Start with the legal issuer, not the token’s brand or the exchange listing. For a token that references the euro, check whether the issuer is an authorised credit institution or electronic-money institution (EMI), find the matching issuer and white paper in the European Securities and Markets Authority (ESMA) MiCA register, and confirm the licence in the relevant national register. A white paper appearing in ESMA’s register is disclosure evidence—not regulatory approval.

What you are actually verifying

“MiCA compliant” is not a single badge. You are testing several linked facts: what type of token is being offered, which legal entity issues it, whether that entity has the required financial-sector authorisation, whether the token’s white paper has been notified and published, and whether the offer or admission to trading is current and free of withdrawal or precautionary measures.

A euro-referenced stablecoin will generally be an e-money token (EMT) under the Markets in Crypto-Assets Regulation (MiCA). Article 48 requires an EMT issuer to be authorised as either a credit institution or an electronic money institution and to notify and publish a crypto-asset white paper in accordance with Article 51. MiCA also states that an EMT referencing an official currency of a Member State is deemed to be offered to the public in the Union.

The check is different if the token references a basket of currencies, commodities, crypto-assets, or another combination of assets. That may make it an asset-referenced token (ART), which follows the authorisation route in Article 16 rather than the EMT route. Do not classify a token from its marketing name alone; use the issuer’s current legal disclosures and white paper.

The evidence hierarchy: what proves what

Evidence What it establishes What it does not establish
ESMA MiCA register entry That ESMA has published a record for an EMT issuer, ART issuer, white paper, or crypto-asset service provider (CASP), including the fields shown in the record. That ESMA or a national competent authority reviewed or approved the white paper’s contents.
National credit-institution or EMI register The issuer’s underlying financial authorisation and its current status in the home Member State. That every token, offer, reserve arrangement, or exchange listing associated with the institution complies with MiCA.
Current white paper The disclosed issuer, token, currency reference, rights, redemption language, competent authority, and version/date. That the token is safe, fully reserved, profitable, or approved by a regulator.
Exchange or distributor listing That a platform says it offers or supports the asset. That the issuer is authorised. The platform may be a separate CASP with a separate regulatory status.
Issuer website or marketing statement The issuer’s own representation of its structure and status. Independent confirmation. Treat it as a lead to verify in official registers.

ESMA’s register rule comes from MiCA Article 109, which requires a public register of ART issuers, EMT issuers, crypto-asset white papers, and CASPs. ESMA’s interim register notice says that the crypto-asset white papers listed there “have not been reviewed or approved by any competent authority in any Member State of the European Union.”

Step 1: identify the legal issuer

Write down the exact entity that issues the token. A commercial token name, foundation, reserve manager, exchange, wallet provider, and distributor can all be different entities. Your first record should contain:

  • the issuer’s full legal name, including corporate suffix;
  • the jurisdiction and registered address, if disclosed;
  • the legal entity identifier (LEI), if one is shown;
  • the token’s commercial name and ticker;
  • the issuer’s stated website and the relevant legal or regulatory page; and
  • the exchange or distributor name, recorded separately from the issuer.

Copy the legal name and LEI character for character. Small differences—such as a parent company, branch, or similarly named subsidiary—can change which licence and competent authority you need to check. If the token page names only a brand, follow its terms, white paper, and redemption instructions until you find the legal entity. If you cannot identify one, stop: you do not yet have an issuer to verify.

Step 2: classify the token as an EMT or ART

When the EMT route normally applies

An EMT is a crypto-asset that purports to maintain a stable value by referencing one official currency. A token referencing the euro normally falls into this category. Under Article 48, the person making the public offer or seeking admission to trading must be the issuer and must hold credit-institution or EMI authorisation. The issuer must also notify and publish its white paper.

When to investigate the ART route

An asset-referenced token references a value or right, or a combination of them, including one or more official currencies, to maintain a stable value. A euro token that also references other assets or a basket may therefore require ART analysis. Article 16 has its own authorisation process and conditions. An ART authorisation granted by the competent authority is valid throughout the Union, but that does not turn an EMT into an ART or remove the need to identify the correct legal category.

Resolve borderline cases from the documents

Read the “reference asset,” stabilisation, redemption, and rights sections of the current white paper. Compare them with the issuer’s legal terms. If those documents conflict—for example, the marketing page says “euro-backed” while the white paper describes a multi-asset reference—treat the discrepancy as unresolved and seek clarification from the competent authority or qualified EU regulatory counsel.

Step 3: search ESMA’s public MiCA register

Use ESMA’s public MiCA register and search by the exact legal issuer name first, then by the token name and LEI. Article 109 covers separate categories, so make sure you are looking at the issuers of e-money tokens section rather than assuming a CASP record is an issuer record.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For the matching EMT entry, capture the fields that appear in the register:

  • legal issuer name and LEI;
  • token name and the associated white paper;
  • the start date for the offer or admission to trading;
  • the date of the credit-institution or EMI authorisation;
  • other crypto-asset services shown for the entity;
  • the home Member State and competent authority, where displayed; and
  • any withdrawal, precautionary measure, or status note.

Download or preserve the current register record and white paper version you relied on. Withdrawals of an ART, EMT, or CASP authorisation remain published in the MiCA register for five years, so an old entry is not automatically evidence of current authorisation. Read the status and dates rather than treating any search result as a permanent approval.

Step 4: independently verify the underlying financial licence

For an EMT, the decisive licence is the issuer’s authorisation as a credit institution or electronic money institution. Follow the competent-authority reference in the ESMA record or white paper to the relevant national register, then search that register independently using the exact legal entity and, where available, licence number or LEI.

Confirm that the national record shows:

  • the same legal entity—not merely a parent, brand, or exchange;
  • an authorisation category covering credit-institution or electronic-money activity;
  • the current status, including suspension, restriction, withdrawal, or surrender;
  • the home Member State and regulator; and
  • any branch or passporting information relevant to the offer.

A CASP authorisation can permit an exchange or other service provider to offer crypto-asset services. It is not a substitute for the issuer’s EMT authorisation. Likewise, a payment or money-services registration in a non-EU jurisdiction does not satisfy Article 48 by itself.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 5: reconcile the current white paper

Open the white paper linked from the register and compare it with the token’s legal and product pages. Record the version date and check whether the document is current, amended, or archived. At minimum, reconcile these items:

White-paper item Verification question
Issuer identity Does the legal name and LEI match the ESMA and national-register records?
Token identity Does the token name, ticker, and contract or network description match the asset you are evaluating?
Currency reference Does it reference only the euro, or a basket or other assets that could change the legal classification?
Rights and redemption Are holder rights, redemption mechanics, fees, timing, and limits stated clearly and consistently?
Competent authority Is the named authority the one connected to the issuer’s actual home Member State and licence?
Version and publication date Is this the version linked to the current register record and intended offer or admission?

Do not interpret publication in ESMA’s register as approval. The register is a transparency and disclosure mechanism; the quoted ESMA limitation applies even when the document is easy to find and appears alongside an issuer record.

Step 6: check dates, transition rules, and offer status

MiCA application date

ESMA and the European Commission identify 30 June 2024 as the start of application for MiCA Titles III and IV, which cover ART and EMT activities, subject to the regulation’s stated transitional provisions. A token launched before that date may have been subject to a national regime or a transition arrangement. That history does not remove the need to establish the issuer’s present status; check the relevant Member State’s transition treatment and the current register.

EMT notification timing

Article 48 requires an EMT issuer to notify its competent authority at least 40 working days before the intended public offer or admission to trading. This is a notification period, not a consumer-facing approval certificate. Record the intended or actual offer/admission date shown in the register and compare it with the white-paper version and the issuer’s launch information.

Do not import ART timelines into an EMT conclusion

For context, Article 21 provides that, after receiving the required opinions, a competent authority has 25 working days to take a fully reasoned decision on an ART authorisation application and 5 working days to notify the applicant. Those figures concern the ART authorisation process; they do not prove that an EMT issuer is authorised.

ART exemption threshold

Article 16 describes an ART exemption involving an average outstanding value below EUR 5,000,000 over a 12-month period, together with other conditions. Do not apply that threshold to an EMT or treat it as a general stablecoin safe harbour. Classification and all conditions must be assessed first.

Use a written verification record

A dated record prevents a later change to a register entry or white paper from being mistaken for the evidence you originally checked. Use a worksheet like this for each issuer:

Field Entry to preserve
Review date and time The date in UTC or your stated time zone.
Token Commercial name, ticker, network, and contract identifier if applicable.
Legal issuer Exact name, jurisdiction, address, and LEI.
Classification EMT or ART, with the document section supporting the conclusion.
ESMA record Category, record details, white-paper version, offer/admission date, and status.
Underlying licence National authority, register name, licence type and number, status, and verification date.
White paper Version/date, issuer match, currency reference, redemption language, and competent authority.
Warnings Withdrawals, precautionary measures, inconsistencies, missing fields, or unresolved questions.

Save the register extracts and the white paper version with the record. A later “current” page can change while the historical evidence remains relevant to a transaction, audit, or compliance decision.

Red flags that should stop the conclusion

  • Brand-only identity: the public page never names a legal issuer.
  • Entity mismatch: the ESMA record, white paper, and national licence use different legal entities or LEIs.
  • CASP substitution: the evidence proves only that an exchange or wallet provider is authorised.
  • Missing financial licence: no current credit-institution or EMI record can be found for an EMT issuer.
  • Classification conflict: marketing describes a euro token while the white paper references a basket or other assets.
  • Stale document: the linked white paper is archived, superseded, or inconsistent with the register’s current version.
  • Status warning: the register shows withdrawal, suspension, restriction, or a public precautionary measure.
  • Date gap: the claimed launch predates the relevant notification or authorisation evidence without a clear transitional explanation.
  • Unclear redemption rights: the document does not explain how and against whom holders redeem the token.

Do not convert a red flag into a “probably compliant” answer. Mark the result as unresolved and request clarification from the relevant authority or qualified EU regulatory counsel.

What a defensible conclusion looks like

Use precise language tied to the evidence you actually verified. For example:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Supported conclusion: “The legal entity named in the current ESMA EMT record matches the EMI entry in the home Member State’s register; the white paper, token identity, and offer date are consistent as of the review date.”
  • Limited conclusion: “The white paper is listed in ESMA’s register, but the underlying EMI authorisation has not yet been independently confirmed.”
  • Unresolved conclusion: “The token’s commercial page and white paper identify different issuers, so no MiCA authorisation conclusion can be reached until the discrepancy is resolved.”

Avoid saying “ESMA approved the stablecoin.” The accurate statement is that the relevant record and white paper are published in ESMA’s register, while the issuer’s financial authorisation must be confirmed with the competent national authority.

When to escalate

Escalate before buying, listing, distributing, or relying on the token when any material identifier differs: legal name, LEI, token name, licence number, authority, register status, or white-paper version. Also escalate when the issuer claims a transition arrangement that you cannot match to the home Member State’s published rules, or when a significant-token designation appears to alter the supervisory contact.

The appropriate escalation point is the relevant national competent authority or a qualified EU regulatory lawyer. Keep your evidence package—register extracts, white paper, dates, and screenshots or archived copies—so the question can be answered against the same documents rather than changing web pages.

Practical decision checklist

  1. Identify the exact legal issuer, jurisdiction, LEI, token name, and separate distributor or exchange.
  2. Classify the asset as an EMT or ART from the current white paper and legal terms.
  3. Find the issuer and white paper in the correct ESMA MiCA register category.
  4. Capture the record’s authorisation date, offer or admission date, version, and status warnings.
  5. Verify the issuer’s credit-institution or EMI authorisation in the home Member State’s current register.
  6. Reconcile issuer identity, token reference, redemption rights, authority, and version across all documents.
  7. Check the 30 June 2024 MiCA application context and any applicable national transition treatment.
  8. Record the result with a review date; do not rely on an old listing as proof of current status.
  9. Pause and escalate every unresolved discrepancy instead of treating a platform listing or white paper as approval.

Bottom line: the three-register test

A euro stablecoin issuer is not verified merely because the token trades on a regulated-looking platform or has a MiCA white paper. A defensible check connects three pieces: the same legal issuer in the ESMA MiCA register, a current credit-institution or EMI authorisation in the relevant national register, and a consistent current white paper covering the token and offer. Record dates and warnings, and treat any mismatch as unresolved until the competent authority or qualified counsel confirms the position.
