There is no universal number of days or years for keeping AI data. Set the shortest period that is necessary for a clearly stated purpose, then account for legal, regulatory, contractual and security-investigation obligations. Apply the rule to the whole AI lifecycle—not just the chat interface—including prompts, uploads, outputs, logs, feedback, evaluation and training data, derived features, backups and retired model artifacts.
A workable policy names each data category, its purpose, the authority for keeping it, a fixed deletion date or review trigger, an owner, the systems where it exists, the deletion or anonymisation method, and evidence that the action occurred. Automate recurring disposal where possible, document approved exceptions, and make vendor settings and public privacy statements match the behavior of the service.
What a defensible AI retention rule must answer
For every category of information, your policy should answer seven questions:
- What exactly is stored, including copies and derived artifacts?
- Why is it processed, and whose information does it contain?
- What legal basis or business need permits the processing?
- When must it be deleted, anonymised or reviewed?
- Which person or team owns the decision?
- Where is it stored, including vendor systems and backups?
- How will disposal be performed and proved?
The European Commission’s GDPR guidance states that an organisation must store personal data “for no longer than necessary for the purposes for which it was collected.” The same guidance recommends setting time limits to erase or review data. This is a purpose-specific rule, not a single AI retention period. Federal Trade Commission business guidance expresses the same practical discipline: “Keep sensitive data in your system only as long as you have a business reason to have it.” Neither statement authorises indefinite storage merely because future uses are possible.

Separate mandatory retention from optional convenience. A tax, employment, anti-fraud, litigation or security-investigation requirement may establish a minimum hold. A desire to improve a future model does not, by itself, justify keeping identifiable personal data forever.
Map the complete AI data lifecycle
Retention decisions fail when they cover only the production database. Build an inventory of systems, owners, providers, data subjects, data flows and model versions. Include the following stages and artifacts where they exist.
| Lifecycle stage | Artifacts to identify | Control question |
|---|---|---|
| Collection | Forms, sensors, imported records and consent or notice records | What purpose and authority allowed collection, and when does that purpose end? |
| Ingestion | Uploaded files, prompts, metadata, parsing copies and queues | Which temporary copies are created, and when are they removed? |
| Production use | Inputs, outputs, conversation history, application logs and user feedback | Which records are needed for service delivery, safety, support or billing? |
| Research and evaluation | Evaluation sets, annotations, red-team material, experiment logs and metrics | Can testing be performed with minimised or anonymised data? |
| Training and fine-tuning | Training datasets, checkpoints, adapters, embeddings, feature stores and lineage records | Can a source record be located in derived artifacts, and what happens when it is withdrawn? |
| Retirement | Archived models, documentation, configurations, incident records and migration copies | What must remain for legal, audit, reproducibility or investigation purposes? |
NIST’s AI Risk Management Framework playbook recommends inventories that record system documentation, responsible actors, data dictionaries and operational links. Its decommissioning guidance says plans should specify where and for how long retired systems, models and related artifacts remain stored. Map data through collection, ingestion, production, research, use and retirement so a deletion request does not stop at the first database it reaches.

A schedule turns principles into executable decisions. The ICO recommends classifying personal information by sensitivity, documenting schedules from business and statutory requirements, and including enough detail to identify records and carry out disposal. Use a row for each meaningful category rather than one broad “AI data” entry.
| Category | Purpose to document | Duration or trigger | Disposal treatment | Evidence |
|---|---|---|---|---|
| Prompts and uploaded content | Delivering a requested interaction, support or a defined safety function | Shortest period needed for that purpose; otherwise a documented review trigger | Delete from application, provider workspace, indexes, caches and derived copies where applicable | Deletion event, record scope, timestamp and operator or job identity |
| Outputs and conversation history | User access, continuity, quality review or complaint handling | Set separately from input retention; tie any longer period to a stated need | Delete or anonymise history and searchable replicas | Job log and exception record |
| Logs and telemetry | Security, reliability, abuse prevention or billing | Minimum needed for the named operational purpose and any applicable duty | Redact or aggregate sensitive fields before retention; purge raw logs on schedule | Retention configuration and periodic review record |
| Evaluation and training material | Model testing, validation, research or approved improvement | Fixed period or owner-led review; document legal basis and source lineage | Remove source records, rebuild or update derived sets when required, and restrict retained copies | Dataset version, approval, deletion propagation result |
| Backups and disaster-recovery copies | Recovery from operational failure | Follow the backup rotation and any justified hold; do not use backups as an indefinite archive | Expire or overwrite through the backup system, with restricted access until then | Backup policy, expiry status and restoration-control test |
| Retired models and artifacts | Migration, audit, reproducibility, legal duty or investigation | Keep only the artifacts with a recorded reason and review or end date | Decommission services, revoke access, then delete or securely restrict the remainder | Decommissioning record, dependency check and approval |
Where a fixed end date is impractical, define a review trigger, a decision owner and the action that follows. A trigger might be the end of a contract, closure of an investigation, replacement of a model or a periodic review date. “Keep until needed” is not an executable rule unless “needed” is defined and reviewed by a named owner.
An eight-step implementation procedure
-
Set scope and ownership
List every AI system, internal application, model endpoint, research environment and service provider in scope. Name the business owner, technical owner, privacy or records-management contact and security contact. Record the data subjects affected and the jurisdictions in which processing occurs. An inventory should link system documentation, data dictionaries, model versions and operational contacts so a deletion request can be routed without guesswork.
-
Classify data and sensitivity
For each artifact, record whether it is personal, sensitive, confidential, proprietary, anonymised or non-personal. Include identifiers hidden in prompts, free text, images, audio, metadata, embeddings and feedback. Classify copies created by parsing, indexing, caching, monitoring and export jobs. Sensitivity affects access controls and the safeguards required while a record is waiting for its deletion date.

Map purpose and authority
Write the specific purpose for processing each category and identify the legal basis or other authority. Note any statutory, regulatory, contractual, employment, tax, anti-fraud, litigation or security-investigation requirement that sets a minimum hold. GDPR transparency information includes purposes, categories, legal basis, storage duration, recipients and relevant rights; your internal schedule should be detailed enough to support those explanations.

Choose the shortest defensible period
Set a fixed end date when the purpose has a predictable life. Otherwise set a review trigger and require an owner to decide whether deletion, anonymisation or a narrowly justified extension is appropriate. Do not convert an example into a universal deadline: the European Commission’s example that a recruitment agency’s proposed ten-year CV retention appears disproportionate illustrates proportionality for that purpose, not an AI-wide ten-year rule.
-
Specify deletion, anonymisation and restriction behavior
Define what “delete” means in each system. It may require removing primary records, search indexes, object-storage copies, queues, exports, derived features and provider-side copies. State whether backups expire through normal rotation or require a separate process. If permanent deletion is technically unavailable, the ICO suggests placing information securely out of reach with access restricted, or anonymising it. Document why the information remains and set a review date; restricted storage is not automatically equivalent to satisfying every legal deletion request.
-
Create an exception and legal-hold path
Allow exceptions only for a specific legal or operational reason, such as a litigation hold, statutory duty or unresolved security investigation. Record the reason, affected systems and records, approving authority, start date, review date and expiry condition. Suspend ordinary deletion only for the defined scope. When the hold ends, return the records to the normal schedule and capture the release in the audit trail.

Verify providers and public commitments
Review each provider’s contract, configuration and product documentation for prompt and output retention, abuse monitoring, human review, model-training use, subcontractors, backup deletion and handling of deletion requests. Check whether data is stored in or transferred to another jurisdiction. A provider’s promise in terms, a privacy notice, a promotion or a marketplace listing can create a consumer-protection commitment; FTC guidance warns that providers must honor such commitments and obtain clear, affirmative express consent before materially expanding uses where consent is required. Configure the service to match your own schedule, and update notices when behavior changes.
-
Automate, test and review
Use scheduled or rolling deletion jobs for recurring categories. Make jobs idempotent so a retry does not create inconsistent results, and alert when a record cannot be found or removed. Log the scope, rule version, timestamp, system response and any exception. Test deletion with synthetic records and trace whether copies disappear from search, analytics, feature stores, evaluation sets and provider dashboards. Keep an inventory, schedule, deletion evidence, exception register and review history. Revisit the design after a new data source, purpose, model update, vendor, jurisdiction or legal obligation.
Deleting source data is not the same as changing a trained model
Removing a prompt, file or row from its source repository does not establish that information has been removed from model parameters, checkpoints, embeddings, evaluation exports or other derived artifacts. The authorities considered here do not define a universal technical method for unlearning or guarantee that deleting a source record changes a deployed model. Your policy should therefore distinguish:
- Source deletion: removal from the original application, storage and operational copies.
- Derived-data handling: locating the source in datasets, features, embeddings, indexes, checkpoints or exports and deciding whether to rebuild, filter, retrain or securely restrict them.
- Model and provider response: the contractual and technical steps a provider supports for training data, fine-tuning material and abuse-monitoring records.
Record what the system can actually prove. If a model cannot identify or remove an individual contribution, state that limitation, prevent further use of the affected source where appropriate, and obtain legal advice on the applicable request and jurisdiction rather than promising parameter-level deletion.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →Backups, replicas and derived artifacts
Deletion must propagate beyond the primary table. Trace object storage, caches, search indexes, data warehouses, analytics extracts, message queues, feature stores, vector indexes, exported datasets, developer workspaces and vendor consoles. Define whether each copy is deleted immediately, expires with a rotation cycle, or is retained under a documented hold.

Backups deserve a separate rule. They may be inaccessible to normal users but still contain personal data. Set a finite rotation or expiry process, restrict restoration access, and prevent a restored backup from silently reintroducing records that were deleted from production. After restoration, run the deletion process again and record the result.
Derived data can reveal information even when obvious identifiers are removed. Evaluate embeddings, summaries, labels, evaluation annotations and aggregate reports for re-identification or linkability. Anonymisation should be assessed for the actual data and threat model; simply hashing an identifier does not automatically make the result anonymous.
Legal and regional considerations
European Union and GDPR
GDPR principles relevant to AI retention include storage limitation, data minimisation, purpose limitation, accountability and transparency. Retain personal data for the shortest period compatible with the processing reason and legal duties, and tell people the storage duration or the criteria used to determine it. National labor, tax and anti-fraud rules can require longer retention for particular records. Those duties do not create permission to retain unrelated AI inputs or outputs for the same length of time.
United Kingdom
The ICO’s AI data-minimisation audit guidance recommends documented schedules, lifecycle mapping, disposal and audit trails. The guidance states that it is under review following the Data (Use and Access) Act. Check its current status and the law applicable to your processing before treating the guidance as current UK compliance advice.
United States
The FTC materials relevant here address business retention practices and consumer-protection risk when privacy promises are broken or uses are expanded without appropriate notice and consent. They are not a comprehensive US AI-retention statute and do not establish a national schedule. Apply sectoral, state, contractual and litigation requirements to the specific data and organisation.
NIST framework
NIST AI RMF 1.0 was released on January 26, 2023 and is voluntary; NIST has said it is being revised. Its inventories, lifecycle controls and decommissioning practices are useful implementation guidance, not binding law. Use them to make responsibilities, dependencies and retirement decisions visible while obtaining jurisdiction-specific legal advice.
Other jurisdictions and regulated sectors
The same sources do not settle retention periods for every country or sector. Banking, healthcare, education, employment, children’s data, public records and cross-border transfers may impose additional duties. Have counsel or a qualified privacy professional validate the schedule where those rules affect the purpose, location or deletion method.
How to make deletion demonstrable
A policy is credible only when an auditor, regulator or affected person can see what happened. Retain evidence about the process without keeping the deleted content itself longer than necessary.

One period for every AI record
Failure: prompts, invoices, safety logs and training data all receive the same expiry date.
Correction: separate categories by purpose, sensitivity and authority. Set a period or review trigger for each category.
Keeping data “just in case”
Failure: possible future model improvement is treated as a permanent business reason.
Correction: document the concrete purpose, minimise the data and schedule a review. If the purpose cannot be stated, do not retain identifiable information for it.
Deleting only the visible conversation
Failure: the user interface removes a chat while logs, exports, indexes, backups or provider copies remain.
Correction: map every copy and define propagation, backup expiry and verification.
Assuming anonymisation is automatic
Failure: names are removed but rare text, identifiers, embeddings or linked datasets still identify a person.

Correction: assess re-identification risk for the actual data and restrict or delete material that is not effectively anonymous.
Ignoring model lineage
Failure: a source record is deleted without checking training sets, fine-tunes, features or checkpoints.
Correction: maintain lineage and state what rebuild, retraining or provider process is technically available. Do not promise unlearning that the system cannot perform.

Using a legal hold as an indefinite archive
Failure: an exception has no scope, owner or end date.
Correction: record the reason, approver, review date and expiry, then release the hold and resume normal deletion.
Publishing a policy the service does not follow
Failure: a privacy notice says data is deleted promptly while provider settings retain prompts for support, abuse monitoring or training.
Correction: reconcile contracts, configuration, notices and operational logs before making the promise; update all four when behavior changes.

- Is every AI system, provider, model version and data flow in the inventory?
- Does each category have a specific purpose, data classification and owner?
- Are legal, regulatory, contractual and investigation holds identified?
- Is the duration the shortest period that satisfies the purpose and duties?
- If there is no fixed date, is the review trigger and decision owner explicit?
- Does deletion cover primary records, replicas, indexes, exports, derived data and backups?
- Can the system prove what was deleted, when, by which rule and with what result?
- Are exceptions bounded, approved and reviewed?
- Do provider terms and settings cover retention, training use, abuse monitoring and deletion requests?
- Do public notices accurately describe purpose, categories, duration, recipients and rights?
- Has the schedule been tested after model, vendor, data-source, jurisdiction or legal changes?
The practical standard is simple but demanding: keep data only for a stated reason, for no longer than that reason and applicable duties require; make every copy and exception visible; and retain enough evidence to show that disposal actually occurred. Treat model retirement and derived artifacts as part of the same lifecycle, not as an afterthought.
