Use AI as a classification assistant, not as the legal decision-maker. A reliable workflow has five parts: define the importing jurisdiction and tariff year, give the model a complete and technically precise product fact sheet, request several ranked HS candidates with reasons and uncertainty, verify those candidates against current official tariff material, and have a qualified reviewer approve classifications whose errors could create material duty, licensing, quota, trade-remedy, or penalty exposure.

The Harmonized System (HS) supplies a common six-digit structure, but customs territories add their own national or regional digits and measures. The code that is correct for one market, tariff edition, or product configuration may therefore be wrong for another. Preserve the facts, sources, prompts, alternatives, and reviewer decision so the classification can be defended and revisited.

What an HS code is—and what “correct” means

The HS is the international nomenclature used to describe traded goods. Its headings and subheadings are interpreted through the General Rules for Interpretation (GRIs), Section Notes, Chapter Notes, Legal Notes, Explanatory Notes, and Classification Opinions. The internationally harmonized portion ends at six digits. An importing country or customs territory can append additional digits for duty, statistical, licensing, quota, trade-remedy, or other measures.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Correct” therefore means more than finding a plausible six-digit phrase. The classification must match the product as imported, the applicable tariff edition, and the legal rules of the destination. Record the importer’s country or customs territory, the transaction date, and the tariff version before asking an AI system to classify anything. The European Union’s Combined Nomenclature, for example, determines customs-duty and statistical treatment and is updated every year.

Why classification matters

The tariff line can affect duty, import VAT treatment, admissibility requirements, permits, quotas, anti-dumping or countervailing measures, origin programs, statistical reporting, and the documents required at entry. The WCO warns that incorrect classification can result in financial penalties, incorrect duties, and supply-chain disruption. A polished model explanation does not remove those consequences.

What AI is good at—and where it stops

AI is useful for turning messy commercial material into structured facts, finding wording that resembles tariff descriptions, ranking plausible headings, identifying missing specifications, and explaining why one candidate appears stronger than another. The WCO’s BACUDA work describes a recommendation model trained on historical commercial descriptions. It recommends several codes for a new description, after which a classification expert validates or corrects the recommendation. The BACUDA report dated 3 March 2022 says, “The model employs state-of-the-art natural language processing technology based on an artificial neural network called Doc2Vec.”

The model is not a customs ruling. It may have stale tariff data, infer composition from marketing language, confuse a six-digit HS subheading with a national tariff line, or cite a decision involving materially different goods. Use its output to focus human analysis, never to bypass the legal sources.

Tasks suited to automation

  • Extracting material, function, dimensions, power, capacity, and manufacturing-stage facts from datasheets, drawings, photographs, and supplier documents.
  • Normalizing synonyms and units, such as converting a trade name into a generic technical description.
  • Retrieving candidate headings and subheadings from a tariff database that is explicitly identified by jurisdiction and edition.
  • Creating a side-by-side comparison of legal wording, notes, exclusions, and prior decisions.
  • Flagging contradictions, missing data, low confidence, and products that changed since the last review.

Tasks that require legal and technical judgment

  • Deciding which heading is legally principal when several describe an article’s materials or functions.
  • Applying Section or Chapter Notes and the GRIs to composite goods, sets, kits, unfinished goods, and parts.
  • Determining whether a national extension or special measure applies.
  • Concluding that an earlier customs decision is comparable enough to rely on.
  • Accepting a final code for a high-value or regulated shipment.

Build a fact sheet before prompting

AI cannot recover a fact that was never supplied. Replace a sales description such as “premium smart kitchen device” with evidence a classifier can test. Ask the supplier for missing information rather than letting the model guess.

Minimum product identity

  • Commercial name and a plain-language generic description.
  • Principal function and every material secondary function.
  • How the item operates, including mechanical, electrical, chemical, optical, software-controlled, or other relevant action.
  • Whether it is a complete article, unfinished article, component, spare part, raw material, mixture, or waste.

Composition and construction

  • All materials and their relative proportions where relevant, with the actual substrate, coating, lining, filling, or active ingredient identified.
  • Technical specifications such as voltage, wattage, capacity, dimensions, density, purity, grade, particle size, or performance range.
  • Manufacturing stage when imported and any processing still required before normal use.
  • For mixtures or multi-material goods, the feature that gives the article its essential character, if that rule becomes relevant.

Presentation and supporting evidence

  • Packaging, retail presentation, and whether multiple articles are packed as a set or kit.
  • Intended use and the user or industry for which the article is designed, without treating a marketing claim as proof of technical function.
  • Datasheets, safety-data sheets, engineering drawings, assembly diagrams, bills of materials, photographs from several angles, labels, and model numbers.
  • Supplier, manufacturer, and product-family information that distinguishes variants with different composition or capability.

Attach source documents or quote the relevant passages. Tell the model which facts are verified, which are supplier claims, and which are unknown. A confidence score is meaningful only when the underlying facts and tariff edition are visible.

A practical AI classification workflow

  1. Set the legal context. Write the importing country or customs territory, the tariff edition or year, the transaction date, and whether you need the six-digit HS level or a national tariff line. If the shipment may enter more than one market, run a separate analysis for each.
  2. Assemble and normalize the facts. Convert units, expand abbreviations, reconcile the datasheet with the invoice and packaging, and list contradictions. Keep the original wording alongside the normalized version so a reviewer can trace every transformation.
  3. Ask for ranked candidates, not one answer. Require several plausible headings or subheadings. For each, request the exact legal wording, the relevant Section and Chapter Notes, the GRI used, the decisive product facts, confidence, and the facts that could change the result.
  4. Require rejected alternatives. Ask the model to name the nearest competing headings and explain why each was rejected. This exposes anchoring on a familiar product name and gives the reviewer a checklist for the next verification step.
  5. Check the current legal material. Compare every candidate with the current WCO nomenclature and Legal Notes, Explanatory Notes, Classification Opinions, and the importing jurisdiction’s tariff. The WCO publishes these interpretive instruments; U.S. Customs and Border Protection describes Explanatory Notes as an official interpretation aid covering the scope and technical descriptions of headings and makes them available through the WCO Online Bookshop. The CBP Explanatory Notes page is dated 13 February 2026, so confirm that the material you use remains current for the filing.
  6. Confirm that the line exists in the edition you will file. Check the complete national or regional code, not just a familiar six-digit prefix. Verify duty, statistical suffixes, licensing conditions, quotas, and trade remedies separately because a code can be structurally valid while a measure has changed.
  7. Compare official decisions. Search classification rulings or decisions where the jurisdiction publishes them. Compare the actual composition, dimensions, function, presentation, and manufacturing stage; a similar product name is not enough.
  8. Escalate material uncertainty. Have a customs broker, in-house trade lawyer, or other qualified compliance professional review the file when the alternatives carry different duties or regulatory obligations, or when shipment value, penalties, quotas, licensing, or trade remedies are significant. Seek a formal ruling when the jurisdiction offers one and the exposure justifies it.
  9. Record the decision. Save the input fact sheet, source documents, model and prompt versions, tariff edition, candidate list, rejected alternatives, legal citations, reviewer, decision date, and final rationale. Store the result with the product master data used by purchasing and logistics.
  10. Recheck on change. Trigger a review when the product, supplier, formulation, packaging, firmware-enabled function, manufacturing stage, destination, or tariff edition changes. Do not silently carry a code from an earlier variant.

Prompt design that produces reviewable results

Give the model a role and a boundary: it is preparing a recommendation for a human reviewer under a named tariff edition. Ask it to quote or identify the legal material it relied on rather than inventing citations. A structured prompt also makes results reproducible across products and model versions.

Classify the product for import into [customs territory] under tariff edition [year/version], for entry on [date]. Work only from the verified facts below. Do not guess; list unknowns and explain how each could change the result.
Return a table with: ranked candidate code; complete legal description; HS level versus national extension; applicable GRI; Section or Chapter Notes; decisive facts; rejected alternatives; confidence (high, medium, or low) with reasons; official tariff or ruling source to verify; and questions for a reviewer.

Then append the fact sheet, separating verified specifications from assumptions. If the model supplies a link or citation, open the underlying official source yourself and check the wording and edition. Do not treat a generated citation as evidence until it has been confirmed.

How to verify a candidate code

Read the hierarchy, not just the product label

Start with the heading text, then apply the GRIs and the relevant Section and Chapter Notes. A product may be excluded from an apparently obvious chapter, or a note may direct it to a different heading. At subheading level, compare only subheadings at the same level before moving to a national extension.

Use Explanatory Notes and Classification Opinions properly

Explanatory Notes describe the scope and technical characteristics of headings and are an important interpretation aid, but they do not replace the binding tariff and notes in the importing jurisdiction. Classification Opinions can clarify how a particular article was treated. Read the facts and reasoning, not only the code at the end.

Check national and regional measures

The WCO text establishes the common framework; the destination’s tariff determines the line actually declared. National extensions can add digits and can split goods by material, use, capacity, or other attributes. Regional systems can also update on their own calendar. The EU Combined Nomenclature is updated annually, so a code used last year must be checked against the current edition.

Compare two plausible codes systematically

When AI returns competing candidates, make the disagreement explicit rather than averaging the scores. Use a comparison record such as the following:

When human review is mandatory in practice

Route the file to a qualified reviewer when candidates differ in duty or regulatory treatment; the product is controlled, dual-use, agricultural, chemical, medical, or subject to quota or trade remedies; the shipment value is high; the importer has a history of corrections; the facts are incomplete; or the model relies on an unverified source. A reviewer should be able to reproduce the path from product evidence to legal note to final line without trusting the model’s prose.

For recurring imports, define approval thresholds. Low-risk, stable products can use an automated first pass followed by sampling and periodic revalidation. New products, changed formulations, unusual combinations, and high-exposure lines should require documented human sign-off before the purchase order or customs entry.

A worked example without guessing the code

Suppose a supplier describes a countertop device as a “smart beverage system.” Before classification, collect its heating and dispensing functions, power rating, fluid-contact materials, capacity, control method, whether it includes a grinder or pump, whether it is imported complete or as modules, and how it is packaged. Add the technical drawing, bill of materials, photographs, and the destination and tariff year.

Ask AI to rank the plausible headings and to explain whether the principal function, material, or presentation controls. The model might identify several competing chapters, but none should be accepted merely because the product name resembles an earlier ruling. Verify the notes and Explanatory Notes, compare the physical configuration with any official decision, check the destination’s national extensions and measures, and escalate if the alternatives change duty or licensing. The result is a defensible classification process even when the article cannot be assigned responsibly from the short marketing description alone.

Implementation patterns for teams

For a small importer

Use a controlled spreadsheet or form for the fact sheet, a fixed prompt, and a review checklist. Save the model response and the official tariff pages with the shipment file. Have a broker review any new product or any candidate split that changes the landed-cost calculation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a larger catalog

Store normalized attributes in the product master, connect each classification to a tariff edition and destination, and use AI to flag records with missing attributes or changed specifications. Require a human approval state before a code reaches the enterprise resource-planning or customs-filing system. Monitor annual tariff updates and supplier change notices as automated review triggers.

For model evaluation

Measure whether the system identifies the correct candidate set, exposes missing facts, cites current legal material, and routes uncertain cases—not just whether its first suggestion matches a historical code. Review false confidence and stale-source failures separately. No accuracy percentage is established by the WCO material cited here, so do not claim one without a controlled, jurisdiction-specific test.

Final decision rule

Let AI do the repetitive work of extracting facts, searching, ranking, and documenting alternatives. Let current official nomenclature, jurisdiction-specific tariff rules, and a qualified reviewer decide the code. A classification is ready to file only when the product facts are complete, the tariff edition is current, the legal reasoning is recorded, and the level of uncertainty is acceptable for the financial and regulatory exposure.
