients, architecture, or training code. Researchers can run models locally, study internal representations, trace some causal pathways, test adversarial changes, and fine-tune controlled variants. They can also check whether a published model corresponds to the artifact actually used in an evaluation.
Weights alone do not prove transparency. Without a reliable version identifier, architecture description, tokenizer details, evaluation code, and documentation of post-training changes, an auditor may still be unable to reproduce the provider’s claims. Local access also does not reveal what data was used unless provenance is documented separately.

Some of the most important audit evidence sits outside the model: training and data-governance records, human-feedback procedures, safety policies, deployment architecture, monitoring, incident logs, red-team reports, change management, and access-control settings. A closed provider can offer substantial outside-the-box evidence through system cards, model cards, evaluation protocols, audit logs, and independent assessments. An open release may provide little of this operational context.

The 2024 FAccT paper Black-Box Access is Insufficient for Rigorous AI Audits, by Stephen Casper and coauthors (version 3 revised 29 May 2024), concludes that white-box and outside-the-box access allow substantially more scrutiny than black-box access alone. Its practical lesson is to seek both internal access and development-and-deployment evidence whenever the risk warrants it.
Open versus closed models across the decisions that matter
| Audit or trust question | Open release advantage | Closed-service advantage or limitation | Evidence to request |
|---|---|---|---|
| Internal inspection | Weights, architecture, activations, and gradients may be available for direct analysis | Provider may expose only outputs; internal failure modes remain harder to examine | Artifact hashes, architecture details, access to weights or a technical explanation of why they cannot be shared |
| Reproducibility | Independent parties can run a pinned artifact and compare results across versions | Hosted behavior can change without local reproducibility unless versions and snapshots are retained | Version policy, release notes, evaluation code, test data, and retention of historical endpoints or containers |
| Accountability | Community scrutiny can identify defects, but responsibility may be dispersed | A named provider may offer contracts, support, incident response, and a route for redress | Legal entity, escalation contacts, service commitments, incident process, and change-approval records |
| Security and misuse | Local deployment reduces dependence on a provider and permits custom controls | Centralized monitoring, rate limits, abuse detection, and rapid rollback may be easier to operate | Threat model, access controls, abuse monitoring, patch process, and evidence that safeguards are tested |
| Privacy | Self-hosting can keep prompts and outputs inside an organization | Provider may have mature isolation, retention controls, and compliance documentation; sending data to a hosted service creates exposure | Retention period, training-on-inputs policy, encryption, subprocessors, deletion process, and data-flow diagram |
| Data provenance | Community can inspect documentation and challenge omissions, but training data may still be undisclosed | Provider may publish a data summary and copyright policy without releasing the corpus | Training-data summary, filtering methods, licensing approach, copyright policy, and records of known restrictions |
| Context-specific performance | Local evaluation and fine-tuning can target the exact workflow | Provider may supply broad benchmark and safety results, but they may not represent your users or language | Evaluation methodology, subgroup results, uncertainty ranges, failure cases, and tests on your own representative data |
| Maintenance | Forks and community fixes can continue after the original maintainer stops | Provider may deliver coordinated updates and support, but you depend on its roadmap and availability | Security-update history, deprecation policy, maintainer commitments, and rollback procedure |
No authoritative source identified a directly comparable statistic proving that open or closed models are more trusted overall. Trust is use-case-specific, and the quality of the evidence matters more than the label.
Are open models automatically safer?
No. Releasing weights can improve scrutiny and allow defenders to run a model without sending sensitive prompts to a third party, but unrestricted weights can also be copied, modified, fine-tuned for harmful purposes, or embedded in services that provide no monitoring. A local deployment transfers responsibility for authentication, patching, abuse detection, logging, and incident response to the deployer.

Documentation quality is another safety variable. A model card that identifies intended uses, known limitations, evaluation conditions, and prohibited uses is more useful than a download link with no provenance. Weak or stale documentation can cause an organization to overestimate safety even when source code and weights are available.

Open artifacts can also be difficult to secure operationally. Teams must verify the file they downloaded, isolate inference services, restrict administrative access, monitor resource consumption, and maintain a rollback path. If a vulnerability is found in a serving library or a model component, a community-maintained project may respond quickly—or not at all. Assess maintenance history rather than assuming that openness guarantees resilience.
Can you trust a closed AI model?
Yes, for some uses, if the provider makes trust claims testable and accepts accountability for failures. A closed model is a defensible choice when the provider supplies a stable model identifier, describes material changes, publishes evaluation methods and limitations, protects customer data, monitors abuse, records incidents, and offers a practical way to investigate and remedy harm.
Closed access becomes a serious concern when the service can change without notice, retains inputs indefinitely, provides only marketing-level benchmark numbers, refuses to describe known failure modes, or offers no incident-reporting channel. A contractual promise cannot substitute for technical evidence, but it can establish responsibilities that a community release may leave unclear.
For high-impact decisions, require evidence tied to the actual deployment rather than relying on general capability scores. A language model that performs well on a public benchmark may still be unreliable for your legal documents, clinical terminology, local dialect, or vulnerable-user population. Ask the provider to test representative inputs and disclose error patterns, not just averages.

What does releasing model weights prove?
Weights prove that a particular numerical artifact can be obtained and, in many cases, executed independently. They enable stronger technical tests than an API alone, including activation analysis, gradient-based investigation, controlled fine-tuning, and reproducibility checks. They do not prove that the artifact was trained as described, that its data was lawfully sourced, that its safeguards remain intact after modification, or that it is the same model used in a hosted product.
To treat weights as meaningful transparency, look for a cryptographic hash or unambiguous version tag, architecture and tokenizer specifications, inference instructions, evaluation scripts, known limitations, and a record of changes. Also ask which components are absent: training data, data-preparation code, reward-model details, safety filters, and deployment telemetry may remain undisclosed.
Regulatory context: what the EU AI Act changes
The European Commission’s AI Act Service Desk explains that qualifying open-source general-purpose AI models may receive limited exemptions when they are released under a free and open-source license and make parameters, weights, architecture, and usage information public. The exemption does not apply to general-purpose models presenting systemic risk.
Open release does not remove every transparency duty. The European Commission guidance says that providers still have obligations such as publishing a summary of training data and a copyright policy where the rules apply. Public weights do not necessarily reveal the training corpus or demonstrate how copyright compliance was handled. Organizations operating in or serving the European Union should assess the model’s legal category, provider role, and risk classification rather than assuming that an “open” label creates a blanket exemption.
A practical audit workflow for either type of model
Use the same risk-based process for an open artifact, a hosted API, or a hybrid system. The difference is how much evidence you can obtain directly and how much you must request from the provider.
- Define the use and harm boundary. Record the users, decisions, data types, languages, required accuracy, unacceptable failure modes, and who could be harmed. Separate low-stakes drafting from automated eligibility, medical, employment, financial, or safety-critical decisions.
- Pin the exact system version. Capture the model name, release date, artifact hash or endpoint version, tokenizer, system prompts, safety settings, retrieval sources, and serving software. For a hosted system, ask how long that version remains available and how changes are announced.
- Map the access level. List which of the weights, architecture, code, training summary, evaluation data, logs, monitoring records, and incident reports you can inspect. Mark every unavailable item; an undocumented component is an audit limitation.
- Review provenance and data handling. Request a training-data summary, filtering and deduplication methods, copyright policy, retention period for user inputs, deletion process, encryption details, and a diagram showing where prompts, outputs, and telemetry travel.
- Reproduce published evaluations. Obtain the test sets, scripts, metrics, sampling method, and hardware or inference settings. Re-run a representative subset with the pinned version. Treat a score as incomplete without its population, uncertainty, and known exclusions.
- Test your own failure modes. Build a held-out set from real, privacy-protected inputs. Include edge cases, ambiguous instructions, adversarial prompts, language and accessibility variants, and attempts to elicit sensitive data. Measure false positives, false negatives, refusal quality, consistency, and recovery after an error.
- Check fairness and robustness. Compare performance across relevant demographic, linguistic, geographic, and accessibility groups. Test distribution shifts, corrupted inputs, long context, missing fields, and dependency outages. Record confidence or abstention behavior where available.
- Inspect security and misuse controls. For local weights, verify sandboxing, authentication, network isolation, model-file integrity, rate limits, and patching. For a hosted service, review abuse monitoring, tenant isolation, key management, logging, and the provider’s process for emergency shutdowns.
- Evaluate operational accountability. Identify the owner of each control, an incident-reporting route, response deadlines, rollback authority, audit-log retention, and a method for users to challenge or correct an output. A technically excellent model without an accountable operator is not a complete system.
- Set acceptance and review rules. Define thresholds for accuracy, subgroup disparity, privacy incidents, unsafe outputs, latency, and availability. Schedule reassessment after model, prompt, data, infrastructure, or policy changes, and preserve evidence from every approved version.
Procurement checklist: evidence to request before deployment
- Model and system cards: intended uses, prohibited uses, architecture, modalities, context limits, known limitations, safety mechanisms, and dependencies.
- Version history: release identifiers, dates, material-change notices, deprecation policy, rollback options, and whether historical behavior can be reproduced.
- Evaluation package: methodology, test populations, metrics, uncertainty, subgroup results, red-team scope, failure examples, and independent audit reports.
- Data-provenance record: training-data summary, collection and filtering process, licensing or copyright policy, synthetic-data disclosures, and known gaps.
- Privacy terms: input retention, whether customer data trains later models, deletion and export procedures, encryption, subprocessors, and data-location commitments.
- Security documentation: threat model, access controls, isolation, vulnerability disclosure, patch timelines, abuse monitoring, and emergency response.
- Accountability materials: legal provider identity, support and escalation contacts, incident records, corrective-action reports, audit-log access, and user redress process.
- Deployment-specific testing: results on your representative data, languages, workflows, and harm scenarios rather than only general benchmarks.
Choosing between open, closed, and hybrid deployment
Choose an open or self-hosted model when
- You need to inspect or modify internals, run reproducible experiments, or retain sensitive prompts inside your environment.
- Your team can operate secure infrastructure, monitor abuse, apply updates, and investigate incidents.
- You can accept responsibility for evaluating a model whose training provenance or maintenance may be incomplete.
- Fine-tuning, local latency, offline operation, or control over version changes is more important than vendor support.
Choose a closed service when
- You need a named provider with contractual accountability, managed updates, centralized abuse controls, and an incident-response team.
- Your organization lacks the capacity to secure and maintain model infrastructure.
- The provider can demonstrate performance, privacy, and safety for your exact use case and offers version pinning or change notice.
- The service’s restrictions reduce misuse risk more effectively than unrestricted local weights would.
Use a hybrid design when
- Sensitive data must remain on premises but some general tasks benefit from a hosted model.
- You want a local model for routine or private work and a controlled external service for difficult cases, with explicit routing rules.
- You need independent local testing while retaining provider-operated monitoring and support for selected functions.
Whichever architecture you select, document why its access level matches the harm profile. An open model is not a substitute for governance, and a closed model is not an excuse to accept unverifiable claims. The strongest position combines the deepest practical access with evidence about development, deployment, monitoring, and accountability.
