U.S. export controls can restrict access to certain advanced AI chips through licensing rules based on the item’s technical classification, the transaction’s destination and parties, and—in some cases—the recipient’s or its ultimate parent’s headquarters. Cloud computing is not categorically banned: BIS guidance describes fact-dependent licensing concerns when advanced-computing items or related services support AI training for specified D:5- or Macau-headquartered parties. As of October 2026, the key is to assess the chip, the entities, the end use, and any applicable authorization together.
What the controls regulate—and why cloud access can matter
U.S. export controls are not a simple list of countries where a particular chip may or may not be used. For advanced-computing items, the analysis can depend on technical characteristics and export classification, the destination and parties to a transaction, the item’s intended end use, and whether a license or an applicable exception is available. BIS—the U.S. Department of Commerce’s Bureau of Industry and Security—administers the relevant Export Administration Regulations (EAR).
A physical shipment is only one way a controlled item can move. BIS guidance also discusses reexports, in-country transfers, and certain U.S.-person support. Cloud infrastructure matters because an IaaS provider may operate servers containing advanced-computing items and make their capabilities available to customers training AI models. The relevant question is not simply whether a customer can reach a cloud service; it is whether the specific items and transaction facts trigger a requirement under the EAR.
That distinction matters for ordinary cloud users. The BIS materials described here do not establish that all cloud access, AI training, or use of a service by someone in a particular country is prohibited. Nor do they establish that every GPU, server, or cloud instance is controlled. A transaction-specific determination requires current rules and facts, including an adequate item classification.

How to assess a chip or cloud transaction
Use these questions to organize an initial compliance review. They are a framework for identifying issues, not a substitute for applying the current EAR to a particular transaction.
- Identify the item. Determine whether the chip, server, or other relevant commodity is covered by an advanced-computing control, using its technical characteristics and the applicable classification. A model name or a general description such as “AI GPU” does not settle the classification.
- Map the parties and locations. Record the shipment destination, the recipient, the parties to the transaction, and the relevant entity’s headquarters and ultimate-parent headquarters. Do not treat a company’s physical location as proof of where it or its parent is headquartered.
- Describe the end use and end user. Establish who will use the item or computing capability, what they will do with it, and whether the provider will train a model for or on behalf of another party. Consider whether a proposed change in use or user alters the analysis.
- Assess knowledge and support. BIS’s cloud-related guidance describes knowledge-dependent circumstances and certain U.S.-person support. Review what the parties know about the intended use and user, rather than assuming that the cloud provider’s location alone decides the matter.
- Check for authorization. Determine whether the EAR requires a license and whether a specific license exception or an entity-specific authorization applies. Do not assume that an exception is available just because a transaction resembles a lower-risk case.
If any of these facts is uncertain, pause before relying on a broad country-level summary. Current EAR text, country groups, license exceptions, entity lists, and authorization terms control the outcome; qualified export-control advice may be appropriate for a concrete transaction.
Which factors can change the result?
| Factor | Why it matters | Question to resolve |
|---|---|---|
| Item classification and technical parameters | BIS’s October 2023 public summary describes controls using performance and performance-density parameters, alongside related measures. The technical classification determines whether an item is within a relevant control. | What is the item’s classification under the current EAR, based on documented technical characteristics? |
| Destination | Destination controls and licensing requirements can apply to specified exports or reexports. BIS’s 2023 summary discusses Macau and arms-embargoed destinations, including China. | Where will the item be shipped, reexported, transferred, or used? |
| Recipient and ultimate parent | BIS’s May 31, 2026 guidance says the specified requirement reaches covered items destined for an entity headquartered in Country Group D:5 or Macau, or an entity whose ultimate parent is headquartered there, even when the entity is located elsewhere. | Where is the recipient headquartered, and where is its ultimate parent headquartered? |
| End user, end use, and knowledge | BIS’s May 2025 guidance describes circumstances involving AI training, IaaS providers, and knowledge of specified end users or end uses. Changes in end use or end user can also matter. | Who benefits from the computing, what activity will it support, and what do the parties know? |
| License, exception, or authorization | A license may be required unless an applicable exception or authorization covers the particular transaction. The terms and availability are specific, not general permissions for a category of cloud customer. | What exact EAR provision authorizes the transaction, and which conditions must be met? |
Why headquarters can matter even when the servers are elsewhere
Country Group D:5 is an EAR country-group designation that includes China; Macau is also identified separately in the BIS guidance discussed here. Under BIS’s May 31, 2026 explanation, a license requirement applies to specified advanced-computing items destined for an entity headquartered in D:5 or Macau, or for an entity whose ultimate parent is headquartered there, even if that entity is physically located in another country.

For example, a company operating outside China could still present a headquarters-related issue if its ultimate parent is headquartered in a covered location and the item falls within the specified controls. That example illustrates the relevance of the parent relationship; it does not establish that every such transaction is prohibited or that every chip is covered.

The May 2026 guidance identifies ECCNs 3A090.a and .b, 4A090.a and .b, and related .z items when discussing the earlier control history. Those references should not be used to classify a particular product by guesswork. Classification depends on the item and the operative EAR provisions, and BIS’s guidance says exporters should continue to seek licenses for covered transactions unless a specified exception is available.
How the rules reach cloud and AI-training arrangements
BIS’s May 13, 2025 industry guidance discusses exports, reexports, and in-country transfers of advanced-computing ICs and certain other commodities to IaaS providers when the provider will train AI models for or on behalf of parties headquartered in D:5 countries, including China, or Macau. It also addresses transfers involving changes in end use or end user, and certain U.S.-person support connected with relevant activities.
The guidance frames these concerns around transaction facts and knowledge. A provider’s involvement, the item, the intended training activity, the customer or beneficiary, and what the parties know can all matter. It is therefore inaccurate to describe the cited guidance as a blanket prohibition on cloud computing or on every AI-training workload associated with a covered country. It is equally unsafe to assume that putting servers in a different country eliminates a licensing issue.

For an IaaS provider, a practical review should distinguish the physical location of the equipment from the identity and headquarters of the customer or party receiving the benefit. It should also document the proposed workload and any known change in the user or use. The cited BIS guidance does not make a customer’s ordinary access alone proof that access is forbidden; the EAR and facts of the particular arrangement determine the result.

What changed after the 2025 AI Diffusion Rule announcement?
The timeline is important because the May 2025 announcement did not erase every earlier advanced-computing control.
- October 2023: BIS summarized revisions to earlier advanced-computing and semiconductor controls. Its public summary describes performance and performance-density parameters, licensing destinations, anti-circumvention measures, and the Notified Advanced Computing (NAC) exception for certain lower-performance items.
- January 15, 2025: BIS says it issued the AI Diffusion Rule on this date, with compliance requirements scheduled to take effect on May 15, 2025.
- May 13, 2025: BIS announced that its enforcement officials would not enforce the AI Diffusion Rule’s new compliance requirements. The agency said it planned to formalize rescission and issue a replacement rule in the future. The announcement concerned those new requirements; it did not itself cancel preexisting controls.
- May 31, 2026: BIS clarified that the preexisting license requirement for specified advanced-computing items linked to D:5- or Macau-headquartered entities remained in effect, including when the entity was located elsewhere. BIS also said bona fide data-center operators engaged in activities consistent with the EAR did not need to cease ongoing use, storage, disposal, or servicing of the relevant items because of that guidance, until further notice.
The NAC exception is not a general permission for all lower-performance chips or all destinations. BIS’s 2023 summary describes notification for exports and reexports to Macau and arms-embargoed destinations, including China, where NAC applies; use elsewhere can proceed without prior notification where the exception’s terms are met. The current EAR determines the operative conditions. Do not infer an exception from a chip’s marketing label or from the fact that a shipment is below a headline performance level.
What the Data Center VEU program does—and does not do
BIS describes the Data Center Validated End User (VEU) program as a route for eligible data centers to obtain facilitated access to predictable exports and reexports of eligible items. An applicant undergoes interagency review, and an authorization is specific to the approved entity and eligible items. It is not a blanket exemption for all facilities, cloud providers, or customers using their services.

Approval can come with conditions, including commitments concerning physical and logical security, on-site reviews, and reporting. A customer should not infer that its workload is authorized simply because a data-center operator has a VEU authorization; the authorization’s scope and conditions matter. The program is an entity-specific route for approved operators, not a general cloud-user license.

Due diligence and diversion risks for providers
BIS’s May 2025 diversion guidance points to checks that can help identify warning signs. These are compliance considerations described by BIS, not a universal checklist that by itself determines whether a license is legally required.
- Customer identity and ownership: Review incorporation date, ownership, and the identity of relevant transaction parties. A recently formed customer or opaque ownership may call for closer examination, but neither fact alone proves a violation.
- Business and proposed use: Compare the customer’s stated business with the proposed AI-training activity. Seek a credible explanation and customer certifications where appropriate, and investigate inconsistencies rather than treating a certification as conclusive.
- Facility and server capability: Consider server infrastructure and data-center attestations alongside the customer’s explanation. BIS says a facility capable of operating servers containing advanced ICs above 10 megawatts merits additional scrutiny. That figure is a due-diligence risk indicator—not a general licensing cutoff, a measure of which chips are controlled, or a statistical estimate of affected facilities.
- Ongoing changes: Reassess when a customer, end user, or intended activity changes. BIS’s guidance specifically addresses certain changes in end use or end user, so initial onboarding does not answer every later question.
Good records should make the reasoning traceable: the item classification, parties and ownership reviewed, destination, stated end use, relevant certifications or attestations, and the basis for any license, exception, or authorization relied upon. The appropriate scope of review depends on the transaction and applicable requirements.
Practical implications for buyers, providers, and data centers
For a business buying cloud compute
Ask the provider what service and infrastructure are involved, who the contracting and benefiting entities are, and whether the proposed workload raises export-control questions. If the business or its ultimate parent is headquartered in D:5 or Macau, the May 2026 guidance makes that relationship particularly relevant for specified items. Do not assume either that access is prohibited or that a foreign server location settles the question.

For an exporter or data-center operator
Check current EAR requirements and any applicable license exception before shipment or transfer. If relying on a VEU authorization, confirm that the entity and items are within its scope and that required security and reporting conditions are met. BIS’s May 2026 statement about continued operations applies to bona fide operators engaged in activities consistent with the EAR and is qualified by “until further notice”; it is not a new blanket authorization for all operators.
What a public summary cannot decide
BIS summaries and guidance explain the agency’s stated position, but they do not classify an individual chip, resolve every cloud arrangement, or replace the current EAR. A specific answer can depend on technical specifications, the applicable ECCN and rule text, country-group status, the identity and headquarters of relevant entities, the intended user and use, knowledge, and the precise scope of an exception or authorization.
For a live transaction, verify current EAR provisions and relevant lists, preserve the classification and end-use analysis, and obtain qualified export-control advice where needed. In particular, do not infer that a particular GPU or server is controlled—or uncontrolled—from its name, its supplier’s marketing description, or the location of a cloud region alone.
