To verify a claim about an ICE encounter, pin down exactly what is being alleged, then compare records and accounts that can independently establish different parts of the story. ICE’s detainee locator can help check whether someone is currently in custody within the system’s limits; its enforcement dashboards report defined aggregate categories; and policies describe procedures. None alone proves every detail of a specific encounter.
Start by defining the claim
Write down the exact claim before searching. Note the alleged date and location, who made the claim, which agency is said to have been involved, and what facts are disputed. Preserve original URLs, timestamps, screenshots, and any available unedited media. Treat these as leads, not confirmation.
Break a broad claim into checkable questions: Was a person taken into custody? Which agency recorded or carried out the action? When and where did it happen? What is alleged to have occurred during the encounter? Different records may answer different questions.
Check an individual’s custody separately from enforcement statistics
For a named person’s current custody
Use the ICE Online Detainee Locator System (ODLS) as a limited custody lookup. ICE says it covers people currently in ICE custody and people in CBP custody for more than 48 hours; it cannot search for anyone under 18. A biographical search requires the person’s exact first and last names and country of birth. ICE also describes the locator as covering people released from ICE custody within the previous 60 days in its attorney information and resources.

A result can support a claim about custody within the locator’s scope at the time of the search. A failed search does not establish that no encounter or detention occurred: age, timing, custody status, and matching details limit what the system can show. It is not a complete historical record.
For claims about numbers of arrests, detentions, or removals
Use the relevant ICE Enforcement and Removal Operations statistics dashboard, and check its category definitions, geography, and time period before comparing figures. Arrests, detention, removals, and alternatives to detention are distinct categories; a count for one is not evidence of another.

ICE says dashboard data are published one quarter in arrears, may fluctuate before the fiscal year is locked, and may be superseded by later quarter-end or year-end reporting. A dashboard value is therefore not a real-time count. Preserve the reporting period and category when describing a figure.
Find records beyond the locator or dashboard
Search agency publications and publicly available FOIA reading-room records first. FOIA.gov advises: “Before making a request, first see if the information is already publicly available.” Start with FOIA.gov guidance on finding records and choosing the right agency.

Request records from the organization likely to hold them. ICE may hold its operational records and records about implementation of its directives; DHS’s Office of Inspector General holds records created or maintained by that oversight office; another federal component may hold its own records; and state or local agencies may have records they created. One agency’s response cannot be assumed to include another agency’s files.
Make a focused FOIA request
When the records are not already public, describe the incident as precisely as possible: date range, location, agency or unit if known, record types, and identifiers that help locate the event. Depending on the claim, potentially relevant records include:

- Incident or arrest reports.
- Dispatch or communication logs.
- Policies in force at the time.
- Body-camera or other agency video.
- Records of communications between agencies.
Ask for reasonably segregable portions if records include material that may be exempt. FOIA does not guarantee full disclosure: exemptions can cover privacy and law-enforcement interests, the agency must have custody of the records, and response times vary with scope and workload. The DHS FOIA handbook provides additional agency request guidance, including identity-documentation considerations.

ICE Directive 19010.3, dated February 18, 2025, addresses body-worn-camera records and public release. It says records are subject to applicable laws, including FOIA and the Privacy Act, and describes review and coordination before release. Footage of serious bodily injury or death in custody is to be reviewed expeditiously; ICE may expedite public release if it determines that release is in the agency’s best interests. The directive also permits withholding or indefinite delay in specified compelling circumstances.

The directive is evidence of the agency’s process, not proof that a recording exists, covers the event, or will be released. A request or policy cannot establish what footage would show before the recording and its provenance are assessed.
Corroborate the account across independent sources
Compare sources created by different actors for different purposes. Depending on the disputed facts, useful material may include agency records, court filings, contemporaneous reporting that identifies its sources, original media with clear provenance, and eyewitness accounts that explain what the witness directly observed.
For each item, check whether it concerns the same person and event; verify dates and locations; determine whether media is complete or edited; and distinguish firsthand observation from inference or repetition of someone else’s account. An agency record is authoritative about what the agency recorded, but it is not automatically an independent account of every disputed detail.
Assess each source on its own terms
- Proximity: Is the account firsthand, or does it rely on another source?
- Timing: Was it created close to the event, or reconstructed later?
- Provenance: Is the original document or full media available, and can its origin be checked?
- Scope: What exactly does the record or statistic cover?
- Independence: Do apparently separate accounts rely on the same underlying source?
- Omissions and incentives: Are records redacted or incomplete, and does the source have a reason to emphasize a particular account?
If accounts conflict, describe the disagreement and the evidence supporting each account. State what is established, what remains disputed, and what a source cannot establish. Do not convert a custody lookup, aggregate dashboard, policy, or single clip into a complete account of an encounter.
Use related ICE custody resources where relevant
ICE’s Detain overview links to facilities, death reports, inspections, and related custody resources. These may help locate records relevant to a particular question, but each resource has its own scope and should be assessed against the claim being checked.
