For most individual investors who want simple, limited-dollar exposure to oil, an unleveraged oil ETF is the more practical choice. You buy shares in a securities account, pay the purchase price in full, and avoid futures approval, margin calls and contract-expiry decisions. Direct West Texas Intermediate (WTI) futures are more precise and highly liquid, with trading available for roughly 24 hours, but they require a futures-enabled account, margin monitoring, active risk controls and the ability to absorb losses that can exceed the initial deposit.

Neither vehicle is a guaranteed proxy for the spot price of crude. Oil ETFs commonly obtain exposure by holding and rolling futures, so contango, backwardation, fund expenses and tracking error can materially change returns. A futures trader controls the contract directly, yet still faces daily mark-to-market, the futures curve, expiry and roll decisions. Your holding period, tax status, account type, tolerance for leverage and expectations for the oil curve should determine the instrument.

What you actually own

Oil ETFs are securities backed by a portfolio of commodity interests

An oil exchange-traded fund is a security that trades like a share during the stock exchange session. You own units of the fund, not barrels of crude. Funds such as the United States Oil Fund (USO) and United States 12 Month Oil Fund (USL) obtain exposure primarily through WTI futures and other permitted commodity interests. The fund handles contract selection, collateral, rolling and daily operations.

Because the fund owns derivatives rather than inventory in a tank, its net asset value (NAV) can diverge from the spot price quoted for physical crude. The ETF share can also trade at a premium or discount to NAV, particularly when markets are stressed or the underlying futures market is moving faster than the share market.

WTI futures are standardized, direct derivative exposure

A WTI futures contract is a standardized NYMEX derivative tied to light, sweet crude delivered at Cushing, Oklahoma. The contract specifies the delivery month, quantity and price. Most individual traders close or roll positions before delivery, but the contract’s physical-market linkage remains important to its pricing.

Futures are marked to market every trading day. Gains are credited and losses debited from the account as the contract price changes. You therefore hold a leveraged derivative position rather than a fully paid security. The contract’s notional value can be many times the cash posted as margin.

Oil ETF versus WTI futures at a glance

Issue Oil ETF WTI oil futures
How you access it Buy and sell shares through a normal securities account; futures approval is normally unnecessary. Use a futures-enabled account, complete broker approval and maintain margin. The CFTC advises checking that both the person and firm are properly registered.
Trading window Trades during the ETF’s exchange session. The share may be above or below NAV intraday. CME advertises roughly 24-hour access, so you can react to overnight weather, elections or other oil-market events.
Exposure Usually obtained through a portfolio of futures and other permitted commodity interests; returns can differ from spot crude. Exposure to the selected WTI contract, subject to the contract’s basis, expiry and any roll you execute.
Leverage An unleveraged share is paid in full. The fund’s derivatives still create structural tracking and market risks. Margin controls a larger notional position. Gains and losses are amplified, and losses can exceed the initial margin deposit.
Roll and carry The fund must roll contracts. In contango, selling a cheaper near contract and buying a more expensive later contract can create a persistent negative roll yield. You choose whether and when to roll, but the futures curve and daily mark-to-market still affect results.
Liquidity Intraday share trading is convenient, although the share price can diverge from NAV in volatile conditions. WTI is described by CME as one of the world’s most liquid oil contracts, with a close connection to the physical market.
Costs Fund expense ratio, share bid-ask spread, brokerage costs, roll slippage and tracking error. Commission, exchange and clearing charges, bid-ask spread, financing or margin-funding cost, and the work of managing expiry or a roll. There is no ETF management fee.
U.S. tax treatment Depends on the fund’s legal structure and investments. Read the current prospectus and tax-reporting documents; USO states that qualifying Section 1256 gains are allocated to shareholders. Qualifying regulated futures generally receive Section 1256 mark-to-market treatment with a 60% long-term and 40% short-term capital-gain split.

Why an oil ETF may not track the spot price

The futures curve, not the pump price, drives the fund’s result

Spot crude is the price for oil available now. A futures-based ETF owns contracts for specified delivery months. Its return reflects changes in those contracts, collateral income or losses, fund expenses and the cost or benefit of replacing expiring contracts. Even if spot oil is unchanged, the ETF can lose value if its roll transactions are unfavorable.

Contango creates negative roll yield

Contango means later-dated futures trade above the expiring or near-month contract. To maintain exposure, a fund sells the near contract and buys a higher-priced later contract. If the curve stays in contango, the fund repeatedly pays that price difference. This drag is called negative roll yield and can compound over a long holding period.

For example, suppose a fund sells a near-month contract at $75 and replaces it with a later contract at $78 while spot oil itself is unchanged. The fund has bought fewer barrels’ worth of exposure for the same notional cash, creating a mechanical headwind before fees and other tracking effects. The figures are illustrative; actual rolls use multiple contracts, dates and prices.

Backwardation can add a positive roll contribution

Backwardation is the reverse curve shape: later contracts cost less than the expiring contract. Selling the near contract and buying the cheaper later contract can contribute positively to returns, all else equal. That benefit is not guaranteed, because the curve can change between roll dates and the fund still pays expenses and trading spreads.

Premiums, discounts and tracking error

ETF shares trade on an exchange while the fund calculates NAV from its holdings. During fast markets, limited liquidity or a closed underlying market, the share price can move above or below NAV. CME notes that ETF correlation with crude can weaken around rolls. A comparison with spot oil should therefore specify the measurement period, the particular ETF and whether the comparison includes distributions, expenses and roll effects.

How leverage changes the futures decision

Margin is a performance bond, not a down payment

A broker does not require you to pay the full notional value of a WTI contract. Instead, you post initial margin and must maintain required funds as the contract is marked to market. CME has cited an illustrative margin range of about 3% to 12% of NYMEX WTI contract value; requirements change with volatility, contract month, broker policy and clearing rules.

A small move in the oil price can therefore produce a large percentage change in the cash in your account. If losses reduce equity below maintenance requirements, the broker can demand more funds or liquidate the position without waiting for your preferred exit price. The CFTC specifically warns that futures leverage can amplify losses.

Contract size matters more than the margin quote

Before placing an order, read the current contract specification for the contract month you intend to trade. Calculate the full notional value, the dollar value of a one-tick move, the initial and maintenance margin, and the maximum loss you could tolerate if the market moves sharply before you can exit. A margin percentage that looks small can still represent a position too large for a personal account.

Daily settlement makes cash management essential

Unlike an ETF, a futures position does not wait for you to sell before recognizing a loss. Daily settlement transfers gains and losses to your account. Keep a cash buffer above the broker’s minimum, monitor margin during volatile sessions and understand the broker’s liquidation rules. Never assume you can hold indefinitely because you have enough cash for the initial margin.

Access, hours and execution

ETF workflow

Open or use a securities account, confirm that the fund is available in your jurisdiction, review its prospectus and trading volume, then place a limit or market order during the exchange session. A limit order can control the worst acceptable share price; a market order prioritizes execution but can fill at a less favorable price in a fast market. Check the fund’s NAV, bid-ask spread, holdings and current roll schedule when the provider publishes them.

Futures workflow

Apply for futures permissions, complete the broker’s risk disclosures, fund the account and confirm that the broker supports the WTI contract and the hours you need. Check the exchange’s contract specifications, trading calendar, price limits and margin schedule. Choose the delivery month deliberately, set an exit level before entry and record the date by which you will close or roll. CME’s roughly 24-hour access is useful for overnight events, but it also means prices and margin can change while you are away from a screen.

Order and liquidity considerations

WTI futures are highly liquid, but liquidity varies by contract month and time of day. The front month generally has the most activity until traders begin moving to the next month. ETF liquidity is visible in the share’s spread and trading volume; it can deteriorate when the underlying futures market is closed or stressed. Compare the executable bid and ask, not just the last traded price.

Costs that determine the net return

ETF cost stack

  • Fund expenses: The annual expense ratio is deducted from assets and reduces NAV.
  • Share spread and commission: You pay the difference between the bid and ask and any brokerage charge.
  • Roll slippage: The fund crosses spreads and may move the market while replacing expiring contracts.
  • Tracking difference: Expenses, collateral returns, curve shape and share premiums or discounts make performance differ from a spot-price chart.

Futures cost stack

  • Trading charges: Commission, exchange fees and clearing fees apply to each entry, exit and roll.
  • Spread: You pay the bid-ask spread, which can widen in volatile or less-active contract months.
  • Financing and cash opportunity cost: Margin must be funded, and the cash set aside cannot be used elsewhere without risking a margin shortfall.
  • Roll transaction: Closing one month and opening another creates two trades and exposes you to the curve spread at that moment.

There is no management fee charged by an ETF sponsor on a futures contract, but that does not make futures free. For a short holding period, commissions and spread may dominate. For a long holding period, ETF expenses and repeated rolls can dominate. Calculate the expected dollar cost for your own position size and holding period rather than comparing one headline percentage.

Taxes: why the account and product structure matter

Qualifying U.S. futures

In the United States, qualifying regulated futures contracts generally fall under Section 1256. Positions are marked to market at year-end even if you have not closed them, and gains are generally treated as 60% long-term and 40% short-term capital gains. The 60/40 split can be advantageous for an investor who otherwise would have only short-term gains, but it does not eliminate risk or guarantee a lower tax bill. Consult the current Internal Revenue Service guidance and a tax professional for your circumstances.

Oil ETF reporting

ETF tax treatment depends on the fund’s legal structure, the instruments it holds and your account type. USO says qualifying Section 1256 gains are allocated to shareholders, but that statement applies to the fund’s specific structure and current reporting. Read the latest prospectus, annual report and tax documents for the exact ETF. Do not assume every oil ETF receives identical treatment.

Taxable versus retirement accounts

Account rules can change the practical choice. A taxable account may require you to track realized ETF gains, distributions and cost basis, while futures mark-to-market creates its own reporting. Retirement accounts can have additional eligibility, margin and prohibited-transaction constraints. Confirm what your broker and tax adviser permit before trading.

Which vehicle fits which investor?

Choose an unleveraged oil ETF when

  • You want a defined cash outlay and share-based trading.
  • You do not have futures approval or do not want margin calls.
  • Your position is small enough that ETF expenses and roll drag are acceptable.
  • You can tolerate tracking differences from spot oil and do not need overnight futures access.
  • You prefer the fund to handle contract selection and rolling.

Consider direct WTI futures only when

  • You understand contract notional value, tick value, margin and daily settlement.
  • You can monitor the account and maintain substantial excess cash.
  • You have a written plan for expiry, delivery avoidance and rolling.
  • You need near-continuous access or tighter linkage to a particular WTI contract.
  • You accept that a rapid move can produce losses larger than the initial margin deposit and can trigger forced liquidation.

When neither is a good fit

If you cannot explain the futures curve, calculate your maximum dollar loss or meet the product’s account requirements, do not use futures. If your objective is a diversified energy allocation rather than a short-term crude-price view, a single-commodity product may be too concentrated. An oil ETF also may be unsuitable if persistent contango would consume the return you need over your planned holding period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical decision process

  1. Define the exposure: Decide whether you want spot-like sensitivity, a specific WTI delivery month or a longer-term commodity allocation.
  2. Set the holding period: A position held through several rolls faces more cumulative curve effects than a short trade.
  3. Inspect the curve: Note whether the relevant contracts are in contango or backwardation and how wide the spreads are.
  4. Estimate all-in cost: Include expenses, spread, commissions, roll slippage, financing and taxes.
  5. Test the risk: For futures, model a sharp adverse move and the resulting margin call. For an ETF, model a large percentage decline without assuming it will match spot oil.
  6. Confirm operational fit: Check trading hours, account permissions, liquidity, contract or fund documents and your ability to monitor the position.
  7. Choose the simpler instrument that meets the objective: If both work, the ETF generally reduces operational complexity; use futures only when their precision or hours justify the additional risk and work.

Common mistakes and how to avoid them

Assuming an ETF is a barrel of oil

Read the holdings and roll methodology. A futures-based fund can lose value from contango even while a news headline says crude is “flat.” Compare the fund’s total return with the relevant futures series, not only a spot quote.

Using the full margin allowance

Broker-approved leverage is a ceiling, not a target. Size the position from the dollar loss you can absorb, leave a cash buffer and set an exit before the order is submitted.

Ignoring the delivery month

A futures position does not automatically become a convenient long-term holding. Record the first-notice and last-trading dates from the current contract specifications, close before delivery obligations apply and roll only after comparing the two months’ prices and liquidity.

Comparing a one-day ETF move with a spot quote

Use matching timestamps and include NAV premium or discount, the fund’s roll activity and expenses. Intraday differences can be temporary; a multi-month difference can be structural.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Relying on old tax assumptions

Fund structures, tax forms and regulations can change. Verify the current prospectus and IRS instructions for the tax year in question instead of copying a rule from an older article.

Bottom line for individual investors

An unleveraged oil ETF is usually the better starting point for an individual investor who wants straightforward oil exposure, a known cash outlay and no futures-account administration. Its convenience comes with a price: the fund may diverge from spot crude because of contango or backwardation, roll execution, expenses and share premiums or discounts.

WTI futures are the more precise and liquid tool when you need a particular contract, near-continuous trading or close physical-market linkage. They are not a cheaper, simpler ETF substitute. Margin, daily settlement, expiry, rolling and the possibility of losses beyond the initial deposit make them appropriate only for investors with the knowledge, liquidity and risk controls to manage those mechanics. There is no universal winner; the futures curve, volatility, fees, taxes, holding period and your capacity for loss decide the fit.
