Game decompilation is not automatically legal or illegal. The answer depends on the jurisdiction, why and how the game is analyzed, whether the copy and access were lawful, whether technical protections were bypassed, how much code was copied, and what happens to the results. In the United States, a copyright fair-use argument and the separate rules against circumventing access controls are different questions; the European Union has a limited interoperability exception with its own conditions.
Why there is no blanket answer
Decompilation can involve reproducing or translating a program’s code to understand how it works. That can raise copyright questions. If the analysis also bypasses a technological measure protecting the game, it can raise a separate anti-circumvention question. A favorable answer to one does not automatically settle the other.
Ownership of a physical copy or a lawful right to use a program may matter, but it is not by itself a general authorization to decompile for any purpose, bypass protections, or distribute the resulting material. The applicable license and other laws can also affect a particular project.

What the U.S. Sega decision does—and does not—say
In Sega Enterprises, Ltd. v. Accolade, Inc., the Ninth Circuit considered an independent developer’s effort to learn the compatibility requirements for games on the Sega Genesis. According to the opinion, Accolade bought a console and commercially available cartridges, disassembled object code, and produced a development manual describing functional interface requirements rather than Sega code.

The court held that, on the record before it, the disassembly was fair use. It considered the purpose and character of the use, the nature of the software, the amount copied, and the effect on the market. The first, second, and fourth factors favored Accolade; the third favored Sega only slightly. The court explained: “In light of the public policies underlying the Act, we conclude that, when the person seeking the understanding has a legitimate reason for doing so and when no other means of access to the unprotected elements exists, such disassembly is as a matter of law a fair use of the copyrighted work.”
That is a case-specific Ninth Circuit decision, not a universal permission slip. Its result concerned a particular compatibility effort and record. It does not establish that copying expressive game code into a new game, decompiling for an unrelated purpose, or distributing proprietary material will be fair use. The fair-use assessment depends on the facts and applies within the relevant U.S. legal context.

U.S. law treats circumvention as a separate issue
Section 1201 of the Digital Millennium Copyright Act generally prohibits circumventing technological measures that control access to copyrighted works, including software and video games. The U.S. Copyright Office describes both this general rule and a process for limited, temporary exemptions. Its ninth triennial proceeding ended with a final rule dated October 28, 2024. That proceeding does not, by itself, establish that an exemption covers a particular game or proposed activity.
Section 1201(f) provides a narrower interoperability exception. Under the statutory text, a person must have a lawful right to use a copy of the program and act solely to identify and analyze elements necessary for interoperability of an independently created program. The information must not already be readily available. The law also limits how the information and means of circumvention may be shared and used; the exception does not authorize infringement or violations of other applicable law.

So even if a project has a plausible copyright fair-use argument, it still needs a separate analysis of whether it circumvents a protected access control and whether a statutory exception or applicable exemption covers that act.
The EU interoperability exception has its own limits
Article 6 of Directive 2009/24/EC allows certain acts of decompilation without the rightsholder’s authorization when reproducing or translating code is indispensable to obtain information needed for interoperability of an independently created program. The conditions include that the person is entitled to use the copy, the information is not already readily available, and the acts are confined to the parts necessary for interoperability.

Information obtained through this route cannot be used for goals other than achieving interoperability, disclosed except where necessary for that purpose, or used to develop a program substantially similar in its expression. The directive’s text does not resolve every country-specific question: national implementation and local case law may matter.

These questions help identify the issues a legal review needs to address; they do not substitute for advice on a particular project.
- Identify the jurisdictions. Consider where the analysis and access occur, where development takes place, and where any resulting work or information will be distributed.
- State the purpose precisely. Interoperability, research, preservation, security analysis, modification, and creating a competing game are not interchangeable purposes. A narrow interoperability exception should not be treated as a general reverse-engineering right.
- Check the copy, access, and license. Establish how the game copy was obtained, whether the right to use it is lawful, what the applicable license says, and whether the analysis requires bypassing a technical protection.
- Ask whether decompilation is necessary and limited. Determine whether the required information is already readily available and whether the work can be confined to the code or portions needed for the stated purpose.
- Plan how findings will be used and shared. Distinguish functional interface information from copied game code. Consider whether disclosure is permitted, whether the new work could be substantially similar in expression, and whether it could affect the original work’s market.
- Check other obligations separately. Contract, trademark, trade-secret, privacy, security, and other applicable law may raise issues beyond copyright and anti-circumvention rules.
What a general explainer cannot decide
Without the jurisdiction, game license, source-copy history, access method, and intended use or distribution, no definite conclusion can be given for a specific project. A project that resembles the compatibility effort in Sega may still differ in legally important ways; likewise, invoking interoperability does not establish that the statutory conditions are met. For a concrete proposal, a lawyer familiar with the relevant jurisdiction and facts can assess the separate copyright, circumvention, contract, and other-law questions.
