Not every J-1 exchange visitor needs a waiver. A waiver matters only when the two-year home-country physical presence requirement in Immigration and Nationality Act section 212(e) applies to you and one of the five statutory waiver bases fits your circumstances. First determine whether you are subject to section 212(e); then select one basis and follow its document and agency-submission rules.
This guide reflects U.S. Department of State guidance current on October 13, 2026. It is general information, not an individual determination or legal advice. Your DS-2019 or IAP-66 records, funding, field, program dates and personal facts control the answer.
What the J-1 two-year requirement means
Some current and former J-1 exchange visitors must spend an aggregate of two years physically present in their home country (or countries of last residence) before they can obtain certain immigration benefits, unless the requirement is waived. The requirement is commonly called the “two-year home-country physical presence requirement.” A J-1 visa by itself does not prove that the requirement applies.

- Qualifying government or international funding: The exchange program was funded in whole or in part by a U.S. government agency, the visitor’s home-country government, or a qualifying international organization.
- Skills List coverage: The program involved a field of specialized knowledge designated as necessary for the home country and listed for that country on the applicable Skills List.
- Graduate medical education or training: The visitor came to the United States for graduate medical education or training.
More than one trigger can apply. For example, a physician may be subject because of medical training even if a funding question is unresolved. Conversely, a person whose country is no longer on the Skills List may still be subject because government funding applies.
How the 2024 Skills List changed the analysis
The Department of State’s 2024 Skills List took effect immediately for preliminary determinations. Its transition rule is important: if you were admitted to the United States or obtained J status before December 9, 2024, and your country does not appear on the 2024 list, you are not subject on the Skills List basis. That does not cancel an independent government-funding or graduate-medical-education basis.
Do not infer your status from an old visa annotation, a colleague’s experience or a list published before 2024. Check the current country-specific list and compare it with your admission or J-status date. If your program records and the list produce an uncertain result, request an advisory opinion rather than assuming you are either subject or exempt.

An advisory opinion is the formal determination route
The Department of State’s online survey can help organize facts, but it is not an official determination. An advisory opinion from the Department’s Waiver Review Division is the official route for deciding whether section 212(e) applies.
Request the opinion by email with a complete record. The Department asks for:
- A description of every J-1 program you attended.
- Program start and end dates and the source of funding for each program.
- All DS-2019 and IAP-66 forms.
- The J-1 visa page in your passport.
- The supplementary applicant-information page.
- Proof of time spent in your home country toward satisfying the two-year requirement, if applicable.
The current Department of State page estimates four to six weeks for review of an advisory-opinion request. That estimate applies only to the opinion review; it is not a promised timeline for a subsequent waiver case. Preserve the email submission and every attachment so you can answer a request for clarification without recreating your history.

The five waiver bases
You may apply under only one waiver basis. These are different legal routes with different initiating authorities and evidence; they are not interchangeable checkboxes.
1. No Objection Statement
Your home-country government may issue a No Objection Statement (NOS) stating that it has no objection to your not returning to satisfy the two-year requirement and to your possibility of becoming a U.S. lawful permanent resident. You normally request the statement from the home government after receiving your waiver case number. A designated official transmits it through the prescribed government channel; you do not simply upload or mail the government’s statement yourself.
A foreign physician who acquired J-1 status on or after January 10, 1977, for graduate medical education or training cannot use the No Objection basis. If your home country will not issue an NOS, the Department of State says you may pursue another basis only if that basis independently applies; otherwise you must fulfill the two-year requirement.
2. Interested U.S. Federal Government Agency
A U.S. federal agency can request a waiver when it determines that your departure would be detrimental to its interest. The agency head or an authorized designee sends a signed request to the Waiver Review Division. The request must explain the U.S. public interest and the harm that your return would cause to the agency’s program or activity.
This is an agency-initiated route. An applicant cannot create a substitute agency letter and submit it as though it were the required request. Discuss the case with the relevant agency before selecting this basis and follow that agency’s internal process for obtaining its recommendation.

You may seek a persecution waiver if you believe returning to your home country would expose you to persecution because of race, religion or political opinion. You must file Form I-612 with U.S. Citizenship and Immigration Services (USCIS). The Department of State will consider a recommendation under this basis only after USCIS makes the required persecution finding.

Build the USCIS filing around specific facts and supporting evidence. A general fear of returning, political instability without a personal connection, or difficulty finding work does not by itself establish the required basis.
4. Exceptional hardship to a qualifying spouse or child
This basis concerns exceptional hardship to your U.S. citizen or lawful permanent resident spouse or child if you return abroad to satisfy the requirement. You must file Form I-612 with USCIS, and the Department of State proceeds only if USCIS finds exceptional hardship.
Family separation alone does not meet the standard. The Department of State, Waiver Review Division, states: “Mere separation from your U.S. citizen (or lawful permanent resident) spouse or child is not sufficient to establish exceptional hardship.” Your evidence must address the qualifying relative, the consequences of your departure and the consequences of relocating the relative abroad, rather than merely describing your own inconvenience.

5. Conrad State 30
Conrad State 30 is limited to foreign medical doctors who received J-1 status for graduate medical education or training. A designated state public health department, or its equivalent, must request the waiver. The request is tied to qualifying service in an area the state identifies under its Conrad State 30 program.
If the doctor’s exchange program received funding from the home-country government, an NOS is also required. Conrad State 30 therefore has both a physician-specific eligibility rule and a possible additional home-government-document requirement.
Choosing the basis to investigate
| Basis | Qualifying circumstance | Who initiates or transmits the request | USCIS threshold finding | Important limitation |
|---|---|---|---|---|
| No Objection Statement | Home government does not object to nonreturn or possible U.S. permanent residence | Designated home-government official transmits the statement after the waiver case number is issued | Not required for this basis | Unavailable to foreign physicians who obtained J status on or after January 10, 1977 for graduate medical education or training |
| Interested U.S. Federal Government Agency | Departure would harm a federal agency’s program or activity | Agency head or designee sends a signed request to the Waiver Review Division | Not required for this basis | The applicant cannot substitute a self-prepared agency request |
| Persecution | Likely persecution in the home country because of race, religion or political opinion | Applicant files Form I-612 with USCIS | USCIS must make a persecution finding before the Department of State proceeds | USCIS finding is a prerequisite to the Department of State recommendation |
| Exceptional hardship | Exceptional hardship to a U.S. citizen or lawful permanent resident spouse or child | Applicant files Form I-612 with USCIS | USCIS must find exceptional hardship | Mere separation from the qualifying relative is insufficient |
| Conrad State 30 | Foreign physician’s qualifying medical training and state public-health need | Designated state public health department or equivalent submits the request | Not required as the threshold decision described for this basis | Limited to foreign medical doctors; a home-government-funded doctor also needs an NOS |
The government pages do not establish a current, generally applicable approval-rate statistic. Do not choose a basis because someone claims it has better odds; choose the one whose legal facts and required sponsor or agency actually exist.

How to apply for a J-1 waiver
Step 1: Establish whether section 212(e) applies
- Review every DS-2019 or IAP-66, your visa page and your program funding records.
- Check the current Skills List and the 2024 transition rule if Skills List coverage may be involved.
- Identify any graduate medical education or training and any government or qualifying international-organization funding.
- If the facts remain unclear, request an advisory opinion before treating a waiver as necessary or selecting a basis.
Step 2: Select one waiver basis
Confirm that the required initiating party exists: a home government willing to issue an NOS, a federal agency prepared to make a public-interest request, facts supporting persecution or exceptional hardship, or a designated state health department for Conrad State 30. Do not file multiple bases simultaneously; the Department of State’s FAQ says applicants may apply under only one.
Step 3: Complete the online Form DS-3035
Use the Department of State’s online Form DS-3035 and pay the processing fee as directed on the current form. The Department says the online form is mandatory. An incorrect form version is returned, and the processing fee is non-refundable, so verify the version and every entry before submission. Keep the generated case number and copies of the complete filing.
Step 4: Arrange third-party documents
After submission, track the documents that must come directly from another authority. Depending on the basis, those documents may come from the home government, a U.S. federal agency, USCIS or a state public health department. Follow the transmission instructions for your case exactly.
The Waiver Review Division warns that it will not follow up on missing third-party documents. Ask the sending organization when it transmitted the document, retain confirmation, and monitor whether the document is associated with your case. A complete DS-3035 does not cure a missing sponsor submission.
Step 5: Add Form I-612 when using persecution or hardship
For persecution or exceptional-hardship cases, file Form I-612 with USCIS. You may complete DS-3035 before or after USCIS makes its finding. The Department of State warns that the DS-3035 fee will not be refunded if USCIS does not make the required finding, so understand that financial risk before submitting the waiver application.

Use the J Visa Waiver Online status function after your application and supporting documents have been submitted. The Department of State says status updates can take at least three to four weeks to appear after supporting documents are received. That is an update delay, not an estimate of total waiver processing time. If nothing appears during that period, first confirm that each third party sent its material and that your case number was used correctly.

Documents and records to organize before filing
- Every DS-2019 and IAP-66 issued for every J-1 program.
- Passport biographical page and J-1 visa page.
- Program dates, sponsors and funding-source records.
- Evidence of time already spent in the home country toward the two-year requirement, if any.
- Your DS-3035 confirmation, case number and payment record.
- Proof that the correct government, agency or state department transmitted its required document.
- For I-612 cases, the USCIS filing record and any finding notice.
Use consistent names, dates and program descriptions across forms. A discrepancy between a DS-2019, visa page and waiver filing can create a clarification request even when the underlying facts are straightforward.
Common mistakes and how to correct them
Assuming every J-1 visitor is subject
J status alone is not a trigger. Check funding, Skills List coverage and medical training. If none applies, a waiver may be unnecessary; obtain an advisory opinion when the evidence is ambiguous.
Treating the Skills List as the only test
The 2024 list can remove a Skills List basis for some people admitted or granted J status before December 9, 2024, but it does not override a separate funding or medical-training basis.
Using an unofficial online survey as a final answer
The survey is not the Department’s official determination. Send the complete advisory-opinion record by email when you need a formal answer.
Submitting a sponsor document yourself
NOS, federal-agency and state-health-department requests have prescribed transmission channels. Have the designated authority send its document directly and retain proof of transmission.
Filing under a basis that is unavailable
Check the physician restriction on NOS cases, the physician-only scope of Conrad State 30 and the qualifying-relative requirement for hardship before paying the DS-3035 fee.
Expecting immediate status changes
Allow at least three to four weeks for an online status update after supporting documents arrive. This lag does not mean the case has been denied or that the whole case will be finished within that period.

- Have you identified every J-1 program, date and funding source?
- Could section 212(e) apply through funding, the Skills List or graduate medical education/training?
- Does the 2024 Skills List transition rule affect your admission or J-status date?
- If uncertain, have you requested the Department of State’s advisory opinion with all listed records?
- Which single waiver basis fits, and which government body must initiate it?

- Are you using the current online DS-3035 and accepting that its fee is non-refundable?
- Have all third parties transmitted their documents directly, with proof you can retain?
- If relying on persecution or exceptional hardship, have you filed Form I-612 with USCIS and understood that its finding is required?
- Have you allowed the Department’s stated three-to-four-week status-update lag before treating a missing update as a problem?
Government forms, fees, Skills List coverage, email instructions and procedures can change. Verify the live Department of State and USCIS instructions immediately before filing and obtain individualized legal advice when your immigration status, funding history or waiver basis is uncertain.
