Deploying an AI agent does not, by itself, make the system your employee. But calling it a tool—or deciding it is not an employee—does not settle who is legally responsible for its actions. That depends on the applicable jurisdiction, the agent’s role and authority, and the rules governing the activity. Before launch, counsel should identify the parties and duties involved, set limits on what the agent can do, and ensure people can supervise and stop it.

1. Which jurisdiction and legal rules apply?

Start by mapping where your organization operates, where affected people are located, and what the agent will do. One deployment may raise several legal questions at once: consumer protection, employment, financial services, health, public-sector obligations, privacy, or cybersecurity. The relevant rules may depend on the activity and the people affected, not just where the software was built or hosted.

Do not treat guidance from one country as a universal liability rule. The EU AI Act, UK consumer-law guidance, Singapore government governance guidance, and Australian cybersecurity guidance address different legal systems and purposes. Counsel should assess which laws apply to the specific deployment, including any applicable transition dates or implementation requirements.

Separate legal status from accountability

“Is the agent an employee?” is not the only—and often not the most useful—question. Employee status and private-law agency are jurisdiction-specific issues. The official frameworks discussed here assign roles and responsibilities to people and organizations around AI systems; they do not establish a universal rule that an AI agent can never be an employee or legal agent. Nor does a conclusion about employee status, on its own, resolve other possible legal duties or liability.

2. Who is the provider, deployer, and decision-maker?

Draw the system’s accountability map before approving its use. Identify who selected and configured the agent, who integrated it with business systems, who gives it instructions, who controls its tools and data, and which organization presents it to customers or staff. Record the agent’s intended purpose and whose authority it acts under.

The EU AI Act defines a deployer as a natural or legal person, public authority, agency, or other body using an AI system under its authority. The Act also defines a provider role. These are regulatory roles; they are not a finding that the AI itself is an employee. A company may need to assess how those roles apply to its particular system and deployment.

Map control, not just the vendor relationship

  • Organization: Who approves the use case, sets operating limits, authorizes access, and decides when human review is required?
  • Provider and integrators: Who supplies the system, configures it, connects tools, or changes its capabilities? What instructions, support, and incident information are available?
  • Decision-makers: Which named roles can approve consequential actions, handle escalations, pause the agent, and correct an outcome?
  • Authority and representation: What actions does the agent appear authorized to take, and what limits are communicated to users and counterparties?

3. What can the agent do without approval?

Translate “autonomous” into a concrete list of permissions. Inventory the data it can read or change, the tools and accounts it can use, the people it can contact, and any purchases, commitments, or other transactions it can initiate. Distinguish actions that can be readily reversed from actions with lasting effects.

Singapore’s Ministry of Digital Development and Information said in a parliamentary written answer on 6 May 2026: “They should not allow high stakes or irreversible actions to take place without human review.” Its guidance supports approval checkpoints and action boundaries; it is not a substitute for the law of another jurisdiction. Australia’s joint cybersecurity guidance recommends incremental deployment, low-risk tasks, strict privilege controls, continuous monitoring, strong identity management, human oversight, and alignment with cybersecurity frameworks.

Set permissions by consequence

Action class Examples Control to consider
Low impact and reversible Drafting text, sorting internal records, or preparing a proposed response Begin with limited access; review output before it is used externally or changes a record.
Consequential but reviewable Sending customer communications, changing account details, or updating business records Require an identified person to approve the action, or tightly constrain which cases the agent may handle.
High-stakes or difficult to reverse Making consequential decisions, committing funds, or taking actions with significant effects on a person Keep a human approval gate before the action; define escalation and stop procedures.

These are governance categories, not a legal classification. The actual risk depends on the use case, applicable rules, and potential consequences. Reduce privileges to the minimum needed for the approved task, and do not give the agent broad access merely because a tool integration makes it convenient.

4. What duties remain if the agent makes a mistake?

Do not assume that delegating work to an agent transfers the organization’s legal obligations. In guidance for businesses using AI agents, published 9 March 2026, the UK Competition and Markets Authority states: “But if an AI agent you use does something illegal, you are responsible.” That statement is made in the context of UK consumer-law guidance. It should not be read as a universal summary of liability for every jurisdiction, claim, or type of agent use.

For the proposed deployment, identify the obligations that apply to the organization and the people operating it. Ask whether the agent’s actions could affect consumers, workers, customers, or other third parties, and who must address an error, unlawful action, or complaint. Contract terms with a provider may allocate responsibilities between businesses, but counsel should not treat those terms as automatically eliminating duties owed under applicable law.

Plan for failures as well as intended use

  • Define which decisions and communications require human authorization.
  • Set an escalation route for uncertain, out-of-scope, or potentially harmful actions.
  • Determine who can suspend access and who owns investigation and remediation.
  • Review provider and integrator responsibilities, including how quickly they must help investigate an incident.

5. Can you reconstruct, stop, and correct what happened?

Before launch, confirm that the organization can understand the agent’s activity well enough to supervise it and respond to an incident. Establish monitoring, suitable logs, identity and privilege controls, human intervention, escalation, and incident-handling procedures. Decide what evidence must be retained and who can access it, consistent with applicable privacy and retention rules.

For covered high-risk systems, the EU AI Act requires deployers to use the system in accordance with its instructions and to assign human oversight to people with the necessary competence, training, authority, and support. The scope of those requirements depends on whether the system and use fall within the Act’s provisions. Australia’s cybersecurity guidance emphasizes continuous monitoring and strong identity management; Singapore’s guidance emphasizes meaningful human review and transparency to users about the agent and its capabilities and data access.

Pre-deployment approval checklist

  • Document the intended purpose, affected groups, applicable jurisdictions, and legal regimes.
  • Identify providers, deployers, integrators, internal owners, and human decision-makers.
  • Record every data source, tool, account, and action permission the agent can use.
  • Set approval gates for high-stakes, externally consequential, or irreversible actions.
  • Test escalation, human override, suspension, and incident-response procedures.
  • Confirm monitoring and logging are adequate to investigate actions and correct errors.
  • Tell users what the agent does, what it can access, and when a person is involved, as appropriate to the use and applicable rules.

Approval should be specific to the deployment design. If the team cannot explain the agent’s authority, bound its permissions, and intervene when needed, the system is not ready for that level of autonomy.
