Kenya’s National Assembly is investigating motorcycle and asset-finance lenders after boda boda riders reported undisclosed charges, costly interest, aggressive recovery and repayments that can exceed a motorcycle’s value. The Finance and National Planning Committee says it will hear implicated lenders on 5 November 2026 and then decide whether legal or regulatory action is warranted.
What triggered the parliamentary probe
The Kenya Boda Boda Riders and Owners Association presented a petition that was referred to Parliament’s Public Petitions Committee on 18 August 2026. Riders say some buy-now-pay-later and asset-finance agreements do not clearly disclose the amount borrowed, interest and additional charges, ownership terms or the consequences of missed payments.
The allegations include high interest, hidden or inadequately explained fees, aggressive debt recovery and repossession after default. Some riders also say they have paid more than the motorcycle’s value without receiving ownership of the vehicle.
These are allegations under investigation, not findings that every motorcycle lender has broken the law.

What the committee says it has received
The Finance and National Planning Committee reported 110 complaints in its 16 October 2026 account of the inquiry. It said some alleged cases involved borrowers paying two to four times the original loan amount.
Committee chairperson Kimani Kuria said: “We have continuously, since the start of this inquiry, received numerous other complaints where there is no disclosure of the loan amount, and some customers have paid even three or four times the loan amount.”
The figures describe complaints received by lawmakers. They do not establish how many contracts contain unlawful terms, whether calculations were correct, or whether the reported amounts include insurance, penalties, collection costs or other charges.

What happens next
Lenders’ testimony on 5 November
The committee has scheduled 5 November 2026 to hear from the lenders implicated in the complaints. Their evidence is expected to address pricing, contract disclosure, default procedures, repossession practices, ownership transfer and licensing.
Parliamentary report and possible action
After completing its inquiry, the committee says it plans to table a report. It may recommend legal or regulatory action if it establishes that companies breached applicable rules. As of 16 October 2026, no final findings, sanctions or new legislation had been announced.
Why licensing is a central question
National Assembly Speaker Moses Wetangula directed lawmakers to establish whether the companies named in the complaints are licensed and regulated by the Central Bank of Kenya (CBK). He told the House: “What you probably should check and inform the House is whether the alleged companies are licensed by the Central Bank of Kenya and, if they are, whether the Central Bank regulates them.”

The Star reported that the investigation follows the Business Laws (Amendment) Act 2024, which brought previously unregulated non-deposit-taking credit providers under CBK oversight. A lender’s exact regulatory status still needs to be confirmed against CBK records and the law applying to its product; a company offering asset finance may also operate through arrangements whose legal treatment differs by product and entity.

The Star’s account also describes Kenya’s in-duplum principle as limiting recoverable interest on a qualifying non-performing loan to the outstanding principal amount when the loan becomes non-performing. In practical terms, the rule is intended to prevent interest from accumulating indefinitely after default.
Whether the principle applies to a particular motorcycle-finance contract depends on the statute, the loan’s classification and the facts of the account. The underlying 2024 legislation and any relevant court decisions should be checked before treating the description as a definitive calculation for an individual borrower. The parliamentary inquiry has not yet ruled on how the principle applies to the complaints before it.

Why Parliament has revisited the sector
Motorcycle finance was examined in a May 2024 parliamentary hearing after allegations that some riders paid three times a motorcycle’s cost under buy-now-pay-later arrangements. Companies named in that hearing included Watu Credit Limited, Mogo Motorcycles Kenya, JoyInc Group, 15 Minutes and My Boda; Mogo Credit Limited and M-Kopa Credit were listed for a later meeting.
During the 2024 hearing, Watu Credit’s Eric Massawe was reported as saying that an 8.6% monthly interest rate was applied to the financed amount using a reduced-balance model. The company also said fewer than 100 motorcycles had been reported lost from a portfolio of 400,000 financed motorcycles. Those figures were company statements reported by The Star, not independently verified findings.

Default does not answer that question by itself. The lender’s contractual security rights, the notices required before recovery, the borrower’s payment history and the applicable Kenyan law all matter. The current inquiry specifically concerns allegations of repossession after default and aggressive recovery, so Parliament is examining whether lenders followed required procedures rather than assuming every repossession was unlawful.

A borrower facing recovery should keep the signed agreement, repayment schedule, receipts, mobile-money records, notices, messages and any inventory or handover documents. Those records can show the original cash price, financed amount, fees charged, amounts paid and whether the lender gave the notices promised in the contract.

What if a lender is not licensed?
That status should be established, not inferred from a company name or an agent’s claims. A borrower can request the lender’s legal entity name, licence details, contract terms and complaint channel, then verify the relevant information with the CBK or another competent authority before paying a deposit or signing.

Unlicensed status would be a serious regulatory issue, but it does not automatically decide every dispute over ownership, debt or repossession. The effect on a particular contract and the available remedy would depend on the applicable law and the facts. Parliament’s investigation is intended to determine which companies fall under CBK oversight and whether any violations occurred.
What is still unresolved
The inquiry was ongoing on 16 October 2026. Parliament had not yet published a final report, confirmed the allegations, announced sanctions or set out a new consumer-protection regime. Lender responses at the 5 November hearing and the committee’s eventual report will determine whether the complaints lead to enforcement, changes in disclosure requirements or other action.
