Short answer: the United States and India announced a framework for an Interim Agreement on February 6, 2026, not a fully published, product-by-product free-trade schedule. The announcement describes intended tariff reductions, an 18% U.S. reciprocal tariff for specified Indian-origin categories, proposed rules of origin and work on non-tariff barriers. It does not establish a final tariff-line schedule, detailed origin tests, an effective date or proof-of-origin paperwork. Importers should not claim a preference for a specific shipment until a final agreement and customs implementation instructions are available.
What the February 2026 announcement actually is
The White House described the February 6 announcement as a framework for an Interim Agreement while negotiations continue toward a broader Bilateral Trade Agreement (BTA). That legal and procedural distinction matters. A framework records intended commitments; it is not, by itself, an operative customs proclamation or a certificate that a particular product enters at a preferential rate.
The official announcements reviewed do not establish that a final instrument was subsequently concluded or entered into force. They also do not publish tariff-line schedules, product-specific origin tests, an effective date or the forms and verification rules an importer would need. Those points must be confirmed in later agreement texts, presidential or agency actions and customs implementation notices before anyone calculates duty on an actual shipment.

- Framework: sets out what the governments say they intend to do and the subjects still being negotiated.
- Final legal text: would define tariff lines, staging, quotas, exceptions, origin requirements and institutional obligations.
- Implementation: would tell customs authorities and traders when the changes take effect, how to claim them and what records must be retained.
Until the latter two stages are documented, the announcement is useful for planning but insufficient as an import-duty instruction.

What India said it would change
India’s announced commitment is to eliminate or reduce tariffs on all U.S. industrial goods and a wide range of U.S. food and agricultural products. The joint statement names dried distillers’ grains, red sorghum used for animal feed, tree nuts, fresh and processed fruit, soybean oil, wine and spirits, among additional products.
“Eliminate or reduce” is deliberately broader than “make every product duty-free.” No line-by-line Indian schedule was published with the framework. A U.S. exporter therefore cannot infer a zero rate for a particular Harmonized System classification, nor assume that every item in a named product family receives the same treatment. The eventual schedule could use different rates, staging periods, tariff-rate quotas or exclusions.
Questions for a U.S. exporter
- Which Indian tariff line covers the product, including packaging and composition rules?
- Does the final schedule eliminate the duty, reduce it to a stated rate or phase the change in over time?
- Is access limited by a quota, seasonal condition, sanitary requirement or other exception?
- What origin and documentary evidence will Indian customs require?
What the United States said it would do
The framework says the United States would apply an 18% reciprocal tariff rate to originating Indian goods in named categories. Those categories include textiles and apparel, leather and footwear, plastics and rubber, organic chemicals, home décor, artisanal products and certain machinery.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsThe 18% figure is not an all-in duty quote for every Indian import. The amount payable on a shipment can also depend on the product’s tariff classification, the ordinary customs duty, any exemption, and separate measures such as national-security tariffs. The framework does not provide enough information to add those components for a particular product.
Conditional treatment for other Indian goods
The statement says the United States would remove the reciprocal tariff on a wide range of other goods—including generic pharmaceuticals, gems and diamonds and aircraft parts—subject to successful conclusion of the Interim Agreement. “Subject to” is a condition, not an immediate entitlement. A trader should not treat the announcement as authority to enter one of these goods at zero reciprocal duty.

Aircraft and aircraft-parts treatment also has a separate national-security dimension. The announcement describes removal of certain tariffs imposed under U.S. national-security proclamations covering steel, aluminum and copper. It separately describes a preferential tariff-rate quota for Indian automotive parts that are subject to a U.S. national-security tariff. A quota normally requires a quantity, allocation and administration rule; none is supplied in the framework summary.
Generic pharmaceuticals and their ingredients are tied to findings from a U.S. Section 232 investigation. The framework therefore does not guarantee one fixed rate for those products independently of that investigation and any resulting action.
| Side | Announced treatment | What is still missing |
|---|---|---|
| India | Eliminate or reduce tariffs on all U.S. industrial goods and a wide range of U.S. food and agricultural products. | Product-level rates, staging, quotas, exceptions and effective date. |
| United States | 18% reciprocal rate for specified categories of originating Indian goods. | Tariff-line coverage, interaction with ordinary and additional duties, and implementation date. |
| United States | Possible removal for generic pharmaceuticals, gems and diamonds, aircraft parts and other goods if the Interim Agreement is successfully concluded. | Final legal commitment and conditions for each category. |
| United States | Certain aircraft and aircraft-parts tariffs addressed; preferential quota described for Indian automotive parts subject to a national-security tariff. | Exact proclamations, quota volume, eligibility and administration. |
Why rules of origin will decide who benefits
Tariff preferences generally attach to goods that meet an agreement’s origin rules, not merely to goods shipped from a signatory country. The two governments say they will establish rules of origin so that benefits accrue predominantly to the United States and India.
The framework does not state the product-specific test, regional-value-content percentage, tariff-shift rule, cumulation treatment, de minimis threshold, certificate format or verification procedure. Those omissions are commercially significant for products assembled with components from several countries.
Origin details to look for in the final text
- Basic qualification: whether a wholly obtained product, a substantial transformation or a specified tariff shift is required.
- Value calculation: the regional-value-content formula, valuation basis and treatment of materials, freight and overhead.
- Cumulation: whether qualifying U.S. and Indian materials can be counted together and whether materials from third countries are excluded.
- Product annex: special tests for textiles, chemicals, machinery, food, automotive parts and other sensitive sectors.
- Evidence: who may issue a certification, required data fields, retention period and electronic-record standards.
- Verification: whether customs can request production records, conduct a site visit or deny a claim after importation.
A company should map its bill of materials and manufacturing steps against those provisions only after the final rules are published. A shipping origin, invoice address or “Made in” label alone may not satisfy an agreement’s test.

Non-tariff barriers are part of the deal
The framework goes beyond customs duty. India agreed to address barriers affecting U.S. medical devices, remove restrictive information-and-communications-technology import licensing procedures or quantitative restrictions, consider acceptance of U.S.-developed or international standards and testing in identified sectors within six months after entry into force, and address barriers affecting U.S. food and agricultural products.
The parties also intend to discuss standards and conformity assessment. These are announced commitments, not evidence that a regulation, license requirement or testing practice has already changed. Businesses must continue following the rules in force in the destination market until the responsible authority publishes a change.
Why these provisions can matter as much as duty
- A lower tariff does not remove a product-registration, labeling or testing obligation.
- Removing a quantitative restriction can increase market access even when a customs rate remains.
- Recognition of an international standard can reduce duplicate testing, but only after the relevant sector rule is issued.
- Medical devices and food products may still face safety, conformity and sanitary controls administered under separate legislation.
The wider Bilateral Trade Agreement agenda
The Interim Agreement framework sits alongside broader BTA negotiations. The stated agenda includes remaining tariff and non-tariff barriers, technical barriers to trade, customs and trade facilitation, good regulatory practices, trade remedies, services and investment, intellectual property, labor, environment, government procurement and state-owned-enterprise practices.
These subjects show why a tariff headline does not describe the whole commercial relationship. Rules on licensing, procurement or state-owned enterprises can affect a business that never claims a tariff preference. Conversely, progress in the broader talks does not automatically change a customs rate unless the relevant legal instrument says so.
Trade context: the numbers behind the negotiations
In an April 2025 terms-of-reference fact sheet, the Office of the United States Trade Representative estimated total U.S. goods trade with India at $129.2 billion in 2024. The same fact sheet reported a $45.7 billion U.S. goods trade deficit with India, a 5.1% increase—or $2.2 billion—over 2023.

That fact sheet also reported aggregate applied-tariff averages of 17% for India and 3.3% for the United States. These are broad averages from 2025 reporting, not negotiated 2026 rates and not the duty for any particular tariff line. They help explain the negotiating focus but cannot replace classification-specific analysis.
“Today’s announcement demonstrates the deepening ties between the United States and India as we create new opportunities for farmers and entrepreneurs in both countries.”
Ambassador Jamieson Greer, the U.S. Trade Representative, made that statement on February 6, 2026. It is an official characterization of the announcement, not evidence that the projected opportunities or trade effects have already occurred.
How to analyze a product when final documents are available
Once legal schedules and implementation notices exist, compare the two sides at the product or tariff-line level. Use this sequence to avoid treating a headline rate as a complete answer.
The Tool Desk
Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →- Classify the product. Confirm the importing country’s tariff code, statistical suffix, description, composition and intended use. A small classification difference can move a product into a different rate or exception.
- Record the baseline. Capture the ordinary pre-agreement duty, any existing preference, and additional measures such as national-security or trade-remedy duties.
- Check the effective date. Determine whether the rate applies to entry, export, shipment or another legally specified event, and whether there is staged implementation.
- Read the origin rule. Apply the product-specific tariff shift, regional-value-content formula, cumulation rule and any sector annex.
- Test exceptions and quotas. Check tariff-rate quotas, annual or seasonal limits, exclusions, safeguard provisions and conditions attached to pharmaceuticals, aircraft parts, automotive parts or other named goods.
- Prepare proof. Follow the prescribed certification, data, retention and verification requirements. Keep supplier declarations and production records that support the calculation.
- Calculate the landed duty. Add the preferential customs rate, ordinary duties that remain, and any separate additional duties or fees. Do not call the result “18%” or “zero” unless the legal text supports that complete calculation.
- Confirm customs guidance. Check the latest customs implementation notice, ruling database and entry instructions before filing a claim.

What businesses should and should not do now
Reasonable planning actions
- List products traded between the United States and India and verify their current tariff classifications.
- Model scenarios rather than booking a guaranteed saving: one scenario for the announced rate, another for no change until entry into force, and others for quota or origin failure.
- Document bills of materials, supplier countries, processing steps and existing origin certificates so they can be tested against the eventual rule.
- Monitor official agreement publications, customs notices, national-security tariff actions and Section 232 developments.
- Ask brokers and compliance staff to flag entries that involve textiles, apparel, pharmaceuticals, gems, diamonds, aircraft parts, automotive parts, medical devices or regulated food.
Claims to avoid
- Do not advertise every Indian product as eligible for an 18% U.S. rate.
- Do not describe India’s commitment as a universal zero-tariff promise.
- Do not enter a product at a preferential rate solely because it was shipped from India or the United States.
- Do not assume that a framework date is the effective date of a customs change.
- Do not combine an announced reciprocal rate with ordinary and additional duties without checking the legal instruments governing each one.
Common misreadings of the framework
“The deal is already in force.”
The cited announcements describe a framework and continuing negotiations. They do not provide an entry-into-force date or implementation instructions.

“Every U.S. product entering India becomes duty-free.”
India’s language covers elimination or reduction across stated categories, but no product schedule establishes that every line reaches zero.
“All Indian goods face 18%.”
The 18% reciprocal rate is described for specified categories of originating Indian goods. Other goods are addressed through conditional language, separate measures or the broader negotiations.
“Origin is obvious from the shipping country.”
Origin rules generally examine production and qualifying content. The framework says such rules will be established but supplies none of the tests or paperwork needed to apply them.
Recommended Free Tools
“Lower tariffs remove regulatory barriers.”
Medical-device, ICT, food, standards and conformity-assessment commitments still require regulatory action. A customs preference does not itself change a safety or licensing rule.
What to watch for in the final legal package
A usable implementation package should answer five practical questions: Which tariff lines change? When do they change? What origin test applies? How is the claim proved and verified? Which quotas, exclusions or additional duties remain? The package should also identify the customs authority responsible for guidance and the treatment of goods already in transit or entered before the effective date.
Until those documents are public, the February 2026 framework is best treated as a negotiating and planning signal. It identifies likely areas of market access, but it does not authorize a product-specific duty claim.
Bottom line
The India–US announcement points toward lower or eliminated Indian tariffs on many U.S. goods, an 18% U.S. reciprocal rate for named categories of originating Indian goods, conditional treatment for additional sectors, and cooperation on origin and regulatory barriers. Its fine print is that the decisive details—tariff schedules, origin formulas, quotas, proof, effective date and customs procedures—are not in the framework announcement. Businesses should plan around the categories and conditions now, but wait for final legal texts and implementation notices before changing an entry declaration, price, contract or origin claim.
