Do not treat a seller’s assurance, a visual style, an artist photograph, or an image found online as proof of authenticity or permission. A reliable check combines documented provenance, confirmation of the relevant Nation or community, culturally informed guidance, image-specific rights clearance, community permission where appropriate, and precise attribution.
Protocols differ among Indigenous peoples and jurisdictions. The workflow below is designed for writers, editors, educators, researchers, collectors, and anyone deciding whether to publish, display, reproduce, or share Indigenous art or imagery.
What you are actually verifying
“Provenance” has two related but different meanings in this context. For an artwork, it is the documented history of creation, ownership, custody, and transfer. The Indigenous Art Code describes provenance as the history or chronology of ownership and points to certificates, receipts, and related records. For an image or cultural object, provenance also includes the route by which a museum, archive, website, photographer, or seller obtained and published it.

It may involve a specific Nation, tribe, band, language group, clan, family, community, or other authorized cultural body. Cultural context is not reliably inferred from appearance, motifs, geography, or a generic label such as “tribal.”

| Question | Evidence to seek | What a positive answer does not establish |
|---|---|---|
| Who made or created it? | A named artist or creator, supported by the artist, an authorized representative, or a reliable institutional record. | That the work is available for any intended use. |
| How did it reach the present holder? | Dated acquisition and transfer records, receipts, catalog entries, or other coherent ownership documentation. | That every transfer was culturally appropriate or legally unrestricted. |
| Which people and authority are relevant? | A specific Nation, community, language group, family, or cultural authority identified through reliable records and consultation. | That a general institutional contact can speak for that community. |
| What does the subject mean and what limits apply? | Community-informed context and explicit information about sacred, seasonal, gendered, confidential, deceased-person, or other restrictions. | That the material may be copied merely because it is visible online. |
| Can you use it? | Copyright, license, privacy, donor, collection, and community permissions that cover the exact proposed use. | That a copyright license alone resolves cultural concerns. |
Why an online image or a seller’s claim is not enough
A searchable page can omit the creator, change the caption, lack a rights statement, or reproduce material without authorization. Earlier publication is evidence that someone published it, not evidence that you may do so. A photograph of an artist holding a work can help connect a person to an object, but Australian buyer guidance specifically says it is not a Certificate of Authenticity.
Visual resemblance is also weak evidence. Artists from different communities may use related materials or techniques, while works from one community can vary widely. Do not assign identity from a pattern, title, clothing, accent, location tag, or a seller’s unsupported description.
The same caution applies to institutional catalogs. The National Museum of the American Indian explains that it may withhold images or information when sensitivities are known or suspected and follows restrictions communicated by authorized Indigenous community or tribal representatives. A record that contains an image is therefore not automatically a statement that the image is unrestricted.

Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Step 1: Define the object and your intended use
Before contacting anyone, make a one-page record of the item and the decision you need to make. This prevents a vague request such as “Can I use this?” from producing an answer that does not cover your actual publication.
- Save the original URL, collection number, accession number, filename, screenshot, or seller listing.
- Describe the work or image without guessing identity: medium, dimensions if known, title as displayed, date as stated, and what is visibly depicted.
- Record every attribution currently supplied, including spelling, diacritics, Nation or community name, and the name of the institution or seller.
- State where the material will appear: article, textbook, exhibition, social post, documentary, database, classroom presentation, product, or advertisement.
- Specify audience, territory, language, publication date, duration, print or digital format, and whether access will be open or restricted.
- Say whether the use is commercial, sponsored, monetized, or educational; whether you will crop, color-correct, translate, animate, overlay text, or create derivatives; and whether you expect to reuse it later.
Ask whether an image is necessary. If the status is uncertain or the subject may be restricted, a text description, a community-approved alternative, or no image may be the respectful choice.
Step 2: Build a documented chain of evidence
Collect the records
Request or download the catalog record, artist or creator details, documented date and place of creation, acquisition history, seller or repository information, certificate, receipts, previous licenses, and any restrictions attached to the record. Keep original files and note when and from whom each record was obtained.

For a museum or archive image, copy the institution’s exact rights statement and the record’s access notes. A catalog description may establish what an institution calls an object; it does not necessarily establish who owns copyright, whether a donor imposed conditions, or whether community permission is required.
Read certificates narrowly
In Australian Aboriginal and Torres Strait Islander arts market guidance, the Australian Government Office for the Arts says an artwork priced above AUD $250 should come with a Certificate of Authenticity. That threshold belongs to this Australian buyer guidance; it is not a universal rule for Indigenous art in every country or market. The certificate can support an authenticity or attribution claim in that transaction, but it does not by itself grant copyright, prove unrestricted reproduction rights, or settle cultural permissions.
Compare the certificate with the seller’s invoice, artist name, work title, medium, dimensions, date, and any catalogue or registry number. Record discrepancies rather than silently correcting them. If the seller cannot explain a gap or gives changing accounts, pause the purchase or publication.
Separate what each document proves
| Document or statement | May support | Still requires a separate check |
|---|---|---|
| Certificate of Authenticity | A market-specific attribution or authenticity assertion. | Copyright ownership, cultural authority, permission for your format, and future reuse. |
| Receipt or invoice | A dated transaction and the identity of the contracting seller or buyer. | Whether the seller had authority to transfer the work or license the image. |
| Museum catalog record | An institution’s identification, collection history, and published description. | Community approval, donor restrictions, current rights holder, and unrestricted image access. |
| Artist photograph or social post | A lead that may help locate the artist or work. | Formal authentication or permission to reproduce the photograph or artwork. |
| Existing license | The rights and conditions expressly listed in that license. | Community protocols, sacred or confidential status, privacy, and uses outside the license scope. |
Step 3: Identify the relevant community and cultural authority
Use the most specific identification the records support. Confirm preferred spellings, names, language-group terms, and whether a Nation, community, family, estate, cultural center, or other body is authorized to advise on this material. Do not substitute an outdated catalog term simply because it is easier to find.
The Dartmouth Libraries protocols emphasize that each tribe, band, and community is unique and that protocols must be interpreted with the relevant community. The practical consequence is that advice for one Nation cannot automatically be applied to another, even when the object type or region appears similar.
Ask the collecting institution which person or office can address the specific material. A general press, marketing, or licensing contact may be able to explain copyright administration but may not hold cultural authority. If the institution cannot identify an appropriate contact, request that it direct you to the authorized community representative rather than guessing from a public directory.

For a work by a living artist, ask the artist or authorized agent about the artist’s identity and cultural affiliation. For an older work, a deceased artist, or communal cultural material, the relevant authority may be an estate, family, Nation, community organization, or other body specified by that community. Do not assume that the current owner or a private seller can speak for all of them.
Step 4: Learn the context and ask about restrictions
Send the authority a clear description or low-resolution reference and explain the exact intended use. Ask whether the subject is:
- sacred, ceremonial, secret, or restricted to particular people;
- connected with burial, mourning, healing, initiation, or a deceased person;
- limited by gender, age, season, place, language, or ceremony;
- confidential knowledge or material that should not be indexed, translated, cropped, or separated from its context;
- appropriate for the proposed audience, territory, medium, and duration; or
- subject to required wording, warnings, attribution, payment, benefit sharing, or removal after a specified date.
The Canadian Conservation Institute notes that sensitivity may not be visually apparent and can depend on the object’s history and use. A photograph that looks ordinary to an outside viewer can therefore require special handling. If the authority says the status is uncertain, treat that uncertainty as a reason to pause, not as permission.

Prior informed consent and consultation, cultural integrity, attribution, and benefit sharing are explicit themes in the NSW Aboriginal Arts and Culture Protocols. The page states: “Through the direction these Protocols give, we can ensure that the NSW Aboriginal cultural sector will continue to grow and thrive built on the foundations of authority, agency and relevance.” That purpose does not replace community-specific instructions; it explains why consultation should occur before publication rather than after an objection.
Step 5: Clear legal rights and cultural permission as separate checks
Copyright and related legal conditions
Identify the copyright owner and confirm whether the proposed use is covered by a written license or another applicable legal exception. Check territory, duration, format, audience, commercial status, attribution wording, cropping or adaptation terms, and whether the license permits sublicensing or future reuse. Also check privacy, donor agreements, contracts, moral rights, and any collection-specific conditions.
Community permission and cultural protocols
Ask the relevant community or cultural representative whether the material may be accessed, reproduced, altered, translated, displayed, or circulated for your stated purpose. A museum’s permission may be necessary but does not, by itself, answer whether a culturally significant image should be made public. Conversely, community support does not transfer copyright that belongs to an artist, photographer, estate, or institution.

The Australian Museum’s image and licensing guidance illustrates the two-track process: it calls for consultation with relevant communities or cultural authorities when material contains Indigenous cultural content and also requires proof of external copyright permission when someone else holds the rights. Use that logic even when working outside Australia, while following the law and authorities of your own jurisdiction.
Step 6: Make a permission request that can be answered
Put the request in writing and attach the exact image or object identifier. Identify yourself, your organization, the deadline, and the people who will see the material. Describe every planned use, including edits and later reuse. Ask for a written response and state that you will follow any conditions, credit line, warning, fee, benefit-sharing arrangement, or takedown instruction.
Subject: Permission and cultural guidance for [object or image identifier]
I am [name and role] with [organization]. We would like to use [specific image/object] in [publication or project], for [audience], in [territory], from [date] to [date]. The use is [commercial/non-commercial], and we propose to [crop, caption, translate, animate, or otherwise edit] it as follows: [details].
Could you confirm:
1. the preferred artist, Nation, community, language-group, and collection attribution;
2. whether the subject has cultural, seasonal, gender, sacred, deceased-person, or confidentiality restrictions;
3. whether this exact use and audience are appropriate;
4. who owns copyright and what written license is required; and
5. any credit, warning, payment, benefit-sharing, storage, or removal conditions?
We will not publish until we receive guidance from the appropriate authority. Please tell us if another person or body should handle this request.
Do not pressure a contact to answer immediately, frame silence as consent, or publish confidential details about the consultation. Preserve the response, date, sender’s role, approved file, and scope of permission in your project record.
Step 7: Evaluate gaps before you decide
Use a separate status for each verification axis. A strong result on one axis cannot compensate for an unresolved failure on another.
| Axis | Confirmed | Partial | Unresolved |
|---|---|---|---|
| Creator attribution | The named artist or authorized source confirms the identification. | An institution or seller names the artist, but direct confirmation is unavailable. | No reliable creator identification or conflicting names. |
| Ownership chain | Dated transfers and supporting records form a coherent history. | Some transfers are documented, but a gap remains. | Accounts conflict, records are missing, or ownership is unknown. |
| Cultural provenance | The specific community and an appropriate authority are identified. | A Nation or group is named, but the route to authority is unclear. | Only a generic label, geography, or visual inference is available. |
| Context and restrictions | The authority addresses the subject and your audience and use. | General protocol is available, but the specific work or use is not addressed. | Potential sensitivity exists and no authorized response has been obtained. |
| Rights and permission | Copyright, license scope, and community permission cover the exact use. | One permission is documented while another is pending or limited. | No rights holder, license, or community authorization can be established. |
| Reciprocity and attribution | Credit, compensation, benefit sharing, and conditions are recorded. | Credit is known but other arrangements remain unclear. | The requested source will not confirm terms or the proposed use ignores them. |
Do not call an item “authentic,” “authorized,” or “free to use” when a material axis is partial or unresolved. Describe the limitation accurately, seek further guidance, choose a different image, or omit the image.

Step 8: Attribute the artist and cultural source precisely
Follow the approved credit line exactly. Where authorized and known, identify the artist or creator, relevant Nation or community or language group, collection or image source, copyright holder, and license. Preserve diacritics and the community’s preferred terminology. If a cultural source should be credited separately from the artist, do not combine the two into a vague label.

The WIPO-hosted visual arts protocol guide states: “Relevant Indigenous language groups or communities should be attributed for the use of their cultural heritage material in artworks.” Apply that principle only with the authority’s preferred wording and scope. Do not disclose a confidential consultant’s name or consultation details without permission.
If identity, ownership history, or cultural affiliation cannot be verified, say what is unknown in the caption or editorial note and avoid guessing. A transparent qualification is more accurate than a confident but unsupported attribution.
Use community-defined metadata and labels
Local Contexts Traditional Knowledge Labels can communicate cultural authority and conditions for access, use, and sharing. Read the label attached to the record, retain it when technically possible, and follow its instructions. A label is a protocol signal, not a substitute for asking when your proposed use is unclear, commercial, derivative, or broader than the label describes.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesWhen building a digital catalog, retain the label, approved credit, source URL, collection identifier, permission date, expiry date, and restrictions in the metadata. Do not strip those fields when exporting a file or posting a derivative. If your system cannot preserve them, document the conditions in the publication record and tell downstream users where the authoritative instructions are maintained.
Workflows for common situations
A museum or archive image
- Copy the record identifier, rights statement, sensitivity note, and source URL.
- Ask the institution which copyright holder and cultural authority address the material.
- Send the precise audience, territory, duration, edits, and commercial details.
- Wait for both the institution’s rights response and the relevant cultural guidance.
- Use the supplied file and credit line; do not download a different copy from an image search.
An artwork offered by a seller
- Request the certificate, receipt, artist details, ownership history, and any prior license.
- Compare names, dates, dimensions, medium, and work number across every document.
- Check whether the artist or authorized representative confirms the attribution.
- Identify the relevant community and ask about cultural restrictions before photographing or publishing the work.
- Obtain a separate written license for the photograph or reproduction if you did not create it or do not own its rights.
An image copied from social media or a personal website
- Save the original post and identify the account holder, photographer, artist, or institution.
- Ask who owns the image and artwork rights; do not assume the account holder owns both.
- Check whether the subject includes ceremony, deceased people, restricted knowledge, or another sensitivity.
- Request permission for the exact platform, caption, edits, audience, and duration.
- If the owner or authority cannot be verified, replace the image or use a non-visual description.
A classroom, newsroom, or tight deadline
Time pressure does not turn uncertainty into permission. Use a verified, appropriately licensed alternative; publish text while consultation continues; or delay the image. If an authority gives conditional approval by phone, ask for a written confirmation before publication and record the date, scope, and conditions.
Common failure modes and how to correct them
| Failure | Why it fails | Correction |
|---|---|---|
| “It looks Indigenous, so it must be from this community.” | Style and motifs do not establish creator or cultural affiliation. | Verify the named artist and community through records and an authorized source. |
| “It is online, so it is public domain.” | Visibility does not remove copyright, privacy, donor, or cultural restrictions. | Trace the rights holder and ask about cultural permission for the intended use. |
| “The certificate settles everything.” | A certificate is evidence for a particular attribution or market transaction, not a universal permission document. | Read its scope and complete the rights and community checks separately. |
| “The museum licensed the file, so community approval is irrelevant.” | Institutional rights and cultural authority can be different. | Obtain both permissions when the material carries Indigenous cultural content. |
| Using “tribal” or another generic label | It erases distinctions and may contradict the preferred terminology. | Use the specific Nation, community, language group, or a clearly qualified unknown. |
| Asking the nearest public contact to speak for a community | Administrative access is not necessarily cultural authority. | Ask the institution or community to identify the appropriate representative. |
| Publishing after a warning because no one objected | Silence is not informed consent, especially for sensitive material. | Pause, seek an authorized response, and choose a safer alternative if needed. |
| Cropping, translating, or recoloring without mention | Edits can remove context or violate the agreed use. | List every edit in the request and follow the approved version and conditions. |
Geography, law, and protocol limits
The guidance linked here comes from Canada, the United States, and Australia. It illustrates a shared practical emphasis on community authority, consultation, respectful attribution, and limits on access, but it does not create one universal Indigenous protocol or a complete legal rule for every country.
Apply the relevant Nation’s or community’s own authority and the law governing your publication, collection, contract, and audience. For a disputed ownership claim, high-value transaction, commercial campaign, or potential legal complaint, obtain advice from a qualified lawyer in the relevant jurisdiction. Keep legal advice distinct from cultural guidance: one cannot stand in for the other.

Publication go/no-go checklist
- The object or image is uniquely identified and its original source is preserved.
- The creator and ownership history are supported by records, with gaps disclosed.
- The specific Nation, community, language group, or other relevant authority is identified without guesswork.
- The authority has addressed the subject’s context and any sacred, seasonal, gendered, deceased-person, confidential, or other restrictions.
- Copyright, license, privacy, donor, and collection conditions cover the exact audience, territory, format, duration, and edits.
- Community permission or support is documented where culturally significant material is involved.
- The approved artist, cultural source, collection, and rights credit is ready to publish.
- Conditions, expiry dates, benefit-sharing terms, warnings, and takedown instructions are stored with the file.
If any material item remains unresolved, do not fill the gap with an assumption. Explain the uncertainty, seek the appropriate authority, or choose an image and description whose provenance and permissions can be demonstrated.
