A move from a U.S. tech role to an India office does not automatically preserve your benefits, seniority, or U.S. employment status. Before agreeing to a start date, get a written transfer letter that identifies the legal employer, recognized service date, job level, compensation and payroll arrangement, and what happens to equity, retirement-plan participation, insurance, and your role if you later return to the United States. These terms depend on your employer and transfer structure; public tax or immigration guidance cannot guarantee them.

What to settle before you accept the transfer

“Transfer to the India office” can describe different arrangements: a temporary assignment while remaining employed by a U.S. entity, a move to an India entity under a new local contract, or another employer-specific structure. The office location alone does not tell you which arrangement applies. The legal employer and written employment terms determine what you need to verify about payroll, benefits, service credit, and the end of the assignment.

Ask HR or the mobility team for the proposed transfer letter, the India employment terms if applicable, and a benefits summary before resigning from or otherwise changing your current role. Treat the following as separate questions, not as an assumed package:

  • Employment continuity: Does your current employment continue, or does it end and restart with another entity? What date will the company recognize for service?
  • Role and seniority: What are your title, level, reporting line, responsibilities, review cycle, promotion eligibility, and work location after the move?
  • Pay and compensation: Which entity pays you, in which currency, and how are salary, bonus, deferred compensation, and equity handled?
  • Benefits: Which retirement, medical, life, disability, leave, and dependent benefits apply, and when does each current plan end or change?
  • Exit or return: If the assignment ends or you want to return to the U.S., is a role, level, location, or service date guaranteed?
  • Authorization and tax administration: Who confirms the work-authorization route and handles payroll withholding, tax support, and any tax equalization?

Have the employer confirm these points in documents that govern your employment or benefits. A verbal assurance such as “your tenure carries over” is not a substitute for knowing which date the company will use for vesting, leave accrual, bonus eligibility, promotion, and severance calculations.

Compare the proposed employment structures

There is no universal U.S.-to-India transfer structure or standard outcome for benefits. If your employer offers alternatives, compare their actual written terms against the same questions rather than assuming that a temporary assignment is better or that a local contract necessarily resets everything.

What to compare Questions to put to the employer Why it matters
Legal employer and contract Which entity employs you in each country? Is the move a temporary assignment, an India employment contract, or another arrangement? Does your U.S. employment continue? The employer and contract structure affect who pays you and which plan and employment terms apply. The title “transfer” does not answer these questions.
Recognized service date What exact date will HR use for service, vesting, leave, bonus, promotion, and severance purposes? Different company programs may use different definitions of service. Ask for the answer for each relevant calculation, not just a general statement about seniority.
Role and level Will title, level, scope, reporting line, performance-review eligibility, and promotion eligibility carry over? A continuous employment date does not by itself establish that your level or promotion path remains unchanged.
Pay and incentives What are the salary, pay currency, payroll entity, bonus terms, deferred compensation treatment, and equity treatment? Compensation earned before the move and future awards may be treated differently. Request specific treatment for each component.
Benefits and retirement Which U.S. and India health, insurance, and retirement arrangements remain available? What happens to participation, contributions, matching, and vesting? Plan participation is not guaranteed merely because employment continues or a U.S. company remains involved.
Tax and social insurance Who handles each country’s payroll withholding and explains any social-insurance coverage arrangement? Coverage depends on the employing entity and applicable arrangement, not just the city where you work.
End of assignment and return What happens if the assignment ends, the India role changes, or you seek to return to the U.S.? Is a position or service date guaranteed? A transfer can be difficult to unwind if a return role and the treatment of service are not settled in advance.
Work authorization What authorization is needed for the India role, who sponsors or arranges it, and what must be approved before the start date? Do not treat travel plans or an internal offer as confirmation that you are authorized to work in India.

Protect service credit, seniority, and your role

“Seniority” can mean length of service, job level, time in grade, promotion eligibility, or priority under a particular company policy. A company may preserve one and not another. Ask HR to identify the governing date and rule for each relevant outcome, rather than relying on a single statement that your seniority is preserved.

Get the service-date treatment itemized

Ask the employer to state whether the date you originally joined the company will count after the move, and whether the answer differs by purpose. Request confirmation for:

  • service and tenure recognition;
  • equity vesting and any new grant schedules;
  • leave accrual and accrued leave carried forward or paid out;
  • annual bonus eligibility and performance-review timing;
  • promotion eligibility and time in level; and
  • severance or other service-based calculations.

Also ask what happens to accrued leave and performance records if your U.S. employment ends and an India contract begins. If the company says that a service date carries over, ask which entity or policy recognizes it and whether that treatment is documented in the relevant employment and plan materials.

Define the job you are moving into

Compare the proposed role with your current role on more than title. Confirm level, responsibilities, manager, team, location, review schedule, and promotion eligibility. If any of these change, ask the company to identify the change explicitly; a preserved service date is not proof that your scope or path to promotion is unchanged.

Set the return or assignment-end terms

Ask whether the move has a fixed term, what happens if the business ends the assignment early, and whether you have a right to return to a U.S. role. Have the employer state any return position, level, location, or service-date commitment in writing. If there is no guaranteed return role, make that clear in your decision: do not infer one from the fact that the move began as an internal transfer.

Check every part of compensation, including equity

Ask for separate answers for salary, annual bonus, deferred compensation, and equity. Confirm the pay currency, payroll entity, payment schedule, and which terms apply after the move. For compensation already earned, ask when it will be paid and whether the transfer changes its eligibility or timing.

For equity, distinguish existing unvested awards from future grants. Ask whether vesting continues on the original schedule, whether a move changes the award or its administration, and what happens to future grants. Obtain the plan administrator’s contact and the documents governing your awards; the transfer letter alone may not explain plan-specific terms.

Do not assume that a U.S. tax result, payroll result, or plan outcome follows from the name of an award or the country where the company is headquartered. The U.S.–India treaty is a relevant primary document, but it does not by itself settle an individual employee’s wage sourcing, equity compensation, retirement treatment, or filing position. Those questions require facts about the employee, compensation timing, employing entity, and tax year. The treaty text is available from the IRS Convention Between the United States of America and India.

Ask the plan administrator about retirement benefits

A move does not establish whether you can continue participating in a U.S. retirement plan. Ask the U.S. plan administrator and HR directly whether you remain eligible and what happens to each plan feature. The official sources cited here do not establish a universal 401(k) outcome for an employee who moves to India.

Request a written response covering:

  • whether you may continue employee contributions while working in India;
  • whether employer matching or other employer contributions continue, and under what eligibility rules;
  • how the move affects vesting of employer contributions;
  • whether existing loans, distributions, or account access are affected; and
  • what happens if contributions stop, your U.S. employment ends, or you later return.

Ask the administrator, rather than relying only on a general HR summary, because plan participation and account rules are plan-specific. The IRS’s guidance on Social Security tax consequences of working abroad addresses tax and coverage rules; it does not promise that an employer will maintain retirement benefits.

Confirm health, insurance, leave, and dependent coverage

Ask for a benefits schedule showing which plans cover you in India and the effective date for each. Clarify when U.S. medical coverage ends, whether an India medical plan begins at the same time, and whether dependents are included. Ask separately about life and disability insurance, leave, and any other benefits that matter to your household.

Get the answer for transitions as well as the steady state: the period between your U.S. plan ending and India coverage starting, a delayed start date, travel back to the U.S., or an early end to the assignment. Ask how accrued leave is treated and which policy governs it after the move. Do not treat a benefits summary as proof that every plan applies internationally; verify eligibility, covered locations, dependents, and effective dates with the relevant plan contact.

Understand payroll and U.S. Social Security and Medicare coverage

Payroll location and work location are not enough to determine U.S. Social Security and Medicare treatment. The Internal Revenue Service says U.S. Social Security and Medicare taxes can apply to services performed abroad in specified arrangements. The actual result depends in part on the employer and the coverage arrangement, so ask payroll to identify the legal employer and explain the basis for its withholding treatment.

Totalization agreements can coordinate social-security coverage and prevent dual contributions when an agreement applies. The Social Security Administration’s published list of agreement countries does not include India. That does not, by itself, answer every employee’s coverage question: IRS guidance separately describes cases in which U.S. coverage can apply to work abroad, and the SSA explains that a U.S. employer may enter a qualifying Internal Revenue Code section 3121(l) agreement covering certain foreign affiliates, using Form 2032. Do not assume such an agreement exists for your employer or that the office location decides coverage.

Ask payroll these specific questions in writing:

  • Which entity is your employer for payroll and employment purposes?
  • Will U.S. Social Security and Medicare taxes be withheld after the move, and on what stated basis?
  • If an India affiliate is involved, is there a qualifying section 3121(l) agreement, and who can confirm its application to your employment?
  • Which entity handles India payroll withholding, and who will explain any difference between payroll withholding and your eventual tax filing obligations?

Read the IRS overview of totalization agreements, the SSA descriptions of international agreements, and the SSA’s information on employees of foreign affiliates as background, then confirm the facts of your employer’s arrangement.

Plan for U.S. and India tax residence and filing questions

Do not assume that moving your job, changing payroll, or spending a particular number of days automatically ends or creates tax obligations. Tax residence and filing consequences depend on your citizenship or residence status, travel days, compensation, employing entity, and the tax year. U.S. citizens and resident aliens abroad should use the IRS’s Publication 54: Tax Guide for U.S. Citizens and Resident Aliens Abroad as general guidance, not as a substitute for advice based on their own circumstances.

India applies statutory individual tax-residence tests separately for each tax year. The Income Tax Department says the Income Tax Act, 2025 applies to tax years beginning on or after 1 April 2026; earlier tax years continue under the 1961 Act. For assessment year 2026–27, its overview describes a 182-day test, or a 60-day stay in the year together with 365 days in the prior four years, subject to exceptions. The result depends on actual travel and personal facts, including citizenship. Track your India arrival and departure dates and retain travel records rather than estimating your days at year-end.

See the department’s Non Resident FAQs and its AY 2026–27 guidance for a non-resident individual. The applicable framework depends on the tax year; do not apply a threshold from one year to another without checking which law governs that year.

Before the move, ask the employer who will handle U.S. and Indian payroll withholding, tax returns, tax equalization if offered, and coordination of any foreign tax credit analysis. Ask a qualified cross-border tax professional to assess your individual facts, particularly if you have equity, deferred compensation, multiple payrolls, or travel in both countries. Neither treaty text nor a general IRS guide establishes your specific filing position.

Resolve India work authorization before setting a start date

Ask the employer’s mobility team or qualified India immigration counsel which work-authorization route applies to your role, who is responsible for arranging it, what documents or approvals are needed, and when you may begin work. Get the expected sequence and timing before booking a move or committing to a start date.

The USCIS material cited here explains L-1 classification for employees moving to work in the United States; it does not establish the authorization required for a person moving to work in India. It is therefore not a basis for deciding your India route. The relevant USCIS L-1 documentation and evidence chapter should not be mistaken for India immigration guidance.

A practical sequence for negotiating and documenting the move

  1. Get the proposed structure. Ask HR to identify the legal employer, payroll entity, contract type, and whether your U.S. employment continues, ends, or changes.
  2. Request a written term sheet. Obtain the India role terms, transfer letter, and benefit summaries before accepting. Ask for the proposed start date and any conditions that must be met first.
  3. Resolve service and role terms. Get the exact service date and its use for leave, vesting, bonus, promotion, and severance. Confirm level, duties, manager, review cycle, and promotion eligibility.
  4. Review compensation component by component. Ask about salary and currency, bonus, compensation already earned, deferred pay, unvested equity, and future grants. Confirm any differences between existing awards and future awards.
  5. Contact the plan administrators. Ask the U.S. retirement-plan administrator about participation, matching, contributions, vesting, loans, distributions, and account access. Confirm health and insurance coverage dates with the appropriate plan contacts.
  6. Get payroll and tax responsibilities named. Identify who handles U.S. and India withholding, social-insurance questions, tax returns, and any tax equalization or foreign tax credit coordination support.
  7. Confirm authorization and timing. Have the mobility team or India immigration counsel state the authorization route and what must be complete before work begins.
  8. Document the off-ramp. Get the consequences of an early end, a return to the U.S., or a change in role in writing, including whether a return position or service-date treatment is guaranteed.
  9. Read all governing documents together. Compare the transfer letter with the employment contract, benefit-plan documents, equity award documents, and any assignment terms. If they conflict or leave a material point unclear, ask the employer to resolve it in writing before you accept.

Warning signs that need a written answer

  • The employer says “nothing changes” but cannot identify the legal employer or payroll entity.
  • “Seniority carries over” is not tied to a date or to specific calculations such as vesting, leave, bonus, promotion, or severance.
  • The offer refers to benefits continuing but does not identify eligible plans, covered dependents, locations, or effective dates.
  • No one can confirm whether you can keep contributing to the U.S. retirement plan or whether matching and vesting continue.
  • Existing equity and future grants are described together without separate terms.
  • The company expects you to relocate before work authorization, payroll treatment, or the start date is settled.
  • A return to the U.S. is implied in conversation but absent from the written terms.

No published statistic in the official sources cited here establishes how often these transfers preserve benefits or succeed. The reliable way to protect your position is to evaluate the specific contract, plan documents, payroll arrangement, and authorization path offered to you.
