Short answer: an oil-and-gas regulator governs the well, lease and production operation; an environmental agency governs what that operation releases or risks in the air, water, land and communities. A drilling project may therefore need an oil-and-gas approval and separate air, water, waste, spill or habitat approvals. On federal land, the Bureau of Land Management (BLM) may approve an application for permit to drill, while environmental review and permits under other laws remain separate obligations.
Which office is responsible depends on the land, the resource owner, the facility and the environmental pathway involved. State commissions often regulate wells on state or private mineral estates. Federal or Tribal lands can add federal or Tribal authorities, and offshore facilities can involve agencies whose responsibilities differ from those onshore.
The core difference: the well versus its environmental effects
The cleanest way to distinguish the two regulators is to ask what is being regulated.
What an oil-and-gas regulator regulates
An oil-and-gas regulator manages petroleum activity itself. Its jurisdiction commonly covers access to the resource, leasing, exploration, drilling and completion approvals, well construction, casing and cementing, well integrity, production measurement, operating conditions, waste prevention, plugging and abandonment, and inspections of field work.

For a federal lease, BLM’s program illustrates this role. An operator submits an application for permit to drill, and BLM rules govern exploration, development and production on federal leases. BLM inspectors examine drilling, production, workovers, abandonment, records and environmental conditions. BLM has conducted more than 25,000 inspections annually since fiscal year 2015. That figure describes BLM’s federal program, not every state or federal oil-and-gas inspection nationwide.
What an environmental agency regulates
An environmental agency protects environmental media and public health. The U.S. Environmental Protection Agency (EPA) describes its permitting programs as covering air, land, groundwater, surface water, marine resources and communities. Permits can limit emissions, pollutant discharges and environmental disturbance, and can require monitoring, recordkeeping and reports.
Depending on the activity and jurisdiction, an environmental authority may issue or administer an air permit, a water-discharge permit, a stormwater authorization, waste requirements, a spill-prevention plan or other environmental approval. It can also investigate releases, require corrective action and enforce permit conditions or environmental statutes.

Side-by-side comparison
| Comparison point | Oil-and-gas regulator | Environmental agency |
|---|---|---|
| Primary object | Wells, leases, production, field operations and resource conservation | Air, water, land, waste, spills, habitat and public health |
| Typical decision | Lease availability; application for permit to drill; casing and cementing; production measurement; plugging; operating conditions | Air permit; water-discharge permit; waste requirements; spill-prevention plan; monitoring and reporting conditions |
| Typical trigger | Proposed exploration, drilling, completion, production, workover or abandonment | A pollutant emission or discharge, waste activity, spill risk or other environmental effect |
| Core oversight tools | Lease stipulations, conditions of approval, field inspections, notices of noncompliance and penalties | Emission or discharge limits, environmental permits, monitoring, reporting, inspections and enforcement |
| Usual geographic basis | Often state-based, with additional federal or Tribal rules on federal or Tribal lands | EPA, or a state, Tribal, territorial or local authority operating an approved program |
| What approval proves | That the specified petroleum operation meets oil-and-gas requirements | That the specified environmental pathway meets the applicable environmental requirements |
No row means one agency automatically replaces the other. A drilling authorization does not generally authorize an air emission, waste disposal or discharge that requires a separate permit. Conversely, an air permit does not authorize a company to drill a well without the oil-and-gas regulator’s approval.
Who issues a drilling permit?
The answer follows the mineral estate and the governing jurisdiction.
Federal onshore leases
For a well proposed on a federal mineral lease, BLM is the federal land and minerals agency that receives and decides the application for permit to drill under its program. Its decision can include lease stipulations and site-specific conditions of approval addressing location, construction, operations, reclamation and resource protection.
BLM cannot approve a federal-land drilling application until the required environmental and cultural reviews are addressed. Those reviews can include the National Environmental Policy Act (NEPA), the National Historic Preservation Act (NHPA) and the Endangered Species Act (ESA). Satisfying those review requirements is part of the federal decision process; it is not the same as receiving every permit required under pollution-control laws.

State and private mineral estates
On state-owned or private mineral estates, a state oil-and-gas commission, department of natural resources or similar agency commonly issues the drilling authorization. The exact title and division vary by state. Local governments may also have land-use or construction requirements, while state environmental departments or EPA may administer pollution permits.
State rules can apply alongside federal rules unless a federal statute preempts a particular requirement. A state-issued drilling permit therefore does not by itself answer whether federal air, water, waste, endangered-species or spill requirements apply.
Tribal and offshore settings
Tribal lands can involve Tribal regulators, federal agencies or both, depending on the authority being exercised and the program involved. Offshore facilities have a different allocation of responsibilities from onshore wells. A facility may also encounter the U.S. Coast Guard or the Department of Transportation (DOT) for transportation-related functions, rather than treating every activity as an EPA matter.
Why one project can need several approvals
Oil and gas operations cross regulatory boundaries. The well is an industrial activity, but it can also emit air pollutants, discharge water, generate hazardous or nonhazardous waste, disturb habitat and create spill risks.

The oil-and-gas regulator reviews the well location, casing, cement, pressure-control equipment, drilling program, completion method and operating conditions. An environmental authority may separately evaluate emissions from engines and tanks, stormwater or wastewater discharges, waste handling, and controls for spills or releases.
Production and storage
Once a well is producing, the oil-and-gas regulator may require production measurement, mechanical-integrity records, inspections and operating reports. Environmental requirements can cover storage tanks, vapor or air emissions, wastewater, produced-water management, waste shipments and spill prevention. The responsible authority can change when material moves from a production site to a pipeline, truck, rail facility, vessel or refinery.
Plugging and abandonment
The oil-and-gas regulator controls the technical plugging and abandonment work, including required barriers and site restoration. Environmental obligations can continue through closure, waste removal, contaminated-soil response, groundwater protection and reporting. Closing a well does not automatically close an environmental case.

Environmental review is not the same as an environmental permit
NEPA is a process obligation for federal agencies. It requires an agency to assess environmental effects and coordinate before making a decision such as approving a federal drilling application. The review can consider direct, indirect and cumulative effects and can lead to alternatives, mitigation measures, lease stipulations or site-specific conditions.

NEPA does not replace substantive permits administered under the Clean Air Act, Clean Water Act, Safe Drinking Water Act or Resource Conservation and Recovery Act. A federal agency may complete NEPA review and still require the operator to obtain a separate air, water, waste or underground-injection authorization from EPA or a delegated authority.
The NHPA and ESA have their own consultation or review requirements. They address historic properties and protected species, respectively; they are not substitutes for pollution permits. Treating “environmental review complete” as “all environmental permits complete” is a common and consequential mistake.
How federal and state environmental programs fit together
EPA writes and enforces federal environmental requirements, but many day-to-day permits are issued by states, Tribes or territories under delegated or approved programs. A delegated program must meet federal requirements. EPA retains oversight and enforcement authority even when a state or Tribal agency implements the permit program.
This creates two practical possibilities. The local permitting office may be the right place to submit an application or report a routine violation, while EPA may retain authority to oversee the program or take an enforcement action. The answer can also differ by program: a state may administer one environmental statute while EPA directly administers another.
On federal lands, state requirements may still apply unless a federal law preempts them. The presence of a BLM lease therefore does not automatically eliminate state air, water or waste requirements.
Who enforces pollution rules at a well site?
Enforcement follows the rule that was allegedly violated.

Oil-and-gas violations
The oil-and-gas regulator can inspect the well, review drilling and production records, issue a notice of noncompliance, impose penalties, require corrective work, suspend or condition operations, and address plugging or abandonment failures. On a federal lease, BLM’s inspection program covers drilling, production, workovers, abandonment, records and environmental conditions connected with the lease operation.
Environmental violations
An environmental agency or delegated authority can inspect for unauthorized emissions or discharges, missing monitoring data, improper waste handling, spill-prevention failures and violations of permit conditions. Available tools can include compliance orders, administrative penalties, civil referrals, permit modifications and requirements to investigate or clean up a release.
Overlapping incidents
A single event can violate both sets of rules. For example, a failed well-control component may breach an oil-and-gas integrity requirement, while the resulting release may violate an environmental permit or spill statute. The agencies can coordinate inspections and enforcement rather than selecting only one regulator.
EPA’s oil-facility memorandum describes this operational split: “The Environmental Protection Agency will generally be responsible for regulating drilling, producing, refining, storing, disposing, and certain transferring operations at various types of facilities.” The same memorandum explains that DOT generally handles transportation and transfers to or from vessels, and that a complex facility can be regulated by EPA and DOT or the U.S. Coast Guard. The exact boundary depends on the facility and the movement being regulated.
A practical method for identifying the right agency
- Identify the regulated object. If the question concerns a well permit, casing, spacing, production measurement, mechanical integrity or plugging, begin with the oil-and-gas regulator. If it concerns an emission, discharge, waste, spill, habitat or public-health exposure, begin with the environmental authority.
- Identify the land and resource owner. Determine whether the site is on federal, state, Tribal, territorial, offshore or private land and identify who owns the mineral estate. This step often determines whether BLM, a state commission, a Tribal authority or another federal agency has the primary petroleum role.
- Map the activity’s environmental pathways. List air emissions, surface-water or groundwater contacts, wastewater, solid or hazardous waste, storage tanks, pipelines, vessels and spill scenarios. Each pathway can have a different permit or reporting rule.
- Separate review from authorization. Check whether NEPA, NHPA or ESA review is required, then separately check Clean Air Act, Clean Water Act, Safe Drinking Water Act, Resource Conservation and Recovery Act and spill-prevention requirements.
- Check delegated-program ownership. Find out whether EPA, a state, Tribal, territorial or local authority issues the particular environmental permit. Delegation can differ from one program to another.
- Confirm transportation boundaries. If the issue involves a pipeline, truck, rail movement or vessel transfer, determine whether DOT or the U.S. Coast Guard has a role in addition to EPA and the site regulator.
- Ask the agency for a written jurisdictional answer. For a real project, provide the parcel, lease number, facility type, process, substances, discharge points and planned dates. A general agency webpage cannot resolve site-specific boundaries reliably.
Common scenarios
“I want to drill on a federal lease. Who do I contact?”
Start with BLM for the application for permit to drill and lease-specific operating requirements. At the same time, identify the environmental reviews and permits that apply to the proposed location and activities. BLM’s approval process does not automatically issue every environmental authorization.
“The well has a drilling permit, but residents smell emissions. Which agency handles it?”
Report the suspected air violation to the environmental permitting or enforcement authority identified for that state or program, and notify the oil-and-gas regulator if the odor may indicate a well-control, equipment or operating violation. The drilling permit does not immunize emissions from environmental enforcement.

No. The oil-and-gas agency may address the well or production operation, while the environmental authority can address the discharge, water-quality requirements, reporting and cleanup. The responsible office depends on the discharge location, permit status and delegated program.

“A truck is moving oil from the facility. Does the site regulator control the trip?”
Not necessarily. The site regulator may control production and storage, while DOT or another transportation authority can control transportation. Transfers to or from vessels can involve the U.S. Coast Guard, and EPA may retain responsibilities for facility operations.
“The project passed NEPA. Can construction begin?”
Only after the decision’s conditions and all required permits, consultations and approvals are satisfied. NEPA informs the federal agency’s decision; it does not replace pollution-control permits.
Appeals, oversight and records
Appeal and review routes depend on the decision. An oil-and-gas permit, a federal land decision, an environmental permit and an enforcement order can each have different deadlines, hearing procedures and reviewing bodies. The issuing agency’s decision document should identify the applicable administrative appeal or judicial-review path.

Key points to retain
- Oil-and-gas regulators authorize and supervise resource development and well operations.
- Environmental agencies regulate emissions, discharges, waste, spills and public-health protections.
- Federal-land drilling can require BLM approval plus compliance with NEPA, NHPA, ESA and separate environmental programs.
- EPA often delegates permit implementation, but it retains oversight and enforcement authority.
- State and federal requirements can apply concurrently, so responsibility is frequently shared.
- The reliable way to identify the right agency is to match the activity, environmental pathway, land status and governing program—not to ask which agency “owns” the entire oil-and-gas project.
Frequently Asked Questions
Is an oil-and-gas commission the same as an environmental agency?
No. An oil-and-gas commission generally regulates wells, leases and production operations. An environmental agency regulates pollution pathways and public-health protections such as emissions, discharges, waste and spills. A single project may answer to both.
Does a drilling permit authorize pollution?
Generally, no. A drilling permit addresses the petroleum operation. Air, water, waste, spill-prevention or other environmental requirements may require separate permits, plans, monitoring and reports.
Who regulates a well on federal land?
BLM commonly handles the federal-lease application for permit to drill and operating conditions, while EPA, a delegated state or Tribal authority, and other agencies may handle environmental permits or specialized reviews.
Can state rules apply on federal land?
Often yes. State requirements may apply alongside federal rules unless a federal statute preempts a particular requirement. The applicable result depends on the program and site.
