Mercenary spyware, stalkerware and ordinary malware are not interchangeable terms. Mercenary spyware is expensive, government-directed surveillance aimed at a small set of selected people. Stalkerware is usually a consumer monitoring app secretly installed by an intimate partner or another person who can unlock the device. Malware is the broad category of malicious software; spyware is one malware type, alongside ransomware, adware, botnets, cryptojacking and trojans.
The distinction matters because the likely attacker, installation method, evidence, urgency and safest response are different. A suspected stalkerware case can be a domestic-abuse safety emergency, while a suspected mercenary-spyware case may require specialist digital-forensics help. An ordinary malware infection usually calls for isolation, patching, scanning and account recovery.
The three terms in plain English
Mercenary spyware
Amnesty International describes commercial or mercenary spyware as surveillance products developed and sold by private companies to governments or state-linked customers. A complete operation can include an exploit chain, a spyware agent on the target device, and backend systems that collect and analyze the data.
These operations select a small number of people because each target can require substantial money and expertise. Targets may be journalists, activists, politicians, diplomats, executives, researchers or others whose work or status attracts state interest. Apple says these attacks can “cost millions and often have a short shelf life.” Apple also says it has notified users in more than 150 countries since 2021. Those notifications are a warning that Apple observed a highly targeted threat signal, not proof that every notified device was successfully compromised.

Stalkerware
The U.S. Federal Trade Commission (FTC) uses stalkerware, also called spyware, for software or an app installed on a phone or other device without the owner’s knowledge. It may track location, record conversations, read messages and email, view photos, or monitor online activity.
The Coalition Against Stalkerware uses a narrower, consent-based definition: software made available directly to individuals that lets a remote user monitor another person’s device without that person’s consent and without explicit, persistent notification. This definition explains why the same technical feature can have different meanings. A transparent parental-safety tool used with informed, continuing agreement is not the same situation as a hidden monitoring app installed on a partner’s phone.
Ordinary malware
Malware is the umbrella term for malicious software designed to disrupt, damage, steal from or gain unauthorized access to systems. NIST classifies spyware as malicious code that is secretly or surreptitiously installed to gather information without the user’s knowledge. Microsoft lists spyware as one malware family among ransomware, adware, botnets, cryptojacking and trojans.
Therefore, spyware is malware, but malware is not necessarily spyware. Ransomware may encrypt files for extortion without secretly reading conversations. Adware may bombard a device with unwanted advertising. A botnet component may turn a computer into a remotely controlled node. A trojan may pretend to be a legitimate application while delivering a different payload.

How they differ
| Axis | Mercenary spyware | Stalkerware | Ordinary malware |
|---|---|---|---|
| Buyer or operator | A commercial vendor selling to a government or state-linked customer | An intimate partner, ex-partner, family member or other individual who buys or deploys monitoring software | A criminal group, fraudster, extortionist or other adversary |
| Target selection | A small number of people selected for political, professional or strategic interest | A specific person whose device the operator can access | Often broad or opportunistic victims, but sometimes a selected organization or person |
| Typical installation | Exploit chains that may require no action from the target | Physical access, an unlocked device, sideloading, rooting or jailbreaking, or a disguised app | Phishing, malicious downloads, trojans, drive-by attacks, exposed services or supply-chain routes |
| Consent issue | The target does not knowingly consent; the context is state surveillance | Covert monitoring without informed, ongoing consent is the defining concern | Unauthorized access or harmful behavior; consent is generally absent |
| Technical sophistication | Exceptional resources, stealth and a short operational life | Commercial monitoring features and concealment; capabilities vary widely | Ranges from simple adware to advanced ransomware, rootkits and espionage tools |
| Data or effect | Messages, calls, files, location, microphone, camera and other device data | Location, texts, email, photos, calls, browsing and other intimate information | Theft, disruption, extortion, spam, credential theft, encryption or surveillance |
| Best first response | Specialist incident response plus device-maker or trusted security-organization guidance | A personalized safety plan and an advocate before scanning or removing anything | Isolate the device, update it, scan it, secure accounts and follow a recovery plan |
Why the categories overlap
These labels describe different dimensions. “Spyware” describes what software does: it gathers information secretly. “Malware” describes the broader malicious-software class. “Stalkerware” adds a consent and relationship context: an individual uses monitoring capability covertly against another person. “Mercenary spyware” adds a purchaser, target-selection and state-surveillance context.
A monitoring app sold as a family-safety product can become a stalkerware concern when someone secretly installs it on a partner’s device, disables visible notifications or uses it to facilitate coercive control. Conversely, an ordinary criminal malware campaign may include a spyware component but have no intimate-partner relationship. Technical capability alone does not tell you which response is safest.
What a suspected infection can and cannot tell you
No single symptom proves stalkerware or any other spyware. Battery drain, a warm phone, increased data use, unfamiliar apps, settings that changed unexpectedly, or an abuser knowing private details can have many explanations. Operating-system updates, a failing battery, cloud-account access, shared passwords and ordinary bugs can produce similar signs.
Treat a cluster of indicators as a reason for a careful assessment rather than an instruction to delete an app immediately. In a stalking or abuse situation, the person monitoring the device may see a scan, notice that permissions changed, lose access and escalate. Removing software can also destroy evidence needed by an advocate, lawyer or law-enforcement investigator.

Questions that help establish risk
- Who could physically unlock or handle the phone, and when?
- Does another person know the passcode, recovery code, Apple or Google account password, or carrier account credentials?
- Are there unfamiliar device-administrator, accessibility, VPN, configuration-profile or management settings?
- Is private information being revealed that could instead come from a shared cloud account, location-sharing service, smart-home device or social-media session?
- Would investigating or changing settings be visible to someone who may be controlling or threatening you?
If you suspect stalkerware: put safety before cleanup
Begin from a device the suspected abuser cannot monitor, such as a trusted friend’s phone, a library computer or an advocate’s device. The FTC warns that contacting an advocate or researching removal on the monitored phone can alert an abuser. If you are in immediate danger, contact local emergency services using a safer device.
Make a personal safety plan
A domestic-violence or survivor-support advocate can help you decide whether to preserve evidence, replace the phone, change accounts, or leave the device untouched. The plan should account for housing, children, transportation, finances, threats, shared accounts and whether the other person has access to your new device.
- Use a safe device to record dates, unusual events, messages and threats. Store notes where the suspected monitor cannot access them.
- Ask an advocate how to preserve screenshots, application names, account alerts or device logs without changing the phone.
- Do not confront the suspected abuser about the software if doing so could increase danger.
- Consider whether a new phone number, a new account and a device purchased or configured without the other person’s involvement are necessary.
Choose between a new phone, a reset and investigation
The Coalition Against Stalkerware says a new phone is the most effective route for escaping a compromised device. A factory reset is almost as effective, but restoring a complete backup can reintroduce unwanted applications or settings. A reset also does not remove access that comes from a shared cloud account, a compromised email address, a carrier account or a person who knows your new passcode.

If evidence may matter, seek advice before resetting. A reset can erase the very information an advocate or forensic examiner needs. If you decide to reset, use a safer device to change important passwords, enable multifactor authentication, review account sessions and set up the phone as new rather than restoring everything automatically. Install only essential applications from the official store and review every permission.

Scanning considerations
Malwarebytes says its Android scanner detects known stalkerware-type applications, but it also warns that a scan can be visible to the person monitoring the phone. A clean scan does not prove that a device is safe: unknown or customized tools may evade detection, and surveillance may occur through an account, a hidden administrator setting or another device.
If you suspect ordinary malware
For a conventional malware incident without an intimate-partner safety threat, prompt containment reduces damage. Use a clean device for sensitive account changes when possible.
- Disconnect the affected device. Turn off Wi-Fi and Bluetooth and unplug network cables. Do not connect removable drives until you understand the scope.
- Protect accounts from a clean device. Change email, banking, cloud and social-media passwords; revoke unfamiliar sessions; enable multifactor authentication; and contact financial institutions if payment information may have been exposed.
- Update the operating system and applications. Install security fixes from the device maker or official software source. Remove unsupported software that no longer receives patches.
- Run a current security scan. Use reputable, up-to-date security software. Let it quarantine or remove detected files, and record the detection name before deleting it if an incident responder may need that information.
- Check persistence points. Review startup programs, browser extensions, installed applications, device-administrator permissions, scheduled tasks and unusual user accounts. Remove only items you can identify safely.
- Recover when necessary. If the infection persists, restore from a known-clean backup or perform a manufacturer reset. Reinstall software from official sources and apply updates before restoring personal data.
- Escalate serious cases. Contact your employer’s security team, a qualified incident responder or relevant authorities when the device holds business data, regulated information, evidence of extortion or signs of a wider compromise.
Do not assume that deleting one suspicious file ends an infection. Credential theft may continue through stolen sessions, and a compromised email account can be used to reset other passwords. After cleanup, review account recovery addresses, forwarding rules, multifactor devices and login history.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesIf you fear mercenary spyware
Mercenary-spyware attacks are unusual enough that ordinary consumer scans cannot establish that a device is clean. They may exploit a vulnerability before a user taps a link, use short-lived infrastructure and collect data through several components.

Apple’s threat-notification process is one important signal for people using its devices. A notification should be taken seriously, but it is not a general warning that everyone in a country is infected. Follow the notification’s current instructions, update the operating system, and seek help from a specialist digital-rights or security organization, the device manufacturer, or an experienced incident-response team.
Preserve information before making major changes
- Save the notification and relevant account-security alerts on a separate, trusted device.
- Do not factory-reset, replace profiles or erase logs until a specialist advises you, unless immediate personal safety requires it.
- Use a clean device for communications that must remain confidential.
- Tell the specialist what device model, operating-system version, travel history, work role and suspicious messages or calls are involved.
Because these attacks are individually targeted and resource-intensive, a generic “phone cleaner” result is not a meaningful clearance certificate. A specialist can determine what evidence is available, whether a compromise is plausible and which remediation steps will preserve the investigation.
Historical detection figures: how to interpret them
Malwarebytes and the Coalition Against Stalkerware reported a 780 percent rise in monitor-app detections and a 1,677 percent rise in spyware detections during January 1 through June 30, 2020. These are historical vendor-telemetry changes for that reporting period, not a current global prevalence estimate and not the probability that a particular phone contains stalkerware.
Recommended Free Tools
Such figures can show that detection activity changed sharply, but they do not identify how many people were monitored, how many apps were installed intentionally, or how many devices were scanned. Use current device evidence and a safety assessment for an individual decision.
Prevention that applies to all three threats
- Use a long, unique device passcode and do not share it. Biometric unlocking is convenient, but know how to disable it when legal or personal-safety circumstances make a passcode preferable.
- Keep the operating system, browser and applications updated. Turn on automatic updates where they do not conflict with work or accessibility requirements.
- Install applications only from official stores or a trusted organizational channel. Avoid sideloaded packages and unknown configuration profiles.
- Review location, microphone, camera, accessibility, notification-reading and device-administrator permissions after major updates.
- Secure the primary email and cloud account first, because control of that account can expose backups, location history and password resets.
- Use multifactor authentication that an abusive partner or thief cannot also access. Review recovery numbers, trusted devices and active sessions regularly.
- Do not click unexpected links or open unsolicited attachments, even when the message appears to come from a known contact.
- Keep independent backups of important photos and documents, and test that you can restore them without restoring unwanted applications.
A practical decision guide
| What you observe | Most useful next step | What to avoid |
|---|---|---|
| An intimate partner may have unlocked the phone, knows private details and could react dangerously | Use a safer device, contact an advocate and create a personalized safety plan | Confronting the person or deleting suspected software immediately |
| An unexpected Apple threat notification or credible indication of state targeting | Preserve the alert and contact a specialist, the manufacturer or a trusted digital-rights organization | Relying on a consumer scan as proof of safety |
| Ransomware, credential theft, pop-ups, suspicious downloads or broad account abuse | Isolate the device, secure accounts from a clean device, update, scan and recover | Continuing to use the device for banking or sensitive communications |
| Only one vague symptom, such as battery drain | Check ordinary causes, update the device and review permissions without assuming spyware | Declaring the device infected from the symptom alone |
What “clean” really means
“No detection” means that a particular scanner did not identify known threats under its current rules. It does not prove that a sophisticated, customized implant, a newly released malware sample, a compromised account or a second device is absent.
Confidence comes from matching the response to the threat: a safety plan and careful evidence handling for stalkerware, specialist examination for suspected mercenary spyware, and containment plus recovery for ordinary malware. If the consequences of being wrong are high, involve an advocate or qualified security professional rather than experimenting on the potentially monitored device.
