If an archaeology employer closes, do not take project files home, upload them publicly, or decide their final destination yourself. Secure the records, identify the person or institution with legal and contractual authority, create a cross-referenced inventory, obtain written transfer instructions, and document the receiving party’s custody. The correct recipient may be a client or sponsor, landowner, permit authority, government agency, Tribal or descendant-community body, designated repository, or an insolvency custodian. Ownership depends on the project’s contracts, permits, funding, applicable law, and community arrangements.

What to do first when the company is closing

Treat excavation documentation as part of the archaeological record, not as ordinary personal work product. Field notes must remain connected to provenience information, maps, photographs, artifact inventories, laboratory records, reports, and related administrative files. The Society for Historical Archaeology (SHA) describes records, notes, reports, catalogs, historical documents, and photographs as integral collection components that should be submitted with artifacts for permanent curation.

Stabilize custody immediately

  • Keep paper files dry, secure, and protected from unauthorized handling. Do not discard boxes, notebooks, labels, printouts, or apparently duplicate sheets.
  • Keep digital data on the employer’s approved systems or a secure, access-controlled device while authority is being established. Do not synchronize project folders to a personal cloud account.
  • Do not publish site coordinates, photographs, burial information, culturally sensitive descriptions, or restricted Tribal or descendant-community information.
  • Follow any existing employer, client, agency, contract, permit, confidentiality, and community requirements. If access is about to be cut off, notify the responsible project authority in writing before copying anything.

Preservation is not permission. Keeping a record safe does not give an employee ownership or a right to remove, copy, publish, or dispose of it.

Find the authority that can direct a transfer

Start with the project’s documents, not with the most convenient archive. Locate the scope of work, contract, permit, repository or curation agreement, agency correspondence, ownership clauses, accession terms, and any instructions naming a project director or responsible official.

Possible authorities

  • Client or sponsor: A private developer, museum, university, public agency, or other commissioning body may own the documentation or control its delivery.
  • Landowner: Ownership or access terms may give the landowner a role, especially on non-federal work.
  • Permit authority or public agency: A permit, compliance program, or state or local law may require filing with a particular office or clearinghouse.
  • Tribal or descendant-community authority: Agreements, repatriation obligations, or community protocols may control access, custody, or disclosure.
  • Designated repository: A repository named in the project agreement may accept the collection but may still need written authorization from the legal owner or agency.
  • Insolvency or liquidation custodian: If the employer is in bankruptcy, receivership, or liquidation, obtain directions from the authorized records custodian, trustee, receiver, or successor entity rather than moving material independently.

Contact several parties, but do not create competing transfers

If a principal investigator or project director is still reachable, ask for the current owner and transfer contact. Send the same factual notice to the client or sponsor, permit or agency official, and named repository when appropriate. Ask who has authority to approve the handoff and who should sign the receipt. Do not send original records to multiple parties “for safekeeping” unless the responsible authority has approved that arrangement.

Build a transfer inventory before packing anything

An inventory lets the authority and repository see what exists, what is missing, and how each record relates to the collection. Use the project’s established site, trinomial, accession, or catalog identifiers; do not invent a replacement numbering system.

Inventory field What to record
Project identifiers Project name, site number, accession number, permit or contract number, client, and responsible agency.
Record type Field notebooks, context sheets, unit forms, drawings, maps, photographs, films, audio or video, oral histories, artifact inventories, laboratory reports, databases, spreadsheets, manuscripts, draft and final reports, correspondence, and administrative files.
Date range and creator Dates covered, preparer or photographer where known, and whether an item is original, copy, draft, or final.
Format and location Paper, optical media, removable drive, server path, database format, image format, box number, shelf, or other physical location. Record file sizes and access dates for digital material when practical.
Collection links Box, folder, specimen, artifact, lot, feature, context, map, photograph, and report references that preserve provenience relationships.
Restrictions Confidentiality terms, culturally restricted information, privacy limits, security classifications, copyright or license conditions, and access embargoes.
Known gaps or problems Missing notebooks, unreadable media, damaged pages, duplicate files, unresolved identifiers, incomplete metadata, or records held by another party.
Unfinished work Draft reports, unprocessed photographs, data cleaning, analyses, cataloging, specialist studies, and outstanding agency or client deliverables.

Cross-reference the inventory to the associated artifacts, samples, maps, photographs, databases, reports, and correspondence. If an item is absent, mark it as “not located” and explain where you last saw it; never silently omit a gap.

Use this transfer workflow

  1. Freeze uncontrolled changes. Stop renaming, reformatting, deleting, annotating, or rearranging files unless the responsible authority directs it. Record any emergency action needed to prevent damage.
  2. Collect governing documents. Assemble the contract, scope, permit, repository agreement, agency instructions, ownership terms, and community protocols. Note the clauses that address records, artifacts, reporting, access, and final curation.
  3. Identify the approving authority. Obtain the name, title, organization, and contact information of the person authorized to order the transfer. In a federal project, this may be the Federal Agency Official and, for a federally administered collection, the owner as well.
  4. Prepare the inventory. List physical and digital materials, identifiers, locations, formats, restrictions, gaps, and unfinished work. Preserve the existing correlation between records and collections.
  5. Ask the intended repository before delivery. Confirm that it accepts the material and obtain its requirements for file formats, naming, metadata, packing, labeling, transport, conservation, and restricted access. Ask whether it needs a deed, accession form, transfer agreement, or agency letter.
  6. Resolve copies and backups in writing. Ask whether a working copy or backup may be retained, by whom, for how long, and under what security controls. Do not make personal copies merely because duplication is technically easy.
  7. Obtain written approval and schedule the handoff. The approval should identify the collection, recipient, authority, conditions, restrictions, transport method, and date. Use tracked or otherwise documented delivery for physical media.
  8. Get a signed or acknowledged receipt. The receipt should reference the inventory, identify sender and recipient, state the transfer date, list exceptions or missing items, and confirm who has custody after delivery.
  9. Store the transaction record. Keep the approval, inventory, correspondence, shipping or courier record, and receipt with the project files if the authority permits. Notify the client or agency of completion and unresolved gaps.

What counts as an archaeological record

For federally owned or administered collections, the National Park Service’s summary of 36 CFR Part 79 treats “associated records” broadly. The list is a useful checklist elsewhere, but it does not prove that every category belongs to a particular employer.

Category Examples
Field documentation Site forms, field notebooks, context or unit forms, drawings, maps, measured sketches, labels, and daily logs.
Visual and audiovisual material Photographs, negatives, films, audio, video, and oral histories, with captions or metadata.
Object and laboratory documentation Artifact inventories, catalog records, sample registers, laboratory reports, conservation records, and analytical data.
Interpretive and reporting files Manuscripts, technical reports, draft reports, final reports, appendices, illustrations, and data tables.
Digital media Databases, spreadsheets, geospatial files, computer media, printouts, scripts, and documentation needed to use them.
Administrative and compliance files Scopes, proposals, contracts, permits, correspondence, compliance files, accession records, catalog and inventory records, and repository agreements.

SHA’s curation guidance similarly identifies field and laboratory documentation, photographs, historical documents, and reports as collection components. Administrative records may be essential to proving ownership, restrictions, and provenance even when they are not stored with the artifacts.

Federal collections: the specific rules under 36 CFR Part 79

Part 79 applies to federally owned or federally administered archaeological collections; it is not a universal rule for every private, state, Tribal, or non-U.S. project. The National Park Service’s guidance explains that associated records are part of the collection and that repository agreements must direct transfer or repatriation requests to the responsible Federal Agency Official.

Written permission controls movement and disposal

  • A repository may not transfer, repatriate, or discard a federally owned collection without written permission from the Federal Agency Official.
  • For a federally administered collection, written permission is required from the Federal Agency Official and the owner.
  • A repository’s acceptance of boxes or digital media does not itself establish authority to change ownership, repatriate material, or destroy records.

Administrative records are part of accountability

Part 79 calls for records identifying the repository, agreements, catalog contents, and later permanent transfers. Include those documents in the handoff inventory when they are in the closing employer’s custody. If a repository asks for a new form, have the authorized owner or agency approve it; do not sign away rights personally unless you are expressly authorized.

Federal storage expectations

The federal framework addresses protection from fire and theft, condition and inspection information, loss records, and duplicate records or access through another responsible party. These controls support continuity, but they do not authorize an employee to create unsanctioned duplicates or select a new storage site.

State, local, private, Tribal, and international projects

Outside the federal context, the destination is project-specific. The Register of Professional Archaeologists (RPA) Code & Standards, revised or amended February 25, 2025, requires compliance with applicable federal, state, local, Tribal, Indigenous, and international law and relevant agency rules. It also calls for field records and collections to remain correlated, inventories to be created, and records and reports to be filed with the appropriate site-record clearinghouse regardless of material disposition.

That professional requirement does not transfer ownership to the employee and does not make a convenient public archive the correct destination. A state office may have a defined role only within its jurisdiction and program. For example, the North Carolina Office of State Archaeology has a collections-management policy for documentation within its remit; its role is an example, not a universal destination. Confirm the responsible state or Tribal office, repository, client, or owner for each project.

Tribal and descendant-community controls

Some records contain information that communities regard as restricted, sacred, private, or subject to specific stewardship protocols. Ask the designated Tribal or descendant-community authority how access, copies, metadata, photographs, human remains information, and publication are to be handled. Put those conditions in the transfer paperwork and tell the repository before delivery.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choose among plausible repositories

When more than one institution appears possible, compare the following factors with the project authority. A repository that can store boxes but cannot preserve the digital database, restrictions, or provenience relationships is not an adequate destination.

Decision factor Questions to ask
Legal authority and ownership Who owns the collection, and has that party authorized this repository in writing?
Permit and contract alignment Does the destination match the permit, scope of work, repository agreement, and agency instructions?
Clearinghouse duty Is this the designated site-record clearinghouse or the office to which reports and records must be filed?
Format capacity Can it accession paper, photographs, maps, geospatial data, databases, media, samples, and oversized material?
Preservation and security Does it provide environmental control, fire and theft protection, inventories, conservation, backups, and documented access?
Restrictions and access Can it enforce confidentiality, cultural restrictions, privacy limits, embargoes, and controlled access?
Community governance Does it recognize Tribal or descendant-community preferences and control over sensitive information?
Accession evidence Will it issue a durable accession or transfer record tied to your inventory?

Prepare digital records without destroying context

Digital files can lose meaning when detached from their folder structure, database schema, software dependencies, or field identifiers. Preserve the original files and associated documentation until the authority and repository approve a conversion.

  • Keep original filenames, paths, timestamps, database tables, lookup tables, and read-me documentation where they explain relationships.
  • Record the software or database version needed to open proprietary formats, but do not migrate files solely for convenience.
  • Include geospatial coordinate systems, projection information, layer names, symbology, and links between spatial data and site or context identifiers.
  • Include photograph metadata, scan settings, audio or video specifications, and any checksum or fixity information the repository requests.
  • Document encrypted, password-protected, or access-restricted material and transfer credentials only through the authorized secure channel.
  • Do not overwrite originals while cleaning data. If a repository requests normalized or open-format copies, retain the originals and document the transformation.

A permitted working copy can help finish reporting, but its owner, retention period, security, and deletion date must be set by the responsible authority. Personal backups are not a substitute for an authorized repository copy.

Pack and label paper records only to repository specifications

Ask the receiving repository about box dimensions, labeling, humidity or temperature requirements, oversized maps, photographs, magnetic or optical media, and transport. Do not place damp, moldy, unstable, or contaminated material in a new box without notifying the repository.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

SHA recommends acid-free paper for paper documentation and recommends planning for curation with the receiving facility and budgeting for it during project design. Those are curation recommendations, not a blanket instruction for a departing employee to buy supplies or rehouse records. Use acid-free folders or other archival materials only when the repository approves the specification, and keep original labels and order unless the repository directs a change.

Label each container with the project and site identifiers, box or folder sequence, contents range, restrictions, and handling warning required by the repository. Place a copy of the approved inventory with the shipment only if the recipient requests it, and protect any sensitive information from being visible on the exterior.

Document the handoff so custody is provable

A complete transfer packet should contain:

  • Written authorization naming the owner, approving official, sender, recipient, and destination.
  • The final inventory, including known gaps, restrictions, formats, and unfinished work.
  • The transfer date, delivery method, tracking number or courier record, and condition notes for physical materials.
  • A receipt signed or acknowledged by the receiving party that references the inventory and identifies exceptions.
  • Instructions for permitted copies, access, return, destruction, repatriation, or later transfer.
  • Contact information for the person responsible for follow-up questions and unresolved reporting.

If the repository refuses a category of material, do not abandon it. Obtain written instructions from the owner or agency for an alternate repository, secure interim storage, or a lawful disposition.

Finish reporting obligations without claiming ownership

Employment may end before analysis and reporting are complete. SHA’s Ethics Committee warns, “There is nothing more tragic in archaeology than an unreported site excavation,” and advises, “Take detailed notes and records for the benefit of future researchers.” Its guidance supports continuity: identify drafts, analyses, unresolved data cleaning, specialist work, and reporting deadlines in the transfer inventory.

A professional obligation to help ensure that excavation results are written and reported does not authorize personal possession, independent publication, or transfer to a self-selected archive. Ask the owner, client, agency, or designated project director how unfinished work should continue, who may edit or sign the report, and where drafts and analytical files belong.

The RPA Code & Standards states the professional imperative: “You shall comply with existing and applicable public federal, state, local, tribal, indigenous, and international law” (the complete clause also addresses pertinent agency rules and laws). Apply the full text and the project’s governing documents to the specific jurisdiction.

Common mistakes and how to recover

Taking notebooks or drives home

Why it fails: Personal custody can breach ownership, confidentiality, permit, or employment terms and can break the chain of custody.

Recovery: Keep the item secure, stop further copying, notify the authorized owner or custodian, describe exactly what you hold, and obtain written delivery instructions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Sending everything to a familiar museum or university

Why it fails: A convenient institution may not be the designated clearinghouse, may lack authority, or may be unable to preserve restricted or digital material.

Recovery: Pause shipment, compare the destination against the contract, permit, repository agreement, and authority’s written direction, then obtain acceptance terms before delivery.

Deleting duplicates, drafts, or “temporary” files

Why it fails: Drafts, metadata, correspondence, and duplicate records may explain decisions, prove provenance, or be required by the repository or agency.

Recovery: Preserve the files, list them as originals, copies, or drafts, and let the authorized authority decide retention or disposal.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Converting files before the repository reviews them

Why it fails: Conversion can strip metadata, alter coordinates, break database relationships, or make an original unreadable.

What a successful transfer accomplishes

At completion, an authorized recipient can identify every box, file set, photograph group, database, report, and related administrative record; explain known gaps; enforce access restrictions; preserve links to artifacts and provenience; and prove when custody changed. The employee’s role is to protect continuity and provide accurate information, while the owner, agency, community authority, or lawful custodian decides where the records belong.
