Kalshi CEO Tarek Mansour says putting U.S. prediction markets under state-by-state control could drive the industry offshore. The warning comes as courts consider whether sports-event contracts are federally regulated derivatives overseen by the Commodity Futures Trading Commission (CFTC) or sports wagers subject to state gambling law. As of October 14, 2026, appellate decisions were split and New Jersey was asking the U.S. Supreme Court to review the dispute, so neither side had secured a final nationwide victory.
Why is Kalshi fighting the states?
The immediate conflict concerns contracts tied to sports results. States argue that these products function as sports betting and should be licensed, taxed and restricted under each state’s gambling rules. Kalshi and the CFTC characterize them as financial event contracts traded on a federally regulated exchange.
Speaking at DC Fintech Week near Washington on October 14, 2026, Mansour framed the choice as existential for the industry: “It’s not a choice of state versus federal market. It’s a choice of whether prediction markets exist in the U.S. or whether they go offshore.” He also said, “The notion that sports does not have economic consequence is ludicrous,” rejecting the idea that sports-related contracts fall outside financial-market oversight simply because they reference games.

New Jersey had asked the Supreme Court to hear the case. Mansour said Kalshi felt “pretty good” about its overall legal position, but that statement is the company’s assessment, not a final legal resolution.

Is Kalshi sports betting or a derivatives exchange?
The answer depends on how the contracts and the marketplace are legally classified. A sportsbook generally accepts a customer’s wager, sets or adjusts odds and takes the opposite side of the bet. Kalshi says its exchange instead matches bids and asks between traders; the platform is not supposed to be the counterparty whose profit rises when a customer loses.
| Issue | State gambling model | Federal exchange model |
|---|---|---|
| Legal authority | State gambling regulators, licensing statutes and state courts | CFTC jurisdiction over specified derivatives traded on designated contract markets |
| Market structure | Sportsbook or casino takes the other side or earns from losing wagers | Exchange order book matches buyers and sellers; the venue says it is not the counterparty |
| Geographic scope | Separate rules, licenses and taxes in each state | One national market operating under federal rules |
| Consumer controls | State gambling limits, exclusion programs and responsible-gaming requirements | Exchange safeguards such as trading breaks, self-exclusion, deposit limits and accountability limits, according to Kalshi |
| Enforcement | State lawsuits, licensing actions and gambling-law penalties | Designated-contract-market surveillance, audit trails, rule enforcement and CFTC action |
This distinction is central but not automatically decisive. A court must determine whether the economic substance and statutory treatment of a sports contract place it inside federal derivatives law, state gambling law, or an area where the two regimes conflict.
What does the CFTC claim?
In an April 28, 2026 release, the CFTC said Congress gave it exclusive jurisdiction over specified derivatives, including event contracts traded on designated contract markets. Chairman Michael S. Selig said, “States cannot circumvent the clear directive of Congress.” The agency said it sued Wisconsin after Wisconsin sued Kalshi and other prediction-market companies, and it referenced related actions involving New York, Arizona, Connecticut and Illinois.
Rank #2
The CFTC’s position means a state could not regulate an eligible event contract merely by labeling it gambling if federal law assigns oversight to the commission. The states’ position is that sports contracts are wagering products that fall within their traditional police powers and that prediction markets have avoided state regulation and taxation.
How broad is the state opposition?
Kalshi’s August 27, 2026 response said that 20 states were engaged in active litigation with Kalshi and/or other prediction markets. The same filing said 44 states had signed a letter to the CFTC arguing that prediction markets had evaded state regulation and failed to pay state taxes. Those figures are Kalshi’s characterization of the legal and political landscape, not an independent finding by a court or federal agency.
The dispute therefore affects more than one company. A ruling on federal pre-emption, the legal reach of the CFTC and the classification of sports contracts could determine whether prediction-market operators need a patchwork of state licenses or can offer a single federally supervised market nationwide.
What does federal oversight require?
The CFTC’s February 25, 2026 enforcement advisory said designated contract markets have an independent duty to maintain audit trails, conduct market surveillance and enforce rules against prohibited conduct. The advisory listed insider trading or misappropriation of confidential information, pre-arranged trading, wash sales, disruptive trading, fraud and manipulation.
Political-candidate trading case
In one regulator-reported case, a political candidate traded on a contract about his own candidacy. Kalshi imposed a $2,246.36 penalty and a five-year suspension. The amount and suspension period were reported enforcement figures, not estimates.
YouTube-editor trading case
In another case, a YouTube-channel editor traded while likely possessing advance knowledge of upcoming videos. Kalshi imposed a $20,397.58 penalty and a two-year suspension.
Rank #4
These cases illustrate the federal model’s focus: the venue must detect and punish conduct that gives traders unfair informational advantages or distorts prices, even when the underlying contract concerns politics or media rather than a conventional commodity.
Why would state regulation push prediction markets offshore?
Mansour’s argument is that state-by-state oversight would make a national exchange impractical. An operator could face different licensing standards, permitted contract categories, consumer-protection rules, tax obligations and enforcement demands in every jurisdiction. Contracts available in one state might be prohibited in another, fragmenting liquidity and increasing compliance costs.

Prediction markets depend on enough buyers and sellers to create continuous pricing. Kalshi says a nationwide market is necessary for that liquidity. If traders and contracts were divided among many state venues, the company argues, spreads could widen, markets could become harder to enter or exit, and operators might relocate to jurisdictions outside the United States where one national framework applies.
Best Value
“Offshore” in this context means operating from outside U.S. jurisdiction rather than necessarily shutting down the product. That could reduce the ability of U.S. regulators to supervise the venue and make it harder for domestic customers to obtain the safeguards available under U.S. rules. It is a warning about a possible consequence of fragmented authority, not a confirmed relocation plan.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Can states ban prediction markets?
States can enforce their own gambling laws and bring lawsuits, but whether they can block contracts offered by a federally regulated designated contract market is the unresolved constitutional and statutory question. The CFTC says its exclusive jurisdiction prevents states from circumventing federal authority. The states argue that sports wagering remains within state control.
Because appellate courts had reached conflicting outcomes by October 14, 2026, the practical answer varies by jurisdiction and by the specific court orders in force. Readers should not assume that a ruling affecting one state automatically settles the rights of every operator or customer nationwide.

A loss on the federal-pre-emption issue could expose Kalshi to state licensing, product bans, state taxes or limits on which residents may trade particular contracts. The company might have to withdraw sports markets in some states, build a state-licensed structure, or challenge additional enforcement actions. Those consequences would depend on the final judgment and any stays or appeal orders.
A loss for the states, by contrast, could preserve a federally supervised national market while limiting state attempts to impose separate gambling regimes on the same contracts. It would not eliminate federal obligations: surveillance, audit trails and enforcement against manipulation and insider trading would still apply.
What is still unresolved?
No final nationwide Supreme Court ruling after October 14, 2026, is established in the available record. The legal classification of sports-event contracts, the boundary between state gambling power and federal derivatives jurisdiction, and the future geographic structure of prediction markets therefore remain pending. Until those questions are settled, claims that either Kalshi or the states have definitively won go beyond the documented status of the case.
