Start with the product’s classification, not the word “seeds.” In India, CBIC’s rate entries include a nil-GST category for seeds, fruit and spores of a kind used for sowing, and CBIC separately identifies seed-quality maize as nil-rated. That does not make every seed-related product tax-free. Seed type, quality, intended use, processing and any bundled goods or services can change the classification.

To check a charge, preserve the transaction evidence, inspect the invoice, identify what was actually supplied, ask the seller to state the HSN/classification and rate, and request an invoice-linked correction if the seller accepts an error. Use GSTN support for a GST-system problem; use the National Consumer Helpline for an unresolved grievance against the seller.

What the GST charge depends on

A receipt that says only “seeds” is not enough to decide whether GST was correctly charged. The relevant question is what the goods are, how they are classified, and what they are intended for.

Seeds intended for sowing

CBIC’s rate schedule lists “seeds, fruit and spores, of a kind used for sowing” in a nil-rate category. The wording is important: the entry is about the kind and use of the goods, not simply the presence of a seed in the product.

CBIC Circular 163/18/2021-GST discusses vegetable seeds, ornamental flower seeds and fruit-tree seeds as examples of seeds of a kind used for sowing. Its discussion of tamarind seeds illustrates why intended use matters: tamarind supplied for sowing is a different classification question from tamarind supplied for another use.

Seed quality and specified entries

The CBIC schedule also contains nil-rate entries for “all goods of seed quality” in specified chapters. CBIC’s rate FAQ gives a narrower example: maize of seed quality under heading 1005 attracts nil GST. Treat that as an example tied to the stated heading and quality, not as a universal decision for every product marketed as maize seed or every seed product.

Products that are not simply sowing seed

A product can contain seeds yet be supplied for food, processing, extraction, decoration, animal feed, a growing kit, or another purpose. Processing, packaging, treatment, germination status, and a bundle containing pots, soil, tools, delivery or other services may also require separate classification. The official entries do not establish nil GST for every such combination.

Tax schedules and notifications can change. Before relying on a classification in an actual dispute, compare the invoice with the current CBIC entry and any applicable notification.

Fast check: what to compare before contacting the seller

Question Evidence to use Why it matters
What exactly was supplied? Invoice description, product page, packet label and photographs “Seeds” is too broad to establish a rate.
What was the represented use? Words such as “for sowing,” “vegetable seed,” “food,” or “ornamental” in the listing and packaging Intended use is part of the sowing-seed classification analysis.
Is it seed quality? Seed certification or quality wording, crop and chapter/heading information supplied by the seller Some nil-rate entries are limited to goods of seed quality or specified headings.
What classification did the seller use? HSN or other classification shown on the invoice or supplied in writing You need to compare the seller’s asserted entry with the CBIC schedule.
Is the tax for seeds alone? Line items for goods, delivery, kits or services A bundled charge may not have the same treatment as qualifying sowing seed.

Step 1: preserve the transaction evidence

Save the invoice or receipt before asking for a change. Also keep the order confirmation, product page, packet or label photographs, proof of payment, delivery record and every message with the seller. Write down what the seller represented the goods to be used for—for example, sowing vegetables, eating, processing or decoration.

30 Packs of Deluxe Valley Greene Heirloom Vegetable Garden Seeds Non-GMO(Guaranteed 30 Different Varieties as Listed)
  • Includes 30 Different Varieties! 30 Packs of Seeds!
  • High Germination Rate within 7-14 days
  • All Seeds are Heirloom, 100% Non-GMO (Non Genetically Engineered)
  • Create a Deluxe Vegetable Garden
  • All seeds are dated Sell By December of the year you are purchasing them in but if kept in a cool dry place seeds typically stay viable for years

This record is practical preparation rather than a special seed-specific legal checklist. It lets you show that the item described on the invoice matches, or differs from, the item that was advertised and delivered.

  • Keep the original file, not only a screenshot that could omit the tax lines.
  • Photograph the front and back of the packet, including variety, crop, quality and use statements.
  • Record whether several products were sold on one invoice and which line carries the tax.
  • Note the seller’s legal name and the date and method of payment.

Step 2: inspect the invoice line by line

CBIC’s sectoral FAQ summarizes the core invoice details you should be able to identify:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Invoice field What to check
Supplier identity Supplier’s name and GSTIN. Check that the name is consistent with the seller you paid.
Invoice identity Invoice number and date. Record them exactly; they are needed for a correction request.
Goods description and value Whether the line says what you bought, the quantity, unit price and taxable value.
Tax rate and amount The stated GST rate and the tax amount, including any split between central and state components where shown.
Signature The signature or prescribed authentication shown on the document.

Also look for an HSN or classification reference, although the decisive issue is whether the classification actually describes your goods and their use. A neat-looking invoice does not prove that its rate is correct.

Do not use the wrong CBIC verification page

CBIC’s document-verification service asks for an issue number in the prescribed format printed on an official CBIC communication. It is designed to verify CBIC-issued documents, not to perform a general lookup of a shop’s invoice. An invoice that cannot be checked there is not, by itself, evidence of fraud.

Step 3: classify the actual product

  1. Read the product and packet wording. Capture statements about crop, seed quality, germination, treatment and intended use.
  2. Separate the seed from other components. List soil, trays, pots, nutrients, tools, testing, delivery or other services shown on the same order.
  3. Match the use to the CBIC wording. Ask whether the goods appear to be seeds of a kind used for sowing or instead a commodity supplied for another purpose.
  4. Ask for the seller’s HSN and reasoning. The seller should identify the entry relied on, not merely repeat “GST applies.”
  5. Check the date. Use the schedule and notifications in force for the invoice date, since a later rate change may not answer an earlier transaction.

For example, a packet clearly sold as vegetable seed for planting is factually different from a food item containing vegetable seeds. Likewise, “maize seed” should be tested against the seed-quality and heading conditions in the CBIC FAQ example rather than assumed to be nil-rated from the label alone.

How to read the relevant CBIC categories

CBIC material What it supports What it does not prove
Rate schedule: seeds, fruit and spores of a kind used for sowing A nil-rate category exists for qualifying sowing goods. That every item containing a seed, or every seed-related service, is nil-rated.
Rate schedule: all goods of seed quality in specified chapters Some specified seed-quality goods have nil-rate treatment. That a seller’s “seed quality” description automatically satisfies the relevant chapter or heading.
Circular 163/18/2021-GST Vegetable, ornamental flower and fruit-tree seeds are discussed as seeds of a kind used for sowing; intended use distinguishes other supplies such as tamarind for non-sowing use. A ruling on every crop, package, processing method or commercial arrangement.
CBIC rate FAQ: maize of seed quality under heading 1005 A specific example of nil GST when the stated classification and quality apply. A universal nil rate for all maize, all agricultural inputs or all products called seed.

If your product does not fit these descriptions, do not force it into a nil category. Ask the seller to identify the alternative entry and explain why it applies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 4: ask the seller to explain and correct the charge

Send a written request through the seller’s support channel or email so that the question and the response are recorded. Include:

  • invoice number and date;
  • the exact line description, quantity and amount;
  • the GST rate and tax amount charged;
  • the product’s packet or listing description and intended use;
  • the HSN/classification entry you believe may be relevant; and
  • a request for the seller’s classification and the reason for applying the charged rate.

Use neutral wording. You are asking for a classification explanation, not declaring that the seller committed fraud.

Subject: GST classification review for invoice [invoice number]
Please review the GST charged on the seed line in invoice [invoice number], dated [date]. The product is described as [description] and was represented as being for [intended use]. The invoice shows [rate] GST and tax of [amount]. Please confirm the HSN/classification used and explain why that rate applies, taking into account the CBIC entry for qualifying seeds of a kind used for sowing, if applicable. If the invoice was classified incorrectly, please issue the appropriate corrected invoice or invoice-linked adjustment and explain how the excess amount will be resolved.

Attach the invoice and product evidence, but keep the originals. Give the seller a reasonable written opportunity to respond and retain the case number or acknowledgement.

What a correction should look like

If the seller agrees that the original tax treatment was wrong, ask for a corrected invoice or the appropriate invoice-linked adjustment rather than an unexplained change to the order total. GST Rule 53 sets out particulars for credit and debit notes, including reference to the original invoice and the tax amount credited or debited. The adjustment should therefore identify the original transaction and show the tax correction clearly.

Rule 53’s documentation requirements do not, by themselves, decide whether you are legally entitled to a particular cash refund, how the seller will pass through the adjustment, or how quickly it must happen in your individual transaction. Ask the seller to state whether the resolution is a credit note, refund, account adjustment or another mechanism, and keep proof of what was actually provided.

Check the revised paperwork

  • Does the correction refer to the original invoice number and date?
  • Does it identify the affected product and tax amount?
  • Does the revised total reconcile with the payment already made?
  • Is the corrected document issued by the same supplier or clearly linked to the supplier’s account?
  • Have you received the amount or credit promised, rather than only a verbal assurance?

Step 5: choose the right escalation route

GSTN self-service portal: GST-system problems

Use the GSTN self-service portal when the problem concerns a GST service or system—for example, difficulty using a portal function, an error while submitting information, or a support issue that the portal’s guidance does not resolve. Search the issue guidance first. If it does not solve the problem, lodge a complaint and save the ticket reference. Use the portal’s status function to track that ticket.

A GSTN ticket is a support case for the GST system. It is not a consumer-compensation process and does not decide, by itself, whether a seller charged the correct rate or must refund you.

National Consumer Helpline: unresolved seller grievance

For a dispute with the seller—such as refusal to explain the rate, refusal to correct an acknowledged billing mistake, or failure to resolve the transaction—use the Department of Consumer Affairs’ National Consumer Helpline as a pre-litigation grievance channel. The department lists toll-free 1915 and web, WhatsApp, SMS, email, app and UMANG routes. Confirm the current contact details and operating options on the department’s official page before submitting a complaint.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Include the invoice, payment proof, product description, your written request, the seller’s reply or non-response, and the remedy you seek. Keep the complaint focused on the transaction and identify the amount of tax in dispute.

If the GSTIN or invoice looks suspicious

Official GST e-invoice guidance recommends checking supplier GSTIN details and the applicable rates when assessing invoice legitimacy. Compare the GSTIN, legal name, invoice number, date, line items and tax arithmetic. An unfamiliar layout or an invoice that cannot be verified through CBIC’s document-verification page is not conclusive proof of fraud, because that page is for CBIC-issued documents carrying its required issue number.

Escalate carefully if the supplier identity, payment destination and document details do not match. Preserve the original files and communications; do not alter an invoice before asking the issuer to explain it.

How to compare two conflicting explanations

When a seller, marketplace or accountant gives a different answer, compare the explanations on the same factual basis:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Comparison axis Question to ask
Exact product and classification Are both parties classifying the same goods under the same HSN or heading?
Intended use and quality Does one explanation assume sowing seed while the other treats the goods as food, processing material or non-seed quality?
Invoice versus packaging Does the invoice description match the packet and order listing?
Scope of the charge Is one rate being applied to a bundle that includes goods or services beyond the seeds?
Official basis Which CBIC schedule entry, clarification or notification is cited, and was it in force on the invoice date?

A rate comparison is unreliable when the products or uses are not the same. Request a written explanation that addresses each difference rather than relying on a generic statement that “seeds are exempt” or “agricultural products are taxable.”

Common mistakes and how to avoid them

  • Assuming every seed is nil-rated: Check use, quality, heading and the actual goods supplied.
  • Relying on the product title alone: Read the packet, detailed description and line-item breakdown.
  • Ignoring bundled items: Separate qualifying seeds from kits, materials, delivery or services.
  • Using CBIC document verification as an invoice lookup: That service is for CBIC documents with the required issue number.
  • Demanding a refund before establishing the classification: First ask the seller to identify the HSN and rate basis.
  • Expecting GSTN to order compensation: GSTN handles GST-system support; a seller grievance belongs with the consumer-helpline route.
  • Deleting the original evidence: Keep the invoice, packet, payment proof and correspondence together.
  • Quoting an old rate without checking the invoice date: Verify the current and transaction-date entries and notifications.

A compact record for your case

Before escalating, make a one-page chronology:

  1. Purchase date, seller name and order or invoice number.
  2. Exact product description, quantity, price and intended use.
  3. GST rate and tax amount shown on each relevant line.
  4. CBIC entry or clarification you asked the seller to consider.
  5. Date of your correction request and the seller’s response.
  6. Adjustment promised, received or still outstanding.
  7. GSTN ticket number or National Consumer Helpline reference, if used.

This chronology prevents a classification dispute from becoming a document dispute and gives an escalation channel the facts it needs to identify the transaction.

Bottom line for a seed-purchase GST check

Check the invoice, then classify the actual goods by seed type, quality and intended use. Qualifying seeds of a kind used for sowing—including the vegetable, ornamental-flower and fruit-tree seed examples discussed by CBIC—can fall in a nil-rate category, while other seed-related goods may not. Ask the seller to identify the HSN and explain the charge; if an error is accepted, request a correction tied to the original invoice and documented under the applicable credit/debit-note particulars. Escalate a GST-system problem to GSTN, and an unresolved seller grievance to the National Consumer Helpline.
