An omnibus wallet pools multiple customers’ crypto-assets in shared on-chain wallets; a segregated setup gives each customer separate on-chain wallets. Either way, a custodian can keep an internal ledger to track each customer’s balance. That ledger is essential to accounting for individual interests in pooled assets, but it does not by itself determine who legally owns those assets or what happens if the custodian becomes insolvent. The custody agreement and applicable law matter too.
What is an omnibus crypto wallet?
An omnibus wallet holds crypto-assets for multiple customers in one or more shared on-chain wallets. Because the blockchain address does not itself show each customer’s share, the custodian may use internal records to attribute balances and activity to individual customers.
A segregated-wallet structure instead assigns separate on-chain wallet(s) to each customer. “Segregated” can also describe a different boundary: keeping customer assets separate from the custodian’s own corporate assets. These distinctions are not interchangeable. Multiple customers may share an omnibus wallet while their assets remain separate from the custodian’s proprietary holdings.

How does a custodian track a balance if coins are pooled?
The custodian maintains customer-level records, often called internal ledger accounts, that map each customer’s interest to the assets held in the wallet arrangement. A sound recordkeeping system needs to capture the customer’s balance and relevant activity, such as deposits, withdrawals, and adjustments, with an audit trail that can support reconciliation.

New York’s Department of Financial Services (NYDFS) describes both customer-specific wallets with internal ledger accounts and customer-only omnibus wallets with internal ledger accounts as possible custody structures. Its September 30, 2025 guidance expects each customer’s beneficial interest to be evident and current in the custodian’s records, with a clear audit trail. It also expects customer assets to be separate from the custodian’s corporate assets on-chain and in its books and records. NYDFS updated custody guidance
What does each arrangement separate?
| Question | Omnibus wallet | Customer-specific wallets |
|---|---|---|
| How are customer assets arranged on-chain? | Assets for multiple customers are pooled in shared wallet(s). | Each customer has separate on-chain wallet(s). |
| Can the custodian keep customer-level records? | Yes. The wallet may be pooled while the custodian uses internal ledger accounts to identify each customer’s interest. | Yes. Separate wallets do not remove the need for accurate customer records. |
| Does the wallet arrangement alone establish separation from the custodian’s own assets? | No. That separation must be assessed separately, both on-chain and in the custodian’s records. | No. Separate customer wallets do not, by themselves, establish how the assets are legally held or treated. |
| Does the wallet label decide insolvency treatment? | No. The agreement and applicable law are relevant. | No. The agreement and applicable law are relevant. |
Are segregated wallets safer if a custodian fails?
A separate wallet can make on-chain grouping easier to distinguish, but the wallet layout alone does not establish legal ownership or determine how assets will be treated in an insolvency. Relevant questions include whose name the assets are held in, whether the custodian acts as agent or trustee, how customer property is characterized under the governing law, what the custody agreement says, and whether customer-level records can be reconciled.

For omnibus custody, reliable records are especially important because the blockchain wallet pools assets while the custodian’s records identify customer interests. NYDFS’s guidance links its expectations for custody structures, recordkeeping, customer disclosure, and insolvency protection; it is supervisory guidance for New York’s virtual-currency context, not a universal rule for every custodian. Can a provider hold customer assets with its own or group assets?
Do not assume that a customer-only omnibus wallet and a wallet shared with the custodian’s own holdings are the same arrangement. The former pools customers’ assets with one another; the latter raises a separate question about separation between client holdings and the provider’s own assets.

Under MiCA Article 75, authorized crypto-asset service providers (CASPs) providing custody and administration on behalf of clients must separate client holdings from the provider’s holdings on the distributed ledger and provide for legal and operational segregation from the provider’s estate, in clients’ interests and under applicable law. The article also addresses return procedures and provider liability in specified circumstances. MiCA Article 75
ESMA’s Q&A 2578, answered June 17, 2025, addresses whether group entities’ crypto-assets may share wallets with client assets and points to Article 75(7)’s separation requirement between client holdings and the CASP’s own holdings. Its answer should be read within that EU rule and question, not treated as a general ruling for every jurisdiction or custody service. ESMA Q&A 2578

NYDFS’s September 30, 2025 guidance describes customer-only omnibus wallets paired with customer-level internal ledger accounts as one possible structure. It expects customer assets to remain separate from corporate assets and calls for disclosure of the custody arrangement. This is specific to NYDFS’s supervisory context; it should not be read as a blanket rule for all U.S. custodians. NYDFS updated custody guidance

What should a custody disclosure explain?
A useful disclosure should make the structure understandable rather than rely on labels alone. Check whether it explains:
- whether customer assets are held in individual wallets or pooled with other customers;
- whether customer assets are kept separate from the custodian’s own assets, on-chain and in its records;
- how the custodian records customer balances and maintains an audit trail;
- whether sub-custodians are involved, and what use of customer assets is permitted;
- how assets are returned and what the agreement says about ownership and insolvency treatment.
For EU clients, Commission Delegated Regulation (EU) 2025/303 addresses information entities provide about segregation, including how they handle multiple clients’ crypto-assets held in omnibus accounts. Commission Delegated Regulation (EU) 2025/303
What the wallet label can—and cannot—tell you
“Omnibus” tells you that assets are pooled on-chain; it does not mean the custodian should leave customer balances unidentified in its records. “Segregated” may refer to separate wallets for customers or to separation of client assets from firm assets, so ask which distinction the provider means. Neither label alone settles legal ownership or insolvency treatment. Those questions depend on the custody agreement and the law that applies.
