Storing data on an optical disc is not automatically illegal. The answer depends on your jurisdiction, what you store, and what you do with it. Laws that regulate commercial disc manufacturing or distribution are different from copyright rules about copying protected content, and both are separate from rules on whether a disc can be used as court evidence.
What “optical storage” means in law
Optical storage generally means recording data on a medium that is read or written using light, often a laser. There is no single global statutory definition in the laws discussed here: each jurisdiction defines optical media for its own legal purposes.
For example, the Philippines’ Republic Act No. 9239, the Optical Media Act of 2003, defines optical media by reference to stored information—such as sounds, images or software code—and access through a lens-scanning mechanism using a high-intensity light source, such as a laser. Montenegro’s Law on Optical Discs defines a disc as a medium or device on which digitally stored data can be read by optical scanning with a high-density light source. Its examples include CD, CD-ROM, CD-R, CD-RW, DVD, DVD-RAM, DVD-ROM, laserdisc and mini-disc.
Malaysia’s Optical Discs Act 2000 includes listed discs and other media on which digital data can be stored and read by laser. These definitions illustrate legal usage; they are not interchangeable rules for every country.

What optical-media laws regulate
A statutory definition is only the starting point. The law’s scope and operative provisions determine which activities it controls. The cited laws address activities such as mastering, manufacture, replication, commercial duplication, import, export or circulation—not simply the act of saving personal data to a disc.
- Philippines: Republic Act No. 9239 regulates activities including mastering, manufacture, replication, importation and exportation. It says optical-disc writers and similar devices in personal computers not used for commercial purposes are not considered manufacturing equipment. That equipment distinction does not establish that every personal copying act is lawful.
- Montenegro: The Law on Optical Discs concerns manufacturing, commercial duplication, circulation, exports and related production inputs. Its inclusion of recordable CD-R media in the definition does not, by itself, determine whether a particular recording is permitted.
- Malaysia: The Optical Discs Act 2000 addresses licensed manufacture. Its definition and licensing rules apply within that statute’s jurisdiction.
These are examples, not a complete survey of national law. A conclusion about a particular disc or activity requires checking the applicable law and any current amendments or implementing rules.

Does copyright make recording a disc illegal?
Copyright questions turn on the content and the acts performed, not on the optical medium alone. Copying or distributing protected music, video, software or other material may require permission or fall within a legal exception, depending on the jurisdiction and circumstances. Using a CD-R or DVD-R does not itself prove that the content was authorized, nor does the fact that a law mentions recording media decide whether a particular copy is permitted.
In the United States, Title 17 of the U.S. Code includes provisions referring to recording devices and media as well as broader copyright rules. Those references do not answer whether a specific copy is allowed; that requires applying the relevant rights, exceptions and conduct under the law. See the U.S. Copyright Act, Title 17.

Can an optical disc be used as legal evidence?
That is a separate question from whether it was lawful to store information on the disc. Whether a court accepts a disc, and how its contents must be authenticated, depends on the court and jurisdiction. A disc’s format alone does not establish admissibility, authenticity or the truth of its contents.
A historical National Bureau of Standards paper by Thomas Bagg, “What Constitutes a Legal Document?”, stated: “The legality of optical media, or any other record media, is based on the acceptance of the information on the media as admissible evidence in a court of law.” Bagg also discussed judicial permission and the judge’s role when parties disagree. This is a historical general discussion, not a current rule for every court. Consult the applicable evidence rules and legal advice for a live proceeding. How to assess a specific situation
- Identify the jurisdiction. Pin down the country and, where relevant, the state or province whose rules apply.
- Describe the activity. Distinguish personal data storage from commercial mastering, manufacture, duplication, import, export or distribution.
- Identify the content and rights. Determine whether the material is your own, licensed, public domain, or protected content you are copying or sharing.
- If using the disc in a dispute, check evidence rules separately. Ask what the relevant court requires for admissibility and authentication.
- Check current law. Definitions, licensing requirements, exceptions and procedures may change; consult current statutes, regulations or a qualified lawyer for a consequential decision.
