Personalized pricing is not automatically illegal. Its legality depends on where you shop, what data a seller uses, how the price is presented, and whether consumer-protection, privacy, anti-discrimination, or competition rules apply. In the United States, the Federal Trade Commission (FTC) discussed a proposed personalized-pricing enforcement policy in August 2026; it was a proposal for public comment, not a final rule or a blanket ban. In the European Union, traders generally must tell you when an automated system and profiling of your behavior personalized the price.
A price changing on your screen does not by itself prove that a seller profiled you. Demand, inventory, location, sales channel, loyalty status, and limited promotions can produce legitimate differences. You can still investigate a suspicious difference by making a like-for-like comparison, preserving dated records, checking disclosures and account settings, and reporting possible deception to the authority serving your jurisdiction.
What personalized pricing means
Personalized pricing, sometimes called surveillance pricing, is a seller’s use of personal data to estimate what a particular consumer is willing to pay and then set that individual’s price accordingly. The data can be information you supplied directly, information inferred about you, or records obtained from multiple sources. FTC staff described those broad data categories and data sources in a January 2025 update about pricing intermediaries, but that publication did not establish a universal test that lets shoppers identify every signal used in a particular transaction.

The important question is not simply whether two people saw different numbers. It is whether personal information about a person was used to choose the amount offered to that person.

Personalized pricing is different from dynamic pricing
Dynamic pricing changes a price in response to market conditions such as demand or available inventory. A concert seat becoming more expensive as seats sell, or a hotel rate changing after rooms fill, can be dynamic pricing without being personalized to a named shopper. FTC guidance on the Unfair or Deceptive Fees Rule indicates that businesses may use demand- or inventory-based strategies when the pricing information shown to consumers is not misleading.
The two methods can coexist. A retailer could adjust a base price because stock is low and then apply an individualized offer based on a customer profile. Conversely, a price that changed between two visits may reflect only time, inventory, location, or a different sales channel. You need evidence about the inputs before concluding that personal profiling occurred.
Is personalized pricing legal in the United States?
There is no general federal rule that makes every form of personalized pricing unlawful. The legal analysis turns on the practice and the facts: what data was used, whether the seller made deceptive statements or omissions, whether another statute applies, and whether the conduct harms consumers in a way an enforcing agency can address.
What the FTC’s August 2026 policy means
In August 2026, FTC Chairman Andrew Ferguson announced a proposed personalized-pricing enforcement policy for public comment. The proposal should not be described as a final regulation, a completed enforcement rule, or a categorical prohibition. The FTC itself said Congress has not granted it authority to ban personalized pricing in all circumstances.

Ferguson stated: “The FTC does not have the legal authority to ban personalized pricing in all circumstances, but businesses that fail to tell consumers how their personal data is being used to set a price may be in violation of the FTC Act and other laws we enforce.” That statement signals the agency’s concern with undisclosed data use and deception, not an automatic finding that every individualized price is illegal.
Disclosure and deception are central issues
A seller can create legal risk by hiding how personal information affects a price, making a misleading claim about a discount, or presenting mandatory charges in a deceptive way. Whether a disclosure is adequate depends on the facts, including what the business says, what a reasonable shopper would understand, and which law governs the transaction. A privacy notice that says data is collected does not necessarily answer the separate question of whether that data is used to set your price; look for pricing or personalization language as well.
FTC enforcement descriptions for covered violations of the fees rule include compliance orders, refunds, and civil penalties. Those are potential agency remedies, not a promise that an individual shopper will receive money back. The FTC’s proposed policy status may also change, so check the agency’s current announcement and legal materials before relying on its August 2026 position.

Even without a nationwide ban on personalized pricing, a particular system could raise questions under consumer-protection, privacy, civil-rights, or competition laws. The relevant rule may depend on the state, the product, the data involved, and whether the seller made a representation that turned out to be false or incomplete. The available federal materials do not resolve every state-law issue or determine whether any named retailer’s system violates law.

What the European Union requires
The European Commission’s Your Europe consumer guidance takes a more specific disclosure approach. Traders must inform consumers when a price is personalized through automated decision-making and profiling of their specific consumer behavior. The notice is meant to tell you that the amount was tailored through those techniques; it does not mean every price difference is forbidden.
Different prices can still be permitted
EU guidance also recognizes that traders may set different net sale prices at different points of sale. A promotion can be limited to a territory within a Member State. Those distinctions may reflect channel, location, or commercial strategy rather than a profile of an individual’s behavior. The legal issue is whether the required information about automated personalization was provided when that method was used, along with any other applicable consumer, privacy, or anti-discrimination obligations.
What the disclosure should help you understand
When shopping in the EU, look for a clear indication that the price was personalized using automated decision-making and profiling. The guidance does not promise that a trader will reveal every variable, formula, or data source. It does give you a reason to distinguish an openly disclosed personalized offer from an unexplained or misleading price presentation.
How to assess whether a price difference is personal
Start with a controlled comparison. Change one factor at a time and record what you observed. The following table lists the conditions that determine whether two offers are genuinely comparable.

| Comparison factor | Why it matters | What to record |
|---|---|---|
| Item and quantity | A different model, size, bundle, or quantity is a different offer. | Product identifier, variant, and number of units. |
| Seller and checkout conditions | Marketplace sellers, shipping terms, taxes, warranties, and fees can change the final amount. | Seller name, delivery terms, mandatory charges, and final checkout total. |
| Time | Demand and inventory can change without any individual profiling. | Date and time for each displayed and final price. |
| Sales channel | Website, app, physical store, and other points of sale may carry different net prices or promotions. | Channel used and the exact path to checkout. |
| Location and inventory | Territorial promotions, local taxes, and nearby stock can produce legitimate differences. | Country or region, delivery address, store selected, and stock message. |
| Account, loyalty, or coupon status | A logged-in member price or targeted coupon is not the same as a public price. | Whether you were signed in, membership tier, and coupon terms. |
| Personalization notice | A disclosure can indicate that automated profiling, rather than only market conditions, affected the price. | Exact wording, where it appeared, and when you saw it. |
Signs that point toward ordinary dynamic pricing
- The amount changes for everyone at roughly the same time as demand or inventory changes.
- The difference appears across channels or locations with different stock, taxes, delivery costs, or promotions.
- The seller describes a time-limited or location-limited offer without referring to your individual behavior.
Signs that justify closer questions
- The same account sees a different amount after a profile-based offer, personalized coupon, or similar notice.
- The seller’s explanation says automated decision-making or behavioral profiling set the price.
- A discount is advertised as available but disappears at checkout without a clear condition.
- Mandatory fees appear only late in the process or contradict an earlier total.
None of these signs proves a legal violation on its own. They tell you what evidence to preserve and what explanation to request.

1. Recreate a like-for-like comparison
- Use the same product identifier, variant, quantity, seller, shipping option, and checkout conditions.
- Compare at the same purchase moment when possible, and note whether inventory or demand messages changed.
- Check the same sales channel and then compare another available channel separately; do not treat a store price and an app price as identical offers.
- Record your location, delivery region, account or loyalty status, and any coupon or promotion applied.
2. Preserve a dated record
Save screenshots of the displayed price, the product page, the cart, and the final checkout total. Include the date and time, product identifier, seller, location, account status, and any fee or discount language. Keep the records together so another person can reproduce the comparison. Screenshots do not automatically create a refund right, but they can make a complaint specific and credible.
3. Read the relevant notices
Review the retailer’s privacy notice and any pricing, promotion, cookie, or personalization explanation shown during shopping. In the EU, look specifically for notice that automated decision-making and profiling of your consumer behavior personalized the price. In the United States, look for an explanation of whether personal data is used to determine an offer, while remembering that the absence of a clear explanation is not by itself proof of unlawful conduct.

4. Check available account controls
Open the account’s privacy, personalization, marketing, and loyalty settings. Turn off optional personalization or targeted offers when the service provides that choice, and note what the setting actually promises. FTC materials describe direct and inferred data and multiple data sources used by pricing intermediaries, so an account switch may not identify or disable every signal used in a transaction.

5. Ask the seller a precise question
Contact customer service with the product identifier, times, screenshots, and the exact difference you observed. Ask whether the amount was determined by demand or inventory, location or channel, account or loyalty status, a coupon, or automated profiling of your behavior. Request the terms of any promotion and an explanation of fees. A written response gives you a clearer record than a general phone conversation.
6. Report suspected deception
If the presentation appears misleading, report it to the consumer-protection authority responsible for your jurisdiction. U.S. shoppers can report concerns to the FTC; shoppers in the EU should use the competent national consumer and privacy authorities for their country. Include the records you kept, explain why the offers were comparable, and identify the statement or omission you believe misled you. An authority may investigate or seek remedies, but no report guarantees an individual refund.
Common mistakes to avoid
- Assuming every change is surveillance pricing: demand, inventory, location, channel, and promotions can change a legitimate price.
- Comparing unlike offers: different sellers, quantities, delivery terms, taxes, fees, or account benefits can explain the gap.
- Treating a proposal as law: the FTC’s August 2026 policy was proposed for comment, not finalized.
- Reading EU disclosure as a ban: EU guidance requires notice for personalized automated pricing but allows certain point-of-sale and territorial price differences.
- Expecting a guaranteed payout: agency remedies such as refunds or civil penalties are possible enforcement outcomes, not an automatic individual remedy.
- Relying on memory: without dated records, it is difficult to show what price, terms, and account state you actually saw.
What remains uncertain
The United States and European Union frameworks do not answer every country, state, product, or retailer-specific question. A lawful dynamic price can coexist with an unlawful deceptive presentation, and a disclosed personalized price can still be subject to other privacy, discrimination, or competition rules. The FTC proposal’s status should be checked again because the August 2026 announcement requested public comment. For advice about a specific transaction, consult the consumer and privacy authority in the place where you live or bought the product and review the law that applies there.

Personalized pricing is a fact-dependent practice, not a universally banned one. In the U.S., the FTC’s 2026 statement emphasizes truthful disclosure and remains a proposal; in the EU, traders must disclose automated profiling when it personalizes a price. Your most effective response is disciplined evidence: compare identical conditions, record the offer and checkout path, read the notices, review account controls, ask the seller for a precise explanation, and report a misleading presentation to the proper authority.
