Do not treat an AI-generated citation as legal authority. Treat it as a lead, locate the actual opinion in an authoritative source, and verify the case identity, citation, quoted language, holding, later treatment, precedential status, and applicable filing rules. A responsible human must complete that review before the authority is relied on in advice or filed in court.
This matters because a plausible-looking result can conceal a nonexistent case, a wrong citation to a real case, an altered quotation, a holding that does not support the proposition, a mistaken jurisdictional attribution, or a precedent later limited or overruled. The following workflow is designed for legal professionals, clerks, researchers, and technology teams checking AI-assisted research across jurisdictions.
Why an AI citation needs more than an existence check
Generative systems can produce fictitious cases, citations, quotations, and references to nonexistent legal sources. They may also state that an answer is accurate when it is not. The Federal Court of Australia warns about each of these risks in its guidance for proceedings before that court. The problem is not limited to completely invented authorities. An AI answer can identify a real decision but attach the wrong reporter information, quote words the court never used, describe dicta as a holding, or assign the decision to the wrong court.

- Does the authority exist? The opinion, order, or published decision must be located in an authoritative source.
- Is it the same authority? Party names, court, date, docket or reporter information, and pinpoint must match.
- Does the text say what the answer claims? The relevant passage and its surrounding reasoning must support the proposition.
- Is the quotation exact? Words, punctuation, omissions, and pinpoint references must be checked against the opinion.
- Can the authority still be used that way? Later decisions may overrule, limit, distinguish, or otherwise affect it.
- Does it bind the relevant court? The deciding court and the issue determine whether the decision is binding or merely persuasive.
- Can it be filed under the current rules? Court-specific disclosure, certification, formatting, and AI-use requirements may apply.
Each question can have a different answer. A real case is not automatically support for the proposition in which an AI system places it.
A step-by-step verification workflow
1. Locate the actual authority
Start with the case name, reporter citation, docket number, court, and date supplied by the AI output. Search those details in an authoritative legal database or the court’s own source. Open the opinion itself rather than relying on a search-result summary, an AI-generated case page, or the model’s assurance that the case exists.
Search variations are useful when the citation is incomplete: try both party names, a distinctive phrase from the alleged quotation, the docket number without punctuation, and the court and decision date. If no authoritative source produces the opinion, stop treating the citation as usable authority. Do not repair a missing case by guessing at a similarly named decision.

Compare the AI output with the document you found. Confirm both parties in the correct order, the deciding court, the decision date, the docket or reporter citation, and the cited page or paragraph. Check whether the document is an opinion, order, memorandum, or amended decision, because the document type can affect what was actually decided.
A citation can be wrong even when a real case with a similar name exists. Record the correct citation exactly as it appears in the authoritative source and investigate any mismatch before moving on. If the AI supplied a parallel citation, verify each parallel reference rather than assuming that one accurate reference makes the others accurate.

3. Read the relevant passage and its context
Resolve the citation, then read the cited language and enough of the surrounding reasoning to understand the issue, facts, procedural posture, and disposition. Identify the proposition the authority is supposed to support and ask whether the court actually decided that proposition.
Distinguish a holding from background discussion, a party’s argument, a hypothetical, or dicta. Check whether the case involved a different statute, contract, procedural posture, or factual limitation. A sentence can appear to support a broad rule when the court adopted a narrower rule tied to the facts before it.
4. Verify every quotation and pinpoint
Search the opinion for the exact words supplied by the AI. Compare capitalization, punctuation, footnote references, ellipses, brackets, and omitted material. Confirm that the pinpoint identifies the page, paragraph, or section where the words actually appear.
Read beyond the quoted sentence. An excerpt can reverse or qualify its apparent meaning when the preceding or following text is included. If the words cannot be found, do not silently rewrite the quotation. Remove it, replace it with language you have personally confirmed, or quote the correct passage with a new pinpoint.
5. Check subsequent treatment
Use a reliable citator or equivalent research source to check what happened after the decision. KeyCite and Shepard’s are examples of services used for this purpose. Review whether a later court overruled, limited, distinguished, criticized, vacated, or otherwise affected the decision, and read the later treatment rather than relying solely on a color or status symbol.

Assess whether the later history matters to the precise proposition you plan to use. A decision may remain persuasive on one issue while being rejected on another. Record the most relevant later authorities and the date on which you performed the check, because treatment can change.

Identify the court that issued the decision and the court in which you intend to rely on it. Determine whether the authority is binding, persuasive, unpublished, nonprecedential, or subject to a jurisdiction-specific restriction. Do not infer binding force from the case’s prominence or from an AI statement that it is controlling.
Check the governing hierarchy for the issue: constitutional provisions, statutes, regulations, controlling higher-court decisions, and applicable local authority may change the analysis. Verify that the authority addresses the same jurisdiction and legal question. Misattributing a state decision to a federal court, or treating an out-of-jurisdiction decision as mandatory, can materially distort a filing.
7. Check the court’s current filing rules
Before filing, review the rules, standing orders, practice notes, and judge-specific instructions for the particular court. Requirements can cover disclosure of AI assistance, certifications, affidavits, evidentiary use, confidentiality, or the form of citations. Court-specific directions control over generalized internet advice.
The Federal Court of Australia’s practice note contains defined disclosure provisions for specified evidentiary uses and allows the Court to require disclosure in other circumstances. That guidance applies to proceedings before that court. U.S. requirements vary among federal and state courts, districts, judges, and case types, so check the instructions that govern your matter on the filing date.

8. Keep a reproducible review record
For each authority you rely on, preserve the source you checked, the exact passage and pinpoint reviewed, the later-treatment search, and the jurisdictional conclusion. Keep the AI prompt and generated text when AI contributed to the submission, subject to confidentiality and records-retention obligations.
A useful record identifies:
- the authoritative opinion or order and access date;
- the verified case name, court, date, docket or reporter citation, and pinpoint;
- the proposition supported and the passage that supports it;
- the quotation as checked against the opinion;
- the citator or equivalent source used and the later treatment found;
- the binding or persuasive status in the filing court;
- the court rules and standing orders reviewed for AI disclosure or certification; and
- the human reviewer responsible for the final decision.
What each research source can and cannot establish
No single interface answers every verification question. Use sources for the functions they perform best, then apply human legal judgment.

Automated citation checkers can help locate discrepancies, but the available guidance does not establish that an automated checker alone can replace reading the primary opinion and exercising legal judgment.

Federal Court of Australia guidance
Section 4.4 of the Federal Court of Australia practice note states: “The presentation of false or inaccurate information to the Court is unacceptable.” Section 4.5 directs the responsible person to confirm, among other things, that cited legal authorities exist and support the proposition stated. The note also addresses disclosure in specified evidentiary circumstances and permits the Court to require disclosure in other circumstances.
That language is a court-specific instruction, not a universal rule for every jurisdiction. It illustrates the basic responsibility that applies whenever a person presents authority to a court: the person responsible must verify what is filed and comply with the court’s own directions.

Reported U.S. guidance
ABA practice commentary attributes this statement to the Noland court: “no brief, pleading, motion or any other paper filed in any court should contain any citations—whether provided by generative AI or any other source—that the attorney responsible for submitting the pleading has not personally read and verified.” Treat that wording as a reported quotation and consult the underlying decision before using it as primary authority. Its practical message is clear: the source of a citation does not transfer the attorney’s verification duty.
Case example: Mata v. Avianca
In Mata v. Avianca, the U.S. District Court for the Southern District of New York found that counsel submitted nonexistent opinions with fabricated quotations and citations produced by ChatGPT. The court emphasized that existing procedural rules already place an accuracy gatekeeping responsibility on attorneys. It imposed sanctions under Federal Rule of Civil Procedure 11.
The sanctions order imposed a $5,000 penalty in 2023. That amount was specific to the case and is not a general schedule of penalties for AI-assisted research. The lesson is not that every citation error produces the same monetary consequence; it is that AI assistance does not excuse a filing that contains authority counsel has not personally checked.

A practical pre-filing checklist
Use this checklist for every AI-assisted authority that remains in a memorandum, brief, pleading, motion, declaration, or submission:
- Open the actual opinion or order in an authoritative source.
- Match the case name, court, date, docket or reporter citation, and pinpoint.
- Read the cited passage and enough context to identify the actual holding.
- Search and compare every quotation word for word.
- Confirm that the authority supports the proposition as written, including any factual or procedural limits.
- Run a current citator or equivalent later-treatment check and read the relevant citing decisions.
- Determine whether the authority is binding, persuasive, unpublished, or otherwise restricted in the filing court.
- Review the court’s current rules, standing orders, and judge-specific instructions for AI disclosure, certification, and citation requirements.
- Preserve the source, pinpoints, later-treatment results, prompts, generated content, and reviewer identity.
- Have the responsible human reviewer approve the final citation before filing.
Bottom line for legal teams using AI
AI can accelerate issue spotting and produce useful research leads, but it cannot authenticate a case, interpret a holding, evaluate later treatment, or satisfy a court’s filing rules on its own. The safe standard is simple: verify the primary text, verify the proposition, verify the authority’s current status, verify the governing court rules, and make a responsible human accountable for the final work.
