Short answer: Treat AI-generated footage like any other published audiovisual work. Before you release or license it, identify and clear every input asset, inspect the finished frames and soundtrack for recognizable protected material, check logos and identifiable people, test whether the presentation implies sponsorship or endorsement, and document the human creative work behind the final edit. These controls reduce risk, but no checklist guarantees a particular legal result.
This guide uses U.S. federal guidance available through October 13, 2026. Copyright, trademark, publicity, privacy, advertising, and unfair-competition rules can differ by state and by the facts of a specific clip. If a project is commercially important or unusually risky, obtain advice for the jurisdictions and uses involved.
What “AI-generated footage” does—and does not—mean legally
“AI-generated” describes a production method. It does not automatically mean that the video is owned by the person who generated it, free of third-party rights, in the public domain, or protected by fair use. Two separate questions must be answered:
- Who authored the expressive elements in the finished work? The U.S. Copyright Office’s Part 2 report, released January 29, 2025, says output may be copyrightable when a human author determined sufficient expressive elements. Human-authored material that appears in the result, and human creative arrangement or modification, can provide a basis for protection. Merely writing prompts is not enough.
- Was the material used to make the work authorized? Footage, photographs, music, sound effects, logos, product designs, or other protected material used as an input can require permission, a license, or a valid exception. Authorization of an input and copyrightability of the output are different issues.
AI assistance does not prevent copyright in a larger human-created work. The key is to identify what a person actually wrote, shot, selected, arranged, edited, or otherwise controlled, rather than claiming machine-determined expression as human authorship.

“Where that creativity is expressed through the use of AI systems, it continues to enjoy protection. Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.”

A pre-publication clearance workflow
Use the following sequence for every clip, including short social videos and footage supplied by a contractor. Keep a written record of the answers.
Free tools Windows power users keep installed
One-click scans. No signup required.
- Define the intended use. Record whether the clip is private, editorial, educational, monetized, commercial, an advertisement, a product placement, an endorsement, or part of a paid campaign. Note where it will be shown, who the audience is, and the countries involved.
- Inventory every input. List prompts, reference images, video, audio, scripts, logos, product photos, character designs, stock material, user uploads, and assets added in editing. For each item, record its creator, source, license or permission, restrictions, and date obtained.
- Read the relevant terms. Save the terms that applied when each asset was uploaded or generated. Confirm whether commercial use, modification, redistribution, and sublicensing are allowed. Do not assume that a tool’s output license clears material supplied by a user.
- Review the entire rendered file. Watch the video and listen to the soundtrack from beginning to end. Examine still frames for logos, distinctive product shapes, packaging, storefronts, uniforms, copyrighted characters, artwork, and recognizable locations. Check background audio, dialogue, and sound effects as carefully as the main subject.
- Check people and likenesses. Determine whether a person is identifiable, whether the image is a synthetic replica of a real individual, and whether the scene suggests that the person used, reviewed, approved, or endorsed a product. Locate releases for any real person whose likeness, voice, or performance was supplied.
- Analyze the viewer’s impression. Ask what an ordinary viewer would believe about sponsorship, affiliation, approval, authorship, or the reality of the depicted event. A disclaimer placed somewhere else does not cure a misleading overall impression.
- Substantiate claims. For advertising or promotional footage, retain evidence for objective claims about performance, safety, price, results, or experience. Make required disclosures prominent and understandable.
- Document the human contribution and final decision. Preserve scripts, storyboards, edit timelines, masks, compositing files, prompts, generation logs, source licenses, releases, review notes, and the final approved file. This record helps explain both provenance and authorship.
Copyright: separate output authorship from input permission
When a person may have copyright in the result
The Copyright Office’s January 29, 2025 report applies a human-authorship test. Protection may cover human-written or human-created material that is perceptible in the final video, as well as a human’s sufficiently creative selection, sequencing, arrangement, or modification of generated material. A person who only supplies instructions and accepts whatever the system produces generally has not determined enough expressive content for copyright in the machine-generated portions.
That analysis is component-based. A human-authored script, original narration, filmed performance, edited sequence, or creative compositing may be protected even if some shots, transitions, or background elements were generated. The generated portions should not be represented as human-authored merely because a person operated the software.

Why a clear output does not clear the sources
If you upload a copyrighted song, movie frame, photograph, illustration, or other protected work as a reference or input, the permission question remains. The fact that the system changes the material, or that the final result looks different, does not create an automatic license. Review the rights for every source and for any derivative or transformed use contemplated by the project.
Fair use is a four-factor, fact-specific analysis
In the United States, fair use can sometimes permit an otherwise unauthorized use, but there is no safe number of seconds, percentage, pixels, or altered frames. Consider all four statutory factors:
| Factor | Questions to ask |
|---|---|
| Purpose and character | Is the use commercial, nonprofit, educational, news-oriented, transformative, or substituting for the original? Commercial use matters, but it is not an automatic loss. |
| Nature of the work | Is the source factual or highly creative? Has it been published? Creative entertainment and artwork generally receive stronger protection than factual material. |
| Amount and substantiality | How much was taken, qualitatively and quantitatively? A short extract can still be substantial if it captures the “heart” of the work. |
| Effect on the market | Could the use replace the original or an existing licensing market? Consider likely as well as actual market harm. |
Weighing these factors is a legal judgment, not a formula. A commercial campaign built on recognizable entertainment footage presents a different question from a critical news report, even if both use the same number of seconds.
Logos, products, and trademarks in generated scenes
Generated footage can reproduce a logo, a word mark, a distinctive package, a product configuration, a storefront, or a uniform even when you did not request it. Trademark law asks whether the use is likely to confuse viewers about the source, affiliation, sponsorship, or approval of goods or services. The U.S. Patent and Trademark Office explains that similarity can arise from sound, appearance, meaning, or overall commercial impression, and that the relationship between the goods or services also matters.
Run a frame-by-frame brand check
- Pause on every scene containing a sign, package, app screen, vehicle, building, uniform, or product.
- Record any visible or spoken brand name, logo, slogan, trade dress, or distinctive product shape.
- Ask whether the clip suggests that the brand supplied, approved, sponsored, or appears in a paid placement.
- Identify whether the video is an advertisement, comparison, review, news report, parody, fictional story, or private project.
- Consider whether the goods or services shown are related to the goods or services associated with the mark.
These are screening questions, not a legal clearance opinion. If a mark is central to a commercial message, obtain a comprehensive clearance search and consider permission or a different visual treatment. Removing an obvious logo may not solve the problem if the remaining product design or context still creates a confusing commercial impression.

Real people, digital replicas, and publicity rights
A realistic synthetic depiction of a real person can create exposure independent of copyright. Possible issues include unauthorized digital replicas, right of publicity, privacy, false endorsement, defamation, and voice or performance rights. The governing rules vary by state and by the relationship between the person, the audience, and the use.

That recommendation is not itself proof that the proposed federal protection became law. Do not describe it as an enacted nationwide right.
The USPTO’s name, image, and likeness guidance, updated September 17, 2026, explains that NIL protections generally arise under state law and differ by state. It also describes federal trademark protection when a person’s NIL is used commercially as a mark for goods or services. For a recognizable person, especially in advertising, verify releases and the applicable state rules instead of assuming that a synthetic image is free to use.
Higher-risk likeness scenarios
- A generated celebrity appears to hold, wear, review, or recommend a product.
- A real employee, customer, politician, athlete, or creator is recreated without authorization.
- The voice, catchphrase, signature gesture, or distinctive performance is imitated closely enough to identify the person.
- The footage presents a fabricated event as if the person actually attended or made the statement.
- The person is shown in a sensitive, defamatory, sexual, criminal, or otherwise reputation-affecting context.
If identity is not essential, use a clearly fictional character, obtain a written release that covers synthetic reproduction and the planned media, or redesign the scene so no reasonable viewer would identify a real person.
Advertising, sponsorship, and endorsement impressions
The Federal Trade Commission says advertising claims must be truthful, non-deceptive, and supported by evidence. Its endorsement guidance says an endorsement must reflect the endorser’s honest opinions, beliefs, or experience; a person should not claim to have used a product when they did not; and material connections that could affect how consumers evaluate the endorsement should be disclosed when required. The FTC notes that its endorsement guides are guidance rather than regulations, while the FTC Act authorizes investigation of potentially unfair or deceptive practices.

Apply the rule to synthetic scenes
- Do not make a generated person appear to report personal experience they never had.
- Do not show a company logo or spokesperson in a way that implies approval when none exists.
- Disclose paid relationships, sponsorships, free products, or other material connections in a clear, prominent way.
- Ensure demonstrations, before-and-after scenes, performance claims, and testimonials have evidence that matches the impression created by the full video.
- Label fictional or simulated events when viewers could reasonably mistake them for real events, people, or results.
The overall impression controls. A small disclosure may be inadequate if the video, audio, captions, thumbnail, and surrounding post strongly imply an official endorsement or real experience.
Registration and proving what a human contributed
The Copyright Office announced on March 16, 2023, that applicants have a duty to disclose AI-generated content in works submitted for registration. When registering a mixed work, identify the human-authored material and do not claim machine-determined expression as human authorship. The 2025 report supplies the current high-level framework: protection depends on the human contribution, not simply on operating an AI system.
What to retain
- Original scripts, narration, storyboards, sketches, and filmed performances.
- Generation prompts, settings, model or service terms, and dated output files.
- Source-asset licenses, permissions, invoices, and public-domain documentation.
- Releases for people, voices, performances, locations, and supplied assets.
- Edit timelines, masks, compositing layers, color work, sound edits, and notes showing creative selection or arrangement.
- Frame-review notes identifying removed or accepted logos, likenesses, and other recognizable material.
- Advertising substantiation and copies of disclosures used with each distribution.
This is practical recordkeeping, not a claim that the cited agencies mandate one particular retention system. Keep enough information to explain provenance, permissions, human authorship, and the final context if a platform, client, rights holder, or regulator asks.

Unexpected logo or product design
Remove, mask, replace, or redesign the element if it is not essential. If the mark is essential to commentary, news, comparison, or another legitimate purpose, document the context and obtain a fact-specific legal review before using it commercially.
Recognizable synthetic person
Stop and determine whether viewers could identify a real individual. Obtain an appropriate release, change the character so it is not identifiable, or remove the scene. A generic disclaimer is not a substitute for consent or a state-law analysis.
Potentially misleading endorsement
Rewrite the script, change the visuals, and add clear disclosures as needed. Remove claims of personal use or results that cannot be substantiated. Recheck the thumbnail, caption, title, audio, and landing page, not only the video file.
Uncertain copyright ownership
Separate the human-authored components from generated components in your records and any registration application. Avoid promising exclusive ownership of material whose expressive elements were determined by the machine.
When to obtain legal advice
Get jurisdiction-specific advice before release when the clip uses a living person’s likeness or voice, depicts a real company in a promotional context, incorporates disputed or high-value source material, relies materially on fair use, makes consequential performance or health claims, or will be distributed broadly under a client’s name. A lawyer can evaluate the actual frames, terms, releases, audience, and jurisdictions; general guidance cannot predict the outcome of a particular dispute.
