Before paying anyone for U.S. immigration help, verify who is authorized to advise or represent you, where that authority applies, what work you are buying, and how your payment and records will be protected. A website, business card, or title such as “visa consultant” does not establish legal authority. Check an attorney’s active license with the relevant U.S. jurisdiction, or confirm a non-attorney representative on the Department of Justice (DOJ) recognition and accreditation rosters. Then match that authority to your case, sign a detailed written agreement, keep copies and receipts, and stop when you see promises of guaranteed approval or special access.
This guide covers services for matters under U.S. federal immigration law. Licensing and representation rules in other countries can be different.
What authority must an immigration provider have?
Immigration assistance is not a regulated activity merely because someone advertises it. For proceedings before the Executive Office for Immigration Review (EOIR), the people who may represent you include attorneys who are licensed and in good standing and DOJ-accredited representatives working through recognized organizations. EOIR’s consumer guidance states: “Notarios, document preparers, immigration consultants, and travel agents are not allowed to practice law.” Read the full explanation at EOIR’s representation guidance.

Attorney versus accredited representative

DOJ recognition is not a quality endorsement. It qualifies an organization to provide services through accredited non-attorney staff under federal rules. An organization that provides services only through attorneys does not need DOJ recognition. DOJ reported approximately 850 recognized organizations and 2,290 accredited representatives in August 2023; those historical program figures are not a current count, a quality ranking, or a measure of fraud.
Step 1: Identify who will actually advise or represent you
Ask these questions before discussing payment:
- What is your full legal name?
- Are you an attorney or a DOJ-accredited representative?
- If you are an attorney, which U.S. jurisdiction licensed you?
- If you are accredited, what recognized organization employs or hosts you?
- Will you personally do the work, or will another person prepare or review it?
- Can you advise or appear for this matter before U.S. Citizenship and Immigration Services (USCIS), EOIR immigration court, or the Board of Immigration Appeals (BIA)?
Request the answers in writing. A company name, “visa expert” label, notary commission, business registration, or polished website cannot replace an individual credential check. Be especially careful when the person avoids giving a full name, changes the proposed provider after you ask for credentials, or says verification is unnecessary because they have “connections.”
Step 2: Verify an immigration attorney’s license and good standing
Use the licensing jurisdiction’s official record
Ask which U.S. state, territory, or other jurisdiction issued the attorney’s license. Search that authority’s current attorney directory or disciplinary record using the attorney’s exact name and, where available, bar number. Confirm that the record identifies the same person who will handle your case and shows an active license and good standing. An attorney licensed in one jurisdiction may not automatically be authorized to practice in every forum or provide every service, so ask how the license covers your matter.
EOIR’s Attorney Licensing Verification page links to jurisdiction resources and notes that some jurisdictions require verification by telephone rather than an online search. Follow the licensing authority’s own procedure; do not rely solely on a directory copied onto a private website. DOJ’s page is a starting point, not a substitute for the licensing authority’s current record.

Record the result
Save or print the official result showing the date you checked, the attorney’s status, and any disciplinary or practice restrictions displayed. If the directory cannot find the person, call the authority using a telephone number from its official website. Do not accept a screenshot supplied by the provider as proof that a license is current.
Step 3: Verify a DOJ-accredited representative and the organization
Check both DOJ rosters
For a non-attorney representative, use the current DOJ Recognition and Accreditation Program information and its linked lists. Find the representative by name on the accredited-representatives list, then find the organization on the recognized-organizations list. Confirm that the accreditation is tied to the same organization the person says they work for or volunteer with. Accreditation belongs to that organizational relationship; a representative cannot take organization-specific accreditation and practice independently.
Understand partial and full accreditation

If removal proceedings, an appeal, or any filing before immigration court or the BIA is possible, do not treat a USCIS-only (partial) representative as authorized for that forum. Ask what happens if your case moves from USCIS to EOIR and who would handle that change.

Step 4: Match authority to the forum and task
Write down the exact work you need: for example, eligibility analysis, form preparation, evidence strategy, filing, responses to requests for evidence, an interview, an immigration-court appearance, or a BIA appeal. Then ask the provider to identify which credential authorizes each part.

Attorneys and fully accredited representatives must register through EOIR’s eRegistry before filing an appearance in immigration court or before the BIA. The registration process is described at EOIR’s Register or Update eRegistry page. eRegistry is a filing requirement; it does not turn a consultant or a USCIS-only representative into an immigration-court representative.
- USCIS-only matter: An attorney with a verified license or a representative with current partial or full accreditation may be able to help, subject to the specific service and organization rules.
- Immigration court or BIA: Verify an attorney or fully accredited representative, the organization relationship where applicable, and the required eRegistry status.
- Mixed or uncertain matter: Ask for a written explanation of who will handle each forum. If the provider cannot state this clearly, pause before paying.
Step 5: Obtain a written agreement before paying
Do not rely on a verbal quote or a message that says only “visa package.” Request a contract that identifies the provider and the client, describes the matter, and states the price and payment schedule. Ask for an English version and, when needed, a version in a language the client understands. The agreement should make the following points unambiguous:
- The exact forms, petitions, applications, evidence review, correspondence, interviews, and appearances included.
- Who will perform the work and whether a supervisor or another attorney will review it.
- The service fee, installment dates, refund or termination terms, and what may cost extra.
- Government filing fees and other third-party costs listed separately from the provider’s fee.
- How the client receives copies of forms, supporting evidence, receipts, notices, and submission confirmations.
- How updates will be delivered, the expected response channel, and what happens if contact information changes.
Do not label a price fair or unfair without current, local, comparable evidence. Instead, compare written scope and total expected cost between providers. A lower quote may omit an interview, evidence response, translation, or court appearance; a higher quote may include work another provider excludes.

Pay in a traceable way when possible and obtain a dated receipt that identifies the recipient, amount, currency, and purpose. Keep the signed agreement, receipts, invoices, messages, and a timeline of submissions. Keep original passports, identity documents, civil records, and immigration notices yourself unless a specific, documented process requires temporary custody. If an original must be delivered, obtain a receipt and a date for its return. Ask for a complete copy of every form before it is filed.

Step 6: Check every form and filing before submission
- Read each answer and supporting statement in a language you understand, using a qualified interpreter if necessary.
- Check names, dates, addresses, travel history, immigration history, and prior applications against your original records.
- Ask the provider to explain any answer that is unclear or that you believe is wrong.
- Never sign a blank form, a form with missing answers, or a statement containing information you know is false.
- Request a signed copy and proof of delivery or electronic submission after filing.
Official USCIS forms are free. A provider may charge for professional services, but a form’s availability on a government website is not a reason to pay a separate “government form” charge. Warning signs that should stop the transaction
Pause the process and independently verify the provider if you encounter any of these claims or demands:
- Guaranteed approval, a guaranteed visa, or a guaranteed work permit. No legitimate provider can promise an agency or court outcome.
- Special access or faster processing through a personal relationship. Claims of secret influence, reserved appointments, or an inside USCIS contact are scam indicators.
- A request for a blank signature. You should see and understand the completed form before signing.
- Pressure to submit false information. False statements can damage an immigration case and create serious legal consequences.
- Government-looking websites, seals, email addresses, or social-media accounts. Compare the address with the official USCIS site and do not assume a professional design proves government affiliation.
- Payment to an individual by phone, gift card, wire, cryptocurrency, or an unexpected email link. Independently call the provider using contact information you obtained from a verified source.
- Refusal to provide a contract, receipts, copies, or the provider’s full name. Stop rather than paying to obtain basic records later.
USCIS warns that it does not use personal social-media accounts to contact people about immigration matters. Once credentials are confirmed, compare only the elements that affect your case. A polished office or a low headline price is not a substitute for authority and a usable agreement.

Do not use testimonials or a provider’s self-described success rate as proof of authorization. References may help you assess communication, but they cannot replace official licensing or accreditation checks.
If you suspect fraud or already paid
Preserve evidence and protect your case
Save the contract, advertisements, emails, text messages, payment confirmations, receipts, forms, and notices. Write down dates, names, phone numbers, account details, and exactly what was promised. Change passwords if you shared account credentials, and contact your bank or payment service promptly about unauthorized transactions. Do not let a dispute cause you to miss an immigration deadline; seek advice from a verified provider about the case itself.
Report through current government channels
USCIS directs people who have been cheated by an immigration consultant to local or state law-enforcement or consumer-affairs authorities and to the FTC. Use the FTC’s current complaint-reporting pages and the agency contacts linked from its immigrant-scam guidance, because reporting procedures and URLs can change. A report does not automatically undo a filing or restore a deadline, so document the case and obtain qualified help quickly.
A printable verification checklist
- Full name of the person who will advise or represent you.
- Attorney license jurisdiction, official status, and date checked; or representative’s DOJ roster entry.
- Recognized organization and accreditation level for a non-attorney representative.
- Forums covered: USCIS, immigration court, and/or BIA.
- eRegistry status when an immigration-court or BIA appearance is required.
- Written contract in a language you understand.
- Specific services, exclusions, extra-cost items, and government fees.
- Payment method, receipt, refund or termination terms, and copies of records.
- Original-document custody plan.
- No guarantee, secret access claim, blank signature request, false-information request, or government impersonation.
Completing this checklist does not predict the outcome of an application. It confirms that you know who is being paid, what that person is authorized to do, and what you are agreeing to buy.
