The dependable way to track U.S. federal AI requirements is to use two layers: start with the Government Accountability Office (GAO) government-wide inventory to discover potentially relevant instruments, then verify every item in the issuing agency’s current record. Keep statutes, executive orders, Office of Management and Budget (OMB) memoranda, Federal Register documents, and agency guidance as separate records with their own dates, obligations, deadlines, amendments, and status. GAO’s inventory is a powerful map, but it is not a live legal-status feed.

Use a two-layer tracking system

Federal AI policy is spread across several kinds of instruments. A law can establish an authority or obligation; an executive order can direct agencies to act; an OMB memorandum can set government-wide management requirements; a Federal Register rule or notice can create or explain regulatory action; and agency guidance can describe how an organization expects people to comply. Treating all of these as interchangeable produces an unreliable tracker.

A practical system separates discovery from verification:

  • Discovery layer: use GAO’s government-wide map to find requirements, responsible agencies, oversight groups, and expected deliverables.
  • Verification layer: open the original issuing record and confirm the operative text, publication date, effective date, affected parties, deadlines, amendments, rescissions, and implementation instructions.

When the two layers disagree, the current issuing record controls the status of the instrument. Preserve the GAO entry as a discovery reference, but do not describe an item as binding, effective, or still active without checking the source that issued it.

What GAO’s inventory tells you—and what it does not

The scope of the map

GAO’s report Artificial Intelligence: Federal Efforts Guided by Requirements and Advisory Groups, published September 9, 2025, identifies AI-related requirements in federal laws, executive orders, and guidance. It organizes requirements by responsible parties and due dates and identifies oversight groups plus ongoing or forthcoming deliverables. This makes it a useful starting index for a government-wide tracker.

GAO stated that it identified 94 AI-related government-wide requirements, or requirements with government-wide implications, for federal agencies. That count reflects the inventory as of July 2025; it is not a live total, and it is not a count of every AI-related action taken by every federal agency. New instruments, revisions, and rescissions can change the landscape after the cutoff.

How to use the cutoff date

Put both dates in your tracker: the report publication date (September 9, 2025) and the inventory cutoff (July 2025). A reader looking at an entry should immediately know whether it was visible in GAO’s snapshot and how much subsequent activity must be checked at the issuing agency. Do not silently present the 94-item count as current for a later month or year.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Why the inventory is not a legal-status feed

GAO’s tables and Federal Rules records summarize requirements and point to underlying documents. They are records about instruments, not replacements for the operative instruments. A memorandum may have been revised, an effective date may have been delayed, an executive-branch policy may have been rescinded, or an agency may have issued implementation guidance after GAO’s cutoff. Those events can change what a reader must do without changing the wording of the older summary.

Create one tracker record for every instrument

Do not combine a statute, an executive order, a memorandum, and an agency FAQ into one row. Give each instrument its own record and link related records through a common subject or requirement identifier. This lets you show that a later notice implements an earlier order, or that guidance explains a memorandum, without erasing the history.

Fields to capture

Field What to record Why it matters
Instrument type Statute, executive order, OMB memorandum, Federal Register rule or notice, or agency guidance Type determines where to verify the text and how to interpret legal effect.
Official title and identifier The issuing body’s exact title, number, memorandum identifier, docket number, or other document identifier Exact identifiers prevent two similarly named documents from being merged.
Issuing body Congress, the President, OMB, or the specific agency or office Shows which source can amend, rescind, clarify, or enforce the instrument.
Publication date Date the instrument or notice was published Provides the historical starting point for the record.
Effective date The date the source says the instrument takes effect, when one is given Separates publication from the date obligations begin.
Affected parties Agencies, contractors, grant recipients, regulated entities, employees, or other named groups Prevents a government-wide summary from being applied to people outside its scope.
Required action The concrete action, control, report, review, consultation, or policy the source requires Turns a document list into an operational checklist.
Due date or cadence One-time deadline, recurring deadline, milestone, or ongoing duty Lets owners schedule work instead of merely collecting links.
Current status For example, proposed, final, effective, superseded, rescinded, delayed, or under implementation Makes the record useful for current decisions and historical research.
Source record The original issuing-page or Federal Register record used for verification Provides the authoritative text and the place to check later changes.
Last checked date The date a person reviewed the source for status and amendments Shows how fresh the verification is.
Related instruments Earlier authority, later amendment, rescission, implementation notice, or agency guidance Preserves the chain of authority and prevents obsolete material from being mistaken for current policy.

Keep obligations separate from commentary

Store the source’s requirement in one field and your explanatory notes in another. For example, “submit a report by a stated date” is different from “the agency has not yet explained its internal process.” Mixing those statements makes it difficult to tell what the instrument actually requires.

Statutes and executive orders

Confirm the enacted law or signed order, not only a summary. Record the exact authority, sections relevant to AI, named agencies, required deliverables, and any deadlines. Then look for later orders, legislation, or agency instructions that modify the original direction. An executive order may direct agencies to produce guidance, while the later guidance supplies the operational details; track both records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

OMB memoranda

OMB memoranda have individual subjects, effective dates, and implementation requirements. GAO’s Federal Rules records list M-24-10 as effective March 28, 2024 and M-24-18 as effective September 24, 2024. Those dates belong to the specific memoranda; they should not be generalized to every OMB AI document. Open the issuing office’s current materials to confirm the operative text, applicability, later revisions, and whether another memorandum supersedes or supplements the original.

When recording an OMB memorandum, capture the memorandum number exactly, identify the agencies or programs it covers, quote or paraphrase the required action narrowly, and record any implementation deadline separately from the effective date. If an agency has published its own implementation instruction, create a linked agency-guidance record rather than overwriting the memorandum entry.

Federal Register rules and notices

Use the Federal Register record for a proposed rule, final rule, request for information, or other notice. Distinguish a proposal from a final rule and a request for comment from an enforceable requirement. Record the publication date, effective date, compliance date when different, docket or document identifier, affected entities, and any later correction or delay. A notice that asks for public comments is an action to monitor; it is not automatically a binding requirement.

Agency guidance and implementation material

Agency guidance can include policies, memoranda, handbooks, FAQs, technical instructions, and other non-rule documents. Record the issuing office and the document’s stated audience. Note whether the agency describes the material as binding policy, recommended practice, internal direction, or explanatory information. Check the agency page for replacement versions and archived editions so a superseded FAQ does not remain in the “current” view.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use a status model that distinguishes legal and operational states

A single label such as “active” hides important differences. Use separate fields for legal status and implementation status, or use a controlled status vocabulary with a note explaining the distinction.

  • Proposed: the agency has announced a possible rule or policy but has not made it final.
  • Open for comment: a notice or proposal is accepting public input during a stated period.
  • Final, not yet effective: the final text is published, but its effective date has not arrived.
  • Effective: the source says the instrument is in force for its covered parties.
  • Under implementation: the instrument is effective or directed, while agencies are still issuing procedures, systems, or internal policies.
  • Delayed: the source has postponed an effective or compliance date.
  • Superseded: a later instrument replaces the earlier one.
  • Rescinded: the issuing authority has withdrawn the instrument.
  • Historical: retained for context but no longer current.

Always attach the source date and a short explanation to a status change. “Effective” without the effective date, affected parties, and source record is not enough for an operational decision.

Build an agency-specific watchlist

After the government-wide pass, narrow the tracker to agencies material to your work. For each agency, monitor proposed rules, final rules, notices, guidance, implementation plans, and revisions as separate document types. This prevents a high-volume agency from burying a small but important update in a general feed.

Use Regulations.gov for docket activity

Regulations.gov is relevant when an agency opens a docket or requests public comment. Record the docket number, document title, comment deadline, and issuing agency from the docket itself. Confirm the final outcome in the agency’s record and, where applicable, the Federal Register publication. The available evidence does not establish the current coverage or alert behavior of portal notification tools, so test any saved-search or alert feature before making it a dependency.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Pair portal monitoring with the issuing agency

Portal searches can miss an agency page that publishes non-rule guidance or a replacement document outside a rulemaking docket. Keep the agency’s policy or AI governance page on the watchlist and check its document archive. For high-impact instruments, subscribe only after confirming what document types and agencies an alert actually covers; retain manual source checks as the verification layer.

Set a review cadence and event-driven checks

A calendar alone is not sufficient. Use routine reviews plus immediate checks after events likely to change status.

  • Routine review: refresh the government-wide index and each agency watchlist on a schedule appropriate to your risk, and record the last checked date for every source.
  • Event-driven review: recheck an entry when the issuing agency announces an amendment, rescission, delay, new implementation guidance, or a related executive action.
  • Deadline review: review well before every recorded due date and again after the deadline to capture extensions, completion notices, or revised instructions.
  • Publication review: when a new GAO assessment or inventory appears, compare its cutoff date with your tracker and add newly identified instruments without deleting older history.

Preserve superseded entries. Add the replacement or rescission reference and the date you changed the status. This gives writers and compliance teams a defensible explanation for why an older requirement appears in historical material but not in the current obligations list.

End-to-end procedure for maintaining the tracker

  1. Define the audience and boundary. Decide whether the tracker covers all federal agencies, a set of agencies, contractors, grant programs, or a particular AI use case. Write that boundary at the top of the tracker.
  2. Seed the index with GAO. Start with GAO’s September 2025 map. Import the requirement title, responsible party, due date, and document identifier where provided, while retaining the July 2025 inventory cutoff.
  3. Split combined entries. Create separate records for each statute, executive order, OMB memorandum, Federal Register document, and agency guidance item. Link related records rather than combining them.
  4. Open the original record. Follow the document identifier or source reference to the issuing authority and the Federal Register record when applicable. Do not rely on a summary for operative text.
  5. Capture dates precisely. Enter publication, effective, compliance, comment, and due dates in separate fields. If a date is not supplied by the source, leave that field out of the published comparison rather than guessing.
  6. Determine applicability. Record the covered agencies, programs, contractors, or other parties and any stated exclusions.
  7. Extract the action. Translate the operative text into a concise task without broadening it. Record recurring duties and one-time deliverables separately.
  8. Check for change. Search the issuing source for amendments, corrections, rescissions, delayed dates, replacement guidance, and implementation instructions.
  9. Assign status and ownership. Use the controlled status model, name the internal owner for each deadline, and record the last checked date.
  10. Review and preserve history. Run the scheduled refresh, respond to event-driven changes, and retain superseded records with their replacement or rescission references.

How to audit a tracker entry before publishing it

  • Can a reader identify the issuing authority and exact instrument from the title and identifier?
  • Are publication and effective dates shown separately, with the relevant region, agency, or program scope?
  • Does the entry distinguish a proposal, notice, guidance document, and final rule?
  • Is the requirement written as an action for the covered party rather than as a vague policy theme?
  • Has the issuing record been checked for amendments, delays, rescissions, or replacement guidance?
  • Is the last checked date visible?
  • Does the entry preserve the older version if a later document changed its status?
  • Are GAO’s July 2025 cutoff and September 9, 2025 publication date kept with the inventory claim?

Common tracking failures and their fixes

Using the 94-item count as a current total

Failure: presenting 94 as the number of federal AI requirements today.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: describe it as GAO’s count of government-wide requirements or requirements with government-wide implications identified through July 2025, and check later issuing records for current status.

Calling every federal AI document a regulation

Failure: treating laws, orders, memoranda, notices, and guidance as if they have the same legal effect.

Fix: record the instrument type and explain what the source says it does. A request for comment is not a final rule, and explanatory guidance is not automatically a regulation.

Copying a summary without checking the source

Failure: relying on an inventory description after an agency has revised or withdrawn the underlying document.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: use the inventory for discovery, then verify the operative text, status, and dates at the issuing authority.

Account for changes after the July 2025 inventory

The federal AI landscape remains unsettled. GAO published a 2026 assessment focused on privacy-related gaps in OMB’s government-wide AI guidance, with the assessment framed as of January 2026. That later work is a reminder to add new assessments and implementation findings to the tracker rather than treating the 2025 inventory as complete.

Agencies also face practical management challenges, including keeping appropriate-use policies current and following revised executive-branch policies and guidance. A tracker should therefore monitor not only new instruments but also whether an agency has updated its internal policy, issued implementation instructions, or changed the status of an earlier requirement.

Choose the right level of tracking for your organization

Small team with one affected agency

Use a spreadsheet or database with one row per instrument, the fields listed above, a source record, and a last checked date. Review the agency’s official pages and relevant dockets on a fixed schedule, with an extra check before each deadline.

Organization working across several agencies

Use separate agency watchlists connected to a government-wide index. Assign owners for source verification and deadline review. Preserve historical versions so a writer or compliance lead can explain which policy was in effect at a particular time.

High-volume monitoring program

Consider an alert service only after confirming the agencies, document types, update frequency, original-source links, and program terms it covers. Alerts can improve discovery, but official issuing records remain the verification layer and should be the citations used in final guidance.
