Short answer for the United States: emulation software, a game ROM, and a BIOS or firmware file are different legal questions. An emulator is not automatically illegal, but downloading or sharing an unauthorized Nintendo DS game copy creates a separate copyright problem, and bypassing technical protections can raise issues under Section 1201 of the Digital Millennium Copyright Act (DMCA).
Owning a physical cartridge does not automatically give you permission to download a ROM from a third-party site, distribute a copy, or obtain a BIOS file from an unauthorized source. The facts that matter include where the digital copy came from, what you do with it, whether access controls were bypassed, and whether a narrow statutory exception applies.
What “Nintendo DS emulation” includes under US law
“Emulation” is often used as if it describes one act, but a typical setup involves several separate components. Keeping them separate prevents the most common legal misunderstandings.
The emulator program
An emulator is software that makes a game designed for one device run on another device. It is a program, not a copy of a particular game. Nintendo’s Intellectual Property & Piracy FAQ describes emulator software in those terms and objects to unauthorized emulators, including emulators that it says circumvent game-security measures. That is Nintendo’s position as the copyright and trademark owner; it is not a universal court ruling that every independently created Nintendo DS emulator is illegal.

The legal analysis can therefore depend on how a particular emulator was created and what it does. The official materials considered here do not establish a DS-specific judicial rule declaring all emulation software unlawful. Installing an emulator and obtaining a copyrighted game file are distinct acts.
The game ROM
A ROM is a digital copy of the game data stored on a cartridge or other game media. It is the copyrighted game content, not the emulator. Nintendo says that game files offered through third-party links or peer-to-peer networks are unauthorized copies and that uploading or downloading pirate copies of Nintendo games is illegal. Nintendo’s FAQ states: “The uploading and downloading of pirate copies of Nintendo games is illegal.”
A 2021 US proceeding discussed in a World Intellectual Property Organization paper illustrates the distribution issue: a California court found a ROM-site operator liable in connection with Nintendo game files uploaded so visitors could download them. That example concerns the operator’s conduct; it should not be treated as a ruling that resolves every possible private copy, every emulator, or every end user’s circumstances.
The BIOS or firmware file
BIOS and firmware are separate code from the game ROM. They are software used by hardware or an emulator to initialize or reproduce system functions. A BIOS file obtained from an unauthorized download is not made lawful merely because the downloader owns a Nintendo DS or a cartridge. Copying firmware from hardware you possess raises different factual questions from downloading someone else’s file, and the sources discussed here do not provide a categorical DS-specific answer for every personal extraction.

Because firmware can also be protected by technical access controls, a BIOS question may involve both copyright and DMCA anti-circumvention rules. Do not assume that a file described online as a “BIOS download” is authorized, and do not treat the legality of a game ROM as automatically determining the legality of firmware.
Nintendo’s warnings versus what courts have decided
Nintendo’s public guidance is intentionally broad from a rights-holder perspective. It warns against unauthorized copies, file-sharing links, and certain emulators, and it directs customers toward officially purchased games. Those statements are important evidence of Nintendo’s position and of the company’s enforcement priorities.
They are not the same thing as a judicial holding that every emulator, every personal backup, or every act of running a ROM is illegal. A court would examine the specific conduct and the applicable law. The Library of Congress summarizes the practical starting point by asking whether the work is copyrighted, whether the person has permission, and whether an exception applies. Its guide also cautions that it “should not be taken as legal advice.”

Are ROMs legal if you own the game?
Not automatically. Buying or possessing a cartridge gives you the physical object. Copyright law separately governs reproduction and distribution of the copyrighted game content. The fact that a ROM is available online does not show that the uploader had permission to make or share it.

The Library of Congress puts the permission problem plainly: “Just because we’ve put a work online doesn’t mean that you can freely reuse it.” Applied to a DS cartridge, that means ownership is one fact in the analysis, not a blanket license to obtain a digital copy from any source.
Downloading from a third-party site
When a site offers a Nintendo game ROM for download without authorization, the source itself is a major warning sign. Nintendo characterizes those files as unauthorized copies and says downloading and uploading pirate copies is illegal. Owning the matching cartridge does not change the origin of that online copy or establish that the uploader had permission.
Sharing or uploading a ROM
Uploading a ROM, placing it in a peer-to-peer folder, or sending it to other people adds distribution beyond your private possession. The ROM-site litigation described by WIPO shows why distribution attracts particular enforcement attention. A private-use argument does not erase the separate act of making a copy available to others.

Making a personal dump from your own cartridge
A person who extracts data directly from a cartridge they lawfully purchased is dealing with different facts from someone who downloads a ROM made by a stranger. However, the cited official sources do not settle every personal Nintendo DS backup scenario. The legality can depend on the copying method, any technical protection that was bypassed, the purpose of the copy, and what happens to the resulting file.
Rank #4
It is therefore inaccurate to promise that every privately made backup is lawful, just as it is inaccurate to say that cartridge ownership never matters. A direct dump kept for a limited personal purpose presents a fact-specific question; uploading it or distributing it creates an additional, clearer risk.
Is downloading a Nintendo DS BIOS file legal?
A downloaded BIOS file from an unauthorized source should be treated as an unauthorized software copy unless the distributor can show permission or another legal basis. Matching the file to hardware you own does not supply that permission. The source, authorization, and method of copying matter.
Extracting firmware from your own device is a separate question. Whether that extraction involves circumvention, whether the firmware is copyrighted, and what you do with the extracted file can all affect the analysis. The materials available for this explanation do not establish a universal rule that makes every personal BIOS dump lawful or unlawful. They also do not justify providing instructions or links for obtaining copyrighted BIOS files.

The anti-circumvention rule
Section 1201 of Title 17 of the US Code generally prohibits circumventing a technological measure that effectively controls access to a copyrighted work. A technical protection that must be bypassed before software or game data can be accessed can therefore create a separate issue from ordinary copyright infringement.

The statute does not turn every technical workaround into an automatic violation. The details matter: what measure was used, what was accessed, how it was bypassed, and whether a statutory exemption applies. The Copyright Office describes the general prohibition together with a limited exemption process rather than a broad consumer permission to copy games.
Trafficking in circumvention tools
Section 1201 also regulates trafficking in devices, services, or technologies designed primarily to circumvent access controls, or that have limited commercially significant uses outside circumvention. That provision is separate from the question of whether an individual successfully used a tool. Selling, distributing, or promoting a circumvention tool can therefore present its own legal exposure.
Because the law treats circumvention and trafficking separately, a person should not assume that a tool is safe merely because it is marketed for personal backups, or that a personal purpose resolves every question about the tool’s distribution.
What the 2024 preservation exemption actually covers
The Copyright Office’s final rule in the ninth triennial Section 1201 proceeding was dated October 28, 2024. The rule maintains limited, temporary exemptions to the general anti-circumvention prohibition. One relevant category concerns preservation of qualifying video games by eligible libraries, archives, and museums under specified conditions.
The preservation provisions are not a general consumer ROM exception. The regulation in 37 C.F.R. § 201.40 describes conditions involving lawfully acquired complete games, discontinued server access or lack of commercial availability, a genuine preservation purpose, qualifying institutional status, and controls on access. A person playing a privately owned DS game at home does not become an eligible preservation institution simply by owning the cartridge.
Nor does the exemption authorize a library, archive, museum, or consumer to distribute preserved game files freely. Eligibility, purpose, the state of the game’s availability, and the required access controls all matter. The existence of a preservation exemption should therefore not be cited as permission to download any DS ROM or BIOS file from the internet.
Compare the conduct, not just the label “emulation”
| Conduct | What is copied or used | Source or action | Main legal question |
|---|---|---|---|
| Installing an emulator | Emulator software | Software intended to run a game on a different device | How the emulator was implemented and whether it circumvents protected access controls |
| Downloading a ROM | Copyrighted game data | Third-party link or peer-to-peer source | Whether the copy is authorized and whether downloading or further sharing infringes rights |
| Dumping a cartridge | Digital copy of game data | Extraction from a lawfully acquired physical cartridge | Copying method, any circumvention, purpose, and subsequent handling of the file |
| Downloading a BIOS | System firmware code | Unauthorized online file source | Authorization for the firmware copy and any access-control or circumvention issue |
| Preserving a qualifying game | Complete game and related software | Eligible library, archive, or museum acting under the applicable exemption | Whether every institutional, availability, purpose, and access-control condition is satisfied |
A practical US-law checklist
- Identify the file. Decide whether you are dealing with an emulator, a game ROM, or BIOS/firmware. They are not interchangeable legal categories.
- Trace the source. An authorized distribution, a direct extraction from your own media, and an anonymous third-party download present different facts.
- Ask what you will do with it. Private possession, uploading, peer-to-peer sharing, and sending a file to another person are not the same conduct.
- Check for access controls. If obtaining or using the copy requires bypassing a technological protection, analyze Section 1201 separately from ordinary copyright questions.
- Test any claimed exception narrowly. The 2024 preservation provisions are limited to qualifying institutions and specified purposes; they are not a general home-user backup rule.
- Keep the jurisdiction straight. This explanation addresses US law. Other countries may define copyright exceptions, circumvention, and private copying differently.
- Get advice for a close case. If your question turns on a particular dumping method, firmware extraction, preservation project, or circumvention device, a US copyright attorney can evaluate the exact facts.
The safest practical takeaway
Use lawfully obtained game copies and avoid downloading or distributing unauthorized Nintendo DS ROMs or BIOS files. Do not infer a blanket right from cartridge ownership, and do not treat Nintendo’s public warnings as proof that every emulator is illegal. The legally important details are the identity of the software, the source of the copy, the act performed, any circumvention involved, and whether a narrowly written exemption actually fits.
