GST and TDS are different taxes. GST is the indirect tax on the online-gaming supply, while TDS is income-tax withholding on a player’s net winnings. For online gaming, the GST Council’s clarified rate is 28%, effective from 1 October 2023. TDS under section 194BA is 30% of net winnings, deducted when a withdrawal occurs and again on remaining net winnings at the end of the financial year.
A 30% deduction from a withdrawal therefore does not mean 30% of every deposit or every gross credit was taxed. The relevant base is “net winnings in his user account,” calculated under Rule 133 of the Income-tax Rules.

GST and TDS at a glance
| Question | GST | TDS |
|---|---|---|
| What kind of tax is it? | Indirect tax on the gaming supply | Income-tax withholding on the player’s winnings |
| Who accounts for it? | The gaming supplier collects and accounts for GST | The person responsible for paying the winnings deducts and deposits TDS |
| What is the base? | The taxable online-gaming supply, including actionable claims supplied in online gaming | Net winnings in the player’s user account, calculated under Rule 133 |
| Rate covered by the cited provisions | 28% | 30% under section 194BA |
| When does it arise? | On the gaming supply; the government says the online-gaming change took effect on 1 October 2023 | When a withdrawal occurs during the financial year, and on remaining net winnings at financial year-end |
| What might a player see? | An amount included in an invoice, entry price, or other wallet pricing; presentation varies | A separate TDS deduction in a withdrawal or year-end account statement |
The two taxes can affect the same gaming activity but they answer different questions. GST is charged in connection with the service or supply you use. TDS is withheld from income attributed to you as net winnings.

What GST means for an online-gaming player
The 28% rate and effective date
The GST Council clarified a 28% GST rate for actionable claims supplied in online gaming. A Press Information Bureau release dated 26 March 2025 states that the government introduced 28% GST in online gaming from 1 October 2023. That date is important: transactions governed by the post-change regime should not be confused with older explanations that describe different treatment.

GST is handled by the supplier
GST is an indirect tax. The gaming platform is the supplier responsible for charging, collecting, reporting, and paying it under the GST system. The player does not normally file a separate GST return merely because the player entered an online game.
Why the amount is not always shown as a separate wallet line
The cited government material establishes the rate and effective date, but it does not establish one universal display format that every platform must use in a player wallet. Depending on the platform’s pricing and invoice design, the economic cost may be built into an entry amount, reflected in a tax-inclusive price, or shown separately in an invoice or transaction statement.
When checking a particular transaction, open the platform’s invoice, deposit record, contest or game-entry receipt, and wallet ledger. Look for labels such as GST, tax invoice, tax-inclusive amount, or a breakdown of the amount paid. Do not assume that the absence of a line labelled “GST” proves that no GST was included.
GST is not calculated as 28% of your withdrawal
A withdrawal is a movement of money from your gaming account to your bank or payment account. GST relates to the taxable gaming supply, not to the act of withdrawing winnings. A withdrawal statement can therefore show TDS without showing a new 28% GST charge on the withdrawal itself.
What TDS under section 194BA means
The statutory base is net winnings
Section 194BA applies when a person responsible for paying income from an online game pays a player. The statutory wording requires income-tax deduction on the “net winnings in his user account.” The Income Tax Department’s current TDS-rate table lists the rate for section 194BA as 30%; the provision is effective from 1 April 2023.

This is why TDS should not be described as 30% of every deposit, every winning transaction, or every gross credit. A deposit is money you put into the account, not income from winnings. The relevant calculation is the net-winnings amount determined under the prescribed rules.
Rule 133 determines the net-winnings calculation
The Ministry of Electronics and Information Technology said in a Lok Sabha answer on 2 August 2023 that Rule 133 of the Income-tax Rules, 1962 lays down the formula for calculating “net winnings.” The same answer explains that net winnings are calculated after aggregating winnings, including losses, during the year.
Recommended Free Tools
In practical terms, losses are relevant to the calculation. TDS is not supposed to be applied independently to every winning credit while ignoring losing entries elsewhere in the calculation period. The platform’s statement should show, or allow you to reconcile, the figures used to arrive at net winnings.
Skill and chance do not create different rates in these provisions
The statutory definition used for section 194BA covers an internet-accessible “online game.” The cited provisions do not create separate TDS rates for games described as skill-based and games described as chance-based. The 30% rate under section 194BA therefore should not be presented as changing merely because a platform uses one of those descriptions.
When the 30% TDS is deducted
During the year: when you withdraw
If you withdraw during the financial year, TDS is deducted on the net winnings attributable to that withdrawal under the section 194BA mechanism. The amount you receive can therefore be lower than the amount requested or the amount shown as gross withdrawal proceeds.

Check the withdrawal confirmation and wallet ledger for separate fields such as gross withdrawal, net winnings, TDS, and net amount paid. Labels differ by platform, so compare the numbers rather than relying on the position of a line item.
At the end of the financial year: even without a withdrawal
The deduction is not limited to withdrawals. Section 194BA also requires deduction on remaining net winnings at the end of the financial year. In India, the financial year runs from 1 April through 31 March. A player who leaves winnings in the account and makes no withdrawal can still see a year-end TDS adjustment if net winnings remain.
Why a player may see more than one deduction
A withdrawal during the year and a separate year-end adjustment are different statutory trigger points. The first relates to net winnings connected with the withdrawal; the second relates to net winnings still remaining at year-end. A second deduction is therefore not automatically a duplicate charge. Reconcile both entries with the platform’s annual statement and the figures used in the Rule 133 calculation.
How losses affect TDS
Losses are considered in the prescribed aggregation
The government’s explanation of Rule 133 says that the formula aggregates winnings, including losses, during the year. This answers the common question “Are losses adjusted before TDS?”: losses are part of the net-winnings calculation rather than being ignored in favour of gross winning credits.
That does not mean a player can choose an informal loss figure or subtract unrelated expenses. The platform must apply the statutory formula to the account data, and your records should support the entries included in that calculation.

Do not infer the amount from deposits alone
Deposits establish money moved into the gaming account; they do not by themselves establish taxable net winnings. A statement that lists only deposits and a final withdrawal is not enough to verify TDS. Ask for or download the period’s game, wallet, withdrawal, and tax records so that winning and losing activity can be matched to the net-winnings figure.
Worked examples
Example 1: a withdrawal with a stated net-winnings amount
Illustrative example only; the platform’s Rule 133 calculation controls. Assume a platform’s withdrawal statement identifies ₹10,000 as net winnings in the user account for the relevant withdrawal. At the 30% section 194BA rate, the TDS amount on that identified base would be ₹3,000, leaving ₹7,000 after that withholding line. This example does not mean that ₹3,000 is deducted from a ₹10,000 deposit or from every ₹10,000 credit.
Example 2: no withdrawal before 31 March
Illustrative example only. Assume the account has ₹4,000 of remaining net winnings at the end of the financial year and the player made no withdrawal during that year. If that is the amount determined under Rule 133, the 30% withholding calculation would be ₹1,200 at year-end. The deduction can occur even though no cash was transferred out during the year.
Example 3: wins and losses in the same year
Illustrative example only. Suppose an account has several winning and losing entries. The platform should aggregate the relevant activity under Rule 133, including losses, rather than applying 30% separately to each winning credit. The final TDS base is the resulting net-winnings amount, not a simple total of all gross wins.

TDS versus the final income-tax charge
TDS is a withholding mechanism: money is deducted before or as winnings are paid. Section 115BBJ is the separate provision that sets a 30% special income-tax rate on online-game net winnings for assessment year 2024-25 onward. Section 194BA governs withholding, while section 115BBJ concerns the rate applied to the income when it is assessed.

- Identify the transaction type. Separate deposits, game entries, prizes or winnings, withdrawals, refunds, bonuses, and tax deductions.
- Find the net-winnings field. Look for “net winnings,” “winnings for TDS,” or equivalent wording. If only a gross amount appears, request the calculation or detailed statement.
- Check the TDS line. Confirm that the deduction is labelled as TDS or income-tax withholding and that the rate shown is 30% where section 194BA applies.
- Match the timing. Mark whether the entry was created at a withdrawal or at financial year-end. A year-end entry should not be mistaken for a new withdrawal fee.
- Reconcile losses. Compare the statement’s winning and losing activity with the Rule 133 net-winnings figure for the same calculation period.
- Review GST separately. Check invoices and entry-price details for GST treatment; do not expect GST to appear as a deduction from the withdrawal amount.
- Save the records. Download statements before the platform changes its wallet interface, and retain transaction dates, amounts, and tax references.
Common mistakes and how to correct them
“GST and TDS are the same tax.”
They are not. GST is an indirect tax on the supply; TDS is income-tax withholding on net winnings. Use the invoice or entry-price record for GST and the withdrawal or annual tax statement for TDS.
“The 30% deduction is 30% of my deposit.”
Section 194BA refers to net winnings in the user account. Deposits are not automatically winnings. Ask the platform how it derived the net-winnings amount under Rule 133.

The government’s explanation of Rule 133 states that the calculation aggregates winnings, including losses, during the year. If the statement ignores losing activity, request a detailed reconciliation rather than calculating a replacement figure yourself.
“No withdrawal means no TDS.”
Remaining net winnings can be subject to deduction at financial year-end even when no withdrawal occurred. Check the account around 31 March and the subsequent annual statement.
“A second TDS line must be an error.”
One deduction can follow a withdrawal and another can arise on remaining net winnings at year-end. Compare each line with its trigger and the platform’s calculation period before disputing it.
“The GST rate applies to my cash-out.”
The 28% GST rate concerns the online-gaming supply. A cash withdrawal is not automatically a new GST-taxable gaming entry. Check the relevant invoice and wallet transaction type.

- Download the complete financial-year statement, not only the latest withdrawal receipt.
- List all deposits, game entries, winning credits, losing entries, withdrawals, TDS deductions, and year-end adjustments by date.
- Ask the platform for the Rule 133 net-winnings working when the statement provides only a final TDS number.

Regulatory context does not change the tax calculation
Government enforcement against unlawful or blocked online betting, gambling, and gaming websites is a separate issue from the GST and TDS rules. MeitY and the Press Information Bureau reported 1,410 blocking directions relating to such websites between 2022 and February 2025. That figure is regulatory context; it is not a tax rate, a TDS trigger, or a formula for net winnings.
