An insurance claim denial means the insurer will not pay all or part of a claim. Start with the denial notice: identify the stated reason and deadline, compare the decision with your policy or health-plan documents, correct factual or coding errors, and file the appeal route described in the notice. Health plans often have federally defined minimum review periods, while auto and homeowners deadlines depend mainly on state law and the policy.

What a denial means and what to read first

A denial is not necessarily the final word. It is the insurer’s position that the submitted service, loss, amount, or documentation does not qualify for payment under the policy or plan. Some denials are corrected by resubmitting information; others require a formal appeal or an external review.

Read every page of the denial letter and, for health claims, the explanation of benefits (EOB). Record these items before contacting anyone:

  • Claim or reference number.
  • Date you received the notice (keep the envelope, email timestamp, or portal record).
  • The precise reason for denial and any cited policy, certificate, evidence-of-coverage, or plan section.
  • The amount denied and any amount the insurer says you owe.
  • The filing method, mailing or portal address, forms, and appeal deadline.
  • Whether the notice describes an expedited, internal, external, independent-medical-review, appraisal, or other procedure.

Do not assume the date printed on the letter is the date your deadline starts. Many rules count from receipt, and a policy may use a different event. Preserve proof of delivery for every submission.

Why insurers deny claims

Administrative or coding errors

Incorrect member, policy, or group numbers; a diagnosis or procedure code that does not match the service; duplicate billing; a provider using the wrong payer; or coordination-of-benefits information can trigger a denial without a substantive coverage dispute. The National Association of Insurance Commissioners (NAIC) says some coding and routing errors can be fixed by a phone call or by having the provider correct and resubmit the claim.

Missing or incomplete information

An insurer may need an operative report, itemized bill, proof of loss, repair estimate, medical record, receipt, photograph, or other document. The NAIC model notice explains that a claimant or provider may resubmit a claim with information needed to complete it. Ask exactly what is missing and obtain the request in writing when possible.

Coverage language, exclusions, limits, and deductibles

A denial may rely on an exclusion, a coverage limit, a waiting period, a deductible, a definition of covered damage, or a condition that the policy says must be met. Compare the cited wording with the full policy, endorsement, certificate, evidence of coverage, and any applicable Summary of Benefits and Coverage. Read definitions and exceptions elsewhere in the document; a sentence quoted without its definitions can be misleading.

Medical-necessity or treatment-judgment decisions

Health plans may deny care as not medically necessary, inappropriate for the setting or level of care, ineffective, experimental, or investigational. The Centers for Medicare & Medicaid Services (CMS) identifies these types of medical-judgment decisions as issues that may qualify for external review in eligible plans.

Late notice or another policy condition

Policies can require prompt notice, proof of loss, examinations under oath, cooperation with an investigation, prior authorization, or use of a network provider. Whether a missed condition permits denial depends on the policy, the facts, and state law. Do not assume a generic deadline or a late-notice clause automatically ends your rights; ask what prejudice or cure standard applies in your jurisdiction.

Health-insurance appeal rights and deadlines

CMS says eligible health plans must explain the denial reason, the right to an internal appeal, the right to external review when available, and the availability of a Consumer Assistance Program when applicable. The Affordable Care Act protects a right to appeal many health-plan decisions, but federal rules do not govern every plan or every insurance product. Employer-plan status, government-plan rules, state law, and the plan document matter.

Typical internal-appeal decision targets

Situation Typical decision target Qualification
Urgent-care appeal 72 hours CMS/NAIC guidance for covered plan contexts; the plan and applicable law control.
Care not yet received 30 days Typical prospective-care timeframe.
Care already received 60 days Typical retrospective-care timeframe.

These are decision targets, not a universal filing period. Your notice should state when and how to appeal. A common filing window is 180 days (six months) after receiving the denial notice. CMS generally describes a written external-review request as due within 60 days after a final internal denial, although some states or plans allow more time.

NAIC model-notice comparison

The NAIC model notice offers a useful framework, while expressly warning that state law and plan terms may differ: 180 days to appeal, 60 days for the carrier’s written internal decision, four months to request external review, and 45 days for a standard external-review decision. Treat those figures as a comparison framework, not as a substitute for your own notice.

Expedited review for urgent care

Ask the insurer and your doctor for expedited internal or external review when waiting could seriously jeopardize life or health or your ability to regain maximum function. Explain the medical risk and ask the doctor to provide supporting records. An expedited process can have a shorter decision period than the standard process.

When external review is relevant

External review is generally available for eligible health-plan denials involving medical necessity, appropriateness, setting, level of care, effectiveness, or experimental or investigational status. Eligibility, exhaustion of internal review, filing windows, and the reviewer’s authority vary. Follow the denial notice and your state’s instructions; an external reviewer typically decides coverage under the plan rather than rewriting the plan.

Auto, homeowners, and other property-claim deadlines

There is no single nationwide deadline for every non-health claim. State law, policy wording, claim type, and the facts determine when notice is due, how long the insurer may investigate, when suit must be filed, and how an appraisal or other dispute process works.

Texas example (not a national rule)

Texas illustrates how state regulation can set timeframes. Generally, an insurer acknowledges an auto or property claim within 15 days. After receiving the information it needs, it generally sends an approval, a denial with reasons, or a delay notice within 15 business days. An approved claim is generally paid within five days after the approval notice, subject to exceptions and disaster-related extensions. Use these figures only for a Texas claim that fits the rule; residents elsewhere should check their policy and state Department of Insurance.

Evidence that matters for property and auto claims

  • Photographs or video showing the condition before and after the loss.
  • Police, fire, weather, or incident reports when relevant.
  • Itemized repair estimates, invoices, receipts, and proof of ownership.
  • Maintenance records and evidence addressing causation, such as a leak report or collision diagram.
  • Communications with contractors, adjusters, lenders, medical providers, or witnesses.
  • The complete policy, declarations page, endorsements, deductibles, limits, and exclusions.

For a denial based on causation or an exclusion, obtain a written explanation and respond to the specific factual assumption. A competing estimate or qualified expert opinion can be more persuasive than a general disagreement.

Health, auto, and homeowners denials compared

Question Health insurance Auto or homeowners
Primary regulatory framework Federal and state rules, depending on plan type and sponsor Mainly state insurance law plus the policy
Review mechanisms Internal appeal; external review or independent medical review when eligible Internal reconsideration, appraisal, mediation, or other mechanism stated in the policy; court action may be available
When the clock may start Often receipt of the denial or final internal decision Receipt of notice, a complete claim, a proof-of-loss event, or another date set by law or policy
Most important evidence Medical records, clinical rationale, coding, authorization, and plan language Photos, estimates, invoices, ownership records, causation evidence, and exclusions
Escalation route Insurer, Consumer Assistance Program, external reviewer, state regulator, or qualified counsel Insurer, state Department of Insurance, appraisal or mediation, and qualified counsel

How to challenge a denied claim

  1. Verify the denial. Match the claim number, dates, insured person or property, and amount to your records. Determine whether the insurer denied the entire claim or only a line item.
  2. Ask for the exact reason and cure. Call the number on the notice, but request the explanation, missing documents, coding detail, or policy provision in writing. Ask whether a corrected claim or supplemental submission is allowed.
  3. Check fixable facts. Confirm member or policy numbers, provider identity, service and loss dates, diagnosis and procedure codes, duplicate billing, coordination of benefits, prior authorization, and the identity of the correct insurer.
  4. Build a complete record. Keep the policy or evidence of coverage, Summary of Benefits and Coverage when applicable, denial and EOB, bills, receipts, records, photographs, estimates, expert or physician letters, and a log of every call. Include the representative’s name, date, time, and promised action. Keep copies of everything submitted.
  5. Write the internal appeal. Follow the notice’s address, form, format, and deadline. State the requested result, identify the policy or plan language, explain the factual or medical error, and organize attachments by number. For urgent health care, clearly request expedited handling and explain the risk of delay.
  6. Send it with delivery proof. Use the permitted portal, fax confirmation, certified mail, or another trackable method. Save the confirmation and the exact version of every attachment.
  7. Evaluate external review or appraisal. If the final health denial concerns a covered medical judgment and you meet eligibility rules, request external review within the stated window. For property claims, check whether the policy provides appraisal, mediation, or a similar process and whether using it affects a lawsuit deadline.
  8. Escalate to the regulator. Contact your state Department of Insurance (or the relevant federal or plan administrator channel) if the insurer ignores the procedure, misses a required response, misstates the policy, or does not explain the decision. The NAIC reports that every state, the District of Columbia, and five U.S. territories have an insurance department.
  9. Get specialized help when stakes are high. A licensed insurance-claims attorney, legal-aid program, or consumer-assistance program can assess limitation periods, bad-faith issues, medical-review rights, or complex causation disputes. Do not wait for a complaint investigation before protecting an appeal or lawsuit deadline.

Appeal letter structure

A concise, documented letter is easier to evaluate than an emotional narrative. Include:

  • Your name, policy or member number, claim number, contact information, and the denial date.
  • A one-sentence request, such as “Please reverse the denial and pay the covered amount of $X.”
  • The denial reason quoted accurately, followed by the policy or plan language that applies.
  • A chronological explanation of what happened and why the insurer’s factual, coding, medical, or causation conclusion is wrong.
  • A numbered attachment list and the name of any doctor, contractor, adjuster, or expert who supplied evidence.
  • A request for a written decision and instructions for the next review level if the appeal is denied.

Send only relevant records, redact unrelated personal information when appropriate, and keep an identical copy of the submission.

Complaints, statistics, and what they do not prove

A regulator complaint and an appeal are separate tracks. A complaint may prompt an explanation or investigation of regulated conduct, but it does not automatically extend an appeal deadline or guarantee payment. File the appeal independently and on time.

NAIC’s confirmed-complaint report, as of May 30, 2019, listed 3,487 claim-handling-denial complaints (14.05% of reported reasons), 4,314 unsatisfactory-settlement-or-offer complaints (17.39%), and 4,074 claim-delay complaints (16.42%). NAIC cautions that states submit data voluntarily and that not all states provide all complaint data. These historical figures are not a current nationwide denial rate and cannot predict the outcome of an individual claim.

Practical organization and deadline control

An optional insurance-claim organizer binder—paper or digital—can keep the policy, denial, evidence, call log, submission receipts, and deadlines together. It is a filing aid only; it cannot change coverage or guarantee an overturned denial. Use one folder per claim, a naming convention such as YYYY-MM-DD_document-type, and a calendar reminder several days before every deadline. Back up scans securely and limit access to sensitive medical, financial, and identity information.

When a denial may require immediate action

  • A treatment delay could seriously endanger life, health, or maximum function.
  • The insurer says the appeal period has expired but you have proof the notice arrived later.
  • A large property loss has a short proof-of-loss or suit-limitation period.
  • The denial cites an exclusion but omits the relevant endorsement or definitions.
  • The insurer requests a statement, examination, inspection, or release that you do not understand.
  • Multiple insurers, a government program, an employer plan, or a lender is involved.

In these situations, preserve evidence, request the controlling rule in writing, and obtain licensed legal or consumer-assistance advice promptly.
