The GST Appellate Tribunal (GSTAT), Delhi principal bench, has directed Indian Railway Catering and Tourism Corporation (IRCTC) to deposit ₹50,41,44,461—about ₹50.4 crore—for allegedly not passing a GST-related price benefit to buyers of Rail Neer packaged drinking water. The order covers supplies made from 1 July 2017 through 31 May 2020.
What the GSTAT order says
The tribunal accepted the Directorate General of Anti-Profiteering (DGAP) calculation that IRCTC retained a tax benefit instead of passing it through its supply chain. The case is about pricing and GST compliance, not a finding that Rail Neer’s water was defective or unsafe.

IRCTC’s exchange disclosure says the company must deposit ₹50,41,44,461 with 18% interest. The sum is to be divided equally between the Central Consumer Welfare Fund and state consumer-welfare funds, using the state-wise calculation in the proceedings.
If the payment is not made within 30 days, a further 10% penalty applies, according to the disclosure. IRCTC has said it is preferring an appeal.

Why IRCTC was asked to pay
The alleged GST benefit
The complaint argued that Rail Neer’s maximum retail price remained ₹15 after GST changed the tax incidence, so consumers did not receive the corresponding reduction. IRCTC cited a 24% combined excise-duty and VAT incidence before GST and an 18% GST rate for the post-GST comparison.
The ₹15 MRP was fixed by Railway Board Commercial Circular 72 of 2012. IRCTC described Rail Neer as being in a “controlled price segment” and argued that the Railway Ministry, rather than IRCTC, controlled the printed price.
MRP versus transfer price
The tribunal’s reasoning separated the printed MRP from the price at which IRCTC supplied Rail Neer. As reported in the case, IRCTC could not alter the MRP but was still required to reduce its transfer price so the tax benefit could reach consumers through railway departments, licensees and other supply points.

That distinction is central to the order: control over the label price did not, in the tribunal’s view, remove IRCTC’s responsibility to adjust the upstream price it charged.
Was Rail Neer 25% cheaper than rival bottled water?
IRCTC maintained that Rail Neer was priced about 25% below competing packaged-water brands. It said its base price reflected higher raw-material, electricity, labour and freight costs, and that its public-service pricing was already subsidised.
The 25% figure is IRCTC’s comparative-price assertion reported during the case, not an independently verified market survey. The tribunal rejected the argument that a lower price than rivals created an exemption from anti-profiteering rules. A product can be cheaper than alternatives and still be required to pass on a specific tax reduction.

How Rail Neer’s distribution affected the dispute
IRCTC said it supplied Rail Neer to railway departments and licensees rather than selling every bottle directly to passengers. That distribution model meant the relevant transaction was not limited to a passenger paying the printed MRP at a station. The tribunal therefore examined the transfer price through the railway-controlled channel.

A simple shelf-price comparison does not establish whether a GST benefit was passed on.
Where the money will go
The ordered deposit is not described as compensation for defective water. It is directed to consumer-welfare funds. Half is allocated to the Central Consumer Welfare Fund and half to state funds, apportioned according to the state-wise profiteering calculation. The 18% interest increases the amount payable, while the additional 10% penalty is conditional on missing the 30-day payment deadline.
Can IRCTC appeal?
Yes. IRCTC’s exchange disclosure says an appeal is being preferred. The GSTAT order remains the operative direction unless a higher court grants relief or changes the outcome. The eventual appeal status, any stay and the final amount actually deposited may therefore differ from the initial order, particularly because interest and the possible delay penalty depend on compliance timing.
Quick Recap
What passengers should understand
- The case concerns alleged non-passing of a GST benefit during a defined historical period, not current proof that every Rail Neer transaction is wrongly priced.
- The ₹15 label price came from a 2012 Railway Board decision; the tribunal focused on IRCTC’s transfer price instead.
- The 25%-below-rivals statement was a defense advanced by IRCTC, not a tribunal-certified market ranking.
- The financial remedy is routed to consumer-welfare funds and includes interest under the disclosure.
