You can use successful ads to learn what makes a campaign persuasive, then apply those strategic lessons to your own product. The safer approach is to analyze the audience, promise, proof and storytelling pattern—not to feed a competitor’s finished ad into an AI tool and ask for a close variation. That reduces risk; it does not guarantee that an ad is lawful. Copyright, advertising and disclosure rules depend on the work, the campaign and the markets where it runs.
What you can learn from another ad—and what you should not carry over
An ad can be a useful reference without becoming a template to reproduce. Study its underlying strategy in your own words: who it addresses, what problem it presents, what benefit it promises, what proof it offers, and how it moves the viewer toward a decision.
Keep that analysis separate from the ad’s particular expression. A memorable line, distinctive layout, characters, music, images, packaging, or recognizable brand device may be protected or raise other legal concerns. There is no universal amount of text, imagery, audio, or visual similarity that makes a new ad safe. Whether a specific use infringes copyright or qualifies as fair use depends on the facts and applicable law.

How to turn an ad reference into a new campaign

Record where the reference came from
Keep the advertiser, source, capture date, market, placement, and any claim you intend to investigate with the ad. This gives your team context for analysis and helps distinguish a reference used for study from material you have permission to reproduce.

Describe the strategy without copying the execution
Write a short analysis in your own words: audience, customer problem, value proposition, narrative arc, proof type, emotional register, pacing, and format. For example, you might record that an ad demonstrates a problem, shows a product resolving it, and ends with a customer outcome. Do not paste in its slogan or ask an AI model to preserve its recognizable composition, characters, music, or graphic treatment.

Build a brief from your own product and evidence
Start with a real customer tension and a differentiated promise your business can support. Give the model approved product facts, the intended audience, brand voice, channel requirements, and a high-level pattern—such as a problem-to-solution story. Do not use a competitor’s finished ad as the creative source for a close variant. Human review and original creative decisions should shape the result.

Generate genuinely different concepts
Ask for options that vary in idea, setting, story, and visual treatment, rather than requesting small edits to one competitor-inspired execution. Review each option for copied wording, a recognizable campaign composition, logos, packaging, identifiable people, and close audio or visual resemblance. Reject work that recreates distinctive expression or could confuse consumers about who made, sponsored, or is affiliated with the ad. A different prompt alone does not establish originality.

Check claims and rights before publication
Verify prices, performance statements, product attributes, comparisons, endorsements, and health or environmental claims against evidence. Review rights for any included source material, music, imagery, or likeness, and check whether the campaign needs disclosures in its intended markets and channels. Keep the brief, approved facts, prompt iterations, selected output, human edits, claim evidence, and review notes.
Does using AI make copying legal—or make the result yours?
No. AI use does not automatically make a source ad lawful to use, make a close imitation non-infringing, or give the advertiser rights to every generated element. These are separate questions: whether source material was used lawfully, whether the finished ad violates someone else’s rights, and whether a human contribution to the new work is copyrightable.
U.S. fair use is a case-specific analysis
U.S. courts consider four fair-use factors: the purpose and character of the use, including whether it is commercial and transformative; the nature of the copyrighted work; the amount and substantiality used; and the effect on the work’s potential market. No fixed percentage or number of seconds guarantees fair use. A commercial ad’s purpose is relevant, but it does not decide the issue by itself. For campaign-specific questions, particularly when recognizable source creative is involved, consult qualified counsel.

Human creative contribution matters to U.S. copyrightability
In its January 29, 2025 announcement, the U.S. Copyright Office said generative AI output may be protected when a human author determines sufficient expressive elements. Mere prompting alone is not enough, while human-authored material, creative arrangement, or modification may contribute protectable authorship. This guidance concerns copyrightability in the United States; it does not decide whether source material was lawfully used or whether a particular ad infringes another right.
Trademark and advertising rules are separate issues
U.S. trademark law contains a specific exclusion from some dilution claims for certain fair uses of famous marks, including comparative advertising that allows consumers to compare goods or services. That provision is not blanket permission to imitate a competitor or create likely confusion about source, sponsorship, or affiliation.

The Federal Trade Commission’s advertising guidance says claims must be truthful, not deceptive or unfair, and evidence-based; some product categories face additional rules. A model-generated claim, testimonial, or comparison still needs review and substantiation. Generating the words or image with AI does not make an unsupported claim true.

Platform features and labels are not a substitute for checking the law and policies that apply to the campaign. Google Ads documents generative image tools for eligible accounts, including use during campaign setup, ad or asset editing, and in its Asset Library. It also allows advertisers to provide product images for product-based imagery. Those are platform-specific feature descriptions, not permission to use a competitor’s creative or a universal compliance checklist.

Google Ads Help cautions: “Use of the AI label setting in Google’s advertising products doesn’t guarantee your compliance with specific regulations.” Check local requirements and platform policies for the actual campaign, asset type, and product category. EUIPO identifies the EU Copyright in the Digital Single Market Directive and the AI Act as relevant frameworks in discussions of copyright-protected content and AI, but requirements can vary by country and context. The materials cited here do not establish every disclosure duty for every jurisdiction, medium, or category; avoid assuming that one disclosure rule applies everywhere.
What to keep in the campaign record
- The reference ad’s source, advertiser, capture date, market, and placement.
- Your strategy notes, written independently of the source’s distinctive wording and design.
- The product facts and evidence approved for use in the brief.
- Prompt iterations, generated options, the selected version, and human edits.
- Similarity-review notes and any rights, claim-substantiation, platform, or disclosure review.
A review record makes the creative process easier to assess and helps identify the human-authored contribution. It does not guarantee copyright registration, prove fair use, or eliminate infringement risk. The IAB’s 2024 overview described pending AI-training cases and said the viability of fair-use defenses for model training was then unclear; that was a time-specific assessment, not a statement of current judicial resolution.
When to get legal review
Seek advice from qualified counsel before launch when the campaign relies on recognizable source creative, a person’s likeness or voice, music, regulated product claims, a close comparison with a competitor, or AI-generated content in a market with disclosure rules. The clearest legal guidance discussed above is U.S.-oriented; requirements elsewhere may differ. This workflow is practical risk reduction, not legal advice or a guarantee.
