Use an AI wellbeing tool at work only within clear limits: know what it collects, who can see it, what decisions it can influence, and when a person must take over. Do not enter health details, identifiable disclosures, passwords, financial information or confidential work material into an unapproved assistant. Treat generated suggestions as prompts, never as a diagnosis, therapy, emergency service or objective measure of anyone’s mental state.
Employers should make the tool optional where possible, explain its purpose and data flows in plain language, involve workers before deployment, minimise collection, prohibit secondary use of wellbeing disclosures for performance management, and keep consequential decisions with accountable human decision-makers. EU rules add specific restrictions and duties, but the exact result depends on the system’s intended purpose, classification and deployment context.
What a safe boundary looks like
A boundary is a practical rule that limits an AI wellbeing system’s information, authority and reach. A sound workplace boundary answers four questions before anyone types a message:
- Purpose: Is the tool offering general reflection prompts, connecting people to an employee assistance service, supporting a medical or safety process, monitoring work, or informing an employment decision?
- Data: What does it collect from messages, voice, sensors, calendars or other systems? Are conversations, scores or inferred traits retained?
- Access: Can the employer, a manager, a vendor or an administrator read raw inputs, or only receive an aggregated report?
- Authority: Can an output change scheduling, evaluation, promotion, discipline, pay or access to work? If so, who reviews it and how can a worker challenge it?
If any answer is unclear, pause and ask for the organisation’s written policy. “It is only a wellbeing app” is not a sufficient explanation of a system that creates worker profiles or sends alerts.

Why conversational AI needs extra limits
Fluent language can make a system appear empathetic and certain. The European Commission warns that AI tools may sound conversational and helpful but do not think, understand emotions or make decisions like people do. A polished response is therefore not evidence of comprehension, confidentiality, clinical competence or factual accuracy.
The same limitation applies to mood scores, sentiment labels, stress predictions and summaries. They are generated outputs based on selected data and a model; they are not an objective record of a person’s inner state. Sarcasm, culture, disability, language, context and ordinary changes in writing style can all be misread. A manager should never treat an inferred emotion as proof that an employee is disengaged, unsafe or unwell.
Use AI to support human judgement, not replace it. For personal distress, persistent symptoms, safety concerns or a decision requiring professional care, contact an appropriate qualified person or local service rather than relying on the tool. The correct emergency and clinical contacts depend on location; an employer should publish verified local routes rather than expecting a chatbot to provide crisis triage.

Before using a workplace wellbeing tool
Complete this sequence before creating an account or sharing a disclosure. An employer should provide the same information proactively; an employee can request it if it is missing.
- Identify the owner and purpose. Ask which organisation operates the service, why it is being offered, whether participation is optional, and whether it is intended for general wellbeing, medical or safety support, employee monitoring or work decisions.
- Request the data map. Ask what the system receives from typed text, audio, wearable devices, calendars, attendance records or other integrations. Request separate explanations for raw messages, derived scores, alerts and aggregate reports.
- Check retention and deletion. Ask whether conversations and inferences are stored, for how long, where they are hosted, whether backups remain, and how an employee can request deletion or correction where applicable.
- Check every access path. Find out whether a manager, human-resources team, occupational-health provider, vendor support staff or administrator can see individual inputs. “Anonymous” should be defined technically: small groups, timestamps or unusual events can make an individual identifiable even when names are removed.
- Ask about downstream use. Confirm whether outputs can affect performance reviews, promotion, discipline, scheduling, absence management, insurance, hiring or termination. If they can, request the human-review process, decision owner, evidence considered and route to contest an outcome.
- Verify approval and account separation. Use an organisation-approved tool and account. Do not copy confidential project material, customer information, health records, passwords or personal financial details into a public or unapproved assistant.
- Record the answer. Save the policy, consent screen and contact for privacy or occupational-health questions. If the policy changes, reassess before continuing.
Information to keep out of an AI assistant
Share the minimum information needed for the immediate, low-risk task. The European Commission advises users to protect personal and sensitive information; workplace guidance from EU-OSHA likewise emphasises minimisation of workers’ data collection and use.
| Information | Default boundary | Possible exception |
|---|---|---|
| Names, contact details and identifying stories | Do not include them in a general-purpose chat. | Only through a documented, approved process with a defined recipient and retention period. |
| Diagnoses, treatment, medication, disability or medical records | Keep out of general assistants and mood-analysis features. | A qualified medical or occupational-health service may require specific information under its own lawful process. |
| Passwords, authentication codes and financial details | Never enter them. | None for a wellbeing conversation. |
| Confidential company, customer or colleague information | Do not paste it into a public or unapproved system. | Only in an approved environment whose access, retention and vendor terms are documented. |
| Free-text feelings or personal circumstances | Use general, non-identifying descriptions when the tool is approved and optional. | More detail only when a clearly explained human-support process requires it. |
Even a message that seems harmless can identify someone when combined with a date, team, location or unusual event. Avoid “anonymising” by changing one detail while leaving a distinctive pattern intact.
How to use the tool without handing it authority
Use it for bounded, low-consequence tasks
Appropriate uses can include generating general reflection questions, explaining a publicly available breathing exercise, helping a team find the published wellbeing policy, or organising questions for a conversation with a qualified professional. Keep prompts general and remove identifying details.

Reject diagnosis and certainty
Do not ask the system to diagnose depression, determine whether a colleague is suicidal, certify fitness for work or decide whether an absence is legitimate. If it produces a label, describe it as an unverified output and do not place it in a personnel record or pass it to a manager as fact.
Do not treat monitoring as consent
A dashboard that infers “mood,” “engagement” or “burnout risk” from messages, keystrokes, camera images or meeting behaviour is monitoring, even if it is branded as support. Workers should know what is collected and should not be pressured to disclose intimate information to obtain ordinary workplace opportunities.
Stop when the situation exceeds the tool
Move to human help when distress is urgent, symptoms persist, a safety issue is mentioned, the advice conflicts with professional guidance, or the decision has legal, medical or employment consequences. Follow the employer’s published escalation route and local emergency guidance.
Questions employees should ask in plain language
- Is participation genuinely optional, and what happens if I decline?
- What exact data is collected from my messages or connected devices?
- Are my words stored, used to train a model, or reviewed by people?
- Who can see individual conversations, scores or alerts?
- Will my information be shared with my manager, human resources, an insurer or another vendor?
- How long are raw inputs and inferred results retained, and how are they deleted?
- Can any output affect my evaluation, promotion, schedule, pay, discipline or continued employment?
- What human reviews an output, what training do they have, and how do I challenge a decision?
- Where can I report an error, privacy concern or harmful recommendation?
- What service should I use for urgent or clinical support instead?
Ask for answers in writing. A vague statement that data is “secure” does not explain access, retention, secondary use or the consequences of an inference.
Employer policy: the minimum controls
Define a narrow purpose
Write one concrete purpose for the deployment and list prohibited uses. “Improve wellbeing” is too broad to govern access or retention. A policy might permit optional access to general self-reflection resources while prohibiting individual mood scores in performance management.
Minimise collection and secondary use
Collect only what the stated service needs. Avoid retaining full conversations when a person can receive a resource without storage. Do not repurpose a wellbeing disclosure for attendance enforcement, productivity ranking or discipline. EU-OSHA identifies privacy invasion and misuse of worker data as risks to workers’ mental health and occupational safety and health.
Explain the data flow
Give workers a plain-language notice covering inputs, model processing, outputs, recipients, retention, vendor access, security controls and deletion. Explain whether reports are individual or aggregated and the minimum group size used for aggregation. Tell workers what the system cannot do, including diagnosis or reliable emotion measurement.

Provide human oversight with real authority
A nominal “human in the loop” is not enough if the reviewer simply approves an automated recommendation. Assign a named role with time, competence, training, access to relevant evidence and authority to disregard or correct the output. Record the reason for consequential decisions and provide a channel for review.
Recommended Free Tools
Involve workers before deployment
Consult affected employees and their representatives while defining the purpose, data fields, retention period, safeguards and stop conditions. EU-OSHA recommends dialogue, consultation, participation and transparency between system developers and deploying organisations. Consultation after launch cannot repair a purpose that workers were never allowed to question.
Teach AI literacy
Training should cover common failure modes, privacy settings, prohibited inputs, uncertainty, escalation and how to challenge a result. The European Commission discusses AI-literacy duties under Article 4 for providers and deployers within the applicable territorial scope. A short product demonstration is not a substitute for teaching workers when not to use the system.
Monitor, review and suspend
Set review dates and measurable stop conditions. Reassess when the vendor changes the model, adds an integration, expands the purpose or begins producing individual alerts. Provide a route to suspend the feature if it causes harm, exposes data or generates unreliable recommendations. This is prudent governance; the exact legal duty depends on the system and jurisdiction.
EU rules: what is prohibited and what is not
Workplace emotion inference is a specific prohibition
The EU AI Act Service Desk states that placing on the market, putting into service or using an AI system to infer a natural person’s emotions in workplace or education settings is prohibited when used for that specific purpose, with an exception for medical or safety reasons. The wording matters: it addresses emotion-inference systems, not every chatbot that offers wellbeing information.
A product marketed as “wellbeing” does not automatically qualify for the medical-or-safety exception. Intended purpose and actual use matter. An employer should obtain a legal assessment before using emotion labels, facial analysis, voice analysis or similar inferences, rather than relying on marketing language.
“Used at work” does not automatically mean high-risk
AI Act classification is purpose- and use-case-based. The fact that a tool appears in a workplace does not by itself make it high-risk. Classification depends on whether the intended purpose matches a specified Annex III use case and on the system’s role in the decision.

Some employment and worker-management applications, such as specified recruitment and evaluation uses, are listed among high-risk use cases. Rules and other AI Act provisions phase in, so organisations should check current European Commission guidance and the dates applicable to their deployment.
Duties for relevant high-risk deployments
Where the high-risk rules apply, Commission guidance describes duties including monitoring use, assigning effective human oversight and informing affected employees and workers’ representatives beforehand. The notice should be provided before deployment, not after a worker discovers a score in a personnel file. Applicability still depends on classification and context.

GDPR and automated decisions
EU-OSHA’s regulatory overview discusses the GDPR’s relevance when worker personal data is processed and the protection concerning decisions based solely on automated processing where legal or similarly significant effects are involved. This is not a blanket right to block every algorithmic input. For a concrete case, obtain current advice on the employer’s role, the processing purpose, the decision’s effects and available safeguards.
Outside the EU: avoid assuming the same result
The AI Act does not establish the law for every country or employer. Employment, health-data, surveillance and automated-decision rules vary by jurisdiction and may also depend on collective agreements, sector rules and the employer’s own policy. A U.S. organisation, for example, should not present EU obligations as a universal legal answer.
NIST’s Privacy Framework is a voluntary enterprise risk-management resource, not legislation. Its BYOD guidance notes that poorly secured personal devices used for work can expose an organisation or employee to data loss or privacy compromise. Those resources are useful for security planning, but they do not replace applicable employment or privacy advice.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Choosing between tool categories
There is no single “safe” category. Evaluate each proposal against the same axes before approval.
| Evaluation axis | Lower-risk design | Higher-risk warning sign |
|---|---|---|
| Data collected | Optional, minimal text needed for a stated feature. | Continuous sensors, full message history or unrelated workplace records. |
| Retention | Short, documented retention with deletion controls. | Indefinite storage, model training or unclear backups. |
| Access | Worker-controlled access and genuinely aggregated reporting. | Managers or vendor staff can inspect individual conversations. |
| Inferences | No individual emotion or health labels. | Mood, stress, burnout or personality scores attached to named workers. |
| Downstream use | Resources and voluntary reflection only. | Performance, scheduling, discipline, promotion or absence decisions. |
| Human review | Qualified reviewer can disregard outputs and explain the decision. | Automated alerts trigger action with no appeal route. |
| Worker participation | Consultation before launch and an ongoing feedback channel. | Workers learn about the system only after deployment. |
A tool that looks acceptable on one axis can still be unsuitable overall. For example, short retention does not cure an unlawful purpose, and human review does not make excessive collection necessary.

BYOD and account security
Personal phones and laptops add a separate privacy boundary. Before installing an app or signing in with a personal account, ask whether the employer can remotely manage the device, collect diagnostics, see notifications or retain backups. Use an approved work profile or device when required, keep the operating system updated, enable a screen lock and avoid shared family devices for sensitive conversations.
Do not forward a private conversation to a work channel merely to obtain a second opinion. That creates a new copy, new recipients and potentially a new retention obligation. If a human needs to help, share the minimum relevant information through the designated confidential route.
What to do when a boundary is breached
- Stop adding data. End the conversation or disconnect the integration; do not attempt to “explain” the disclosure with more sensitive information.
- Preserve basic evidence. Note the date, feature, account, information entered, visible recipients and any resulting alert or decision. Avoid copying more personal data than necessary.
- Use the stated contact. Report the issue to the privacy, security, occupational-health or employee-relations contact named in the policy.
- Request containment. Ask whether access has been restricted, copies deleted where appropriate, and downstream reports withdrawn or corrected.
- Challenge consequences. If an output affected a work decision, request the human decision-maker, evidence considered and review route. Do not assume an automated label is accurate or final.
- Seek human care. If the breach or the underlying situation creates immediate danger or severe distress, use the employer’s verified local emergency or clinical support route.
Worked examples
Optional reflection chatbot
An employee uses an approved chatbot to generate journaling prompts. The service does not share individual messages, explains that it is not medical care, and offers a link to the employer’s human support service. The employee writes a general description without names or project details. This remains a low-consequence use only while those boundaries are true; the employee should stop if the policy changes or the tool begins creating a manager-visible score.
Mood dashboard for team leaders
A vendor proposes a weekly “team mood” score based on chat messages. Even if names are hidden, a small team, timestamps or unusual wording may reveal individuals. The employer should not deploy it casually: it must assess the purpose, data minimisation, worker participation, access, retention and legal classification. If the system infers emotions in the workplace, the EU prohibition described above is directly relevant.
Safety-related occupational-health process
A regulated occupational-health service may need specific medical information for a defined safety purpose. That does not authorise copying the same information into a general wellbeing assistant. The employer must keep the purpose, professional access, retention and decision process separate and explain them to affected workers.
A one-page decision rule
Do not use the tool when its purpose, data access or employment consequences are unclear; when participation is coerced; when it infers emotions about named workers; when it asks for passwords or confidential material; or when no accountable person can review and correct a consequential output.
Use it cautiously only when the purpose is narrow, collection is minimal, access and retention are documented, workers have been informed and consulted, participation is voluntary where feasible, and the output remains a non-authoritative prompt.
