Use an Indigenous image only after you have identified the people and cultural material involved, contacted the relevant Indigenous person, community or cultural authority, and secured permission for the specific use. Copyright permission from a photographer, archive or museum is not automatically cultural consent. Agree in writing on the audience, channel, edits, promotion, duration, attribution and future reuse, then keep the caption and surrounding story accurate to the community’s direction.
Protocols differ among First Nations, Inuit, Métis and other Indigenous communities and between jurisdictions. The practical steps below help educators, editors, publishers and designers work respectfully without treating one institution’s policy as universal law.
Why an Indigenous image requires more than a copyright check
An image can involve several distinct interests at once. The person who pressed the shutter may own copyright; the person pictured may control how their name and identity are used; a family or community may hold cultural authority; and a museum, archive or representative organization may control access to a collection. One party may be able to license the photograph while another must approve the cultural context.

Treat that as a practical warning: a stock-site license, a photographer’s release or a public webpage does not by itself settle every permission question.

Copyright and cultural consent answer different questions:
- Copyright: Who may reproduce, distribute, adapt or display the visual work under copyright law?
- Cultural consent: Who has authority to approve the depiction, the interpretation, the audience and the way cultural knowledge or identity is presented?
- Personal consent: Has the person shown, or an authorized representative, agreed to this image and this use?
Some projects need all three forms of clearance. The Australian Museum, for example, requires community support or clearance for image requests from First Nations collections containing Indigenous cultural and intellectual property (ICIP). Its collection process also distinguishes permission for internet availability from agreement to use an image in marketing.
Begin by defining exactly what you want to do
Write a one-paragraph use brief
Before searching for an image or commissioning a photographer, describe the proposed use in plain language. Include:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →- the message the image should communicate;
- the publication, course, exhibition, website, social channel or presentation where it will appear;
- the intended audience and geographic reach;
- whether access is private, registered-user, paywalled or public;
- planned cropping, color changes, overlays, animation, subtitles or other edits;
- promotion, advertising, press use or social-media excerpts;
- how long the image will remain available;
- possible translations, syndication, print runs, recordings or later reuse.
“For a classroom” is not a complete purpose. A slide shown once to 20 students, a recording posted to a public video platform and a downloadable course pack can require different permissions. State the most expansive use you genuinely expect, and say that any new use will be checked before publication.
Identify what the image contains
Ask whether the proposed image involves an identifiable person, a community, a specific Nation or language group, a sacred or restricted place, an object, design, ceremony, story, song, dance, language or other cultural material. A landscape can still contain culturally sensitive places. An artwork can carry ICIP even when the artist is known and copyright is clear.
Do not infer identity from appearance, clothing, location or a photographer’s unverified caption. Record the confirmed Nation, community, language group and person’s name only when the relevant authority says that identification is accurate and appropriate.
Find the local contact before proceeding
Ask the depicted person, artist, community-controlled organization, cultural center, Elders’ group, collection manager or other locally recognized authority who should be consulted. A photographer, teacher, publisher or archive employee may be an important contact without being the person who can approve cultural use.

If you cannot determine who has authority, pause the project. Concordia University Indigenous Directions advises seeking permission before producing representations and before writing captions or descriptions. The International Society of Ethnobiology (ISE) policy likewise recommends checking local or cultural guidance instead of assuming that one rule applies everywhere. Its central practical message is: “If there is one takeaway from this document, it is when in doubt, ask!”
A permission-and-consent workflow
- Draft the use brief. List channel, audience, edits, promotion, duration, storage and anticipated reuse.
- Map the interests involved. Identify the photographer or artist, depicted person, family or community, cultural custodians, archive or museum, and any representative organization.
- Ask before creating or selecting. Seek guidance before photographing, commissioning, downloading, adapting, captioning or publishing. A public event or an image already online is not evidence of unrestricted reuse.
- Explain the project plainly. Show the proposed image or concept, the draft caption, the audience, the distribution plan and any commercial or promotional setting. Explain edits and whether an image will be combined with other material.
- Confirm who can authorize each part. Separate copyright authorization from personal permission and cultural clearance. If an organization represents a community, ask how its authority is defined and whether additional consent is needed.
- Record the agreement in writing. Use a written license, release, cultural-consent form or other document appropriate to the jurisdiction and relationship. The National Library of Australia recommends written licenses and cultural consent forms in the same way copyright permissions are required.
- Review the finished context. Send the final crop, caption, headline, neighboring text, translations and promotional copy for review when the agreement or community protocol calls for it.
- Recheck before a material change. A new audience, platform, campaign, edit, translation, duration or reuse can be a new purpose. Return to the rights-holders instead of silently extending the original permission.
What each kind of permission covers
| Question | Permission or decision | Who may be involved | What it does not automatically cover |
|---|---|---|---|
| May we reproduce the visual work? | Copyright license or assignment | Photographer, artist, estate, archive or other copyright owner | Cultural approval, personal dignity, accurate identity or approval of a new context |
| May we show this person? | Personal consent or an authorized representative’s permission | Depicted person, family or legally authorized representative | Permission to use associated cultural designs, stories, places or community knowledge |
| May we present this cultural material? | Cultural consent, clearance or protocol-based approval | Relevant Nation, community, custodians, Elders or community-controlled body | Ownership of the photographer’s copyright unless separately licensed |
| May an institution release the file? | Collection or access permission | Museum, library, archive or organization holding the file | Authority to waive community restrictions or approve marketing and future reuse |
| May we change the image or story? | Agreement on edits and faithful interpretation | Copyright owner plus relevant person or cultural authority | A general right to distort, stereotype or detach the material from its meaning |
Put the permitted uses next to the restriction on the same document. “Online use allowed” is less useful than “public course website, one academic year, no paid promotion, no cropping, credit in the caption, no third-party syndication.”
Choose an image source by authority, not convenience
Commissioned, archival, museum and partner-supplied images can all be appropriate. Compare them on the same practical axes before choosing.
| Source | Authority to verify | Questions to ask | Typical risk if unchecked |
|---|---|---|---|
| Commissioned photograph or artwork | Artist’s copyright and the depicted person or community’s cultural and personal consent | Who approves the concept, location, participants, edits, caption and future licensing? What benefit and attribution are expected? | A clear creative contract but no community approval, or a person agreeing to be photographed without agreeing to publication |
| Library or archive image | Archive’s access terms, copyright owner, depicted person or community and cultural custodians | Are restrictions attached to the collection? Does the archive’s permission cover public web, teaching, promotion and reuse? | Assuming “open access” means culturally unrestricted |
| Museum image | Museum licensing process plus any First Nations community clearance | Does the museum require prior community support, separate internet consent or a distinct marketing agreement? | Using a collection image in a campaign when only a limited research or exhibition use was approved |
| Image supplied by a partner | Partner’s license chain and the community or artist who authorized the material | Can the partner show the written permission? Does it cover your exact audience, edits, term, attribution and distribution? | Treating a partner’s possession of a file as proof that it can grant every right |
| Image found online | Original creator, depicted person, community and any platform or collection restrictions | Can you trace the source and contact the relevant authorities? Is the context authentic and current? | Copying an image because it is visible online, then amplifying it in a new context without consent |
Use fair value and relationship as selection criteria. Creative Workplaces advises recognition of the value of First Nations cultural and intellectual property and decision-making by First Nations people. A respectful commission can include fair payment, community benefit, local review and control over how the work is interpreted, not merely a one-time file transfer.
Write captions, credits and surrounding text with care
Make identity specific only when confirmed
Name the person, Nation, community, language group, place and artist exactly as confirmed. If a person prefers anonymity or a community uses a collective attribution, follow that direction. Do not turn one individual into a generic spokesperson for all Indigenous peoples.
Describe what the image actually shows
Separate observation from interpretation. A caption can identify who appears, what they are doing, where and when the image was made, and who created it. Do not add invented explanations about ceremony, symbolism, spirituality or community life. Ask the relevant participants or community to review descriptions when the material is sensitive or the meaning is not obvious.
Preserve the story and expression
Creative Workplaces recommends keeping stories and expressions true to First Nations voices and avoiding changes to ICIP that misrepresent it. Cropping out a maker’s credit, replacing a community’s wording with a generic “Indigenous” label or pairing ceremonial material with an unrelated headline can change meaning even when the pixels are unaltered.

Credit every required contributor
Follow the copyright license for photographer or artist credit, then add cultural attribution or community wording required by the consent agreement. Keep spelling, diacritics, Nation names and preferred titles exactly as supplied. Store the credit line with the asset so it survives handoffs to designers, learning-platform administrators and social teams.

Private teaching is not a blanket exemption
A teacher may have more limited exposure when showing an image in a closed classroom, but that does not make any image ethically suitable or remove all legal requirements. Do not assume that a classroom license covers a recorded lecture, a public website, a conference handout or student publication.
| Educational use | Checks before use | Extra approval to consider |
|---|---|---|
| Live, closed classroom slide | Copyright terms, accurate caption, sensitivity of the material and whether the slide will be recorded or distributed | Community or cultural review for restricted, sacred or identity-sensitive material |
| Learning-management system visible only to enrolled students | Access controls, download settings, term of availability and license scope | Written consent if the original agreement did not specify this audience |
| Recorded lecture or public course page | Public accessibility, searchability, subtitles, thumbnails and duration | Explicit agreement for internet availability and any promotional clips |
| Student assignment or exhibition | Whether students may download, edit, repost or submit the image to a public showcase | Updated permissions and clear instructions prohibiting unauthorized reuse |
Give students a short rights note: identify the source, follow the stated credit, do not repost outside the permitted setting, and ask before editing or adding a new caption. If a community has requested a warning, restricted access or no reproduction, place that information where students will see it before opening the material.
Using images in editorial, publishing and public campaigns
Editorial publication adds discoverability, permanence and the possibility of reuse by third parties. A news feature, textbook, nonprofit report, museum label, social post and paid campaign should be treated as separate contexts unless the written agreement clearly combines them.
Before assignment or selection
- Tell the photographer or artist that cultural consultation is part of the assignment, not an optional caption check.
- Budget time and payment for community consultation, translation, review and revisions.
- Ask whether the subject or community wants a say in headline, crop, placement, neighboring images and promotional copy.
- Decide who will respond to takedown, correction or cultural-safety requests after publication.
Before release
- Send the final image and caption, not an earlier draft, for any agreed approval.
- Check that metadata, alt text, search tags and social thumbnails do not introduce generic or inaccurate language.
- Confirm that print, ebook, website, newsletter, podcast artwork, event screens and advertising are all covered.
- Set an archive date and a process for removing or replacing material when consent expires or circumstances change.
When a story changes after publication
If an image is moved from an educational article into a fundraising appeal, a political campaign, a product package or a global social feed, stop and consult again. A permission tied to one purpose should not be stretched to a more public, commercial or controversial context.

Protocols are context-specific guidance, not a single worldwide legal code. Apply the local law and the community’s own protocol to the actual project.
| Resource or context | What it contributes | How to use it responsibly |
|---|---|---|
| Creative Australia, Protocols for Using First Nations Cultural and Intellectual Property in the Arts | Australian guidance on First Nations cultural and intellectual property; the official page says the protocols were first published in 2002 and revised in 2007. Funded projects engaging First Nations artists or cultural heritage are required to comply as a funding condition. | Apply it to Australian projects and consult the relevant community. Do not present it as the law of every country. |
| First Peoples Cultural Council, Indigenous Protocols for the Visual Arts Toolkit | Canadian practical guidance published October 14, 2022. | Use it with First Nations communities in its Canadian context and confirm local Nation-specific practice. |
| CARFAC, Indigenous Protocols for the Visual Arts | Canadian guidance addressing legal, ethical and moral considerations for First Nations, Inuit and Métis visual arts engagement. | Use it as a starting framework, not a substitute for consent from the people involved. |
| Concordia University Indigenous Directions | Institutional guidance emphasizing permission before producing imagery and care with captions and descriptions. | It governs or advises its community; other institutions should adapt the principle rather than claim the policy is universal. |
| National Library of Australia and Australian Museum protocols | Australian examples of multiple consent parties, written licenses, cultural-consent forms and collection-specific clearance. | Follow the named institution’s terms when using its material and seek separate authority where its policy requires it. |
Creative Australia quotes lawyer and protocol author Dr Terri Janke: “While works by individual artists are protected by copyright, Australia does not yet have a law that prevents alteration, distortion or misuse of traditional symbols, songs, dances, performances and story that may be part of the heritage of particular Indigenous language groups.” That statement is specifically about the Australian context described by the source; it should not be generalized to every country or treated as a current legal conclusion outside that context.

Keep a permission record that survives the project
Create one rights-and-protocol record for each image. A useful record contains:
- asset filename, thumbnail and source URL or collection reference;
- photographer, artist, estate, archive or museum contact;
- depicted person and the confirmed Nation, community or language group, where identification is approved;
- cultural authority or community contact and the date of consultation;
- exact permitted channels, audience, territory, term and access level;
- approved crops, edits, translations, alt text, caption and credit line;
- permission for internet availability, promotion, marketing, syndication and future reuse;
- restrictions on sacred, sensitive, deceased-person or ceremonial material;
- review or expiry date and the person responsible for re-consultation;
- copies of signed licenses, releases, cultural-consent forms and email confirmations.
Limit access to sensitive files and store the record with the asset-management system. When staff, students or contractors receive a copy, include the restrictions instead of assuming they will find them elsewhere.
Common mistakes and how to repair them
“It was already online, so it is free to use.”
Why it fails: Online visibility does not establish copyright, personal consent or cultural authority.
Repair: Trace the original source, pause publication and seek the relevant permissions. If authority cannot be established, choose another image.
“The photographer gave us permission, so the community has approved it.”
Why it fails: Copyright and cultural consent may belong to different parties.
Repair: Ask the photographer who was consulted, identify the cultural rights-holders and document both approvals where needed.

Repair: Compare the new use with the written scope and re-consult before expanding it.
“Indigenous” is an adequate caption.
Why it fails: It erases Nation, community and individual identity and can make one person appear to represent everyone.
Repair: Use confirmed, preferred attribution or explain why a person is not identified. Have the relevant participants review sensitive descriptions.
“We only changed the crop and headline.”
Why it fails: Cropping, juxtaposition, translation and headline language can alter meaning or imply a claim the image never made.
Repair: Include edits and surrounding text in the approval process and retain the approved final version.
“A generic stock image is safer.”
Why it fails: Generic depictions can stereotype Indigenous people and provide no evidence that the people or culture represented consented to the context.
Repair: Use a specific, accurately attributed image created or supplied with appropriate consultation, or choose a non-human visual that does not make an unsupported identity claim.
A quick decision test before publication
- Can I name what and whom this image depicts without guessing?
- Can I identify the copyright owner and the relevant personal or cultural authority?
- Has each appropriate party agreed to this exact audience, channel, edit, promotion, duration and reuse?
- Is the caption accurate, specific and approved where appropriate?
- Does the presentation preserve the material’s intended meaning rather than use it as decoration or a generic symbol?
- Can my team show the written permission and restrictions months from now?
- What is our response if a person or community asks for correction, removal or a new consultation?
If any answer is “no” or “unknown,” do not publish yet. Ask the relevant person or community, clarify the scope and document the decision. That pause is part of respectful practice, not an administrative delay.
