Indian IT professionals on H-1B visas are governed by the same federal specialty-occupation, wage, portability and travel rules as other H-1B workers, but several 2025–2026 policy changes make petition dates, visa interviews and online-presence screening especially important. Your H-1B status in the United States, your employer’s petition and your visa stamp are separate things. A valid status does not automatically create a valid entry document, and an unexpired visa stamp does not by itself extend your authorized stay.
This guide explains what those distinctions mean when you start a job, change employers, travel to India, apply for a new stamp or bring an H-4 dependent. It summarizes published U.S. government guidance; individual outcomes depend on the facts of your case and the instructions in force when you apply.
What H-1B status means for an Indian IT worker
H-1B is an employer-sponsored, temporary classification for a specialty occupation. The job must require the theoretical and practical application of specialized knowledge and at least a bachelor’s degree, or equivalent, in the specific specialty. A software, systems, data or similar IT position is not automatically a specialty occupation; the petition must connect the position’s duties and requirements to the relevant specialty and to your qualifications.

The U.S. employer files the petition and makes the required labor-condition attestations. The Department of Labor describes an annual allocation of 65,000 regular H-1B numbers plus a 20,000 exemption for people with qualifying U.S. advanced degrees. Those figures are program-wide limits, not a count of Indian workers and not a prediction of an individual approval.
Status, petition and visa stamp are different
| Document or concept | What it does | What it does not do |
|---|---|---|
| H-1B status | Authorizes qualifying employment and stay in the United States for the period granted by the government. | It is not itself a travel document and does not guarantee admission after a trip abroad. |
| Employer petition (Form I-129) | Asks U.S. Citizenship and Immigration Services to approve a particular employer, role, location and period of H-1B employment. | It does not let you work for an unrelated employer before that employer makes a qualifying filing. |
| Visa stamp | Allows you to seek admission at a U.S. port of entry while the stamp is valid. | It does not set your authorized period of stay or guarantee that an officer will admit you. |
| Labor Condition Application (LCA) | Supports the employer’s wage and working-condition attestations for the listed occupation and work area. | It does not replace the H-1B petition or authorize work outside its covered facts. |
How pay and workplace protections work
The employer generally must pay at least the higher of two figures: the actual wage paid to workers with similar experience and qualifications in that employment, or the prevailing wage for the occupational classification and area of intended employment. The Department of Labor states: “You must be paid the actual wage, which is the same wage rate your employer pays other workers with similar experience and qualifications, or the local prevailing wage for the occupation in the area of intended employment, whichever is higher.”
#1 Best Overall
The obligation is tied to the employment described in the LCA and petition. A change in worksite, occupation, duties, hours or pay can require a new or amended filing. Do not assume that a salary shown in a recruiter’s offer, a payroll deposit or an LCA automatically resolves every wage question; classification, location and the circumstances of a deduction matter.
Protections worth monitoring
- Nonproductive time: DOL guidance addresses pay when the employer, rather than the worker, causes a period in which no work is available.
- Benefits: H-1B workers must generally receive fringe benefits on the same basis as comparable U.S. employees.
- Costs and deductions: Employers cannot charge workers certain petition and business expenses. Whether a particular deduction is lawful depends on the cost and the surrounding facts.
- Working conditions: The employer must attest to conditions comparable to those of similarly employed workers.
- Records and access: The LCA and required public-access material must be maintained, and workers can preserve copies and payroll evidence.
- Retaliation: DOL describes protection for workers who raise compliance concerns or cooperate with an investigation.
Keep a personal compliance file
Save offer letters, pay statements, time records, worksite and employer addresses, notices of changes in duties or location, and a copy of the LCA if available. These records help an attorney or agency assess whether the wage and worksite attestations match what actually happened. A disagreement is not automatically a violation; document the facts before concluding that a deduction or pay difference is unlawful.
Can I change jobs on an H-1B?
Often, yes, through H-1B portability, but a job offer alone is not enough. The portability rule is designed for an H-1B worker who is already employed in valid H-1B status. The prospective employer must file a nonfrivolous Form I-129 petition before your authorized stay expires and must have an unexpired, approved LCA covering the offered employment.
Rank #2
The Department of Labor summarizes the purpose this way: “The portability provision enables an H-1B worker to change to a different job without the risk of being ‘out of status.’” The filing must still satisfy the specialty-occupation, wage, worksite and status requirements. If the petition is deficient, withdrawn or denied, the practical consequences can be different from a routine transfer.
Can I start work before my transfer is approved?
When the portability conditions are met, the cited DOL guidance says the worker may begin the new employment after the qualifying petition is filed, before USCIS adjudicates it. Coordinate the start date with the new employer’s immigration team and keep the filing receipt, LCA information and evidence that you were maintaining status. Do not begin based solely on an offer letter, an unsigned draft or a petition that was filed after your authorized stay expired.
Job-change decision check
- Confirm that you are currently working in valid H-1B employment and know the end date of your authorized stay.
- Ask the new employer whether it has filed a nonfrivolous I-129 and obtained an approved, unexpired LCA covering the actual job and work area.
- Match the petition’s employer, duties, location, wage and start date to the job you will perform.
- Keep proof of the filing and continue complying with the old job until portability requirements for the new job are satisfied.
- Obtain individualized advice before starting if there has been a layoff, status gap, prior violation, material worksite change or an unusual filing history.
Does the new $100,000 rule apply to my current H-1B?
A September 19, 2025 presidential proclamation applies prospectively to specified H-1B employment petitions filed with USCIS after September 21, 2025, at 12:01 a.m. Eastern Daylight Time. The State Department describes visa issuance and entry restrictions for those petitions unless they are accompanied or supplemented by a $100,000 payment, with exceptions determined by the Department of Homeland Security under the proclamation.

This is a condition attached to specified petitions and entry; it is not described as a fee that every H-1B worker personally owes. USCIS’s September 20, 2025 memorandum says the measure does not apply to beneficiaries of petitions filed before the effective date, beneficiaries of currently approved petitions, or holders of validly issued H-1B visas. It also states that the proclamation does not affect current visa holders’ ability to travel to or from the United States.
Because implementation, litigation or later amendments can change the practical result, have the employer verify the petition’s filing date, payment or exception documentation and the latest agency instructions before filing or traveling. Do not infer your answer from nationality, job title or the date you entered the United States.
Do H-1B applicants have to make social media public?
Yes, current State Department guidance updated September 18, 2026 places H-1B and H-4 visa applicants under online-presence review and instructs applicants to make social-media profiles public or open. This is a visa-screening instruction. It does not itself change your underlying H-1B status, authorize employment or guarantee visa issuance.

Before submitting a visa application, review the consular instructions for the post where you will apply, ensure that application answers and identity information are accurate, and preserve evidence that explains legitimate employment, education and travel history. Privacy settings and screening practices can change, so follow the current notice rather than an older checklist circulating online.
Where should I book my visa interview?
Under a State Department instruction dated July 15, 2026, nonimmigrant applicants should generally schedule interviews at a U.S. embassy or consulate in their country of nationality or residence. If you apply based on residence, you must be able to demonstrate that residence. Applying elsewhere can make it more difficult to qualify and may involve different appointment availability or processing procedures.
Before leaving the United States
- Check the expiration date and entries listed on your passport and visa stamp.
- Confirm that your H-1B petition and authorized stay cover the planned return date.
- Check the interview-location rule and the consulate’s appointment, document and online-presence instructions.
- Carry copies of the approval notice, employment evidence, recent pay statements and contact details for the employer’s immigration representative.
- Ask counsel about any pending amendment, extension, portability filing, status issue or proclamation-related condition before booking nonrefundable travel.
How long is an H-1B visa stamp valid for Indian citizens?
The State Department’s India reciprocity schedule lists H-1B and H-4 visas as multiple-entry with 35 months of validity. That is a country schedule, not a promise that every applicant will receive exactly 35 months. Consular issuance remains discretionary and can be affected by the individual application and current instructions.

Visa validity only describes the period in which the stamp may be used to seek entry. At the port of entry, the government determines whether to admit you and for how long. Your authorized stay is reflected in the admission record and underlying immigration authorization, not created by the reciprocity table.
Can I travel to India and return with an expired visa stamp?
An expired visa stamp generally cannot be used to seek a new admission to the United States. H-1B status or an unexpired petition does not automatically renew the stamp. If you need to return after the stamp expires, plan for a new visa application and interview under the instructions for the post where you apply, unless a specifically applicable exception is confirmed for your facts. Do not rely on the petition approval date, the visa’s original end date or a prior entry as a substitute for checking the document required for your next admission.
How H-4 dependents fit into these rules
H-4 applicants are expressly included in the September 18, 2026 online-presence-review instruction. They must follow the same interview-location guidance when applying for a visa and should distinguish the visa stamp from the dependent’s authorized stay in the United States.
The rules summarized here do not establish when an H-4 spouse qualifies for employment authorization. Eligibility depends on current USCIS rules and the family’s individual facts, so obtain current, case-specific guidance rather than relying on an old H-4 employment checklist.
A practical decision framework
| Your situation | Primary question | Action to take |
|---|---|---|
| Continuing with the same employer in the same role | Do the wage, worksite, duties and authorized-stay dates still match the approved filings? | Keep payroll and LCA records; ask the employer about any material change. |
| Changing employers while in the United States | Has the new employer filed a qualifying petition with an approved, unexpired LCA before your stay expires? | Use portability only after the filing and factual requirements are met. |
| Traveling with a valid visa | Does the stamp, petition and authorized stay cover the planned trip and return? | Carry current approval and employment evidence and check the latest screening rules. |
| Traveling with an expired visa | Do you have a new visa or a confirmed exception permitting your particular return? | Plan the appropriate visa application before departure; status alone does not renew the stamp. |
| Petition filed after September 21, 2025 | Is the filing subject to the proclamation’s payment condition or a DHS exception? | Have the petitioner verify the filing date, payment and exception documentation under current guidance. |
When professional advice is especially important
Consult a qualified U.S. immigration attorney before acting if you have been terminated, worked without pay, changed worksites or duties, had a petition denied or withdrawn, overstayed, spent substantial time outside the United States, or are planning travel while a filing is pending. Also obtain advice when an employer proposes passing petition costs to you, reducing pay below the applicable wage, or assigning work that is materially different from the approved position. Agency pages describe general rules; they cannot decide the facts of your individual case.
