UK retail investors still cannot be sold, marketed or distributed cryptoasset derivatives such as crypto futures or CFDs by firms in or from the UK. The Financial Conduct Authority (FCA) has not lifted that ban. A change introduced on 8 October 2025 allows a narrow category of crypto exchange-traded notes (cETNs) for retail investors, but only when they are on the UK Official List and traded on a UK Recognised Investment Exchange. Those cETNs are not a reopening of retail crypto-derivatives trading.

What the UK crypto-derivatives ban actually prohibits

The FCA’s retail restriction took effect on 6 January 2021 through Policy Statement PS20/10. A covered firm must not sell or distribute a cryptoasset derivative or a non-UK-RIE cryptoasset exchange-traded note (ETN) to a retail client. It also must not market such a product where the communication is likely to be received by a retail client.

The wording in COBS 22.6.5 is broader than simply blocking the final trade. “Marketing” includes communicating or approving a financial promotion. “Distribution or sale” includes dealing. In practical terms, an exchange, broker, platform or intermediary can create a UK regulatory problem through advertising, onboarding, arranging or approving access even if the customer’s final order is executed elsewhere.

Products normally caught by the restriction

  • Crypto futures: contracts whose value is linked to a cryptoasset and that settle at a future date or through cash differences.
  • Crypto options and similar contracts: instruments giving derivative exposure to a cryptoasset price.
  • Contracts for difference (CFDs): leveraged contracts that pay the difference between opening and closing prices.
  • Other cryptoasset derivatives: the legal category is not limited to a product’s marketing label. A platform calling a leveraged product a “perpetual,” “margin contract” or “synthetic” instrument does not by itself take it outside the rules.
  • Non-UK-RIE cryptoasset ETNs: these remain unavailable to UK retail clients under the relevant restriction.

The FCA introduced the ban because it considered retail losses from these products likely to be significant. Its 2020 estimate put avoided retail harm at £19 million to £101 million a year. That is an FCA estimate, not a guaranteed saving for every year or every trader.

Can a UK retail trader legally trade crypto futures or CFDs?

Not through a firm that is selling, distributing or marketing the covered cryptoasset derivative to UK retail clients. The fact that a product is visible online, denominated in pounds, or available through an app does not establish that it is lawful for a UK retail customer.

A trader’s client classification matters. The retail ban is directed at retail clients; a firm may have different obligations when dealing with an eligible professional client. However, professional status is not created merely by clicking a declaration or choosing a higher-risk account. The firm must apply the relevant FCA classification and conduct requirements, and no current official record establishes that any particular overseas platform is authorised to provide derivatives to UK professionals.

FCA rules for ordinary CFDs are a separate regime and should not be mistaken for permission to sell crypto CFDs. Where the general CFD protections apply, they include leverage limits ranging from 30:1 to 2:1 depending on the underlying asset, a 50% margin close-out rule, negative-balance protection, bans on inducements and standardised risk warnings. The FCA estimated those broader CFD measures would save retail consumers £267 million to £451 million a year in 2019. Those safeguards constrain permitted CFD business; they do not cancel the specific prohibition on retail cryptoasset derivatives.

Why crypto ETNs can be available when derivatives are not

From 8 October 2025, the FCA allowed retail access to a tightly defined class of crypto exchange-traded notes. A qualifying cETN must be listed on the Official List, admitted to trading on a UK Recognised Investment Exchange (UK RIE), and supported by a prospectus that has been reviewed and approved. The products are treated as Restricted Mass Market Investments, which brings additional distribution and risk-information requirements.

An ETN is a debt security issued by a legal entity. Its return tracks a reference asset or index, subject to the note’s terms and the issuer’s credit risk. A futures contract or CFD is a derivative contract whose value is derived from an underlying asset and is generally designed for contractual settlement, often with margin or leverage. Similar price exposure does not make the legal products interchangeable.

The 2025 reform therefore creates a narrow venue-and-product exception, not a general reopening. A cETN listed on a non-UK venue, or a product that fails the Official List and UK-RIE conditions, does not qualify for the retail route described by the FCA. The FCA has expressly said that its ban on retail access to cryptoasset derivatives remains in force.

How to check whether an advertised crypto product is the exception

  1. Identify the legal product: read the final terms and prospectus to determine whether it is an ETN, CFD, future, option or another derivative. “Exchange traded” alone is not enough.
  2. Check the listing: confirm that the cETN is on the UK Official List and admitted to trading on a UK Recognised Investment Exchange, rather than merely displayed on an overseas platform.
  3. Review the prospectus status: qualifying products require a reviewed and approved prospectus. Treat an issuer’s marketing summary as incomplete until the formal documents are available.
  4. Check the distribution classification: qualifying cETNs are Restricted Mass Market Investments, so firms must apply the distribution controls that accompany that category.
  5. Separate the product from the venue: a compliant-looking security offered through an unauthorised or inappropriate channel is not automatically available to a UK retail client.

How the rules reach overseas crypto exchanges

Moving a website, server or company outside the United Kingdom does not remove UK financial-promotion exposure. The UK regime applies to firms marketing to UK consumers, including firms based overseas, when their communications are capable of having an effect in the UK.

Since 8 October 2023, a cryptoasset promotion aimed at UK consumers must use one of four lawful routes:

  1. Communication by an FCA-authorised person.
  2. Communication by an unauthorised person that has been approved by an FCA-authorised person.
  3. Communication by or for an FCA-registered cryptoasset business relying on the Article 73ZA exemption.
  4. Another exemption in the Financial Promotion Order.

The route concerns the promotion itself. It does not turn a prohibited retail crypto derivative into a permitted product. An overseas exchange could therefore face two separate questions: whether its promotion is made through a lawful route, and whether the underlying product may be sold or distributed to a UK retail client.

When an overseas website is likely to be in scope

The FCA says a promotion need not expressly say “for UK customers” to fall within the regime. If UK consumers can view it and potentially engage with the promoted activity, the communication is likely to be relevant. This can include a public website, a mobile application, social-media posts, influencer material, referral links, email campaigns and customer-support messages that explain how to open or fund an account.

Regulators look at the practical effect of the communication, not only the company’s incorporation address. A banner offering derivatives, a sign-up flow that accepts a UK address, or instructions for bypassing a UK restriction can all be more significant than a disclaimer in the footer.

Does a VPN make an overseas exchange legal for a UK resident?

No. A VPN can change the apparent network location of a device, but it does not change the customer’s residence, the firm’s regulatory obligations or the nature of the product. Using a foreign IP address does not create a UK exemption from COBS 22.6 or the financial-promotion rules.

Geo-blocking can be a useful compliance control for an exchange, but it is not a legal safe harbour for a customer who deliberately circumvents it. A UK resident who uses a VPN may still be treated as a UK customer under the platform’s terms and under regulatory analysis. The user may also lose access to ordinary complaint, compensation or safeguarding arrangements, and an exchange can close the account or reject withdrawals if it later identifies the UK connection.

The key distinction is between technical access and lawful provision. A page loading successfully proves only that the website delivered content; it does not prove that the firm lawfully marketed or supplied the product to a UK retail client.

Access, advertising and execution are separate compliance questions

Question What must be examined Why it matters
What is the product? Derivative, qualifying UK-RIE cETN, non-UK-RIE ETN or another security The retail derivative ban and the cETN exception apply to different legal products.
Who is the customer? Retail or properly classified professional client The FCA prohibition is specifically directed at retail distribution, while professional treatment has its own classification rules.
Where is it traded? UK Recognised Investment Exchange or non-UK venue Only the specified UK-RIE route is part of the 2025 cETN exception.
How was it promoted? Authorised communication, authorised approval, Article 73ZA route or another exemption An overseas firm still needs a lawful UK financial-promotion route when its communication can affect UK consumers.
What geographic controls exist? UK blocking, account restrictions and monitoring of residence Geo-blocks can reduce exposure for a firm but do not legalise VPN circumvention by a resident.
What are the trading terms? Leverage, margin, liquidation, negative-balance protection and inducements These determine risk and may indicate whether a product is a CFD or another derivative; CFD safeguards are not a crypto-derivatives permission.
What is the firm’s status? FCA authorisation or cryptoasset registration for the relevant activity Registration or a promotion route does not automatically authorise every product or service.

What recent enforcement signals mean for overseas platforms

In February 2026, the FCA announced legal proceedings concerning alleged continuing UK promotions by HTX on a website and social-media channels. The announcement is an enforcement signal, not a final court finding. It demonstrates that the FCA is prepared to pursue alleged overseas promotions rather than treating offshore location as a complete defence.

The FCA has also discussed geo-blocking and warned regulated payment and crypto firms about relationships with unregistered overseas businesses. For an exchange, that creates operational risks beyond an FCA notice: banking and payment access can be interrupted, marketing partners may be unwilling to carry campaigns, and UK users may face account restrictions when a firm changes its compliance position.

Practical checks for UK retail traders

  • Read the legal classification: do not rely on labels such as “earn,” “perpetual,” “margin” or “exchange traded.”
  • Look for the exact venue: for a claimed retail cETN exception, verify the Official List and UK Recognised Investment Exchange status.
  • Check the firm and promotion: determine whether the communicating or approving entity has the relevant FCA status or relies on a stated exemption.
  • Check residency questions: an exchange asking for a UK address, tax residence or identity document is likely to treat you as a UK customer regardless of your IP address.
  • Do not infer protection from leverage limits: a platform advertising 30:1 or another CFD-style limit has not thereby obtained permission to sell crypto derivatives to UK retail clients.
  • Keep records: save the product terms, prospectus, risk warning, account classification and promotion you relied on. These records help distinguish a compliant listed product from an offshore derivative offer.

What this means for exchange operators

Separate product governance from marketing governance

An exchange should first determine whether the instrument is a prohibited retail cryptoasset derivative, a non-UK-RIE ETN or a qualifying UK-RIE cETN. It should then map every UK-facing communication to one of the lawful promotion routes. Product approval and promotion approval are different controls.

Control the whole customer journey

Compliance review should cover search advertising, social posts, affiliates, referral codes, app-store descriptions, onboarding screens, customer support and trading interfaces. COBS 22.6 reaches communications and dealing conduct, so removing one advert does not cure a UK-facing sign-up journey that still invites retail users to trade a prohibited product.

Use geo-blocking as one control, not the entire answer

Blocking UK IP addresses, rejecting UK residence declarations and monitoring payment or identity data can help demonstrate that the firm is not serving UK consumers. Those controls need to be consistent: allowing a UK address after a VPN sign-up, or continuing targeted social advertising, can undermine the stated restriction.

Firms considering UK crypto financial-promotion compliance training should treat it as a specialist legal and compliance procurement decision. No training provider is automatically endorsed by the FCA, and training cannot substitute for the permissions, controls and product analysis required for a particular business model.

Bottom line for UK readers

The FCA’s retail ban on cryptoasset derivatives remains in force in October 2026. A UK retail trader cannot rely on an overseas exchange, a VPN, a foreign server or a CFD-style risk warning to make crypto futures, CFDs or similar derivatives lawful. The only material retail opening in this area is the narrow cETN route for products on the Official List and traded on a UK Recognised Investment Exchange. Overseas exchanges must treat UK-facing promotion as a separate regulatory issue, and the FCA’s continuing enforcement activity shows that offshore incorporation does not end that exposure.
